करती ह,ै अथा(cid:6981)त:—
1. (1) इस आदेश का सिं (cid:6979)(cid:7009) त नाम ग(cid:7008) ना (िनयं(cid:7074)ण) (संशोध(cid:7008)) आदशे , 2016 ह।ै
(2) यह राजप(cid:7074) म (cid:7286)(cid:7079)काशन क(cid:7409) तारीख को (cid:7079)व(cid:7004)ृ त होगा।
2. ग(cid:7008) ना (िनयं(cid:7074)ण), आदशे , 1966 म(cid:7286) ,-
(क) ख(cid:7003) ड 6ग के (cid:7021)थ ान पर, िन(cid:7013) निलिखत ख(cid:7003) ड रखा जाएगा, अथात(cid:6981) :-

के िलए अनु(cid:6980)ा पर रोक के कारण िवलंब अंतव(cid:7414)लत ह,ै अिधकतम दो वष (cid:6981) का िव(cid:7021)त ार (cid:7079)दान कर सकेगा जो एक समय म(cid:7286) एक
वष(cid:6981) स े अिधक नह(cid:7277) होगा । ऐस ेसभी मामल(cid:7298) म(cid:7286) िव(cid:7021)त ार या तो (cid:7079)भावी उपाय करने के िलए या शक(cid:6981)रा उ(cid:7004)प ादन (cid:7079)ारंभ करन े के
िलए, य(cid:7408)द आव(cid:7019) यक हो, संबिं धत रा(cid:6996) य सरकार(cid:7298) से परामश(cid:6981) करके मजं ूर (cid:7408)कया जाएगा ।”;

ORDER
New Delhi, 24th August, 2016.
S.O. 2787(E).—In exercise of the powers conferred by section 3 of the Essential Commodities Act, 1955 (10 of
1955), the Central Government hereby makes the following Order further to amend the Sugarcane (Control) Order, 1966,
namely:––
1. (1) This Order may be called the Sugarcane (Control) (Amendment) Order, 2016.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. In the Sugarcane (Control) Order, 1966,––
(a) for clause 6C, the following clause shall be substituted, namely:––
“6C. Time-limit to implement Industrial Entrepreneur Memorandum.–– The stipulated time for taking
effective steps shall be three years and commercial production shall commence within five years with effect from the
date of filing the Industrial Entrepreneur Memorandum with the Central Government, failing which the Industrial
Entrepreneur Memorandum shall stand de-recognised as far as provisions of this Order are concerned and the
performance guarantee shall be forfeited:
Provided that the Chief Director (Sugar), Department of Food and Public Distribution, Ministry of Consumer
Affairs, Food and Public Distribution may, after the expiry of the aforesaid period, give extension of maximum two
years, not exceeding more than a year at a time, in cases involving delay due to any unforeseen circumstances beyond
control, such as, natural calamities, drought or non-availability of sugarcane (raw material) during off season in a year
wherein the extended validity period terminates, non-financing of sugar sectors, stay on permission for land use by the
courts due to environmental or other reason. In all such cases extension shall be granted in consultation with respective
State Governments, if necessary, either for taking effective steps or for commencement of sugar production.”;
(b) after clause 6D, the following proviso shall be inserted, namely:––
“Provided that the performance guarantee shall be returned if,––
(i)(cid:32) the commercial production is commenced within the stipulated period of seven years including two
years of extension;
(ii)(cid:32) the commercial production is not commenced even after seven years for reasons not attributable to the
project proponent and the same is fully established on merit and be recorded in writing;
(iii)(cid:32) the project proponent,(cid:115)(cid:117)(cid:109)(cid:116)(cid:111)(cid:111)(cid:117) , opts to forego its Industrial Entrepreneur Memorandum within two
years from the date of its filing and requests for return of performance guarantee with due
justification.”.
