(घ) उप-िनयम (6) के ,थान पर िन-िलिखत उप-िनयम रखा जाएगा, अथा(cid:13)त्:-
“(6) नीलामकता(cid:13) के (cid:5)प म(cid:2) अनु(cid:21)ि(cid:23) ज़ारी करने हते ु और (cid:14)यौहारी के (cid:5)प म(cid:2) अनु(cid:21)ि(cid:23) के ज़ारी करन,े नवीकरण करने और
संशोधन करने के िलए (cid:3)0यके आवेदन के साथ नीचे Aदए अनुसार फ़4स और यथा लागू कर, संल8 ह#गे ।
(क) नीलामकता(cid:13) अनु(cid:21)ि(cid:23) के िलए संदये फ़4स -
(i) पुि,तका नीलामी
(1) ज़ारी करना – 15,000/- Nपए;
(2) संशोधन करना – 5,000/-Nपए ;
(ii) बोड(cid:13) >ारा ,थािपत साव(cid:13)जिनक ई-नीलाम के<=# म(cid:2) ई-नीलाम
(1) ज़ारी करना – 1,00,000/- Nपए;
(2) संशोधन करना – 5,000/- Nपए ;
(ख) (cid:14)यौहारी अनु(cid:21)ि(cid:23) के िलए संदये फ़4स
(i) ज़ारी करने या नवीकरण करने या ि>नीितयक के िलए – 10,000/- Nपए;
(ii) संशोधन करने के िलए : 5,000/- Nपए । "
(2) िनयम 5 म(cid:2) -
(क) उप-िनयम (1) के ,थान पर िन-िलिखत उप-िनयम रखा जाएगा, अथा(cid:13)त् :-
“(1) नीलामकता(cid:13) या (cid:14)यौहारी के (cid:5)प म(cid:2) अपनी अनु(cid:21)ि(cid:23) का नवीकरण करने का इQछुक SिJ िविन$द(cid:13)% (cid:3)(cid:5)प म (cid:2)
अपना आवेदन मसाला बोड(cid:13) को उस वष(cid:13) क4 30 जून को या उससे पूव(cid:13) िजसम(cid:2) अनु(cid:21)ि(cid:23) क4 िविधमा<यता क4 समाि(cid:23)
होती ह,ै (cid:3),तुत करेगा:
परंत,ु मसाला बोड(cid:13) >ारा समय-समय पर अनुबंिधत अनुसार आवेदन (cid:3),तुत करने क4 अंितम तारीख बढाई जाएगी। "
(ख) उप-िनयम (2) के ,थान पर िन-िलिखत उप-िनयम रखा जाएगा, अथा(cid:13)त्:-
"(2) मसाला बोड(cid:13) को यAद आवेदक क4 उपयुJता का समाधान हो जाता ह ै तो वह यथाि,थित िविहत (cid:3)(cid:5)प म (cid:2)
अनु(cid:21)ि(cid:23) का नवीकरण करेगा।"
(ग) उप-िनयम (3) के ,थान पर िन-िलिखत उप-िनयम रखा जाएगा, अथा(cid:13)त् :-
""""(3) ई-नीलामी के िलए Aकसी अनु(cid:21)ि(cid:23) का तीन उUरवत: खंड अविधय# के िलए नवीकरण नहV Aकया जाएगा यAद
नीलामकता(cid:13) एक वष(cid:13) क4 लगातार क4 अविध केिलए Aकसी कारबार का संSवहार करने म(cid:2) असफ़ल रहता ह ैया िनयम
10 के उप िनयम (1) के खWड (ट) और खWड (ड) के अनुपालन करने म(cid:2) असफ़ल रहता ह।ै "
(3) िनयम 10 म(cid:2) -
(क) उप-िनयम (1) के खWड (ट) के ,थान पर िन-िलिखत खWड रखा जाएगा, अथा(cid:13)त् :-

NOTIFICATION
New Delhi, the 8th March, 2018
G.S.R. 215(E).— In exercise of the powers conferred by section 38 of the Spices Board Act, 1986 (10 of 1986),
the Central Government hereby makes the following rules further to amend the Cardamom (Licensing and Marketing)
Rules, 1987, namely:-
1. (1) These rules may be called the Cardamom (Licensing and Marketing) Amendment Rules, 2018.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Cardamom (Licensing and Marketing) Rules, 1987, -
(1) in rule 4,-
(a) in sub-rule (1), for the words, letters and brackets “Form A (Auctioneer) or A1 (Dealer) to the Board” the
words “ the specified form, to Spices Board” shall be substituted.
(b) for sub-rule (2), the following sub-rule shall be substituted, namely:-
“(2) Every application, for license as auctioneer or dealer for a block period of three years or part
thereof, shall be accompanied by a receipt of fee as specified in sub-rule (6). For subsequent block
periods, there shall be a revision of fees, as stipulated by Spices Board from time to time, with the
approval of the Central Government, for issue, renewal and amendment of license. The fee shall be
payable in the form of bank transfer or crossed account payee demand draft drawn in favour of the
Spices Board, payable at Ernakulam or Kochi”.
(c) for sub-rule (3), the following sub-rule shall be substituted, namely:-
“(3) Spices Board may, if it is satisfied as to the suitability of the applicant as per sub rules (4) and (5)
as applicable, issue license in the specified form, as the case may be”.
(d) for sub-rule (6), the following sub-rule shall be substituted, namely:-
“(6) Every application for issue of license as auctioneer and issue, renewal and amendment of license
as dealer shall be accompanied by a fee as under, plus the tax as applicable:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(a) The fee payable for auctioneer license is -
(i) manual auction
(1) issue: Rs.15,000/-;
(2) amendment: Rs. 5000/-;
(ii) e- auction in common e-auction centers established by the Board
(1) issue: Rs.1,00,000/-;
(2) amendment: Rs. 5,000/- ;
(b) The fee payable for dealer lic ense is-
(i) issue or renewal or duplicate : Rs.10,000/-;
(ii) amendment: Rs.5,000/- ; ”
(2) in rule 5, -
(a) for sub-rule (1), the following sub-rule shall be substituted, namely :-
“(1) Any person desiring to renew his license as auctioneer or dealer may submit his application to
Spices Board in the specified form, on or before 30th June of the year in which the validity of the
license expires:
Provided that the date for submission of application shall be extended, as stipulated by Spices Board
from time to time”.
(b) for sub-rule (2), the following sub-rule shall be substituted, namely :-
“(2) Spices Board may, if it is satisfied as to the suitability of the applicant, renew the license in the
prescribed form as the case may be”.
(c) for sub-rule (3), the following sub-rule shall be substituted, namely:-
“(3) The license for e-auction shall not be renewed for the succeeding block period, if the auctioneer
fails to transact any business for a continuous period of one year or fails to comply with clause (k) and
clause (m) of sub-rule (1) of rule 10”.
(3) in rule 10,-
(a) for clause (k) of sub-rule (1), the following clause shall be substituted, namely :-
“(k) the auctioneer shall maintain a register in the specified form and forward a copy of the same to
Spices Board within seven days from the date of auction”.
(b) for clause (l) of sub-rule (1), the following clause shall be substituted, namely:-
“(l) the auctioneer shall submit an interim report of the auction to Spices Board, on the next day of the
auction in the form specified by the Board” .
(c) for Clause(c) of sub-rule (2), the following clause shall be substituted, namely:-
“(c) every dealer shall maintain a register in the form specified by Spices Board”.
(d) for Clause (d) of sub-rule (2), the following clause shall be substituted, namely:-
“(d) every dealer shall submit a monthly return in the form specified by Spices Board so as to reach
the Board on or before the 10th day of the succeeding month”.
(4) “FORM- A, FORM A1, FORM -B, FORM B1, FORM B3, FORM C, FORM D, FORM E, and FORM F
shall be omitted from the Cardamom (Licensing and Marketing) Rules, 1987 and the same may be specified by
Spices Board from time to time with the approval of the Central Government”.
