(1) इर् जिजर्यमों को कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 कहा िाएगा. (2) य ेजर्यम रािपत्र म ेंउर्के प्रकािर् की तारीख से लाग ूहोंगे. 2. कर्ााटक जिकास ग्रामीण बकैं (कमाचारी) पेंिर् जिजर्यम, 2018 (इसके बाद इस े उक्त जिजर्यम कहा िाएगा) के, जिजर्यम 2 के, उप-जिजर्यम (1) के, खडं (के) में, आंकड़,े अकं और िब् द "अप्रलै , 2018 का पहला ददर्" के स्ट्थार् पर "र्िंबर 1993 का पहला ददर्" आंकड़,े अंक और िब्द प्रजतस्ट्थ ाजपत दकए िाएगं े. 3. उक्त जिजर्यमों म,ें जिजर्यम 3 को जर्म्र् जलजखत जिजर्यम स ेप्रजतस्ट्थाजपत दकया िाएगा, र्ामत:, - 7118 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] "3. अर्प्रु योग - (1) कोई भी कमाचारी िो - (क) 1 जसतंबर, 1987 और 31 माचा 2010 के मध् य बैंक की सेिा में था और कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 की अजधसूचर्ा की तारीख से पहले सेिाजर्िृत्त या बखाास्ट्त या हटा ददया गया या सेिा की समाजि कर दी गई और आजधकाठरक रािपत्र म ें कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 की अजधसूचर्ा की तारीख से पंद्रह ददर्ों के भीतर ठरफंड करता ह ै या जर्जध का सदस्ट् य बर्ता ह ै और उसके द्वारा प्राि संपूणा अंजतम राजि (कमचा ारी पेंिर् योिर्ा, 1995 के तहत भजिष्य जर्जध में बैंक का योगदार् और राजि की प्राजि की तारीख तक उस पर अर्िात ब्याि) को ठरफंड कर देता ह ै और कमाचारी पेंिर् योिर्ा, 1995 के तहत उसके द्वारा प्राि आिजधक पेंिर्, यदद कोई हो, तो आजधकाठरक रािपत्र में कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 की अजधसूचर्ा की तारीख से पहले दकसी भी अिजध के जलए आरोप्य, या अर्ारोप् य, दकसी भी जस्ट्थजत म,ें ऐसी राजियों की प्राजि की तारीख से ठरफंड की तारीख तक ऐसी राजियों पर ब्याि का भुगतार् करर्ा अपेजक्षत र्हीं होगा. बिते दक कोई कमाचारी जिससे इस खंड के अर्ुसार राजि िापस करर्ा अपेजक्षत है, बैंक द्वारा उसको देय राजि में स ेइर् राजियों को समायोजित करर्े के जलए बैंक को प्राजधकृत कर सकता ह.ै और, बित े दक कोई कमाचारी िो उक्त जिजर्यमों के तहत पिें र् का जिकल्प चुर्र्े का पात्र था, लेदकर् जर्धााठरत समय के भीतर उसर्े पेंिर् का जिकल्प र्हीं चर्ु ा या चुर्ा ककंतु जर्धााठरत समय के भीतर धर् िापस र्हीं दकया, तो उस कमाचारी को, कमाचारी पेंिर् योिर्ा, 1995 के तहत उसके द्वारा प्राि आिजधक पेंिर्, यदद कोई हो, को िापस करर्े की आिश्यकता र्हीं होगी. (ख) 1 जसतंबर, 1987 और 31 माच ा 2010 के मध् य बैंक की सेिा में था और आजधकाठरक रािपत्र में कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 की अजधसूचर्ा की तारीख को या उसके बाद बैंक की सेिा म ें िारी रहता ह,ै और जर्जध का एक सदस्ट्य होता ह ै या सदस्ट्य बर्ता ह ै और आजधकाठरक रािपत्र में कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 की अजधसूचर्ा की तारीख से पंद्रह ददर्ों के भीतर, जिजर्यम 4 में गठित जर्जध म ें बैंक के पूरे योगदार् को ि उस पर अर्िात ब्याि के साथ अंतठरत कर िमा कर देता ह ैया करिाता ह ैतथा कमाचारी पेंिर् योिर्ा 1995 के तहत उसके द्वारा प्राि और आजधकाठरक रािपत्र में कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 की अजधसूचर्ा की तारीख से पहले दकसी भी अिजध के जलए आरोजपत पिें र् का भाग, यदद कोई हो, को िापस कर देता ह.ै (ग) 1 जसतंबर, 1987 और 31 माचा 2010 के मध् य बैंक की सेिा में था और अजधजर्यम की धारा 23 ए की उप- धारा (3) के खडं (बी) के तहत जिसर्े एक जिकल्प का प्रयोग दकया था या उक्त जिजर्यमों की अजधसूचर्ा स े पहल े इस्ट्तीफा दे ददया था, दोर्ों ही मामलों म,ें 20 साल की अहका सेिा पूरी करर्े के बाद और उजचत र्ोठटस देकर, जर्जध का सदस्ट्य बर्ता ह ैऔर आजधकाठरक रािपत्र म ें कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 की अजधसूचर्ा की तारीख से पंद्रह ददर्ों के भीतर, उसके द्वारा प्राि संपूण ा अंजतम राजि (कमाचारी पेंिर् योिर्ा, 1995 के तहत ि भजिष्य जर्जध में बैंक का योगदार् और राजि की प्राजि की तारीख तक उस पर अर्िात ब्याि) को ठरफंड कर देता ह ै और कमाचारी पेंिर् योिर्ा, 1995 के तहत उसके द्वारा प्राि आिजधक पिें र्, यदद कोई हो, तो आजधकाठरक रािपत्र में कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 की अजधसूचर्ा की तारीख से पहल े दकसी भी अिजध के जलए आरोप्य, या अर्ारोप् य, दकसी भी जस्ट्थजत में, ऐसी राजियों की प्राजि की तारीख से ठरफंड की तारीख तक ऐसी राजियों पर ब्याि का भुगतार् करर्ा अपजे क्षत र्हीं होगा. बिते दक एक कमाचारी, जिससे इस खंड के तहत राजि िापस करर्ा अपेजक्षत ह,ै बैंक द्वारा उसको देय राजि में स ेइर् राजियों को समायोजित करर्े के जलए बैंक को प्राजधकृत कर सकता ह.ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (2) उप-जिजर्यम (1) के खडं (क) और (ग) के तहत िाजमल दकया गया कमाचारी का पठरिार इर् जिजर्यमों के तहत पाठरिाठरक पेंिर् का हकदार होगा, िब ऐसे ददिंगत कमाचारी का पठरिार आजधकाठरक रािपत्र में कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 की अजधसूचर्ा की तारीख से तीस ददर्ों के भीतर, ददिंगत कमाचारी द्वारा या यथाजस्ट्थजत पठरिार द्वारा प्राि पूरी अंजतम राजि, कमाचारी पिें र् योिर्ा, 1995 के तहत भजिष्य जर्जध म ें बैंक का योगदार् और ददिगं त कमाचारी या यथाजस्ट्थजत ददिंगत कमाचारी के पठरिार द्वारा राजि की प्राजि की तारीख तक उस पर अर्िात ब्याि और कमाचारी पिें र् योिर्ा के तहत कमाचारी या ददिंगत कमाचारी के पठरिार द्वारा प्राि पिें र् या पाठरिाठरक पेंिर्, यदद कोई हो, को ठरफंड कर ददया हो या ठरफंड करता हो, ककंत ु दोर्ों मामलों म ेंप्राजि की तारीख से िापसी की तारीख तक ब्याि का भुगतार् करर्ा अपेजक्षत र्हीं होगा. बिते दक ददिंगत कमाचारी का पठरिार जिससे इस खंड के तहत राजि िापस करर्ा अपेजक्षत है, बैंक द्वारा उसको देय राजि में से इर् राजियों को समायोजित करर् ेके जलए बैंक को प्राजधकृत कर सकता ह.ै (3) इस जिजर्यम म ें दकसी बात के होते हुए भी, िो कमाचारी 1 अप्रलै , 2010 को या उसके बाद बैंक की सेिा म ें िाजमल हुआ ह,ै उसे राष्ट्रीय पिें र् प्रणाली म ेंिाजमल दकया िाएगा. 4. उक्त जिजर्यमों के जिजर्यम 20 म,ें उप-जिजर्यम (1) के पश्चात्, जर्म्नजलजखत परंतुक अतं ःस्ट्थाजपत दकया िाएगा, र्ामत: - "बित े दक जिजर्यम 3 के उप-जिजर्यम (1) के खंड (सी) के अतं गात आर्े िाल े कमाचाठरयों का सेिाकाल समपहृत र्हीं होगा.” 5. उक्त जिजर्यमों के जिजर्यम 32 में जर्म् र्जलजखत जिजर्यम को प्रजतस्ट्थाजपत दकया िाएगा, र्ामत: - "कजतपय कमाचाठरयों के संबंध में पेंिर् या पाठरिाठरक पिें र् का भुगतार्, - (1) िे कमाचारी िो 1 जसतंबर 1987 और 31 अक्त ूबर 1993 के मध् य बैंक की सेिा से सेिाजर्िृत्त हुए ह,ैं ि े प्रभािी तारीख से पेंिर् के जलए पात्र होंग.े (2) ददिंगत कमाचारी, िो 1 जसतंबर 1987 और 31 अक्त ूबर 1993 के मध् य सेिा म ें था और 31 अक्त ूबर 1993 से पहल े उसकी मृत् यु हो गई थी, उसका पठरिार प्रभािी तारीख से पठरिाठरक पिें र् के भुगतार् के जलए पात्र होगा. 6. उक्त जिजर्यमों के जिजर्यम 50 में जर्म् र्जलजखत जिजर्यम को प्रजतस्ट्थाजपत दकया िाएगा, र्ामत: - "जिस तारीख से पेंिर् देय होती ह ै – (1) जिस कमाचारी पर जिजर्यम 32 के उप-जिजर्यम (1), जिजर्यम 41 या 44 के उपबंध लागू होत े ह,ैं को छोड़कर, कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 के तहत जर्धााठरत समय के भीतर जिजर्यम 3 के उप-जिजर्यम (1) के तहत जर्र्दाष् ट पूरी राजि को ठरफंड कर देर्े या ठरफंड दकए िार्े या समायोिर् हते ु प्राजधकृत करर् े पर, पाठरिाठरक पेंिर् को छोड़कर, उस तारीख की अगली तारीख से पिे र् देय हो िाएगी जिस तारीख को कोई कमाचारी सेिाजर्िृत्त होता ह ै या, यथाजस्ट्थजत, पदत् याग करता ह ै या अजधजर्यम की धारा 23 क की उपधारा (3) के खंड (ख) के तहत अंतठरती बैंक में िाजमल होर् े का जिकल्प र्हीं चुर्ता ह.ै (2) जिस कमाचारी पर जिजर्यम 32 के उप-जिजर्यम (1), जिजर्यम 41 या 44 के उपबंध लाग ू होते ह,ैं को छोड़कर, कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 के तहत जर्धााठरत समय के भीतर जिजर्यम 3 के उप-जिजर्यम (2) के तहत जर्र्दाष् ट पूरी राजि को ठरफंड कर देर्े या ठरफंड दकए िार्े या4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] समायोिर् हते ु प्राजधकृत करर् े पर, उस तारीख की अगली तारीख से पाठरिाठरक पेंिर् देय हो िाएगी जिस तारीख को कमाचारी की मृत् यु होती ह.ै (3) इर् जिजर्यमों में दकसी बात के होते हुए भी, दकसी कमाचारी या ददिंगत कमाचारी के पठरिार के मामले म,ें िो उक्त जिजर्यमों के तहत यथाजस्ट्थजत पेंिर् या पाठरिाठरक पेंिर् का जिकल् प चुर्र् े के जलए पात्र था, उसर्े जिकल् प र्हीं चुर्ा या जिकल् प तो चुर्ा ककंतु पैसा ठरफंड र्हीं दकया ककंतु अब िह जिजर्यमर् (3) के उप-जिजर्यम (1) के खंड (क) के तहत यथाजस्ट्थजत, ठरफंड करता ह ै या समायोिर् हते ु प्राजधकृत करता ह ै तो िह जिजर्यम 3 के उप- जिजर्यम (2) के तहत कर्ााटक जिकास ग्रामीण बैंक (कमाचारी) पेंिर् (संिोधर्) जिजर्यम, 2024 की अजधसूचर्ा पर या उसके बाद, उप-जिजर्यम (1) या जिजर्यम 3 के खडं (ग) के तहत या जिजर्यम 3 के उप-जिजर्यम (2) के तहत सेिाजर्िृजत्त या इस्ट्तीफे की तारीख या मृत्यु, िो भी बाद में हो, से यथाजस्ट्थजत ठरफंड या समायोिर् की तारीख से यथाजस्ट्थजत पेंिर् या पाठरिाठरक पेंिर् के जलए पात्र होगा. श्रीकांत एम भंजडिाड, अध्यक्ष [जिज्ञापर्-III/4/असा./658/2024-25] र्ोट : मलू अजधसूचर्ा सं. 519 ददर्ांक 20.12.2018 के भारत के रािपत्र, असाधारण, भाग III, खंड 4, के माध् यम स े प्रकाजित की गई थी. KARNATAKA VIKAS GRAMEENA BANK NOTIFICATION Dharwad, the 8th October, 2024 No. KVGB/Pension Regulations/2024.—In exercise of the powers conferred by Section 30 read with sub-section (1) of section 17 of the Regional Rural Banks Act, 1976 (21 of 1976) the Board of Directors of Karnataka Vikas Grameena Bank, after consultation with Canara Bank being the Sponsor Bank, and the National Bank for Agriculture and Rural Development and with the previous sanction of the Central Government, hereby makes the following regulations to amend the Karnataka Vikas Grameena Bank (Employees’) Pension Regulations, 2018, namely: 1. (1) These Regulations may be called Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Karnataka Vikas Grameena Bank (Employees’) Pension Regulations, 2018 (hereinafter referred to as the said regulations), in regulation 2, in sub-regulation (1), in clause (k), for the figures, letters and words “1st day of April, 2018”, the figures, letters and words “1st day of November, 1993” shall be substituted. 3. In regulation 3 of the said regulations, the following regulation shall be substituted, namely: - “3. Application. –(1) Any employee who – (a) was in the service of the Bank between the 1st September, 1987 and the 31st March, 2010 and retired or dismissed or removed or terminated from service before the date of notification of Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024 and refunded or becomes a member of the Fund and refund within fifteen days from the date of notification of Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by him (the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995 and interest accrued thereon till the date of receipt by him of the amount) and the periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995 attributable to any period before date of notification of Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette but without, in either case, requiring to pay interest on such amounts from the date of receipt of such amounts to the date of refund: Provided that an employee who is required to refund the amounts as per this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee:[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 Provided further that an employee who was eligible to opt for pension under the said regulations but did not opt within the stipulated time or having opted not refunded the money within the stipulated time, the periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995, need not be refunded. (b) was in the service of the Bank between the 1st September, 1987 and the 31st March, 2010 and continue to be in the service of the Bank on or after the date of notification of Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, and a member or becomes member of the Fund and caused or cause to transfer the entire contribution of the Bank along with the interest accrued thereon, within fifteen days from the date of notification of Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, to the credit of the Fund constituted in regulation 4 and refund the portion of pension, if any, received by him under Employees’ Pension Scheme 1995, and attributable to any period before date of notification of Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette. (c) was in the service of the Bank between the 1st September, 1987 and the 31st March, 2010 and exercised an option under clause (b) of sub-section (3) of section 23A of the Act or resigned before the notification of the said Regulations, in either case, after having completed twenty years of qualifying service and by giving proper notice, shall become member of the Fund and refund within fifteen days from the date of notification of Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by him (the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995 and interest accrued thereon till the date of receipt by him of the amount) and periodic pension, if any, received by him under the Employees’ Pension Scheme, 1995 attributable to any period before date of notification of Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette but without, in either case, requiring to pay interest on such amounts from the date of receipt of such amounts to the date of refund: Provided that an employee, who is required to refund the amounts, under this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee. (2) The family of the employee covered under clauses (a) and (c) of sub-regulation (1), shall be entitled to family pension under these regulations when the family of such deceased employee refunded or refunds within thirty days from the date of notification of Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024 in the Official Gazette, the entire final amounts received by the deceased employee or as the case may be the family, the corpus comprising of Bank’s contribution to provident fund under the Employees’ Pension Scheme, 1995, and interest accrued thereon till the date of receipt of the amount by the deceased employee or, as the case may be, the family of a deceased employee and pension or family pension, if any, received by the employee or the family of the deceased employee under the Employees’ Pension Scheme, 1995, but in either case without requiring to pay interest from the date of receipt to the date of refund. Provided that a family of the deceased employee, who is required to refund the amounts under this clause may authorise the Bank to adjust these amounts from the amounts payable by the Bank to the employee. (3) Notwithstanding anything contained in this regulation, any employee who joined the service of the Bank on or after the 1st April, 2010 shall be covered by the National Pension System”. 4. In regulation 20 of the said regulations, after sub-regulation (1), the following proviso shall be inserted, namely:- “Provided that there would no forfeiture of service for employees covered under clause (c) of sub-regulation (1) of regulation 3”. 5. In regulation 32 of the said regulations, the following regulation shall be substituted namely: - “Payment of pension or family pension in respect of certain employees. - (1) Employees who have retired from the service of the Bank between the 1st September, 1987 and the 31st October, 1993 shall be eligible for pension from the effective date. (2) The family of a deceased employee, who was in service between the 1st September, 1987 and the 31st October, 1993 and died before the 31st October, 1993 shall be eligible for payment of family pension from the effective date”. 6. In regulation 50 of the said regulations, the following regulation shall be substituted, namely: - “Date from which pension becomes payable. - (1) Except in the case of an employee to whom the provisions of sub-regulation (1) of regulations 32, or 41, or 44 apply a pension other than the family pension shall become payable from the date following the date on which an employee retires or, as the case may be, resigns or opts not to join the transferee bank under clause (b) of sub-section (3) of section 23A of the Act on refund6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] or refunding or authorising adjustment of the entire amounts specified under sub-regulation (1) of regulation 3 within the time stipulated under Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024. (2) Except in the case of an employee to whom the provisions of sub-regulation (1) of regulations 32, or 41, or 44 apply, family pension shall become payable from the date following the date of death of the employee, on refunding or authorising adjustment of the entire amounts specified under sub-regulation (2) of regulation 3 within the time stipulated under Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024. (3) Notwithstanding anything contained in these regulations, in case of an employee, or as the case may be, family of the deceased employee who was eligible to opt for pension, or as the case may be, family pension under the said regulations but did not opt or opted but did not refund the money, but refunds or authorise adjustment of money under clause (a) of sub-regulation (1) of regulation (3), or as the case may be, under sub-regulation (2) of regulation 3 on or after notification of Karnataka Vikas Grameena Bank (Employees’) Pension (Amendment) Regulations, 2024 shall be entitled for pension, family pension, or as the case may be, from date of refund or adjustment under clause (c) of sub-regulation (1) of regulation 3, or as the case may be, sub-regulation (2) of regulation 3, or the date of retirement or resignation, or death, as the case may be, whichever is later.” SHREEKANT M.
