L.-33004/99 EXTRAORDINARY III— 4 PART III—Section 4 PUBLISHED BY AUTHORITY 221] No. 221] NEW DELHI, FRIDAY, JUNE 21, 2019/JYAISTHA 31, 1941 फुटवियर वडजाआन और विकास सस्ं थान ऄध्यादेश नइ ददल्ली, 21 जून, 2019 फा. स.ं एफडीडीअइ/एचओ/एमडीओ/सीओपी(डीपी)/2019/044.—वसनेट, फुटवियर वडजाआन और विकास ऄवधवनयम, 2017 (2017 का 20) की धारा 28 के साथ पठठत धारा 29 द्वारा प्रदत्त शवियक का प्रय ग करते ए ए फुटवियर वडजाआन और विकास संस्थान के वलए वनम्नवलवखत ऄध्यादेश बनाती ह ै , ऄथाात:— 1. सवं िप्त नाम, लाग ू ह ना और प्रारं भ.—(1) आन ऄध्यादशे क का संविप्त नाम फुटवियर वडजाआन और विकास संस्थान ऄध्यादेश, 2019 ह ै। (2 ) ये फुटवियर वडजाआन और विकास संस्थान और आसके पठरसरक पर लागू हकगे । (3 ) ये राजपत्र में आनके प्रकाशन की तारीख से लागू हकगे । 2. पठरभाषाए.ँ —(1) आन ऄध्यादेशक में, जब तक दक संदभा स ेऄन्यथा ऄपेवित न ह , (क) "ऄवधवनयम" स ेफुटवियर वडजाआन और विकास संस्थान ऄवधवनयम, 2017 ( 2017 का 20) ऄवभप्रते ह ै; (ख) "शैिविक" से वशिि, ऄध्ययन, व्यिहार एिं ऄनुसंधान से संबंवधत दियाकलाप ऄवभप्रते हैं ; (ग) “एक शैिविक कैलेंडर” में विवभन्न शैिविक दियाकलापक की तारीखें सवममवलत ह;ैं (घ) “एक शैिविक मैनुऄल” से ऐसे शैिविक मामलक म ेंवनयमक और विवनयमक का संकलन ऄवभप्रेत ह ै; (ड.) “एक शैिविक कायािम” में वडग्री, वडप्ल मा या प्रमाि पत्र प्रदान करने के वलए ऄग्रसर शैिविक दियाकलापक का िम सवममवलत ह ै; (च) "एक शैिविक िषा" से ग्रीष्म कालीन ऄिकाश के साथ द वनयवमत सेमेस्टर ऄवभप्रेत ह ै ; (छ) "ईपाबंध" से आन ऄध्यादशे क से संलग्न ईपाबंध ऄवभप्रेत ह ैं; 2991 GI/2019 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ज) "ऄभ्यथी" स े ऐसा व्यवि, ज संस्थान के दकसी भी प स्ट-डॉक्ट रल, डाक्ट रल, स्नातक त्तर, स्नातक, वडप्ल मा या प्रमािपत्र कायािम म ेंप्रिेश के वलए अिेदन करता ह,ै ऄवभप्रेत ह ै; (झ) "प्रमािपत्र" स े ऄवभप्रेत संस्थान द्वारा एक िष ा की ऄिवध तक के प्रस्तावित दकए गए दकसी भी शैिविक कायािम से ह ै; (ञ) "दीिांत समार ह" से संस्थान का दीिांत समार ह ऄवभप्रेत ह;ै (ट) "पाठ्यिम" में ईन विषयक का िम शावमल ह ैवजन्ह ेंएक समे ेस्टर के दौरान पूरा दकया जाएगा ; (ठ) " कायािम के पाठ्यिम" स ेपाठ्यिम और ऄन्य शैिविक दियाकलापक का एक विवन्द् – सेट ऄवभप्रेत ह ै; (ड़) "वडग्री" से डॉक्टर ऑफ दफलास् फी, मास्टर ऑफ वडजाआन, मास्टर ऑफ वबजनेस एडवमवनस्रेशन, बचै लर ऑफ वडजाआन, बैचलर ऑफ वबजनेस एडवमवनस्रेशन या संस्थान द्वारा प्रदान दकया गया वडप्ल मा या प्रमाि पत्र ऄवभप्रेत ह ै ; (ढ़) "चयनात्मक" से विशेषीकृत िेत्र म ेंविकल्पक के बीच प्रस्ताि दकया गया विषय ऄविप्रते ह ै ; (ि) "परीिा" से दकसी छात्र के शैिविक प्रदशान का मूल्यांकन करन े के वलए प्रय ग की जाने िाली प्रदिया ऄवभप्रेत ह ै ; (त) "ग्रडे " से दकसी कायािम या सेमेस्टर म ेंदकसी छात्र के समग्र प्रदशान क आंवगत करने िाला ग्रडे ऄवभप्रेत ह ै ; (थ) "संस्थान" से फुटवियर वडजाआन और विकास संस्थान ऄवभप्रेत ह ै ; (द) "ज्यूरी" से पाठ्यिम की अिश्यकता के ऄनुसार सेमेस्टर के दौरान और ऄतं म ें छात्रक के प्रदशना के मूल्यांकन के वलए संकाय सदस्यक और बाहरी विशेषज्ञक का एक पैनल ऄवभप्रेत ह ै; (ध) "पठरवनयम" से सस्ं थान का पठरवनयम ऄवभप्रेत ह ै ; (न) "छात्र" से संस्थान में यथावस्थवत वडग्री, वडप्ल मा या प्रमािपत्र प्राप्त करन े हते ु पूिाकावलक या ऄंशकावलक, दकसी शैिविक कायािम के वलए पंजीकृत छात्र ऄवभप्रेत ह ैं। (2) ईन शब्दक और पदक के ज आन ऄध्यादेशक म ें प्रयिु ह ैं दकन्तु पठरभावषत नहीं दकए गए ह ैंपरंत ु वजन् ह ें ऄवधवनयम या पठरवनयम में पठरभावषत दकया गया ह ै ईन शब् दक और पदक का ऄथ ा िही ह गा वजनक िमश: ऄवधवनयमक या पठरवनयमक में समनुदेवशत दकया गया ह ै। 3. शिै विक कायिा म.—संस्थान पठरवनयम 14 म ेंयथाविवन्द् विवभन्न स्कूलक म ें (क) ईपावध; या (ख) वडप्ल मा; या (ग) प्रमािपत्र, प्रदान करने िाले विवभन्न शिै विक कायािमक का प्रस्ताि करेगा । 4. कायािमक की ऄिवध.—(1) डॉक्टरेट कायािम न्यूनतम तीन िषा का ह गा और आसकी ऄवधकतम ऄिवध छह िषा ह गी। (2) स्नातक त्तर पाठ्यिम की ऄिवध द िषा ह गी । (3) स्नातक के पाठ्यिम की ऄिवध चार िष ा की ह गी। (4) प्रमािपत्र पाठ्यिम की ऄिवध एक िषा की ह गी। 5. सस्ं थान म ेंछात्रक के प्रिशे के वलए.—(1) स्नातक कायािमक में प्रिेश के वलए छात्रक की पात्रता वनम्नानुसार हकगी, ऄथाात-् (ऄ) क इ ऄभ्यथी वजसन े वनमन वलवखत परीिा ईत्तीिा की ह ै: (क) दकसी मान्यता प्राप्त ब डा से 10 + 2 , दकसी भी विषय में, या (ख) भारत में दकसी स्कूल या ब डा या विश्वविद्यालय परीिा या विदेश म ें भारतीय विश्वविद्यालय एस वसएशन द्वारा मान्यता प्राप्त 10+2 प्रिाली के यथा समतल्ु य ; या (ग) न्यूनतम पांच विषयक के साथ राष्ट्रीय ओपन स्कूल द्वारा संचावलत स्कूल परीिा; याIII 3 (घ) दकसी भी राज्य या संघ राज्यिेत्र के तकनीकी वशिा ब डा द्वारा प्रस्तावित किा दसिीं के बाद ऄवखल भारतीय तकनीकी वशिा पठरषद ( एअइसीटीइ) द्वारा ऄनुम ददत तीन साल पूि ाकावलक वडप्ल मा; या (अ) क इ ऄभ्यथी, ज खंड (ऄ) के ऄधीन वन्द् दकसी वडग्री के वलए दकसी भी परीिा में ईपवस्थत रह े हक और वजनका पठरिाम, प्रिेश के समय घ वषत न ए अ ह , िह भी स्नातक कायािम में प्रिेश के वलए अिेदन करन े के पात्र ह गें और चयवनत ह जाने पर ऐसे ईममीदिार क ऄनंवतम प्रिेश ददया जाएगा तथा परीिा पठरिाम क संबंवधत िष ा के वसतंबर माह के 30िें ददन या आसके पहल ेप्रस्तुत करना ऄपेवित ह गा, वजसमें विफल ह न े पर ईममीदिार का प्रिशे रद्द दकया जा सकेगा । (आ) बैचलर कायािम के वलए अयु सीमा प्रिेश चाह ेगए शैिविक िषा की 1 जुलाइ क पच्चीस िषा ह नी चावहए । (2) स्नातक त्तर म ें प्रिेश के वलए पात्रता .- ऄ (क) मास्टर ऑफ वडजाआन (फुटवियर वडजाआन और प्र डक्शन ) - फुटविऄर या लेदर गुड्स और ईपसाधन वडजाआन या वडजाआन या आंजीवनयररग या ईत्पादन या प्रौद्य वगकी में स्नातक (ख) मास्टर ऑफ वडजाआन (कंप्यूटर से सहायता प्राप्त वडजाआन) - फुटविऄर या लेदर गुड्स और ईपसाधन वडजाआन या वडजाआन या आंजीवनयररग या ईत्पादन या प्रौद्य वगकी या लवलत कला म ेंस्नातक की वडग्री (ग) मास्टर ऑफ वबजनेस एडवमवनस्टेशन (फुटकर और फैशन पण्य िस्तु) .- दकसी भी विषय में स्नातक की वडग्री। (अ) क इ ऄभ्यथी, ज खंड (ऄ) के ऄधीन वन्द् दकसी भी वडग्री के वलए दकसी भी परीिा में ईपवस्थत रह े हक और वजनका पठरिाम, प्रिेश के समय घ वषत न ए अ ह , त भी िह स्नातक त्तर कायािम में प्रिेश के वलए अिेदन करने के पात्र ह गें और चयवनत ह जान े पर ऐस े ऄभ्यथी क ऄनंवतम प्रिेश ददया जाएगा तथा परीिा के पठरिाम क संबंवधत िषा के वसतंबर माह के 30 िें ददन या ईससे पहले प्रस्ततु करना ऄपेवित ह गा, वजसमें विफल रहने पर ईममीदिार का प्रिेश रद्द दकया जा सकेगा । (3) डॉक्टरल कायािम में प्रिेश के वलए पात्रता (डॉक्टर ऑफ दफलॉसफी) (पीएचडी) .- ऄ (क) प स्ट ग्रेजुएट वडप्ल मा िाले ऄभ्यथी ज दकसी भी मान्यता प्राप्त संस्थान या विश्वविद्यालय से परास्नातक वडग्री के समतुल्य है, पीएचडी कायािम में प्रिेश के वलए पात्र हकगे : बशते दक वडग्री की समतल्ु यता क एस वसएशन ऑफ आंवडयन यूवनिर्ससठटज या दकसी ऄन्य कानूनी वनकाय से मान्यता ह ; या दकसी मान्यता प्राप्त संस्थान या विश्वविद्यालय से सुसंगत िेत्र में स्नातक त्तर वडग्री ज सेकेंडरी (किा दसिीं) के बाद न्यूनतम सात साल की वशिा ह वजसमें ऄंवतम िष ास्नातक त्तर वडग्री या ईपयुाि का ह । (ख) स्नातक त्तर वडग्री म ें जहा ं लेटर ग्रेड प्रदान दकया जाएगा िहां 10 पांआट स्केल म ें 6.0 (ऄनुसूवचत जावत और ऄनुसूवचत जनजावत के ऄभ्यथी के वलए 5.5) न्यनू तम संचयी ग्रेड पाआंट औसत (सीजीपीए) या ऄंक प्रदान दकए जाने हैं िहां कुल ऄंक 55 प्रवतशत (ऄजा और ऄजजा के वलए 50 प्रवतशत) (सभी िषों ऄथिा सेमेस्टरक के वलए) दकया जाएगा । अ. ऐसे ऄभ्यथी ज वनय वजत ह,ै के वलए ईपयिुा पात्रता मानदंडक क परू ा करने के ऄलािा, ईन्ह ेंऄपने ितामान वनय िा स े‘’ "ऄनापवत्त’’ प्रमाि पत्र प्रस्तुत करने की अिश्यकता ह गी । आ. क इ ऄभ्यथी, ज खंड ऄ (क) में वन्द् ईि वडग्री के वलए दकसी भी परीिा में ईपवस्थत रहा ह और वजसका पठरिाम, प्रिेश के समय घ वषत न ए अ ह , िे भी डाक्ट रल कायािम में प्रिेश के वलए अिेदन करने के पात्र ह गें और चयवनत ह जान े पर ऐसे ईममीदिार क ऄनंवतम प्रिेश ददया जाएगा तथा परीिा के पठरिाम क संबंवधत िषा के वसतमब र माह के 30 िें ददन या आसके पहल े प्रस्तुत करना ऄपेवित ह गा, वजसमें विफल ह ने पर ऄभ्यथी का प्रिेश रद्द दकया जा सकेगा । (4) प्रमािपत्र पाठ्यिमक में प्रिेश के वलए पात्रता (क) पयािेिी पाठ्यिम ईममीदिार वजसने वनमन वलवखत ईत्तीिा दकया ह - (क) दकसी भी मान्यता प्राप्त ब डा से दकसी भी विषय म ें10 + 2 ; या (ख) भारत से ऄथिा विदेश म ें भारतीय विश्वविद्यालय संघ द्वारा मान्यता प्राप्त दकसी स्कूल या ब डा या विश्वविद्यालय से 10 + 2 प्रिाली के यथा समतुल्य या; (ग) नेशनल ओपन स्कूल द्वारा न्यूनतम पांच विषयक में संचावलत स्कूल परीिा;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (ख) कायाकारी विकास कायािम: - (क) क इ ऄभ्यथी वजसने दकसी मान्यता प्राप्त विश्वविद्यालय से दकसी विषय में स्नातक ईत्तीिा दकया ह ै; और (ख) संबंवधत िेत्र में एक िषा का औद्य वगक ऄनुभि ह । 6. प्रिशे प्रदिया.—(i) संस्थान के सभी कायािमक म ें प्रिेश के वलए संस्थान की िेबसाआट सवहत प्रप्रट और ऄन्य मीवडया में व्यापक प्रचार दकया जाएगा। (ii) स्नातक की वडग्री और मास्टर वडग्री कायािम के वलए प्रिेश, संस्थान या सस्ं थान द्वारा ऄवधकृत दकसी भी एजेंसी द्वारा अय वजत राष्ट्रीय स्तर पर प्रिेश परीिा के माध्यम से य ग्यता के अधार पर ह गा । (iii) डाक्टर ऑफ दफलास् फी में प्रिेश परीिि या सािात्कार के माध्यम से संस्थान द्वारा राष्ट्रीय स्तर पर चयन के अधार पर दकया जाएगा (iv) प्रमािपत्र कायािम में प्रिशे पहले अओ पहले पाओ के अधार पर दकया जाएगा। 7. प्रिशे म ेंसीटक के अरिि.—(1) विकलांग सवहत अरिि म ें प्रिेश क (पीडब्ल्यूडी) श्रिे ी (ददव्यागं जन) क समय-समय पर केंद्रीय सरकार द्वारा जारी सुसंगत मागदा शाक वसद्ांतक या ऄनुदेशक द्वारा शावसत दकया जाएगा । (2) पीडब्ल्यूडी क टा के ऄधीन अिेदन करन े िाले ऄभ्यर्सथयक से विकलांगता प्रमािपत्र जारी करने म ेंसिम प्रावधकारी द्वारा जारी विकलांगता प्रमािपत्र प्रस्तुत करना ऄपेवित ह गा । (3) दकसी विशेष कायािम के वलए विवश् शारीठरक एि ं बौवद्क ऄपेिाओं के ऄनुसार विशेष कायािम के वलए ददव्यागं ऄभ्यर्सथयक की य ग्यता का अकलन करन े के पश्चात ऄभ्यर्सथयक क कायािम अंबठटत दकए जाएगं े । (4) ददव्यागं ता का अकलन एक सवमवत द्वारा दकया जाएगा और आसके पश्चात कायािम अंबटन दकया जाएगा । (5) ददव्यागं श्रेिी के ऄधीन अरिि चाहने िाल ेसभी ऄभ्यर्सथयक के वलए अकलन ऄवनिाया ह गा । (6) दकसी विशेष कायािम के वलए ईपयिु न पाए जाने पर सस्ं थान ईममीदिार क ऄय ग्य करार द ेसकता ह ै। (7) मानक ददव्यांग िाले व्यवियक क प्रिेश के वलए ईच्च अय ुसीमा में पांच िषा की छूट दी जाएगी । 8. ऄप्रिासी भारतीयक या भारतीय ईद्य ग द्वारा प्राय वजत विद्यार्सथयक क प्रिशे .—(1) दकसी शैिविक िषा में घ वषत सीटक के ऄलािा प्रत्येक शैिविक कायािम म ें घ वषत सीटक का दस प्रवतशत ऄप्रिासी भारतीय ऄभ्यर्सथयक और भारतीय ईद्य ग द्वारा प्रय वजत ऄभ्यर्सथयक के वलए ईपलब्ध रहगे ा । (2) दकसी शैिविक िष ा में आस श्रेिी के तहत बची ए इ ठरि सीटक क दकसी ऄन्य श्रेिी के ईममीदिारक से नहीं भरा जाएगा और ईस सत्र में ि ेसीटें ठरि रहेंगी । (3) आस प्राय वजत श्रेिी के तहत प्रिेश पान े के आच्छुक ईममीदिार के वलए स्िीप्रनग परीिि स े गुजरना अिश्यक ह गा और आसे सफलतापूिाक ऄर्सहत करने पर प्रिेश ददया जाएगा । (4) ऐस ेप्राय वजत ऄभ्यर्सथयक क कायािम और कैमपस का अिं टन पहल ेअओ पहले पाओ के अधार पर दकया जाएगा । (5) प्राय वजत ऄभ्यर्सथयक से फीस ईपाबंध-II के ऄनुसार ली जाएगी । 9. सरकार द्वारा प्राय वजत विद्यार्सथयक क प्रिशे : - (1) दकसी शैिविक िषा में घ वषत सीटक के ऄलािा प्रत्येक शैिविक कायािम में घ वषत सीटक की दस प्रवतशत सीटें सरकार (राज्य ऄथिा केन्द्र) द्वारा प्रय वजत ऄभ्यर्सथयक के वलए ईपलब्ध रहगें ी । (2) दकसी शैिविक िष ा म ें , यदद दकसी शैिविक कायािम में ईपलब्ध सभी वनयवमत सीटें नहीं भरी जाती ह ैं और सरकार ईन वनयवमत ठरि सीटक पर ऄभ्यर्सथयक प्राय वजत करना चाहती ह ै त संस्थान सरकार द्वारा प्राय वजत आन ऄभ्यर्सथयक क प्रिेश का प्रस्ताि दे सकता ह ै। (3) दकसी शैिविक िष ा म ें आस श्रेिी में बची ए इ ठरि् सीटक क दकसी ऄन्य श्रिे ी के ऄभ्यर्सथयक से नहीं भरा जाएगा और िे सीटे पूरे सत्र के दौरान ठरि रहगें ी । (4) ईन प्राय वजत ऄभ्यर्सथयक क कायािम और कैमपस का अिं टन पहल ेअओ पहले पाओ के अधार पर दकया जाएगा । (5) प्राय वजत ऄभ्यर्सथयक से फीस ईपाबंध-II में यथा विवन्द् के ऄनुसार ली जाएगी ।III 5 10. शिै विक कायिा मक म ें विद्यार्सथयक का नामाकं न.—(1) प्रत्येक छात्र वजसे संस्थान म ें कायािम में प्रिेश का प्रस्ताि ददया जाएगा ईसे कायािम शरूु ह ने के 60 ददनक के भीतर प्रिशे विभाग क यथा ऄपेवित शैिविक प्रमािपत्र और दस्तािेज ईपलब्ध कराना ह गा, ऐसा न करने पर ईनकी ऄभ्यर्सथता रद्द ह सकेगी : परन्त ुशत ा यह ह ैदक अपिाददक पठरवस्थवतयक म ेंछात्र या ईसके ऄवभभािक के वलवखत ऄनुर ध पर, वजसमें विलमब के कारिक का ईल्लेख ह , ईि ऄिवध क मामला दर मामला अधार पर संबंवधत कायाकारी वनदेशक द्वारा सात ददनक के वलए बढ़ाया जा सकता ह ै। (2) प्रिेश प्रस्ताि िाल े प्रत्येक छात्र क ऄपनी सीट अरवित करने के वलए स्पॉट पर ही फीस ऄदा करना ऄपेवित ह गा और ईि ऄदा रावश क छात्र स ेदेय शुल्क म ेंसमाय वजत दकया जाएगा । (3) सीट अरवित करने के दस ददनक के भीतर या कायािम शरूु ह ने से पूिा, ज भी पहले ह , शासी पठरषद द्वारा ऄनुम ददत और संस्थान द्वारा यथा विवन्द् दकए गए ऄनुसार छात्र क ट्यूशन एिं ऄन्य फीस और जमा का भुगतान करना ह गा, ऐसा न करने पर ऄभ्यर्सथता रद्द की जा सकती ह ै। (4) फीस एिं जमा की ऄदायगी और सभी अज्ञापक दस्तािेजक के सत्यापन के बाद, संस्थान छात्र क नामांकन सं. ईपलबध कराएगा । (5) नामांकन संख्या संबंवधत छात्र की संस्थान के सभी ऄवभलखे क में स्थाइ संदभा संख्या ह गी । 11. ट्यशू न और ऄन्य फीस तथा जमा.—(1) छात्र से यथा लागू ट्यूशन फीस, ऄन्य फीस और जमा प्रभाठरत दकए जाएगं े । (2) सेमस्े टर शुरू ह ने स ेपहल ेपूरी फीस ऄदा की जाएगी (3) ऄपिाददक पठरवस्थवतयक में मामला दर मामला अधार पर संबंवधत संस्थान कैमपस के कायाकारी वनदेशक द्वारा फीस ऄदायगी के वलए समय सीमा बढ़ाइ जा सकती ह ै। (4) सेमेस्टर शुरू ह न े से पहले या संबंवधत कायाकारी वनदेशक द्वारा ऄनुम ददत ऐसी तारीख तक यदद फीस ऄदा नहीं की जाती ह ैत विद्याथी क कायािम में भाग लने े की ऄनुमवत नहीं दी जाएगी । (5) एक बार जमा की गइ सेमेस्टर फीस िापस नहीं की जाएगी । (6) ऄभ्यथी से ईपाबंध-II के ऄनुसार फीस प्रभाठरत की जाएगी । (7) सभी जमा या फीस की ऄदायगी अंबठटत कैमपस म ें फुटवियर वडजाआन और डेिलपमेंट आंस्टीटयूट के पि में वडमांड ड्राफ्ट या अनलाआन रांसफर द्वारा ऄदा की जाएगी । (8) ज छात्र संस्थान क क सा के मध्य से छ ड़ता ह ै या ईस े दकसी कारि स े संस्थान छ डन े के वलए कहा जाए त िह प्रवतदेय प्रवतभूवत जमा की रावश के ऄलािा फीस के प्रवतदाय का पात्र नहीं ह गा । 12. छात्रक की ईपवस्थवत, ऄनपु वस्थवत एि ंछुट्टी.—(1) दकसी प्रत्येक वनधााठरत लैक्चर, ट्यूटेठरयल; प्रेवक्टकल क्लास म ेंप्रत्यके किा के शुरू ह न े से पहले राल ॅकालॅ की जाएगी तादक विशेष कायािम की ईपवस्थवत का ऄवभलेख रखा जा सके । (2) शैिविक कायािम म ें नामादं कत विद्याथी क सभी ऄनुसूवचत लैक्चर, ट्यटू ठरयल, प्रेवक्टकल क्लॉस म ें भाग लने ा ऄपवे ित ह गा । (3) सेमेस्टर की परीिाओं में बैठने के पात्र ह ने के वलए छात्र क प्रत्येक क सा या विषय में न्यूनतम 70 प्रवतशत ईपवस्थवत बनाए रखना ह गा : बशते की संबंवधत कायाकारी वनदेशक दकसी विशेष सेमेस्टर में क सा या विषय में 10 प्रवतशत तक ऄवधकतम 20 प्रवतशत, की छूट द े सकता ह ै। (4) कायाकारी वनदेशक मामला दर मामला अधार पर और केिल छात्र के वनयंत्रि से बाहर अपात वस्थवत या अकवस्मता के मामले में वलवखत म ेंकारिक क ऄवभवलवखत करन े के पश् चात खण्ड (3) के तहत छूट दे सकता ह ै। (5) छात्र क ईपवस्थवत में छूट का दािा करने का क इ ऄवधकार नहीं ह गा ।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (6) आस ऄध् यादेश के ईपबंधक के ऄनुसार छूट के साथ या ईसके वबना ज छात्र न्यूनतम ईपवस्थवत क परू ा नहीं करता है, त ईसे आस क सा या विषय में ऄंवतम सेमेस्टर की परीिाओं म ेंनहीं बैठने ददया जाएगा वजसमे ईसकी ईपवस्थवत कम ह ै। (7) ऄध् यादेश 18 के ईपबंधक के ऄनुसार दकसी क सा या विषय म ें विशेष शैिविक िषा के दकसी सेमेस्टर के परू ा ह न े के बाद छात्र क पुन: परीिा में बैठने की ऄनुमवत दी जा सकेगी : बशते दक दकसी विशेष सेमेस्टर म ें दकसी विषय म ें छूट के साथ या छूट के वबना ईपवस्थवत म ें 50 प्रवतशत स े ऄवधक की कमी ह ै त ईस छात्र क पनु : परीिा का ऄिसर ददए वबना कवनष्ठ बचै के साथ िह िषा पनु : पूरा करने क कहा जाएगा । (8) (i) छुट्टी – क इ छात्र अकवस्मकताओं और ऄन्य प्रवतबद्ताओं की वस्थवत म ें छुट्टी ले सकता है और नीचे दी गइ सारिी के ऄनुसार आस ेऄनुम ददत दकया जाएगा, ऄथाात ् : - ि. सं. छात्र द्वारा ली गइ छुट्टी सिम प्रावधकारी ठटप्पवियां 1. <_ 15 ददन विभागाध्यि केिल पूिा सूचना से 2. > 15 ददन कायाकारी वनदेशक केिल पूिा सूचना से (ii) छुट्टी संबंधी चेतािनी–कम ईपवस्थवत िाले छात्र या ईसके माता–वपता क संबंवधत क सा के समन्ियक या विभागाध्यि द्वारा समय – समय पर इ–मेल, फ न या संचार के दकसी ऄन्य तरीके से सूवचत दकया जाएगा । (iii) ऄनवधकृत छुट्टी ऄथाात् वबना सूचना या स्िीकृवत के ऄनुपवस्थवत : - ज छात्र वबना ऄवधकृत स्िीकृवत के ऄनुपवस्थत रहगे ा ईस पर संस्थान के वनयमक के ऄनुसार ऄनुशासनात्मक कारािाइ की जाएगी और दकसी भी कारि से द सप्ताह से ऄवधक समय तक छात्र के ऄनवधकृत रूप से ऄनुपवस्थत रहन ेपर ईसे संबंवधत सेमेस्टर या क सा से वििर्सजत दकया जा सकता ह ै। 13. छात्रक का ऄनशु ासन.—(1) छात्र से हर समय ऄनशु ासन बनाए रखने की ऄपेिा की जाती है; (2) वनम्नवलवखत कृत्यक क न करना या करना ऄनुशासनहीनता मानी जाएगी, ऄथाात ् : - (क) जानबूझकर या ऄसािधानी से संस्थान की संपवत्त क नुकसान पए चँ ाना या विकृत करना या त ड़ फ ड़ करना । (ख) सस्ं थान के पठरसर के भीतर सस्ं थान के शैिविक, प्रशासवनक, खेल–कूद, सामावजक या ऄन्य कायाकलापक म ें ऄनुवचत व्यिधान । (ग) कैमपस म ें या संस्थान से सबं ंवधत दकसी दियाकलाप म ें शावमल ह त े समय प्रहसक, ऄभद्र, विच् छृखंल, धमकी या अिामक भाषा या व्यिहार । (घ) संस्थान या संस्थान स ेसंबंवधत दकसी दियाकलाप म ेंवलप्त ह ने पर कपट, प्रिंचना, छल या बेइमानी करना । (ड.) किा में या परीिा हॉल म ें म बाआल फ न और ऄन्य दकसी आलेक्र वनक गैजेट का ऄप्रावधकृत ईपय ग : परन्त ु शत ा यह ह ै दक, म बाआल फ न सवहत दकसी आलेक्र वनक युवक्त का ईपय ग संकाय द्वारा ऄवधकृत शैिविक ईद्देश्यक के वलए दकया जा सकता ह ै। (च) दकसी भी प्रकार की रैप्रगग या अचार संवहता का ईल्लंघन और रैप्रगग में वलप्त ह ना । (छ) धूम्रपान, तमबाकू चबाना, पान, गुटका, मादक पदाथों या दकसी ऐसे ईत्पाद का संस्थान के पठरसर में ईपय ग । (ज) परीिा म ेंदकसी तरह की सावहवत्यक च री, नकल करना या छल । (3) (क) संबंवधत कैमपस के कायाकारी वनदेशक द्वारा एक ऄनुशासनात्मक सवमवत गठठत की जाएगी और दकसी छात्र से संबंवधत दकसी भी मामले क ऄनुशासनात्मक सवमवत के समि शावस् त देन े के वलए वसफाठरश करते ह,ैं ऄग्रेवषत दकया जाएगा । (ख) ऄनुशासनात्मक सवमवत की संस्तुवत के अधार पर विभागाध्यि मामलू ी शावस् त अर वपत कर सकत े ह ैं और, ऐसी शावस्त के विरुद् छात्र कायाकारी वनदेशक के समि ऄपील कर सकता ह ै। (ग) खण्ड (ख) म ें ऄन्त र्सिष्ट दकसी बात के ह ते ए ए भी, ऄनुशासनात्मक सवमवत की वसफाठरशक के अधार पर कायाकारी वनदेशक भारी या मामूली शावस् त अर वपत कर सकते ह ैं और ईि शावस् त से ऄसंत्ु क इ भी छात्र प्रबंध वनदेशक के समि ऄपील कर सकता ह ै।III 7 (4) मामलू ी शावस्त : (क) छात्र ऄनशु ासन के दकसी ईल्लघं न पर पांच हजार रुपये तक का जुमााना । (ख) संपवत्त क नुकसान पए चँ न े या िवतग्रस्त ह ने पर नुकसान या झगड़े की वस्थवत म ें वचदकत्सा व्यय पर ए ए खचे की लागत की िसूली । (ग) पठरप्रनदा या चेतािनी - प्रथम ऄपराध के वलए चेतािनी ऄवभवलवखत नहीं की जाएगी और बार-बार ऄपराध करन े पर चते ािनी ऄवभवलवखत की जाएगी और ईसके वलए बडी शावस् त देकर कारािाइ की भी जा सकती ह।ै (5) बडी शावस् त - (क) संस्था से वनष्कासन । (ख) विवन्दष् ट समयािवध के वलए वनलम बन । (ग) ऄंवतम सेमेस्ट र की परीिा म ेंबैठने पर र क । (घ) प्लेसमेंट सेिाए ं िापस लेना । (ङ) कवनष्ठ बैच के साथ पाठ्यिम दफर से करना । 14. शिै विक कैलडें र.—संस्थान के प्रमुख (शैिविक) का कायाालय प्रत् येक सेमेस्ट र के अरंभ में सभी कैम पसक में सभी शैिविक कायािमक का शैिविक कैलेंडर तैयार करेगा और ऄंवतम रूप दगे ा तथा आसे वसनेट के समि ऄनुम दन हते ु प्रस्त ुत दकया जाएगा । 15. छात्र ऄवभलखे क का रख-रखाि.—(1) संस्थान कैम पस का प्रवशिि एि ं परीिा विभाग संबंवधत कैम पसक म ें शैिविक कायािमक में प्रिेश लेन े िाले प्रत्य ेक छात्र की ‍ यवक्त गत फाआल रखेंग ेऔर यह ‍ यवक्त गत जानकारी ग पनीय रखी जाएगी। (2) खण् ड (1) में वन्दष्ट व्यविगत फाआल म ें वनमन वलवखत वनवहत ह गा – (i) छात्र द्वारा प्रिेश के समय भरा गया ‍ यवक्त गत डाटा ; (ii) माता-वपता और स्थानीय ऄवभभािक संबंधी जानकारी ; (iii) प्रिेश के समय प्रस्ततु वचदकत् सीय पूिािृत् त और स् िस् थता प्रमाि-पत्र ; (iv) छात्र द्वारा प्रस्तुत सभी िचन–पत्र ; (v) छात्र क जारी दकए गए दकसी भी प्रकार का चेतािनी पत्र या ज्ञापन आत् यादद की प्रवतवलवप ; (vi) छात्र या माता-वपता या ऄवभभािक के साथ दकया गया पत्राचार, यदद क इ ह ; (vii) छात्र क जारी सभी मल्ू यांकन ग्रेड शीट और शैिविक प्रगवत ठरप टा की प्रवतवलवप; (viii) फीस के भुगतान सवहत हॉस् टल में प्रिेश का ऄवभलेख ; (ix) संस् था की फीस के भगु तान का ऄवभलेख ; (x) छात्र के ऄध् ययन एिं कैम पस जीिन काल स े सुसंगत ऐसी समस्त जानकारी । 16. परीिा एि ं मल्ू याकं न.—(1) ऄध् ययन के सेमेस्टर के दौरान परीिा म ें क इ परीिि या ईपय ग में लायी गयी मूल् यांकन पद्वत सवम मवलत ह गी । (2) छात्रक का मूल्यांकन मानदंड सतत मल्ू यांकन, मध्य सेमेस्ट र परीिा, ऄंवतम सेमेस् टर परीिा, मौवखक परीिा, प्रवै क्ट कल, ऄसाआनमेंटस, वनिाायक सवमवत, कौशल परीिि, प्रस् ततु ीकरि और ऄन् य य गात् मक प्रिाली के द्वारा ह गी। (3) वडग्री प्रदान करने के वलए सभी कायािमक क परीिा लाग ूह गी । (4) संस्थान के सभी संस् थान कैम पस में सभी परीिाओं के संचालन की वजम मेदारी परीिा वनयत्रं क की ह गी। (5) संस्थान के सभी कैम पसक में ईप परीिा वनयंत्रक ऄपने-ऄपन े संस्थ ान कैम पसक म ें संबंवधत कायाकारी वनदेशक के संपिू ा पयािेिि के ऄधीन परीिाओं के संचालन के वलए वजम मेदार हकगे ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (6) परीिा वनयंत्रक या ईप-परीिा वनयंत्रक ऄधीिकक की वनयुवक्त करेंगे और संबंवधत संस्थ ान कैम पसक के कायाकारी वनदेशकक के परामश ासे परीिाओं के संचालन हते ु अिश् यक ‍ यिस् था करेंगे। (7) परीिा वनयंत्रक विवभन्न परीिाओं के पठरिाम प्रकावशत करेंगे । (8) मूल्यांकन प्रिाली- दकसी विशेष पाठ्यिम या विषय में छात्र का मूल्यांकन परीिा या मूल् यांकन म ें मल्ू यांदकत ईसके वनष्प ादन भारांक के अधार पर वनमन वलवखत रीवत स े दकया जाएगा, ऄथाात ् :- (क) ि.स.ं मल्ू याकं न के मापदण्ड प्रवतशत म ेंथ्य री के वलए भाराकं (क) ऄसाआनमेंट या प्रस्तुतीकरि 20 (ख) मध्यािवध परीिा 20 (ग) ऄंवतम परीिा 60 (ख) ि.स.ं मल्ू याकं न मापदण्ड प्रवतशत म ेंप्रवै क्टकल के वलए भाराकं (क) प्रय गशाला में मल्ू यांकन 60 (ख) मौवखक-परीिा या ऄंवतम मूल् यांकन 40 (9) वडग्री प्रदान दकए जान े के वलए पात्रता प्राप् त करन े वलए , दकसी छात्र द्वारा प्रत्येक विषय क ईत् तीि ा करना और औसत 6 न्यूनतम संचयी ग्रेड ऄंक प्राप् त करना अिश् यक ह गा । (10) आस ऄध् यादेश म ें विवन्दष् ट मानदण् डक के ऄनुसार यदद क इ छात्र दकसी पाठ्यिम या विषय म ें ईत त् ीि ा नहीं ह पाता , त ईसे पुन: परीिा के वलए प्रस्त ुत ह ना ऄपेवित ह सकेगा । (11) पठरिामक में सुधार - कायाकारी वनदेशक दकसी भी ऄभ् यथी के पठरिामक क िापस ल े सकता ह ै, - (i) यदद छात्र सेमेस्ट र परीिा म ें ऄनुवचत साधनक के प्रय ग के कारि ऄनह ा घ वषत दकया गया ह और ऐसे मामले म ें छात्र क पुन: परीिा में प्रस् तुत ह ने के वलए कहा जाएगा ; (ii) छात्र पुन: परीिा में ऄनुवचत साधनक के प्रय ग के कारि ऄनह ा घ वषत दकया गया ह और ऐस े मामल े म ें छात्र क शैिविक िष ा दफर से पूरा करन े के वलए कहा जाएगा ; (iii) छात्र के पठरिाम में क इ त्रुठट पाइ जाती ह ै और ऐसे मामले म ें त्रुठट सुधार दकया जाएगा और तदनुसार, पठरिाम पनु : घ वषत दकया जाएगा । (iv) यदद छात्र या ऄवभभािक द्वारा पठरिाम घ वषत ह न े के 15 ददनक के भीतर पनु मूाल्य ांकन के वलए वलवखत म ें अिदे न दकया गया ह त ऐसे मामल े म,ें कायाकारी वनदेशक पन् द्रह ददनक के भीतर पनु मूाल् यांकन कराएंगे और तदनुसार पठरिाम घ वषत कराएगं े । (v) दकसी छात्र क दकसी विवशष्ट परीिा म ेंकेिल एक बार ही पुनमूाल् यांकन की ऄनुमवत दी जाएगी। (12) ऄंक सूची जारी करना - (1) संस्थान सभी छात्रक क ऄंक सूची जारी करेगा। (2) छात्र क संबंवधत कैम पस से कागज की या वडजीटल फॉरमेट में सेमेस् टर–िार ऄंक सूची जारी की जाएगी। (3) छात्रक क पाठ्यिम के पिू ा ह ने के पश् चात प्रमुख कायाालय से ऄंकक की समेदकत वििरिी जारी की जाएगी। 17. पद न्नवत.—(1) सेमेस्ट र या िषा के वलए क इ छात्र की प्र न् नवत वनमन ानुसार ह गी, ऄथाात् :- (क) अगामी िष ा म ें प्र न् नवत के वलए छात्र क विशेष शिै विक िष ा के सभी पाठ्यिमक या विषयक क ईत् तीि ा करना अिश् यक ह गा । (ख) यदद क इ छात्र दकसी सेमेस्ट र म ेंऄपेवित ईत् तीि ा ऄंक प्राप्त करन े म ें ऄसफल रहता ह ैया ईपवस्थ वत म ें कमी के कारि या द नक मामलक में छात्र की 50 प्रवतशत विषयक म ें पुन: परीिा ह ती ह ै त अगामी शैिविक िष ा में ईस े जूवनयर बैच के साथ िषा की पुनरािृवत् त करनी ह गी।III 9 (ग) (i) अबंठटत संपूि ा शैिविक पाठ्यिम के दौरान छात्र के समग्र प्राप् तांकक के अधार पर छात्र क वनमन ानुसार ग्रेड ददए जाएंगे, ऄथाात ् : - ि.सं. ग्रेड संविप्तािर ऄंकक का िगीकरि ग्रेड ऄंक (i) ईत्कृ् आ एक्स 90-100 10 (ii) बए त ऄच्छा ए 80-89 9 (iii) ऄच्छा बी 70-79 8 (iv) ईवचत सी 60-69 7 (v) औसत डी 50-59 6 (vi) ईत्तीिा पी 35-49 (थ्य री) 5 40-49 (प्रैवक्टकल) (vii) ऄनुतीि ा एफ ऄसफल 2 34 या ईससे कम (थ्य री) 39 या ईससे कम (प्रैवक्टकल) (viii) ऄनुपवस्थत एबी ऄनुपवस्थत - (ii) सेमेस्टर ग्रडे औसत ग्रडे ऄकं और संचयी औसत ग्रेड ऄंक की गिना ईपाबद्–I में विर्सनददष् ट तरीके स ेकी जाएगी। 18. पनु :परीिा.—(1) क इ छात्र एक विषय में पुन: परीिा देने का पात्र ह गा यदद ईस छात्र की ईपवस् थवत ऄपेवित ईपवस् थवत स ेकम ह ऄथिा िह विषय में ऄनुतीिा ह । (2) यदद दकसी छात्र की 50 प्रवतशत विषयक म ें ऄनुपवस्थवत के कारि, ऄनत्ु तीि ा ह ने के कारि या द नक के कारि पनु : परीिा ह ती ह ैत ईसे पुन: परीिा देने की ऄनुमवत दी जाएगी। (3) यदद दकसी छात्र की 50 प्रवतवशत विषयक म,ें ईपवस्थवत के कारि, ऄनुत् तीिा ह न े के कारि या द नक के कारि पनु : परीिा ह ती ह ै त ईसे जूवनयर बैंच के साथ िष ा की पुनरािृवत् त के वलए कहा जाएगा। (4) छात्र द्वारा पुन: परीिा म ें प्राप् तांकक क छात्र की ऄसाआनमेंट या प्रस् तुतीकरि के प्राप् तांकक और मध् यािवध परीिा भाराकं और कुल प्राप् तांकक में ज ड़ा जाएगा। आससे यह यह वनधााठरत ह गा दक छात्र पाठ्यिम या विषय में ईत् तीिा ए अ ह ै ऄथिा नहीं। 19. वडग्री प्रदान करना - No. FDDI/HO/MDO/CoP(DP)/2019/044.—In exercise of the powers conferred by section 29 read with section 28 of the Footwear Design and Development Act 2017 (20 of 2017), the Senate makes the following ordinances for the Footwear Design and Development Institute, namely:— 1. Short title, application and commencement.—(1)These Ordinances may be called the Footwear Design and Development Institute Ordinances, 2019. (2) They shall apply to the Footwear Design and Development Institute and its campuses. (3) They shall come in to force from the date of their publication in the official Gazette. 2. Definitions.— (1) In these Ordinances, unless the context otherwise requires, (a) ―Act‖ means the Footwear Design and Development Institute Act, 2017(20 of 2017); (b) ―academic‖ means the activities concerned with teaching, studies, practices and research; (c) ―academic calendar‖ includes dates for various academic activities; (d) ―academic manual‖ means the compilation of rules and regulations in academic matters; (e) ―academic programme‖ includes the sequence of academic activities leading to award of a degree, a diploma or a certificate; (f) ―academic year‖ means two regular semesters along with a summer break; (g) ―annexure‖ means the annexure appended to these ordinances; (h) ―candidate‖ means an individual who applies for admission to any post-doctoral, doctoral, post- graduate, graduate, diploma or certificate programmes of the Institute; (i) ―certificate‖ means any academic programme offered by the Institute up to one year duration; (j) ―convocation‖ means the convocation of the Institute; (k) ―course‖ includes a sequence of topics which can be covered during a semester; (l) ―curriculum of a programme‖ means a specified set of courses and other academic activities; (m) ―degree‖ means the Doctor of Philosophy, Master of Design, Master of Business Administration, Bachelor of Design, Bachelor of Business Administration, Diploma or a Certificate awarded by the Institute; (n) ―elective‖ means the subject offered amongst options in specialised field; (o) ―examination‖ means procedure used to evaluate the academic performance of a student; (p) ―grade‖ means the grade indicating the overall performance of a student in a programme or semester; (q) ―Institute‖ means the Footwear Design and Development Institute; (r) ―jury‖ means a panel of faculty members and external experts for evaluation of performance of students during and at the end of semester as per the requirement of the course; (s) ―statutes‖ means the Statutes of the Institute; (t) ―student‖ means a student registered for any academic programme for full-time or part-time study leading to award of degree, diploma or certificate at the Institute, as the case may be; (2) Words and expressions used and not defined in these Ordinances but defined in the Act or the Statutes shall have the same meanings, as respectively, assigned to them in the Act or the Statutes. 3. Academic Programme.—The Institute shall offer various academic programmes leading to the award of - (a) Degree; orIII 13 (b) Diploma; or (c) Certificate in various Schools as specified under Statute 14. 4. Duration of Programmes.—(1) The Doctoral programme shall be for a minimum duration of three years and a maximum duration of six years. (2) The duration of a Master’s programmes shall be two years. (3) The duration of a Bachelor’s programmes shall be four years. (4) The duration of a Certificate programmes shall be up to one year. 5. Admission of the students to the Institute.— (1) Eligibility for admission to Bachelor’s Programmes shall be as under, namely.— (A) A candidate who has passed,- (a) 10+2, in any stream, from any recognised Board; or (b) any School or Board or University examination in India or in foreign country recognised by the Association of Indian Universities as equivalent to 10+2 system; or (c) School Examination conducted by the National Open School with a minimum of five subjects; or (d) All India Council for Technical Education (AICTE) approved three-year full time Diploma after Class X offered by Board of Technical Education of any State or Union territory; or (B) A candidate, who has appeared for any examinations under clause (A), and whose result has not been declared at the time of admission, shall be eligible to apply for admission to the Bachelor’s Programmes and such candidate, if selected, shall be granted provisional admission and shall be required to submit the result of the requisite examination on or before the 30th day of September of the respective year, failing which the candidate’s admission may be cancelled. (C) The age-limit for the Bachelor’s program shall be twenty-five years as on the 1st July of the academic year in which the admission is being sought. (2) Eligibility for admission to Master’s Programmes.— A. (a) Master of Design (Footwear Design and Production).–A Bachelor’s degree in Footwear or Leather Goods and Accessories Design or Design or Engineering or Production or Technology. (b) Master of Design (Computer-Aided Design).–A Bachelor’s degree in Footwear or Leather Goods and Accessories Design or Design or Engineering or Production or Technology or Fine Arts. (c) Master of Business Administration (Retail and Fashion Merchandise).- A Bachelor’s degree in any discipline. B. A candidate, who has appeared in any examination for any of the degree referred to under clause (A) and whose result has not been declared at the time of admission, shall be eligible to apply for admission to the Master’s Programmes and such candidate, if selected, shall be granted provisional admission and shall be required to submit the result of the requisite examination on or before the 30th day of September of the respective year, failing which the candidate’s admission may be cancelled. (3) Eligibility for admission to Doctoral Programme (Doctor of Philosophy) (Ph.D.).– A. (a) Candidates with Post Graduate Diploma which is equivalent to Masters Degree from any recognised institute or university shall be eligible for admission to Ph.D programme: Provided that the equivalence of the degree should be recognised from Association of Indian Universities or any other statutory body; or Master’s Degree in the relevant area from any recognised institute or university with minimum seven years of education after Secondary (Class X), last of which was the Master’s degree or above. (b) A minimum Cumulative Grade Point Average (CGPA) of 6.0 on a 10 point scale (5.5 for Scheduled Caste or Scheduled Tribe candidates) wherever letter grades are awarded; or 55% (50% for Scheduled14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] Caste or Scheduled Tribe candidates) marks in aggregate (of all the years or semesters) where marks are awarded in the Master’s degree. B. A candidate who is employed, besides fulfilling the above eligibility criteria, shall be required to submit ―No Objection‖ certificate from his/her current employer. C. A candidate, who has appeared in any examination for any of the said degree referred to under clause (A) and whose results has not been declared at the time of admission, shall be eligible to apply for admission to the Doctoral Programme and such candidate, if selected, shall be granted provisional admission and shall be required to submit the requisite result of the examination on or before the 30th day of September of the respective year, failing which the candidate’s admission may be cancelled. (4) Eligibility for Admission to Certificate Courses.- (A) Supervisory courses: A candidate who has passed,- (a) 10+2, in any stream, from any recognized Board; or (b) any School or Board or University examination in India or in foreign country recognised by the Association of Indian Universities as equivalent to 10+2 system; or (c) School Examination conducted by the National Open School with a minimum of five subjects; (B) Executive Development Programme:- (a) A candidate who has done graduation in any stream from a recognized University; and (b) shall have one year industrial experience in the related field. 6. Admission Process.—(i) Admission to all programs of the Institute shall be given wide publicity in print, and other media, including the website of the Institute. (ii) Admissions to Bachelor’s Degree and Master’s Degree program shall be on the basis of merit through a national level admission test conducted by the Institute or any agency authorised by the Institute. (iii) The admissions to Doctor of Philosophy shall be based on the national level selection by the institute through test or interview. (iv) The admissions to the Certificate programme shall be on first come first serve basis. 7. Reservation of seats in Admission.—(1) Reservation in admissions including for those belonging to the person with disability (PWD) category (Divyangjan) shall be governed by the relevant guidelines or instructions issued by the Central Government from time to time. (2) Candidates applying under PWD quota shall be required to produce a disability certificate from the authority competent to issue such certificate. (3) A programme shall be allotted to the candidates after assessing the suitability of the disabled candidates for a particular programme as per the specific physical and intellectual requirement of the particular programme. (4) The disability shall be assessed by a committee and programme allocation shall be done thereafter. (5) The assessment shall be compulsory for all candidates seeking reservation under the disabled category. (6) The Institute may disqualify a candidate in case of non-suitability for a particular programme. (7) The persons with benchmark disabilities shall be given an upper age relaxation of five years for admission. 8. Admission to Non Resident Indian or Indian Industry Sponsored Students.— (1) In addition to the seats announced in an academic year, ten per cent of the seats announced in each academic programme shall be available to Non Resident Indian candidates and Indian Industry sponsored candidates. (2) Seats remaining vacant under this category in an academic year shall not be filled from any other category of candidates and shall remain vacant for the session. (3) The candidates seeking admission under this sponsored category shall be required to go through a screening test and shall be given admission upon successfully qualifying the same.III 15 (4) The allotment of programme and campus to such sponsored candidates shall be on first come first serve basis. (5) The fee shall be charged from the sponsored candidate as per annexure– II. 9. Admission to Government Sponsored Students.—(1) In addition to the seats announced in an academic year, ten percent of the seats announced in each academic programme shall be available to Government (State or Centre) sponsored candidates. (2) In any academic year, if all regular seats available in an academic programme are not filled and Government wishes to sponsor candidates against those regular vacant seats, the Institute may offer admission to such Government sponsored candidates. (3) Seats remaining vacant in this category in an academic year shall not be filled from any other category of candidates and shall remain vacant for the session. (4) The allotment of programme and campus to such sponsored candidates shall be on first come first serve basis. (5) The fee shall be charged from the sponsored candidate as per fee for regular seats as specified in annexure – II. 10. Enrolment of students in academic programmes.— (1) Every student offered admission to a programme at the Institute shall within sixty days of commencement of the programme, submit to the admission department, such academic certificates and documents as may be required, failing which their candidature may be cancelled: Provided that in exceptional circumstance, on a written request from the student or his parent stating the reasons for the delay, the said duration may be extended for seven days by the concerned Executive Director on case to case basis. (2) Every student offered admission shall be required to pay the fees on the spot to reserve his seat and the amount so paid shall be adjusted against the fees due from the student. (3) The student shall pay the tuition and other fees and deposits as approved by the Governing Council and as specified by the Institute, within ten days from the date of reserving his seat or before the commencement of the programme whichever is earlier, failing which their candidature may be cancelled. (4) Upon payment of fees and deposits and verification of all mandatory documents, the Institute shall provide an enrolment number to the student. (5) The Enrolment Number shall be the permanent reference number in all records of the Institute pertaining to the student concerned. 11. Tuition and Other Fees and Deposits.—(1) The tuition fees, other fees and deposits, as applicable shall be charged from the student. (2) The fee shall be paid in full before commencement of the semester. (3) In exceptional circumstances, extension of time for payment of fees may be granted by the Executive Director of the respective Institute Campus on case to case basis. (4) The students shall not be allowed to join the programme, if fees are not paid, before commencement of semester or by such date as may be approved by the Executive Director concerned. (5) The Semester fees once deposited shall not be refunded. (6) The fee shall be charged from the candidate as per annexure – II. (7) All deposits or payment of fees shall be made by Demand Draft or on-line transfer in favour of the Footwear Design and Development Institute payable at the allotted campus. (8) A Student who leaves the Institute mid-course or who is asked to leave the Institute for any reason, shall not be entitled to refund of fees, except the amount of the refundable security deposit.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 12. Attendance, Absence and Leave for the Students.—(1) A roll call in beginning of each class shall be taken in order to maintain the attendance record of a particular programme in every scheduled lecture, tutorial, practical class. (2) A student enrolled in an academic programme shall be required to attend all scheduled lecture, tutorial, practical class. (3) To be eligible for appearing in the semester examination, a student shall maintain minimum 70 per cent attendance in each course or subject: Provided that the Executive Director concerned may grant relaxation up to 10 per cent in maximum of 20 per cent of the course or subject in a particular semester. (4) The Executive Director is to grant relaxation under clause (3) after recording reasons in writing on case-to- case basis and only for cases of emergency or exigencies beyond the control of the student. (5) A student shall have no right to claim the relaxation in the attendance. (6) Any student who is not able to meet the minimum attendance as per the provisions of this Ordinance with or without relaxation shall not be allowed to appear for the end semester examinations in the course or subject in which there is a shortfall. (7) A student may be allowed to appear for the re-do examination scheduled after the completion of any semester of the particular academic year in any courses or subject as per the provision of Ordinance 18: Provided that a student having shortfall in attendance in more than 50 per cent of the subject with or without relaxation in a particular semester shall be asked to repeat the year with the junior batch without any opportunity of any re-do examination. (8)(i) Leave.—A student may avail leave for exigencies and other commitments and the same shall be approved as per the table given below, namely:- Sl. (iii) Unauthorised absence i.e. any absence without information or permission.— A student absenting himself without any authorised permission shall be liable for disciplinary action as per the rules of the Institute and any unauthorised absence of a student for more than two weeks due to any cause may lead to student being debarred from the concerned semester or course. 13. Student Discipline.—(1) A student is expected to maintain discipline at all times; (2) The following acts of omission or commission shall constitute an act of indiscipline, namely:- (a) Damage or defacement or vandalisation to the Institute property caused intentionally or recklessly. (b) Improper interference with the academic, administrative, sporting, social or other activities of the Institute inside the institute premises. (c) Violent, indecent, disorderly, threatening or offensive behavior or language whilst on campus or while being engaged in any activity related to the Institute. (d) Indulging in fraud, deceit, deception or dishonesty in relation to the Institute or in any engagement activity relating to the Institute. (e) Any unauthorized use of mobile phone and such other electronic gadget inside the class room or examination hall: Provided that any electronic device, including mobile phone, may be used for academic purpose as authorized by the faculty. (f) Any form of ragging or violating the code of conduct and indulging in ragging.III 17 (g) Smoking, chewing tobacco, beetle (pan), gutkha use of drugs, narcotics or any such products in the premises of the Institute. (h) Plagiarism, copying and cheating in any manner in the examination. (3) (a) A Disciplinary Committee shall be constituted by the Executive Director of the respective campus and any case in respect of a student shall be forwarded to the Disciplinary Committee to make recommendation for the award of penalty. (b) On the basis of recommendation of the Disciplinary Committee the Head of the Department may impose minor penalty and any student aggrieved with the said imposition of penalty may prefer an appeal against such penalty before Executive Director. (c) Notwithstanding anything contained in clause (b), on the basis of recommendation of the Disciplinary Committee the Executive Director may impose both major or minor penalty and any student aggrieved with the said imposition of penalty may prefer an appeal before the Managing Director. (4) Minor Penalty.-(a) Fine up to five thousand rupees for violation of any student discipline. (b) Recovery of the cost of any damage in relation to any property lost or damaged or any expenditure incurred on medical expenses in case of a scuffle. (c) Censure or Warning – A non-recordable warning for the first offence and repeated offence shall attract recordable warning and may also invite action under major penalty. (5) Major Penalty.- (a) Expulsion from the Institute. (b) Suspension for a specified period. (c) Debarment from appearing in end semester examination. (d) Withdrawal of placement services. (e) Repeating the course again with the junior batch. 14. Academic Calendar.— The Office of Head (Academics) of the Institute shall prepare and finalise the academic calendar of all academic programmes at all campuses at the start of each semester and the same shall be placed before the Senate for approval. 15. Maintenance of Student Records.—(1)The Training and Examination Department of the Institute campus shall maintain a personal file of every student admitted to the academic programmes at the respective campuses and such personal information shall be kept confidential. (2) The personal file referred to in clause (1) shall contain – (i) personal data filled by the student at the time of admission; (ii) information about parents and local guardian; (iii) medical history and fitness certificate submitted at the time of admission; (iv) all undertakings submitted by the student; (v) copy of any warning letters or memos etc. issued to the student; (vi) communication with the student or parent or guardian, if any; (vii) copy of all evaluation grade sheets and academic progress reports issued to the student; (viii) record of admission to the hostel including payment of fees; (ix) record of payment of fees of Institute; and (x) all such other information relevant to the study and campus life of the student. 16. Examination and Evaluation.—(1) An Examination shall include any test or evaluation method used during a semester of study. (2) The criteria for assessment of students shall be through continuous evaluation, mid-semester examination, end-semester examination, viva voce, practical, assignments, juries, skill test, presentations or any other summative mode. (3) The examination shall apply to all programmes leading to award of a degree.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (4) The Controller of Examination at the Institute shall be responsible for the overall conduct of examinations in all the Institute campuses. (5) The Deputy Controller of Examination at the Institute campuses, shall be responsible for the conduct of examinations in their respective Institute campuses under the overall supervision of the Executive Director concerned. (6) The Controller of examination or the Deputy Controller of Examination shall appoint invigilators and make necessary arrangements for conduct of examination in consultation with Executive Directors of the concerned Institute Campuses. (7) The Controller of Examinations shall publish the results of the various examinations. (8) Assessment Methodology.-The assessment of a student in a particular course or subject shall be done based on his weighted performance evaluated in the assessments or examinations in the following manner, namely:- (A) Sl. (10) A student who is not able to pass a course or subject as per the criteria specified under this Ordinance may be required to appear in the re-do examination. (11) Rectification of Results.-The Executive Director may recall the result of a candidate if,- (i) the student is disqualified for using unfair means in the semester examination and in such case the student shall be asked to appear for the re-do examination; (ii) the student is disqualified for using unfair means in the re-do examination and in such case the student shall be asked to repeat the academic year; (iii) an error is detected in the student’s result and in such case the error shall be rectified and result shall be declared accordingly. (iv) if re-evaluation is sought by a student or guardian through an application in writing submitted within fifteen days of declaration of the result, in such case, the Executive Director shall cause the re- evaluation to be done within fifteen days and declare the result accordingly. (v) a student shall be allowed to seek re-evaluation of a particular examination only once. (12) Issue of Mark Sheet.-(1) The Institute shall issue mark-sheet to all the students. (2) The semester-wise mark-sheet shall be issued to the student, in paper or digital format, from the respective campus. (3) The consolidated statement of marks shall be issued to the students from the Head Office after completion of the programme. 17. Promotion.— (1) The promotion of a student for semester or year shall be as follows, namely:- (a) to get a promotion to the next year, a student shall be required to pass in all course or subject in that particular academic year. (b) Any student having re-do in more than 50 per cent of the subjects in any semester, whether on account of failure in obtaining the requisite pass marks or on account of shortfall in attendance or both, shall be required to repeat the year with the junior batch in the next academic year.III 19 (c)(i) Based on the overall marks obtained by a student in the subject as allocated during the entire academic program, the student shall be awarded Grades in the following manner, namely:- Sl. Re-do Examination.—(1) A student may be eligible to take re-do examination in a subject in which the student has either less attendance than the requisite attendance or has failed in the subject. (2) A student who has re-do in up to 50 per cent of the subject, either on account of attendance or failure or both, shall be allowed to appear for the re-do Examination. (3) A student having re-do in more than 50 per cent subjects on account of attendance or failure shall be asked to repeat the year with the junior batch. (4) The marks scored by a student in the re-do examination shall be added to the marks scored by the student in the assignment or presentation score and mid-terms examination score and the total marks so scored shall determine whether a student has passed the course or subject or not. 19. Award of Degrees.—(1) A student, who has completed all the requirements as applicable, shall be recommended for the award of the degree in the ensuing Convocation. (2) It shall be mandatory for every student to clear all subjects of each semester within the maximum duration allowed as per the table below failing which the degree shall not be awarded to concerned students and he shall be declared as ―Not Fit‖, namely:- Sl. Medium of Instruction and of Examination.—The medium of instruction and of examination of all academic programs of the Institute shall be English. 21. Medals and prizes.— The institute shall award following prizes and medals to meritorious students, namely:- (i) Every Department Topper shall be awarded Silver medal; (ii) Over all Topper of the campus shall be awarded Gold medal. Computation of Semester Grade Point Average (SGPA) and Cumulative Grade Point Average (CGPA) - (i) The SGPA shall be the ratio of sum of the product of the number of credits (Ci) with the grade points (Pi) scored by a student in all the courses taken by a student in a semester and the sum of the number of credits (Ci) of all the courses undergone by a student in a semester, i.e. SGPA(Si) =∑(Ci x Pi) ___________ ∑Ci where Ci is the number of credits of the ith course and Pi is the grade point scored by the student in the ith course.
