**Report: Analysis of the Removal of Licensing Requirements, Stock Limits and Movement Restrictions on Specified Foodstuffs Amendment Order, 2021**
**1. Executive Summary:**
This report analyzes the Removal of Licensing Requirements, Stock Limits and Movement Restrictions on Specified Foodstuffs Amendment Order, 2021. This amendment modifies the 2016 order concerning the specified foodstuffs by introducing stock limits on pulses, excluding Moong, until October 31st, 2021. The amendment specifies stock limits for wholesalers, retailers, millers, and importers, and mandates the declaration of stocks exceeding these limits on a designated portal within a specific timeframe. The amendment aims to manage the availability and distribution of pulses by regulating stock levels for different market participants.
**2. Introduction:**
The purpose of this report is to provide an informative analysis of the Removal of Licensing Requirements, Stock Limits and Movement Restrictions on Specified Foodstuffs Amendment Order, 2021, based solely on the information provided in the official text. This report will outline the changes introduced by the amendment, identify the affected stakeholders, and infer the intended outcomes of these modifications.
**3. Policy Overview:**
* This order is an amendment to the Removal of Licensing Requirements, Stock Limits and Movement Restrictions on Specified Foodstuffs Order, 2016.
* The core objective of the 2016 policy (inferred from the title) was to remove licensing requirements, stock limits, and movement restrictions on specified foodstuffs to facilitate trade and availability.
* The Core objective of this Amendment is to introduce stock limits on pulses except Moong till 31st October 2021
**4. Background and Rationale:**
This amendment introduces stock limits on pulses (excluding Moong) until October 31, 2021. The likely rationale for this amendment is to address concerns regarding the availability and pricing of pulses. The introduction of stock limits suggests a potential issue of hoarding or price volatility that the government is attempting to mitigate by regulating the quantity of pulses held by various stakeholders in the supply chain. The limited duration of the stock limits (until October 31, 2021) suggests that the government views this as a temporary measure to address a specific short-term situation.
**5. Key Provisions / Changes:**
This amendment modifies the Removal of Licensing Requirements, Stock Limits and Movement Restrictions on Specified Foodstuffs Order, 2016 by adding a new item (i) to subclause (2) of clause 3. The key changes are:
* **Specific Part of Original Policy Changed:** Clause 3, subclause 2, item (i) of the 2016 Order.
* **New Rule/Provision:** The amendment introduces stock limits on "All Pulses put together except Moong" for a period up to October 31st, 2021. The specific stock limits are as follows:
* **Wholesaler:** 200 MT (with a condition that no more than 100 MT should be of one variety).
* **Retailer:** 5 MT.
* **Millers:** Stock limits will be last 3 months production or 25% of annual installed capacity, whichever is higher.
* **Importers:** For stocks imported prior to 15th May 2021, the stock limit applicable to wholesalers (200 MT) applies. For stocks imported after 15th May 2021, the wholesaler stock limit applies after 45 days from the date of customs clearance.
* **Difference/Effect of the Change:** The original 2016 order aimed to *remove* stock limits. This amendment *reintroduces* stock limits, but only for pulses (excluding Moong) and for a limited time. This change restricts the quantity of pulses that different stakeholders can hold, potentially impacting their trading and storage practices.
**6. Target Audience and Stakeholders:**
The primary stakeholders directly affected by this amendment are:
* Wholesalers of pulses
* Retailers of pulses
* Millers of pulses
* Importers of pulses
* State Governments and Union Territories responsible for enforcing the order.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency:** Department of Consumer Affairs (inferred from the mention of the portal fcainfoweb.nic.in and the Department's name in the order).
* **Timelines/Procedures:**
* The stock limits are in effect until October 31st, 2021.
* Entities holding stocks exceeding the prescribed limits are required to declare the same on the portal fcainfoweb.nic.in within 30 days of the issue of the notification (i.e., by August 1st, 2021, based on the date of the order - July 2nd, 2021).
* Entities must bring their stock levels down to the prescribed limits within 30 days of the issue of the notification.
* Regular declaration and updating of pulse stock on the portal is required.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of these specific changes are:
* **Stabilization of Pulse Prices:** By limiting the amount of stock any one entity can hold, the amendment aims to prevent hoarding and reduce artificial price inflation.
* **Improved Availability of Pulses:** The stock limits are intended to ensure a more consistent supply of pulses in the market, preventing shortages.
* **Increased Transparency:** The requirement to declare stock levels on a government portal will provide better visibility into the pulse supply chain, enabling better monitoring and enforcement.
* **Potential Impact on Trade:** Wholesalers and importers may need to adjust their procurement and storage strategies to comply with the stock limits. Millers may have to optimize their production schedules.
**9. Conclusion:**
The Removal of Licensing Requirements, Stock Limits and Movement Restrictions on Specified Foodstuffs Amendment Order, 2021, temporarily reintroduces stock limits on pulses (excluding Moong). This amendment is likely a response to concerns about pulse availability and price stability. While aimed at benefiting consumers by ensuring a stable supply and preventing price gouging, the amendment will require significant adjustments from wholesalers, retailers, millers, and importers in their stock management and reporting practices. The effectiveness of this intervention will depend on the enforcement of the stock limits and the accuracy of the stock declarations made by the affected stakeholders.
