Executive Summary & Key Takeaways

This notification from the Ministry of Mines announces the Mineral Conservation and Development Amendment Rules, 2019, effective August 13, 2019. The amendment modifies the Mineral Conservation and Development Rules, 2017, specifically regarding star ratings for mining operations. The key changes are: * Mining operations may be suspended by the Regional Controller or authorized officer of the Indian Bureau of Mines if a mine has not achieved at least a three-star rating within four years from February 27, 2017, or four years from the commencement of mining operations, following a 45-day show cause notice. The original rule required a higher, unspecified, star rating. * Subrule 5 is amended, replacing "four-star rating" with "three-star rating." This amendment is issued under the authority of Section 18 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957). For further information, contact Dr. Niranjan Kumar Singh, Joint Secretary, File No. 16112019-M.VI. The Mineral Conservation and Development Rules, 2017, were initially published in the Gazette of India, Extraordinary, Part II, Section 3, Subsection (i), dated February 27, 2017.
