Short title and commencement.- (1) These regulations may be called the Establishment of New Medical College, Opening of New or Higher Course of Study or Training and Increase of Admission Capacity by a Medical College Regulations, 2019. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definition. - In these regulations, unless the context otherwise requires,- (a) “Act” means the Indian Medicine Central Council Act, 1970 (48 of 1970); (b) “Form” means a Form annexed to these regulations; (c) “section” means a section of the Act; and (d) words and expressions used herein and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act. 3. The permission for establishment of a medical college, opening of new or higher course of study or training and increase of admission capacity.-Any person intending to establish a medical college or any medical college intending to open a new or higher course of study or training or intending to increase admission capacity in any course of study or¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 15 training shall follow the procedure and criteria mentioned in regulations 4 to 6 and submit a scheme to the Central Government along with an application in the form specified in regulation 4. 4. Application Form of scheme.–(1) Any person intending to establish a medical college shall submit the application online in Form-1 as amended from time to time along with non-refundable application fee. (2) Any medical college intending to open a new or higher course of study or training shall submit the application online in Form-2 as amended from time to time along with non-refundable application fee. (3) Any medical college intending to increase its admission capacity in any course of study or training shall submit the application online in Form-3 as amended from time to time along with non-refundable application fee. 5. Authority to whom the schemes and applications is to be submitted.–Applications and schemes under regulation 4 shall be submitted online to the Secretary to the Government of India, Ministry of Ayurveda, Yoga and Naturopathy, Unani, Siddha and Homoeopathy (AYUSH), as per the schedule annexed to the regulations. 6. Eligibility for making an application.–(1)For making an application under sub-regulation (1) of regulation 4, a person shall be eligible if, - (a) his one of the objectives is to impart education about Ayurveda or Siddha or Unani Tibb or Sowa Rigpa; (b) owns or possesses the land on lease of not less than thirty years, in the name of college and renewal shall be required on expiry of lease; (i) for intake capacity upto sixty seats, a single piece of land, not less than three acres; (ii) for intake capacity from sixty one to hundred seats, land shall not be less than five acres and not more than two plots at a distance not exceeding two kilometers; (iii) plot, if separated by a road or canal or rivulet but connected with a bridge, shall be treated as one piece of land. (c) has obtained ‘No Objection Certificate’ in Form- 4 from the concerned State Government for establishing a new medical college at the proposed site; (d) has obtained a ‘Consent of Affiliation’ in Form- 5 for establishing a new medical college from a University established under any Central or State statute; (e) owns and manages a hospital in Ayurveda or Siddha or Unani or Sowa Rigpa and in a position to establish infrastructure and manpower in phased manner as specified in the notified requirements of Minimum Standard regulations of concerned systems of Indian Medicine. (f) furnishes an undertaking that, selection or admission of students will be made strictly on the basis of academic merit as prescribed by Central Council; (g) furnishes an undertaking that, the nomenclature of courses and teacher-student ratio will be kept as laid down in the concerned regulations; (h) has not already admitted students in any class or standard or course or training of the proposed medical college; and (i) is in a position to furnish fixed security deposit valid for a period of five years in favour of the Central Council of Indian Medicine, New Delhi as follows:- (i) for the establishment of medical college: upto 60 seats - rupees one crore; (ii) between 61 - 100 seats – rupees two crores: Provided that it shall not apply to the colleges governed by the State Governments or Union Territories, if they give an Undertaking to provide funds in their plan budget regularly till requisite facilities are fully provided as per time bound programme indicated by them. (2) For making an application under sub-regulation (2) of regulation 4, a medical college shall be eligible if,- (a) has obtained the permission of the concerned State Government or the Union Territory Administration (Form- 4); (b) has obtained the concurrence of the University established under any Central or State Statute (Form- 5); (c) is able to produce documentary evidence in support of additional financial resources, staff, space, equipment and other infrastructure as per Central Council norms; (d) permitted by the central government for running Under-Graduate or Post-Graduate courses in Ayurveda or Siddha or Unani or Sowa Rigpa and completed at least four years six months and three years respectively after first permission; (e) is exempted by the Central Government for being owned or managed by the Central Government or the State Government or Union Territory from fulfilling the criteria specified in sub-clause (d); (f) selection of students for post-graduate courses is made strictly on the basis of academic merit as prescribed by Central Council;16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (g) the nomenclature of post-graduate degree or diploma and super-specialty courses and teacher-student ratio is as laid down in the concerned regulations; (h) in a position to establish infrastructure and manpower in such manner as specified in the notified concerned regulations prescribed by Central Council of Indian Medicine; (i) furnishes a fixed security deposit valid for three years in favour of the Central Council of Indian Medicine as follows:- (i) Post-graduate degree course -rupees fifty lakhs per speciality; (ii) Post-graduate diploma Course - rupees ten lakhs per speciality; (iii) Super-specialty course-rupees one crore per speciality; (iv) any other recognised course-rupees thirty lakhs per speciality: Provided that it shall not apply to the colleges governed by the State Governments or Union Territories, if they give an Undertaking to provide funds in their plan budget regularly till requisite facilities are fully provided as per time bound programme indicated by them. (3) For making an application under sub-regulation (3) of regulation 4, a medical college shall be eligible if, (a) has obtained the permission of the concerned State Government or the Union Territory Administration (Form- 4); (b) has obtained the concurrence of the University established under any Central or State Statute (Form- 5); (c) has produced documentary evidence in support of additional financial resources, staff, space, equipment and other infrastructure as per Central Council norms; (d) permitted by the central government for running Under-Graduate or Post-Graduate courses in Ayurveda or Siddha or Unani or Sowa Rigpa and completed at least four years six months in case of Under-Graduate course and three years in case of concerned speciality of Post-Graduate degree course(s) and two years in case of concerned speciality of Post-Graduate Diploma Course(s) respectively after first permission; (e) is exempted by the Central Government for being owned or managed by the Central Government or the State Government or Union Territory from fulfilling the criteria specified in sub-clause (d); (f) selection of students for Under-Graduate course, post-graduate courses or diploma and super-specialty courses is made strictly on the basis of academic merit as prescribed by Central Council; (g) the ratio of teaching staff and students are maintained as laid down in the regulation on Minimum Standards and requirements for admission in the medical college; (h) the maximum number of admissions shall not exceed the limit as prescribed in the concerned regulations; (i) in a position to establish infrastructure and manpower in such manner as specified in the notified concerned regulations prescribed by Central Council; (j) furnishes a fixed security deposit valid for five years in case of under-graduate course and three years in case of Post-graduate course in favour of the Central Council of Indian Medicine, New Delhi as follows:- (i) Under-graduate course: Up to 60 seats - rupees twenty five lakhs; (ii) between 61 to 100 seats - rupees fifty lakhs; (iii) Post-graduate degree course: per seat - rupees five lakhs; (iv) Post-Graduate diploma Course: per seat- rupees two lakhs; (v) Super-specialty course: per seat- rupees ten lakhs; and (vi) any other recognised course: per seat - rupees two lakhs: Provided that it shall not apply to the colleges governed by the State Governments or Union Territories, if they give an Undertaking to provide funds in their plan budget regularly till requisite facilities are fully provided as per time bound programme indicated by them. 7. Recommendation of Central Council.-(1) The Central Government, after receipt of the applications shall scrutinized the application on the basic of eligibility criteria like Application Fee, No Objection Certificate of the State Government and Consent of Affiliation of the University etc. and the Central Government shall forward only eligible applications to the Central Council of Indian Medicine for further consideration and the ineligible and incomplete applications shall be rejected and returned to the applicants by the Central Government. (2) The Central Council of Indian Medicine shall inspect colleges and issue Letter of Intent at their level in Form-6, if the college is found eligible as specified in the regulations 6 and the Central Council of Indian Medicine shall again inspect or verify the compliance of requirement of minimum standards as specified in concerned regulations and other conditions of Letter of Intent and send the recommendations only once for denial or issuing Letter of Permission as the case may be in Form-7, by the 31st March for approval of the Central Government. 8. Fee to be submitted along with application.- An application alongwith all necessary documents to be submitted under regulation 4 shall be accompanied by the following non-refundable application fee by way of a demand draft or¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 17 Online payment (National Electronic Funds Transfer /Real Time Gross Settlement) payable to the 'Central Council of Indian Medicine', New Delhi:- (a) to establish a medical college - rupees ten lakhs; (b) to open a new or higher course of study or training - rupees five lakhs per course per speciality; (c) to increase admission capacity – (i) for under-graduate course-rupees five lakhs; (ii) for post-graduate courses-rupees five lakhs per speciality. 9. Permission Order. – (1)The Central Government on the recommendation of the Central Council and after submission of security deposit by the applicant, shall issue a Letter Of Permission to set up a new Medical College or to open new course or to increase intake capacity with such conditions or modifications in the original proposal as may be considered necessary. (2) The permission to establish a medical college and admit students shall be granted initially for a period of one year and shall be renewed on yearly basis subject to verification of the achievements of annual targets and it shall be the responsibility of the person to apply to the Central Council of Indian Medicine for the purpose of renewal prior to six months to the expiry of the initial permission. (3) This process of renewal of permission shall continue till such time the establishment of the medical college and expansion of the hospital facilities are completed and a formal recognition of the medical college is granted: Provided that the admissions shall not be made at any stage unless the requirements of the Central Council are fulfilled and the Central Government shall at any stage convey the deficiencies to the applicant and provide him an opportunity and time to rectify the deficiencies. (4) The Central Council may obtain any other information from the proposed medical college as it deems fit and necessary.
