L.-33004/99 सससीीी...जजजीीी...---डडडीीी...एएएललल...---अअअ...---222666000222222000222666---222777000555111222 xxxGIDHxxx CCCGGG---DDDLLL---EEE---222666000222222000222666---222777000555111222 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 142] नई दिल्ली, बुधिार, फरिरी 25, 2026/फाल्ग नु 6, 1947 ष 22, 1947 No. 142] NEW DELHI, WEDNESDAY, FEBRUARY 25, 2026/PHALGUNA 6, 1947 s 1947 भारतीय मानक ब्यरू ो (उपभोक्ता मामल े जिभाग) अजधसचू ना नई दिल्ली, 25 फरिरी, 2026 एफ.स ं . बीएस/ XI/11/01/2025-26.— ब्यरू ो, भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) की धारा 39 के साथ पठित धारा 12 और 13 द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, केन्द्रीय सरकार के पूिविती अनुमोिन स े भारतीय मानक ब्यूरो (अनुरूपता मूल्यांकन) जिजनयम, 2018 का और संिोधन करने हते ु जनम्नजलजखत जिजनयम बनाता ह,ै अथावत:् — 1. संजिप्त नाम एि ं प्रारंभ — (1) इन जिजनयमों का संजिप्त नाम भारतीय मानक ब्यरू ो (अनुरूपता मल्ू यांकन) संिोधन जिजनयम, 2026 ह।ै (2) य ेरािपत्र म ें प्रकािन की तारीख स े प्रिृत होंगे। 2. भारतीय मानक ब्यूरो (अनरूु पता मल्ू यांकन) जिजनयम, 2018 (जिसे इसके पश्चात मख्ु य जिजनयम कहा गया ह)ै , के जिजनयम 5 म,ें उप-जिजनयम (2) के पश्चात,् जनम्नजलजखत उप-जिजनयम प्रजिष्ट दकया िाएगा, अथावत:— 1415 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “(3) िुल्क का भुगतान अनुज्ञापत्र के अनुिान के समय और िधै अनुज्ञापत्र के संचालन की जनरंतरता के जलए अजिम रूप स े िार्षवक आधार पर दकया िाएगा।” 3. मुख्य जिजनयम के जिजनयम 6 म,ें उप-जिजनयम (14) के पश्चात,् जनम्नजलजखत उप-जिजनयम प्रजिष्ट दकया िाएगा, अथावत:— “(15) अनुज्ञाधारी उत्पािन जििरण के साथ िये िार्षवक राजि का भुगतान समयसीमा के भीतर करेगा।” 4. मुख्य जिजनयम के जिजनयम 8 म,ें — (क) िीषवक के स्ट्थान पर जनम्नजलजखत िीषवक प्रजतस्ट्थाजपत दकया िाएगा, अथावत:— “अनज्ञु ापत्र के संचालन की जनरंतरता और उसका निीकरण”; (ख) उप-जिजनयम (2) के स्ट्थान पर जनम्नजलजखत उप-जिजनयम प्रजतस्ट्थाजपत दकया िाएगा, अथावत:— “(2) उप-जिजनयम (1) के अधीन आिेिन, ब्यरू ो को अनुज्ञापत्र की िैधता की समाजप्त स े पूि व दकया िाएगा, िैसा दक अनुसूची-II म ें िी गई लागू स्ट्कीम म ें जिजनर्िवष्ट ह ै और िल्ु क का भुगतान अनज्ञु ापत्र के निीकरण के समय और निीकरण के पश्चात िैध अनज्ञु ापत्र के संचालन की जनरंतरता के जलए अजिम रूप स े िार्षवक आधार पर दकया िाएगा। ” (ग) उप-जिजनयम (9) के पश्चात,् जनम्नजलजखत उप-जिजनयम प्रजिष्ट दकए िाएंगे, अथावत:— “(10) दकसी िैध अनुज्ञापत्र के संचालन की जनरंतरता के जलए िार्षवक आधार पर िये िल्ु क का भुगतान अजिम रूप स े जनयत तारीख स े पूि व दकया िाएगा, िैसा दक लाग ू स्ट्कीम म ेंजिजनर्िवष्ट ह।ै (11) यदि उत्पािन जििरण सजहत िार्षवक िुल्क जनयत तारीख तक प्राप्त नहीं होता ह,ै तो अनुज्ञापत्र का संचालन जनयत तारीख स े नब्ब े दिन की अिजध के जलए या लाग ू स्ट्कीम म ें उपबंजधत अिजध के जलए जनलंजबत जस्ट्थत रहगे ा: परंत ु ऐसी ििा म ें िब उत्पािन जििरण सजहत िार्षवक िल्ु क नब्बे दिन की अिजध के भीतर पाचाँ हज़ार रुपये के जिलंब िल्ु क सजहत प्राप्त हो िाता ह,ै तो जनलंबन जनरस्ट्त हो िाएगा: परंत ु यह और दक उत्पािन जििरण सजहत िार्षवक िल्ु क यदि जनलंबन की अिजध के भीतर प्राप्त नहीं होता ह,ै तो अनज्ञु ापत्र रद्द कर दिया िाएगा। (12) उप-जिजनयम (10) और (11) म ें अतं र्िवष्ट दकसी बात के होत े हुए भी, यदि उत्पािन जििरण सजहत िार्षवक िुल्क जनलंबन अिजध के नब्बे दिनों के भीतर अिा कर दिया गया ह,ै तो अनुज्ञापत्र का जनलंबन तब तक जनरस्ट्त नहीं दकया िाएगा, िब तक दक नमूनों की अनुरूपता न होने या अन्द्य अननुपालनों के कारण जनलंबन िार्षवक िुल्क भुगतान की जनयत तारीख स े पिू व ही पहले स े लगाया गया था या लगाया िाना अपेजित ह ै और यदि िे जिसंगजतया ाँ िो जनलंबन की जनरंतरता का कारण बनीं, िरू कर िी िाती ह,ैं तो ब्यूरो द्वारा जनलंबन जनरस्ट्त दकया िा सकता ह।ै 5. मख्ु य जिजनयम के जिजनयम 10 म,ें उप-जिजनयम (3) के स्ट्थान पर जनम्नजलजखत उप-जिजनयम प्रजतस्ट्थाजपत दकया िाएगा, अथावत:—[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 “(3) उप-जिजनयम (2) के अधीन अनुज्ञापत्र जनलंजबत करने स े पूि,व अनुज्ञाधारी को इक्कीस दिन की सूचना िी िाएगी, उन मामलों को छोड़कर िहााँ अनुज्ञापत्र िार्षवक िल्ु क के भुगतान न होन े के कारण जनलंजबत दकया गया ह,ै जिसके जलए जिजनयम 8 का उपबंध लागू होगा।” 6. मख्ु य जिजनयम के जिजनयम 11 म,ें उप-जिजनयम (1) के स्ट्थान पर जनम्नजलजखत उप-जिजनयम प्रजतस्ट्थाजपत दकया िाएगा, अथावत:— “(1) इक्कीस दिन स े अन्द्यून अिजध की सूचना िेकर ब्यरू ो जलजखत आिेि द्वारा अनुज्ञापत्र रद्द कर सकेगा, यदि- (क) अनुज्ञाधारी अनुज्ञापत्र की दकसी ितव का अनुपालन करने म ें जिफल रहता ह;ै (ख) अनुज्ञापत्र त्रुठििि िारी गया ह,ै उन मामलों को छोड़कर िहााँ अनुज्ञापत्र उत्पािन जििरण सजहत िार्षवक िुल्क के भुगतान न होने के कारण रद्द दकया गया ह,ै जिसके जलए जिजनयम 8 के उप-जिजनयम (11) का उपबंध लागू होगा।” 7. मुख्य जिजनयम के जिजनयम 13 म,ें उप-जिजनयम (3) के पश्चात,् जनम्नजलजखत उप-जिजनयम प्रजिष्ट दकया िाएगा, अथावत:— “(4) िल्ु क का भुगतान अनुरूपता प्रमाणपत्र के अनुिान के समय और पश्चात उसकी जनरंतरता के जलए अजिम रूप स े िार्षवक आधार पर दकया िाएगा।” 8. मख्ु य जिजनयम के जिजनयम 14 म,ें उप-जिजनयम (11) के पश्चात,् जनम्नजलजखत उप-जिजनयम प्रजिष्ट दकया िाएगा, अथावत:— “(12) अनुरूपता प्रमाणपत्र धारक िये िार्षवक राजि का भुगतान उत्पािन जििरण के साथ समयसीमा के भीतर करेगा।” 9. मुख्य जिजनयम के जिजनयम 16 म,ें — (क) िीषवक के स्ट्थान पर जनम्नजलजखत िीषवक प्रजतस्ट्थाजपत दकया िाएगा, अथावत:— “अनरूु पता प्रमाणपत्र के संचालन की जनरंतरता और उसका निीकरण”; (ख) उप-जिजनयम (2) के स्ट्थान पर जनम्नजलजखत उप-जिजनयम प्रजतस्ट्थाजपत दकया िाएगा, अथावत:— “(2) उप-जिजनयम (1) के अधीन आिेिन, ब्यूरो को अनरूु पता प्रमाणपत्र की िैधता की समाजप्त स े पूिव दकया िाएगा, िैसा दक अनुसूची-II म ें िी गई लाग ू स्ट्कीम म ें जिजनर्िवष्ट ह ै और िल्ु क का भगु तान अनुरूपता प्रमाणपत्र के निीकरण के समय और उसके पश्चात उसकी जनरंतरता के जलए अजिम रूप स े िार्षवक आधार पर दकया िाएगा।” (ग) उप-जिजनयम (10) के पश्चात,् जनम्नजलजखत उप-जिजनयम प्रजिष्ट दकया िाएगा, अथावत:— “(11) दकसी का भुगतान अजिम रूप स े जनयत तारीख स े पूिव दकया िाएगा, िैसा दक लाग ू स्ट्कीम म ें जिजनर्िवष्ट ह।ै (12) यदि उत्पािन जििरण सजहत िार्षवक िुल्क जनयत तारीख तक प्राप्त नहीं होता ह,ै तो अनुरूपता प्रमाणपत्र का संचालन जनयत तारीख स े नब्ब े दिन की अिजध के जलए या लाग ू स्ट्कीम म ें उपबंजधत अिजध के जलए जनलंजबत जस्ट्थत रहगे ा:4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंतु यदि उत्पािन जििरण सजहत िार्षवक िुल्क नब्बे दिनों की अिजध के भीतर पााँच हिार रुपय े के जिलबं िुल्क सजहत प्राप्त हो िाता ह,ै तो जनलंबन जनरस्ट्त हो िाएगा: परंत ु यह और दक उत्पािन जििरण सजहत िार्षवक िल्ु क यदि जनलंबन की अिजध के भीतर प्राप्त नहीं होता ह,ै तो अनरूु पता प्रमाणपत्र रद्द कर दिया िाएगा। (13) उप-जिजनयम (11) और (12) म ें अंतर्िवष्ट दकसी भी बात के होत े हुए भी, यदि उत्पािन जििरण सजहत िार्षकव िुल्क जनलंबन अिजध के नब्बे दिनों के भीतर अिा कर दिया गया ह,ै तो अनरूु पता प्रमाणपत्र का जनलंबन तब तक जनरस्ट्त नहीं दकया िाएगा, िब तक दक नमूनों की अनुरूपता न होने या अन्द्य अननपु ालनों के कारण जनलंबन िार्षवक िुल्क भुगतान की जनयत तारीख स े पूिव ही पहले स े लगाया गया था या लगाया िाना अपेजित ह ै और यदि िे जिसंगजतयााँ िो जनलंबन की जनरंतरता का कारण बनीं, िरू कर िी िाती ह,ैं तो ब्यूरो द्वारा जनलंबन जनरस्ट्त दकया िा सकता ह।ै ” 10. मुख्य जिजनयम के जिजनयम 18 म,ें उप-जिजनयम (3) के स्ट्थान पर जनम्नजलजखत उप-जिजनयम प्रजतस्ट्थाजपत दकया िाएगा, अथावत:— “(3) उप-जिजनयम (2) के अंतगवत अनरूु पता प्रमाणपत्र को जनलंजबत करने स े पहले, अनुरूपता प्रमाणपत्र के धारक को इक्कीस दिन का नोठिस दिया िाएगा, जसिाय उन मामलों के िहां िार्षवक िुल्क का भगु तान न करन े के कारण अनुरूपता प्रमाणपत्र जनलंजबत माना िाता ह,ै जिसके जलए जिजनयमन 16 के उप-जिजनयम (12) के संबंजधत प्रािधान लागू होंगे।” 11. मुख्य जिजनयम के जिजनयम 19 म,ें उप-जिजनयम (1) के स्ट्थान पर जनम्नजलजखत उप-जिजनयम प्रजतस्ट्थाजपत दकया िाएगा, अथावत:— “(1) इक्कीस दिन स े अन्द्यून अिजध की सूचना िेकर ब्यूरो जलजखत आििे द्वारा अनरूु पता प्रमाणपत्र रद्द कर सकेगा, यदि – (क) अनरूु पता प्रमाणपत्र धारक, अनुरूपता प्रमाणपत्र की दकसी भी ितव का अनपु ालन करने म ेंजिफल रहता ह;ै (ख) अनरूु पता प्रमाणपत्र त्रुठििि िारी गया ह,ै उन मामलों को छोड़कर िहा ाँ अनरूु पता प्रमाणपत्र जिजनयम 16 के उप-जिजनयम (12) के उपबंधों के अनुसार उत्पािन जििरण सजहत िार्षवक िुल्क के भगु तान न होन े के कारण रद्द दकया गया ह।ै ” 12. मुख्य जिजनयम की अनुसूची-II म,ें स्ट्कीम-I स ेपूिव, जनम्नजलजखत पैरा प्रजिष्ट दकए िाएगं े, अथावत:— “1. इस अनुसूची म ें उत्पाि (माल अथिा िस्ट्तु), प्रणाली, सेिा तथा प्रदिया हते ु िस जभन्न अनरूु पता मूल्यांकन स्ट्कीम ें उपबंजधत ह ैंऔर इन िस स्ट्कीमों म ें स,े सात स्ट्कीम ें उत्पािों के अनुरूपता मल्ू यांकन के जलए ह ैंऔर िेष तीन प्रणाली, सेिा और प्रदिया हते ु ह,ैं जहतधारकों (उद्योग और उपभोक्ता िोनों सजहत) की आिश्यकताओं और जिजनयामक उद्देश्यों पर जनभरव करत े हुए, तकनीकी जिजनयमों या गुणित्ता जनयंत्रण आििे ों के अधीन अजधसूजचत उत्पािों के जलए प्राजधकाठरयों द्वारा राष्ट्रीय बािार म ें िोजखम और व्यापार प्रथाओं िैसे पहलओंू पर जिचार करत े हुए उपयक्तु स्ट्कीम ें चुनी िाती ह।ैं 2. उत्पाि के जलए सात स्ट्कीमों को मोि े तौर पर नीचे िो श्रेजणयों म ें िगीकृत दकया गया ह,ै िो ब्यूरो द्वारा प्रमाणन के अनुिान हते ु अनुरूपता जनधारव ण म ेंिाजमल तत्िों के आधार पर ह:ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 ि.स.ं प्रिग व प्रासंजगक स्ट्कीम ें 1. साइि पर मल्ू यांकन सजहत स्ट्कीम-I, स्ट्कीम-IV, स्ट्कीम-V, स्ट्कीम-IX और स्ट्कीम- X 2. साइि पर दकसी मूल्यांकन के जबना स्ट्कीम-II और स्ट्कीम-VII”. 13. मुख्य जिजनयमों की अनुसूची-II म,ें— (क) स्ट्कीम-I म,ें— (i) परै ा 8 के स्ट्थान पर जनम्नजलजखत पैरा प्रजतस्ट्थाजपत दकए िाएंगे, अथावत:— “अनज्ञु ापत्र की िैधता 8. (1) मानक मुहर के प्रयोग का अनुज्ञापत्र आरंभ म ेंपााँच िषव तक के जलए अनुित्त दकया िाएगा; (2) अनज्ञु ापत्र का निीकरण पाचाँ िषव तक की और अिजध के जलए दकया िा सकेगा; (3) अपेजित िुल्क का भुगतान अजिम रूप स े िार्षवक आधार पर जनयत तारीख स े पूिव दकया िाएगा और जनयत तारीख स े पूिव उत्पािन जििरण सजहत िार्षवक िुल्क के भुगतान न होने की ििा म,ें जिसके जलए जिजनयम 8 का उपबंध लागू होगा।” (ii) पैरा 11 म,ें उप-परै ा (6) के स्ट्थान पर जनम्नजलजखत उप-परै ा प्रजतस्ट्थाजपत दकया िाएगा, अथावत:— “(6) इक्कीस दिन की सूचना िारी करने के पश्चात ब्यूरो अनज्ञु ापत्र जनलंजबत कर सकेगा और अनज्ञु ाधारी को अपन े उत्पाि पर मानक मुहर का प्रयोग न करन े का जनिेि िे सकेगा, िब आििेक द्वारा अपेजित िल्ु क का भुगतान नहीं दकया िाता ह,ै उन मामलों को छोड़कर िहााँ अनज्ञु ापत्र िार्षवक िुल्क के भुगतान न होने के कारण जनलंजबत दकया िाएगा, जिसके जलए जिजनयम 8 का उपबंध लागू होगा।”; (ख) स्ट्कीम-II के स्ट्थान पर जनम्नजलजखत स्ट्कीम प्रजतस्ट्थाजपत की िाएगी, अथावत:— “स्ट्कीम-II मालों और िस्ट्तुओं के जलए भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपेिाओं या िोनों के अनुरूपता के स्ट्ि - घोषणा पर आधाठरत पंिीकरण के माध्यम स े मानक मुहर के प्रयोग या लगाने हते ु अनुज्ञापत्र अनुित्त करन े की अनुरूपता मूल्यांकन स्ट्कीम (स्ट्कीम िाइप सी पर आधाठरत, यथानुसूची-I) जिस्ट्तार 1. (1) इस स्ट्कीम के अधीन, िो िाइप सी पर आधाठरत ह,ै दकसी जिजनमावण पठरसर म ें जिजनर्मवत और सम्बंजधत भारतीय मानकों या उत्पाि हते ु अजधसूजचत आिश्यक अपेिाओं या िोनों की सभी अपेिाओं के अनरूु प िस्ट्तओंु या आलेखों ( जिन्द्ह े इसके पश्चात ् उत्पाि कहा गया ह ै ) के जलए मानक मुहर के प्रयोग या लगाने हते ु अनुज्ञापत्र, अनुरूपता के स्ट्ि-घोषणा पर आधाठरत पिं ीकरण के माध्यम स ेब्यूरो द्वारा अनुित्त दकया िा सकेगा। *स्ट्पष्टीकरण 1.-* उप-पैरा (1) के प्रयोिनों के जलए जिजनमावण पठरसर म ें ऐस े अन्द्य पठरसर सजम्मजलत हो सकते ह,ै िो आिेिक के स्ट्िाजमत्ि िाले हों या अन्द्यथा, िहा ाँ जिजनमावण दियाकलाप का एक भाग होता ह ै और इसम ें िह पठरसर सजम्मजलत ह ैिहााँ अंजतम जिजनमावण दियाकलाप दकया िाता ह ैऔर िहााँ मानक मुहर का प्रयोग या लगाया िाना ह ै6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] *स्ट्पष्टीकरण 2.-* आिश्यक अपेिाए ं सम्बंजधत भारतीय मानक म ें िी िा सकती ह ै या उत्पाि हते ु या िोनों के जलए अजधसूजचत की िा सकती ह।ैं (2) अनज्ञु ापत्र का अनुिान और उसका संचालन पैरा 3 म ेंजिजनर्िवष्ट प्रदियाओं के अनुसार दकया िाएगा। पठरभाषाएं 2. (1) "तृतीय पि प्रयोगिाला" स े ब्यूरो द्वारा स्ट्थाजपत, अनरु जित या मान्द्यता प्राप्त या सरकारी प्रयोगिालाए,ाँ िैसा भी मामला हो, ब्यूरो द्वारा पैनलबद्ध / सूचीबद्ध या ब्यूरो की कायवकाठरणी सजमजत द्वारा जनर्णवत कोई अन्द्य प्रयोगिाला अजभप्रेत ह ै स्ट्कीम की प्रदियाए ाँ 3. (1) चयन:- (क)- जिजनमावता जनम्नजलजखत की पहचान करेगा — (i) भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपिे ाए ं या िोनों िो उस उत्पाि पर लागू होते ह ै जिसके जलए िह अनुज्ञापत्र प्राप्त करने का आिय रखता ह;ै (ii) जिजनमावण और परीिण िमताए ं और उपलब्धता की पुजष्ट करना; तथा (iii) प्रयोग दकए िाने िाल े मॉडल संख्या और ब्ांड नाम; (ख) जिजनमावता अनुज्ञापत्र के इजछछत जिस्ट्तार और प्रजतचयन दििाजनििे ों स े उत्पाि के परीिण हते ु आिश्यक नमून े की न्द्यूनतम सख्ं या सुजनजश्चत करेगा; (ग) जिजनमावता अनरूु पता की स्ट्ि-घोषणा पर आधाठरत पंिीकरण के माध्यम स े अनुज्ञापत्र के अनुिान हते ु इस स्ट्कीम के साथ संलग्न प्ररूप-I म ेंप्रत्येक उत्पाि के जलए पथृ क रूप स ेआििे न कर सकेगा; (घ) प्रत्येक ब्ांड नाम के जलए पथृ क आिेिन दकया िाएगा, िब तक दक ब्ांड नाम स्ट्िामी एक ही न हो; (ड) जिजनमावता यह सुजनजश्चत करेगा दक उत्पाि का भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपेिाओं या िोनों की सभी अपेिाओं के जिरुद्ध अनरूु पता के जलए परीिण दकया िा चुका ह ै और इस स्ट्कीम के साथ संलग्न प्ररूप-II के अनुसार प्रजतज्ञा प्रस्ट्तुत करेगा तथा तृतीय पि प्रयोगिाला द्वारा िारी पठरिण प्रजतिेिन उस उत्पाि के जलए उपलब्ध प्रजतचयन दििाजनिेिों के अनुसार प्रस्ट्तुत करेगा; (च) जिजनमावता अजधजनयम की धारा 18 की उप-धारा (6) और (7) तथा धारा 31 का अनुपालन सुजनजश्चत करन े के जलए इस स्ट्कीम के साथ संलग्न प्ररूप-III क, ख या ग, लाग ू होन े के अनुसार, िपथपत्र प्रस्ट्तुत करेगा; (छ) जििेिी जिजनमावताओं की ििा म,ें इस स्ट्कीम के साथ संलग्न प्ररूप-IV के अनुसार एक भारतीय प्रजतजनजध नामांदकत दकया िाएगा और नामांदकत भारतीय प्रजतजनजध अजधजनयम की धारा 18 की उप-धारा (6) और (7) तथा धारा 31 का अनुपालन सुजनजश्चत करने के जलए इस स्ट्कीम के साथ संलग्न प्ररूप-III क, ख या ग, लागू होने के अनुसार, िपथपत्र प्रस्ट्ततु करेगा; तथा (झ) अनुज्ञापत्र की ितो एि ंजनयमों की स्ट्िीकृजत। (2) जनधावरण:- ब्यूरो दकसी आिेिन की प्राजप्त पर आिेिन म ें िी गई सूचना की पणू वता की िााँच करेगा और तृतीय पि प्रयोगिाला स े प्राप्त उत्पाि के परीिण पठरणामों की उनकी िुद्धता और भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपेिाओं या िोनों के साथ अनरूु पता के जलए िााँच की िाएगी। (3) समीिा:- आिेिन की समीिा की िाएगी और तृतीय पि प्रयोगिाला स े प्राप्त उत्पाि के परीिण पठरणामों की, उनकी िुद्धता और भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपिे ाओं या िोनों के साथ अनुरूपता के जलए समीिा की िाएगी। (4) जिजनिचय:- अनरुु पता के स्ट्ि-घोषणा पर आधाठरत पंिीकरण के माध्यम स ेअनज्ञु ापत्र अनुित करने पर जिजनश्चय ब्यरू ो द्वारा तब जलया िाएगा िब आिेिक द्वारा प्रस्ट्तुत आिेिन यह इंजगत करता ह ै दक जिजनमावता के पास जनरंतर आधार पर[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 गुणित्ता िाल े उत्पािों के जिजनमावण के जलए आिश्यक अिसंरचना ह ै और परीिण पठरणाम उत्पाि की संबंजधत भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपेिाओं या िोनों के साथ अनुरूपता तथा समीिा के संतोषिनक पठरणाम को इंजगत करत े ह।ैं (5) प्रमाणन:- अनुरूपता के स्ट्ि-घोषणा पर आधाठरत पंिीकरण के माध्यम स े अनज्ञु ापत्र अनिु त करने का जिजनश्चय लेने पर ब्यूरो, अनुज्ञापत्र का जिस्ट्तार, अनज्ञु ापत्र संख्या, जिजनमावता का पता, ब्ांड-नाम, मॉडल संख्या, अनुज्ञापत्र की िैधता, भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपेिाओं या िोनों का जििरण, मानक महु र की प्रजतकृजत ििावने िाला एक िस्ट्तािेि जिजनमावता को इस स्ट्कीम के साथ संलग्न प्ररूप-V म ें िारी करेगा। (6) अनुिीिण:- (क) ब्यरू ो बािार या पारिहन स े नमून े ल े सकेगा और ऐस े नमनू ों को परीिण अनुरोध सजहत परीिण हते ु तृतीया पि प्रयोगिाला को भिे सकेगा। (ख) यदि बािार नमनू ा लने ा दकसी कारणिि संभि नहीं ह,ै तो नमूने प्रषे ण बबंि ु से जलए िा सकते ह ैं और ब्यूरो अजधमानतः सगं ठित केताओं से प्रजतपुजष्ट प्राप्त कर सकेगा। जिकायते 4. (1) ब्यूरो मानक मुहर िाले उत्पाि की गुणिता के संबंध म ेंप्राप्त दकसी भी जिकायत को स्ट्िीकार करेगा और उसकी िााँच करेगा। (2) जिकायत के जनपिान की कायविाही नब्बे दिनों के भीतर परू ी की िाएगी, उत्पाि के परीिण स े संबंजधत परीिण समय को छोड़कर, िहा ाँ उत्पाि का परीिण िाजमल ह।ै िुल्क 5. (1) आिेिन िल्ु क, िार्षवक अनुज्ञापत्र िुल्क और निीकरण आिेिन िुल्क एक हिार रुपय ेप्रजत होगा। (2) िार्षवक आधार पर अजिम रूप स े िये संसाधन िुल्क अनज्ञु ापत्र के अनुिान और अनुज्ञापत्र के संचालन की जनरंतरता के जलए प्रजत आिेिन पच्चीस हिार रुपय ेहोगा। (3) एक स े अजधक परीिण प्रजतिेिन िाले आिेिनों के जलए प्रत्येक अजतठरक्त परीिण प्रजतिेिन के जलए बीस हज़ार रुपय े की िर स ेअजतठरक्त िुल्क जलया िाएगा और िल्ु क का भगु तान अजिम रूप स े दकया िाएगा। (4) आिेिक अनज्ञु ापत्र की िैधता के निीकरण और अनुज्ञापत्र के संचालन की जनरंतरता के समय िार्षवक आधार पर अजिम रूप स ेपच्चीस हिार रुपय े का संसाधन िुल्क अिा करेगा। (5) िब निीकरण के जलए िो िषव स े अजधक की अिजध हते ु आिेिन दकया िाता ह,ै तो प्रत्येक अजतठरक्त िष व के जलए पच्चीस हिार रुपय े का िल्ु क जलया िाएगा और िल्ु क का भुगतान अनज्ञु ापत्र की िैधता अिजध के जलए िार्षवक रूप स े अजिम दकया िाएगा। (6) रािपत्र म ें भारतीय मानक ब्यूरो (अनुरूपता मल्ू यांकन) संिोधन जिजनयम, 2026 के प्रकािन की तारीख स े और 31 मई, 2029 तक, सूक्ष्म उियमों या स्ट्िािव-अप के संबंध म ें संसाधन िल्ु क म ें ठरयायत अस्ट्सी प्रजतित, लघ ु उियमों के संबंध म ें पचास प्रजतित और मध्यम उद्यमों के संबंध म ें बीस प्रजतित होगी, और 1 िून, 2029 की तारीख स े प्रभािी, सूक्ष्म, लघ ु और मध्यम उि य् मों के संबंध म ें संसाधन िल्ु क म ैंठरयायत बीस प्रजतित होगी। *स्ट्पष्टीकरण 1:-* इस उप परै ा के प्रयोिन के जलए, “सूक्ष्म, लघु और मध्यम उ द्यम" पि का िही अथ व होगा िो सूक्ष्म, लघ ु और मध्यम उि य् म जिकास अजधजनयम, 2006 (2006 का 27) म ेंउसे प्रित ह।ै8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] *स्ट्पष्टीकरण 2:-* स्ट्िािव-अप का िही अथ व होगा िो आय-कर अजधजनयम, 1961 (1961 का 43) म ेंउसे प्रित ह।ै (7) नई दकस्ट्मों या मॉडलों के समािेि या अनुिापत्र के जिस्ट्तार के जिस्ट्तार हते ु आिेिन की ििा म,ें प्रजत आिेिन तीस हिार रुपय ेकी राजि ती िाएगी। (8) अनुिीिण या जिकायत िााँच के जलए जलए गए नमूनों की लागत और उनके परीिण िल्ु क का भुगतान आिेिक या अनुज्ञाधारी द्वारा दकया िाएगा, िैसा भी मामला हो। (9) अनज्ञु ापत्र के अनुिान के पश्चात,् नाम, पता, प्रबंधन, भारतीय प्रजतजनजध या ई-मले या संपकव जििरण म ें पठरितवन या अनुज्ञापत्र के जिस्ट्तार म ें मॉडल िापसी, अनज्ञु ापन के जिस्ट्तार म ें मॉडलों के महत्िपूण व घिक का अ द्यतनीकरण िैसी कोई भी सेिा अनुरोध, प्रत्येक अनरु ोध के जलए पााँच हिार रुपय ेके िल्ु क के भुगतान पर दकया िाएगा। अंकन और जचहनांकन अपेिाए ाँ 6. (1) प्रत्येक उत्पाि या पैकेि, या िोनों पर, इस स्ट्कीम के साथ उपाबंध-I के रूप म ें सलं ग्न मानक मुहर के प्रयोग हते ु दििाजनिेिों म ें जिजनर्िवष्ट मानक मुहर या ब्यूरो द्वारा जिजनर्िवष्ट अजतठरक्त अंकन और जचहनांकन अपेिाओं स े अंदकत दकया िाएगा। (2) मानक मुहर के माप इस स्ट्कीम के साथ संलग्न उपाबंध-II म ें जिजनर्िवष्ट होंगे। (3) मानक मुहर की रंग स्ट्कीम इस स्ट्कीम के साथ संलग्न उपाबधं -III के अनुसार होगी। (4) मानक मुहर पर अनुज्ञापत्र संख्या और भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपेिाओं या िोनों का संिभव िश्ृ यमान तरीके स ेअंदकत होगा और यह अनुज्ञापत्र म ें जिजनर्िवष्ट अनुसार होगा। (5) यदि अनुज्ञापत्र संख्या मानक मुहर के नीच े नहीं रखी िा सकती ह,ै तो इस े मानक मुहर के समीप रैजखक तरीके स े उपयुक्त रूप स ेरखा िाएगा। (6) उत्पाि जििरण, भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपिे ाओं या िोनों की अपेिा के अनुसार, जिसम ें दकस्ट्म, मॉडल संख्या, लॉि या बैच संख्या, जिजनमावण की तारीख या सप्ताह, जिजनमावता का परू ा पता सजम्मजलत हो सकता ह,ै उत्पाि या पैकेबिंग पर या उत्पाि स े िुड़ े लेबल म ेंअंदकत दकया िाएगा। (7) जचहनांकन जििरण म ें मानक मुहर िाल े उत्पाि की प्रामाजणकता सत्याजपत करन े के जलए ब्यूरो की िेबसाइि का संिभ व होगा। (8) यदि ब्यरू ो द्वारा अपेजित हो, तो मानक मुहर के अजतठरक्त, अनुज्ञाधारी उत्पाि या पकै ेि पर "अनरूु पता की स्ट्ि- घोषणा" िब्िों के पश्चात ् प्रासंजगक भारतीय मानक संख्या या उत्पाि हते ु अजधसूजचत आिश्यक अपेिाओं या िोनों का संिभ व अंदकत करेगा। (9) दकसी जिजिष्ट उत्पाि के जलए, अजतठरक्त अंकन और जचहनांकन अपेिाए ाँ ब्यूरो द्वारा जिजनर्िवष्ट की िा सकती ह,ै जिनका अनुज्ञाधारी अनपु ालन करेगा। अनुज्ञापत्र की ित े 7. अनुज्ञापत्र की ित ें िैसी ही होंगी िैसी इन जिजनयमों के जिजनयम 6 म ेंउपबंजधत ह।ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 9 अनुज्ञापत्र की िैधता 8. (1) मानक मुहर के प्रयोग का अनुज्ञापत्र आरंभ म ेंपााँच िषव तक के जलए अनुित्त दकया िाएगा। (2) अनज्ञु ापत्र का निीकरण पाचाँ िषव तक की और अिजध के जलए दकया िा सकेगा। (3) अपेजित िुल्क का भगु तान अजिम रूप स े िार्षवक आधार पर जनयत तारीख स े पूिव दकया िाएगा। जनयत तारीख स े पिू व उत्पािन जििरण सजहत िार्षवक िुल्क के भगु तान न होन े की ििा म,ें जिजनयम 8 के अधीन प्रासंजगक उपबंध लाग ू होंगे। अनुज्ञापत्र का निीकरण 9. (1) मानक मुहर के प्रयोग हते ु अनुज्ञापत्र के निीकरण के जलए आिेिन उसकी समाजप्त के तीन माह पूि व ब्यूरो को इस स्ट्कीम के साथ सलं ग्न प्ररुप-VI म ें दकया िाएगा। (2) ब्यूरो इस स्ट्कीम के साथ सलं ग्न प्ररूप-VII म ेंअनुज्ञापत्र का निीकरण करेगा। (3) अनज्ञु ापत्र का निीकरण इन जिजनयमों के जिजनयम 8 के अनुसार दकया िाएगा। अनुिापत्र के जिस्ट्तार म ेंपठरितनव 10. (1) मानक मुहर के प्रयोग हते ु अनुज्ञापत्र के जिस्ट्तार म ें पठरितवन हते ु आिेिन ब्यूरो को इस स्ट्कीम के साथ संलग्न प्ररूप- VIII क, ख, लागू होन े के अनुसार, दकया िाएगा। (2) अनुज्ञापत्र के ित्रे जिस्ट्तार हते ु, आिेिन पर अनज्ञु ाधारी द्वारा प्रस्ट्तुत उत्पाि के पणू व परीिण प्रजतिेिन, िो तृतीय पि प्रयोगिाला द्वारा िारी दकया गया ह,ै के आधार पर जिचार दकया िा सकेगा। (3) ब्यूरो अनुज्ञापत्र के जिस्ट्तार म ें इस स्ट्कीम के साथ संलग्न प्ररूप -IX क, ख, लागू होन े के अनुसार, संिोधन कर सकेगा। जनलंबन 11. (1) अनुज्ञाधारी स्ट्िेछछा स े ब्यूरो को सूजचत करते हुए मानक मुहर का प्रयोग जनलंजबत कर िेगा, यदि दकसी भी समय उत्पाि की भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपिे ाओं या िोनों के साथ अनरूु पता बनाए रखन े म ें कठिनाई होती ह।ै (2) िैसे ही न्द्यूनताए ं िरू हो िाती ह,ै जचहनांकन पनु ः आरंभ दकया िा सकेगा और ऐसे पनु ः आरंभ दकए िाने की सूचना तुरंत लेदकन पुनः आरंभ दकए िाने की तारीख स ेसात दिनों के भीतर, ब्यूरो को भेिी िाएगी। (3) अनुज्ञाधारी स्ट्िेछछा स े जिजनमावण इकाई के नए पत े पर स्ट्थानांतरण के कारण ब्यूरो को सूजचत करत े हुए मानक मुहर का प्रयोग जनलंजबत कर िगे ा। (4) सभी कारविाई पूरी होन े के पश्चात ् ब्यरू ो को अपेजित िल्ु क सजहत सूजचत दकया िाएगा। (5) जनलंबन का जनरसन, ब्यूरो द्वारा प्रस्ट्ततु िस्ट्तािेिों के सत्यापन और अपेजित िल्ु क िमा करने पर दकया िा सकेगा। (6) ब्यरू ो इक्कीस दिन की सूचना िारी करन े के पश्चात ् अनुज्ञापत्र जनलंजबत कर सकेगा और अनज्ञु ाधारी को अपन े उत्पाि पर मानक मुहर का प्रयोग न करन े का जनिेि ि े सकेगा, िब आिेिक द्वारा अपेजित िल्ु क का भगु तान नहीं दकया िाता ह,ै उन मामलों को छोड़कर िहााँ अनुज्ञापत्र िार्षवक िल्ु क के भगु तान न होने के कारण जनलंजबत हो िाएगा, जिसके जलए जिजनयम 8 के अधीन प्रासंजगक उपबंध लागू होंगे।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (7) ब्यूरो उप- पैरा (6) के अधीन िारी जनलंबन िये राजि की प्राजप्त पर जनरस्ट्त कर सकेगा। अनुज्ञापत्र का रद्द ीकरण 12. (1) ब्यूरो इन जिजनयमों के जिजनयम 11 के अनुसार अनुज्ञापत्र रद्द करेगा। (2) यदि दकसी भी समय, ब्यरू ो के पास पयावप्त साक्ष्य ह ै दक मानक मुहर िाला उत्पाि संबंजधत भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपिे ाओं या िोनों के अनुरूप नहीं ह,ै तो ब्यरू ो अनुज्ञाधारी को सूचना िेने के पश्चात ् अनुज्ञापत्र रद्द कर सकेगा, उन मामलों को छोड़कर िहााँ अनुज्ञापत्र जिजनयम 8 के उप-जिजनयम (11) के उपबंधों के अनुसार उत्पािन जििरण सजहत िार्षवक िल्ु क के भुगतान न होन े के कारण रद्द हो िाएगा। (3) अनुज्ञाधारी या उसका प्रजतजनजध रद्द ीकरण की तारीख के पश्चात ् मानक मुहर िाल े उत्पाि की आपूर्त,व आयात और जििय बंि कर िगे ा। उपाबंध-I (स्ट्कीम ॥ के पैरा 6 के उप परै ा (1) का संिभव) मानक मुहर के प्रयोग हते ु दििाजनिेि 'मानक मुहर का जचहन उपाबधं II और III म ें दिए गए जचत्र म ें बताई गई िलै ी म ें बनाए गए सजचत्र जनरुपण स े जमलकर बना ह ैऔर जनम्नजलजखत ितो पर इसका फोिोिादफक लघुकरण और आिधनव अनुमत ह.ै अथावत:- (i) 'मानक मुहर’ को नीच े दिए गए जििरण के अनुसार एकल रंग या बहु-रंग म ें प्रिर्िवत दकया िा सकता ह।ै बहु-रंग म ें प्रयोग दकए िान े िाले मानक महु र के जलए रंग स्ट्कीम नीच े बताए अनुसार प्रयोग की िाएगी; (ii) अनज्ञु ाधारी 'मानक मुहर को इस प्रकार प्रिर्िवत करेगा दक िह िस्ट्तु या पैकेबिंग पर या दकसी जििेष उत्पाि के जलए ब्यूरो द्वारा जिजनर्िवष्ट अनुसार आसानी स े दिखाई ि;े (iii) मानक मुहर सुपाठ्य, अजमि और अजनिाय व होगा और जचहनांकन की स्ट्थाजयत्ि संबंजधत भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपेिाओं या िोनों के उपबंधों के अनुसार होगी, िहााँ भी लाग ू हो; (iv) भारतीय मानक या उत्पाि हते ु अजधसूजचत आिश्यक अपेिाओं या िोनों का संिभव, पिं ीकरण संख्या और िब्िों का प्रििवन एठरयल फॉन्द्ि आकार 6 स े कम नहीं होगा; तथा (v) एकीकृत प्रििनव स्ट्िीन िाला एक उपकरण उत्पाि पर भौजतक प्रस्ट्तुजत के स्ट्थान पर मानक मुहर को इलेक्ट्रॉजनक रूप स े (ई-अंकन) प्रस्ट्तुत कर सकता ह।ै[भाग III—खण् ड 4] भारत का रािपत्र : अनपु ालन करेंग े दक मानक मुहर का फोिोिादफक बड़ा या छोिा रूप भी उपयोग दकया िा सकता ह,ै िब तक दक ब्यूरो द्वारा अन्द्यथा जिजनर्िवष्ट न दकया गया हो। (iii) अजधजनयम के उपबंधों, उसके अंतगवत बनाए गए जनयमों एि ं जिजनयमों तथा समय-समय पर दकए गए संिोधनों का सिैि पालन करेंगे। (iv) उन जितरकों, डीलरों या खुिरा जििेताओं की सूची उपलब्ध कराएंग,े जिन्द्ह ें मानक मुहर यक्तु िस्ट्तओंु या उत्पािों की आपूर्तव की िाती ह।ैं (v) जिन िस्ट्तुओं, लेखों, प्रदियाओं, प्रणाजलयों या सेिाओं के संबंध म ें मानक मुहर प्रयुक्त या लागू की गई ह,ै उस भारतीय मानक अथिा उत्पाि के जलए अजधसूजचत अजनिाय व अपेिाओं या िोनों स े अनरूु पता के जिषय-ित्रे स े बाहर या गैर-अनुरूप माल, सामिी, प्रदियाओं, प्रणाजलयों या सेिाओं के संबंध म ें मानक मुहर का उपयोग नहीं करेंगे। (viii) जिस अनुरूपता मूल्यांकन स्ट्कीम के अंतगवत अनज्ञु जप्त प्रिान दकया गया ह,ै उसके सभी प्रािधानों का, जिसम ें लेबबलगं और मुहरांकन की अपिे ाए ं िाजमल ह,ैं पालन करेंगे। (ix) यह सुजनजश्चत करेंगे दक अनुज्ञजप्त के जनलंबन की अिजध के िौरान अथिा उसकी समाजप्त/जनरस्ट्तीकरण होन े के बाि, दकसी भी िस्ट्त,ु सामिी, प्रदिया, प्रणाली या सेिा और दकसी आपूर्तव, आयात या जबिी के संबंध म ें मानक मुहर का उपयोग नहीं हुआ ह।ै (x) गरै -अनुरूप माल या सामिी की आपूर्तव और जबिी रोकना सुजनजश्चत करेंगे तथा पहल े स े आपूर्त व की गई या जबिी हते ु प्रस्ट्तुत की गई ऐसी गैर-अनरूु प िस्ट्तुए ं जिन पर यह मुहर लगी हो, को बािार या दकसी भी ऐसे स्ट्थान स,े िहा ाँ स े उनके जबिी हते ु प्रस्ट्ततु दकए िाने की संभािना हो, िापस मंगाएंगे अथिा सेिा प्रिान करना प्रजतबंजधत करेंगे। (xi) यह सुजनजश्चत करेंग े दक यदि हम या हमारे प्रजतजनजध द्वारा मानक मुहर या उसके दकसी भी भ्रामक नकल स े यक्तु ऐस े सामान, िस्ट्तुए,ाँ प्रदियाएाँ, प्रणाजलयााँ या सेिाए ाँ बेची गई ह ैं िो संबंजधत मानक के अनरूु प नहीं ह,ैं तो ब्यरू ो हम ें या हमारे प्रजतजनजध को जनम्नजलजखत के जलए जनिेि ि े सकेगा— (क) जिजनर्िवष्ट प्रकार स े मानक मुहर यक्तु सामान, िस्ट्त,ु प्रदिया, प्रणाली या सेिा की मरम्मत, प्रजतस्ट्थापन या पुनःप्रसंस्ट्करण करना; या (ख) ब्यूरो द्वारा जिजहत दकए गए के अनुसार उपभोक्ता को प्रजतकर िने ा; या (ग) ऐस े गरै -अनरूु प सामान, िस्ट्तु, प्रदिया, प्रणाली या सेिा स े हुई िजत के जलए ब्यूरो द्वारा जिजहत रीजत स े उपभोक्ता को मुआिज़ा िने ा। (xii) अपने पठरसर म ें जनरीिण या ऑजडि दकए िाने के संबंध म ें ब्यरू ो को समस्ट्त सहायता प्रिान करेंगे और इस सहायता म ें प्रमाणन अजधकारी द्वारा जचजन्द्हत एि ं सील दकए गए नमूनों को जनर्िवष्ट कायावलय या प्रयोगिाला म ें भेिना तथा जनरीिण, ऑजडि या मूल्यांकन की तारीख स े सात दिनों के भीतर ऐसे नमनू े का प्रेषण सुजनजश्चत करना िाजमल होगा। (xiii) ब्यूरो द्वारा मागाँ े िाने पर उत्पािन तथा मानक मुहर के उपयोग या लागू करने स े सबं ंजधत िानकारी प्रिान करेंगे। (xiv) ब्यूरो तथा/अथिा केन्द्रीय सरकार के सभी जित्तीय बकायों का भुगतान उसके द्वारा जिजनर्िवष्ट रीजत स े करेंगे। (xv) यह सुजनजश्चत करेंग े दक यदि मानक मुहर यक्तु दकसी उत्पाि की गणु ता के संबंध म ेंकोई जिकायत पाई िाती ह,ै तो भजिष्य म ें ऐसी जिकायतों की पुनरािृजत्त रोकने हते ु उपयक्तु सुधारात्मक किम उिाए िाएंगे। (xvi) यह स्ट्िीकार करते ह ैं दक अनुज्ञजप्तधारी को कम स े कम एक माह का नोठिस िेकर ब्यूरो को अनुज्ञजप्त की दकसी भी ितव म ेंसंिोधन करन े का अजधकार होगा। (xvii) अनज्ञु जप्त के जिषय-ित्रे म ें आने िाले दकसी मॉडल के नाम/प्रबंधन, स्ट्थान, संपकव जििरण, अजधकृत प्रजतजनजध या दकसी महत्िपूणव घिक म ें हुए दकसी भी पठरितवन की सूचना ऐसे पठरितवन की तारीख स े इक्कीस दिनों के भीतर बीआईएस को प्रिान करेंगे। (xviii) िब भी हम रजिस्ट्रीकरण स्ट्कीम के संचालन के साथ दकसी अन्द्य ब्ांड नाम/रेडमाकव का उपयोग करन े का प्रस्ट्ताि करें, तो इसकी अजिम सूचना भारतीय मानक ब्यूरो को िेंगे। (xix) यह समझते ह ैं दक पैरा 15(क) म ें िी गई ब्ांड नाम संबंधी िानकारी भारतीय मानक ब्यूरो को केिल सूजचत करने के उद्देश्य स े िी गई ह ै तथा यह दक भारतीय मानक ब्यूरो की दकसी भी ब्ांड नाम या रेडमाकव को अनुमजत िेन े या अनुमोदित करने म ें कोई भूजमका नहीं ह ै तथा यह भी दक इस े दकसी भी प्रकार स े यह नहीं माना िाएगा दक भारतीय मानक ब्यूरो ने उपयक्तुव ब्ांड नामों या रेडमाकों के उपयोग की अनुमजत या स्ट्िीकृजत िी ह;ै और इसका पणू व उत्तरिाजयत्ि मेरी/हमारी होगी। (xx) सुसंगत भारतीय मानक अथिा उत्पाि के जलए अजधसूजचत आिश्यक अपेिाओं या िोनों म ें दकए गए पुनीिलोकन एि ं संिोधनों को, िैसा भी बीआईएस द्वारा जनिेजित दकया िाए, लागू करेंगे।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 17 (xxi) अजधजनयम, जनयमों एि ं जिजनयमों म ें समय-समय पर दकए गए अद्यतनों का पालन करेंगे तथा बीआईएस द्वारा िारी दििाजनिेिों और पठरपत्रों का अनुसरण करेंगे। (xxii) यह सुजनजश्चत करने का िचन िेते ह ैं दक हमारे द्वारा नाजमत प्रजतजनजध बीआईएस या बीआईएस स े संबंजधत दकसी अन्द्य दियाकलाप म ें संलग्न नहीं होगा, िैसे—नमनू ों का परीिण, बीआईएस द्वारा मान्द्यता प्राप्त प्रयोगिालाओं की दियाकलापों म ें संजलप्त होना, बािार जनगरानी करना आदि, या कोई अन्द्य गजतजिजध जिसम ें बीआईएस की इस स्ट्कीम के अधीन जहतों का िकराि िाजमल हो। (xxiii) यदि दकसी भी स्ट्तर पर यह पाया िाता ह ै दक भारतीय प्रजतजनजध उपयुवक्त दियाकलापों म ें स े दकसी म ें या बीआईएस के कायों से संबंजधत दकसी अन्द्य ऐसी दियाकलाप म ें संलग्न ह ै जिसम ें जहतों का िकराि िाजमल ह,ै तो प्रिान दकया गया रजिस्ट्रीकरण रद्द दकए िाने के जलए अधीन होगा। ऐसे भारतीय प्रजतजनजध को बीआईएस स े संबंजधत दकसी भी दियाकलाप को करने के जलए ब्लैकजलस्ट्ि/प्रजतबंजधत कर दिया िाएगा। (ग) घोषणा: म/ैं हम यह भी घोषणा करते ह ैंदक— i) इस घोषणा म ेंिी गई िानकारी मेरी/हमारी सिोत्तम िानकारी और जिश्वास के अनुसार सत्य ह।ै ii) जिन नमूनों के जलए परीिण ठरपोिव संलग्न की गई ह,ैं िह मेरे/हमारे बंि कर दिया िाएगा और बीआईएस को सूजचत दकया िाएगा। 5. अनुज्ञजप्तधारी को अजधजनयम के उपबंधों तथा अधीन बनाए गए तथा समय-समय पर यथासंिोजधत जनयमों और जिजनयमों के उपबंधों का अनपु ालन करना होगा। 6. या जनलंबन या रद्दकरण होन े पर, अनुज्ञजप्तधारी सुसंगत संबंजधत भारतीय मानक या उत्पाि के जलए अजधसूजचत आिश्यक अपिे ाओं या िोनों के जलए अनरूु पता की स्ट्ि-घोषणा को तत्काल बंि करेगा तथा सभी प्रचारात्मक और पैमान े के उद्योगों के जलए प्रजत िषव पचास हिार रुपय े होगा और सूक्ष्म, लघ ु तथा मध्यम उद्यमों के जलए बीस प्रजतित की ठरयायत प्रिान की िाएगी, जिसे िार्षवक आधार पर अजिम रूप म ें संिाय दकया िाएगा।”’;36 जनम्नजलजखत उपपरै ा रखा िाएगा, अथावत:— “ब्यूरो िब अपेजित फीस संरत नहीं की गई ह,ै तब 21 दिन का नोठिस िारी करने के बाि अनुरूपता प्रमाणपत्र जनलंजबत कर सकेगा और इसके धारक को अनुरूपता प्रमाण पत्र का उपयोग रोकन े के जलए जनिेजित कर सकेगा और प्रमाणपत्र धारक द्वारा िोध्यों के संिाय पर जनलंजबत प्रजतसंहृत दकया िा सकता ह,ै जसिाय उन मामलों के िहााँ िार्षवक फीस के असंिाय के कारण अनरूु पता प्रमाणपत्र जनलंजबत माना िाता ह,ै जिसके जलए जिजनयम 16 के उपबंध लाग ू होंगे।” (ङ) स्ट्कीम-IX म,ें — (i) परै ा 8 के, उपपैरा (1) के स्ट्थान पर जनम्नजलजखत उप-पैरा रखा िाएगा, अथावत:— “(1) मानक मुहर का उपयोग करने के जलए अनज्ञु No. BS/XI/11/01/2025-26.—In exercise of the powers conferred by section 39 read with sections 12 and 13 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Bureau, with previous approval of the Central Government, hereby makes the following regulations further to amend the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018, namely:—38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 1. Short title and commencement.— (1) These regulations may be called the Bureau of Indian Standards (Conformity Assessment) Amendment Regulations, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018 (herein after referred to as principal regulations), in regulation 5, after sub-regulation (2), the following sub-regulation shall be inserted, namely:— “(3) The fee shall be paid on an annual basis in advance at the time of grant of licence and for continuation of operation of a valid licence.”. 3. In the principal regulation, in regulation 6, after sub-regulation (14), the following sub-regulation shall be inserted, namely:— “(15) The licensee shall pay annual dues within timelines alongwith the production statement.”. 4. In the principal regulation, in regulation 8, — (a) for the heading, the following heading shall be substituted, namely:— “Continuation of operation of licence and its renewal”; (b) for sub-regulation (2), the following sub-regulation shall be substituted, namely:— “(2) The application under sub-regulation (1) shall be made to the Bureau before the expiry of the validity of licence as specified in the applicable Scheme given in Schedule-II and the fees shall be paid on an annual basis in advance at the time of renewal of licence and for continuation of operation of valid licence after the renewal.”. (c) after sub-regulation (9), the following sub-regulations shall be inserted, namely:— “(10) The fees to be paid on an annual basis for continuation of operation of a valid licence shall be paid in advance before the due date as specified in the applicable scheme. (11) If the annual fee with production statement is not received by the due date, the operation of licence shall stand suspended for a period of ninety days from the due date or as provided in the applicable Scheme: Provided that in case the annual fee with production statement is received within a period of ninety days along with late fee of rupees five thousand, the suspension shall stand revoked: Provided further that the annual fee with production statement if not received within the period of suspension, the licence shall be cancelled. (12) Notwithstanding anything contained in sub-regulations (10) and (11), if the annual fee with production statement has been paid within ninety days of suspension period, the suspension of licence shall not be revoked, if suspension on account of non-conformity of samples or other non- compliances was already imposed before the due date for annual payment of fee or is required to be imposed and in case the discrepancies which led to the continuation of the suspension are removed, suspension may be revoked by the Bureau.”.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 39 5. In the principal regulation, in regulation 10, for sub-regulation (3), the following sub- regulation shall be substituted, namely:— “(3) Before the suspension of licence under sub-regulation (2), a notice of twenty-one days shall be given to the licensee, except for the cases where the licence is suspended due to non-payment of annual fees for which, the provision of regulation 8 shall apply.”. 6. In the principal regulation, in regulation 11, for sub-regulation (1), the following sub- regulation shall be substituted, namely:— “(1) The Bureau may by order in writing cancel the licence after giving a notice of not less than twenty-one days, if- (a) the licensee fails to comply with any of the conditions of licence; (b) the licence has been issued in error, except for the cases where licence is cancelled due to non-payment of annual fees along with production statement for which, the provision of sub-regulation (11) of regulation 8 shall apply.”. 7. In the principal regulation, in regulation 13, after sub-regulation (3), the following sub-regulation shall be inserted, namely:— “(4) The fee shall be paid on an annual basis in advance at the time of grant of certificate of conformity and for its continuation thereafter.”. 8. In the principal regulation, in regulation 14, after sub-regulation(11), following sub-regulation shall be inserted, namely:— “(12) The holder of certificate of conformity shall pay annual dues within timelines alongwith the production statement.”. 9. In the principal regulation, in regulation 16, — (a) for the heading, the following heading shall be substituted, namely:— “Continuation of operation of certificate of conformity and its renewal”; (b) for sub-regulation (2), the following sub-regulation shall be substituted, namely:— “(2) The application under sub-regulation (1) shall be made to the Bureau before the expiry of the validity of certificate of conformity as specified in the applicable Scheme in Schedule-II and the fees shall be paid on an annual basis in advance at the time of renewal of certificate of conformity and for its continuation thereafter.”; (c) after sub-regulation (10), the following sub-regulations shall be inserted, namely:— “(11) The fees to be paid on an annual basis for continuation of operation of a valid certificate of conformity shall be paid in advance before the due date as specified in the applicable scheme. (12) If the annual fee with production statement is not received by the due date, operation of certificate of conformity shall stand suspended for a period of ninety days from the due date or as provided in the applicable Scheme: Provided that if the annual fee with production statement is received within a period of ninety days along with late fee of rupees five thousand, the suspension shall stand revoked:40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Provided further that the annual fee with production statement if not received within the period of suspension, the certificate of conformity shall be cancelled. (13) Notwithstanding anything contained in sub-regulations (11) and (12), if the annual fee with production statement has been paid within the ninety days of suspension period, the suspension of certificate of conformity shall not be revoked, if suspension on account of non-conformity of samples or other non-compliances was already imposed before the due date of annual payment of fee or is required to be imposed and in case the discrepancies which led to the continuation of the suspension are removed, suspension may be revoked by the Bureau.”. 10. In the principal regulation, in regulation 18, for sub-regulation (3), the following sub- regulation shall be substituted, namely:— “(3) Before suspending the certificate of conformity under sub-regulation (2), a notice of twenty-one days shall be given to the holder of certificate of conformity, except for the cases where certificate of conformity is suspended due to non-payment of annual fees for which the provision of sub-regulation (12) of regulation 16 shall apply.”. 11. In the principal regulation, in regulation 19, for sub-regulation (1), the following sub- regulation shall be substituted, namely:— “(1) The Bureau may by order in writing cancel the certificate of conformity after giving a notice of not less than twenty-one days, if- (a) the holder of certificate of conformity fails to comply with any of the conditions of the certificate of conformity; (b) the certificate of conformity has been issued in error, except for the cases where certificate of conformity is cancelled due to non-payment of annual fees alongwith production statement as per provisions of sub-regulation (12) of regulation 16.”. 12. In the principal regulations, in Schedule-II, before Scheme-I, the following paragraphs shall be inserted, namely:— “1. Ten different conformity assessment schemes are provided in this Schedule for product (goods or articles), system, service and process and out of these ten schemes, seven schemes are for conformity assessment of products and remaining three are for system, service and process, depending upon the needs of the stakeholders (including both Industry and Consumers) and regulatory objectives, suitable schemes are opted by the authorities for products notified under the technical regulations or quality control orders considering aspects like risks and trade practices in the national market. 2. The seven schemes for products are broadly classified below into two categories on the basis of elements involved in determination of conformity for grant of certification by the Bureau: Sr. No. Category Relevant Scheme(s) 1. With assessment at site Scheme-I, Scheme-IV, Scheme-V, Scheme- IX and Scheme-X 2. Without any assessment at site Scheme-II and Scheme-VII”. 13. In the principal regulations, in Schedule-II,— (a) in Scheme-I,— (i) for paragraph 8, the following paragraphs shall be substituted, namely:—[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 41 “Validity of Licence 8. (1) The licence to use Standard Mark shall be granted initially upto five years; (2) The licence may be renewed for a further period up to five years; (3) The requisite fee shall be paid in advance on an annual basis before the due date and in case of non-payment of annual fee along with production statement before the due date for which, the provision of regulation 8 shall apply.”. (ii) in paragraph 11, for sub-paragraph (6), the following sub-paragraph shall be substituted, namely:— “(6) The Bureau may suspend the licence after issuing a notice of twenty-one days and direct the licensee not to use Standard Mark on its product when requisite fee is not paid by the applicant, except for the cases where the licence shall be suspended due to non-payment of annual fees for which, the provision of regulation 8 shall apply.”; (b) for Scheme-II, the following scheme shall be substituted, namely:— “Scheme - II Conformity assessment scheme for grant of licence to use or apply Standard Mark through registration based on self-declaration of conformity for goods and articles as per Indian Standard or essential requirements notified for the product or both (based on scheme Type C as per Schedule-I) Scope 1. (1) Under this Scheme which is based on Type C, licence to use or apply a Standard Mark, through registration based on self-declaration of conformity, may be granted by the Bureau for goods or articles (hereinafter referred to as products) manufactured in a manufacturing premises and conforming to all the requirements of the relevant Indian Standards or essential requirements notified for the product or both. Explanation 1.- For the purposes of sub-paragraph (1), manufacturing premise(s) may include such other premises, either owned by the applicant or otherwise, where a part of the manufacturing activity takes place and includes the premises where the final manufacturing activity is carried out and where Standard Mark is to be used or applied. Explanation 2.- Essential requirements may be given in the relevant Indian Standard or notified for the product or both. (2) The grant of licence and its operation shall be done in accordance with the processes specified in paragraph 3. Definitions 2. (1) “third party laboratory” means a laboratory established, maintained or recognised by the Bureau or Government laboratories, as the case may be, empanelled by the Bureau or any other laboratory decided by the Executive Committee of the Bureau. Processes of the Scheme 3. (1) Selection.- (a) The manufacturer shall identify— (i) the Indian Standard or essential requirements notified for the product or both applicable for the product against which it intends to obtain a licence; (ii) the manufacturing and testing capabilities and confirm availability; and42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (iii) the model numbers and brand name to be used; (b) the manufacturer shall ascertain from the intended scope of the licence and sampling guidelines, the minimum number of sample required for testing of the product; (c) the manufacturer may apply for grant of licence through registration based on self-declaration of conformity separately for each product in Form–I annexed to this Scheme; (d) separate application shall be made for each brand name unless the brand name owner is the same; (e) the manufacturer shall ensure that the product has been tested for conformity against all the requirements of the Indian Standard or essential requirements notified for the product or both and submit undertaking as per Form–II annexed to this Scheme and shall submit test report which is issued by third party laboratory as per the sampling guidelines available for that product; (f) the manufacturer shall submit affidavit as per Form–III A, B or C, as applicable, annexed to this Scheme to ensure conformity to sub-sections (6) and (7) of section 18 and section 31 of the Act; (g) in case of foreign manufacturers, an Indian representative to be nominated as per Form–IV annexed to this Scheme and the nominated Indian representative shall submit an affidavit as per Form–III A, B or C, as applicable, annexed to this Scheme to ensure conformity to sub-sections (6) and (7) of section 18 and section 31 of the Act; and (h) acceptance of terms and conditions of the licence. (2) Determination.- The Bureau on receipt of an application shall examine the completeness of the information given in the application and the test results of the product from the third party laboratory shall be examined for their correctness and conformity with the Indian Standard or essential requirements notified for the product or both. (3) Review.- The application shall be reviewed and the test results of the product from the third party laboratory shall be reviewed, for their correctness and conformity with the Indian Standard or essential requirements notified for the product or both. (4) Decision.- The decision on grant of licence through registration based on self-declaration of conformity shall be taken by the Bureau when the application submitted by the applicant indicate that the manufacturer has necessary infrastructure for manufacturing quality products on a continuous basis and the test results indicate conformity of the product to the relevant Indian Standard or essential requirements notified for the product or both and the satisfactory outcome of review. (5) Attestation.- The Bureau on taking decision to grant a licence through registration based on self- declaration of conformity, a document indicating the scope of the licence, licence number, address of the manufacturer, brand-name, model numbers, validity of licence, details of the Indian Standard or essential requirements notified for the product or both, facsimile of the Standard Mark shall be issued to the manufacturer in Form –V annexed to this Scheme. (6) Surveillance.- (a) The Bureau may draw samples from market or in-transit and send such samples for testing to a third party laboratory along with the test request. (b) In case drawal of market sample is not possible due to any reason, samples may be drawn from the despatch point and the Bureau may obtain feedback preferably from organised buyers. Complaints 4. (1) The Bureau shall acknowledge and investigate any complaint received regarding quality of the product bearing Standard Mark.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 43 (2) The actions for closure of complaint shall be completed within ninety days, excluding the testing time, where testing of the product is involved. Fee 5. (1) The application fee, annual licence fee and renewal application fee shall be rupees one thousand each. (2) The processing fee on an yearly basis payable in advance shall be rupees twenty five thousand per application for grant of licence and continuation of operation of licence. (3) Applications with more than one test report shall be additionally charged at the rate of rupees twenty thousand for each additional test report and the fee shall be paid in advance. (4) The applicant shall pay processing fee of rupees twenty five thousand on an yearly basis in advance at the time of renewal of validity of licence and continuation of operation of licence. (5) When renewal is applied for a period of more than two years, a fee of rupees twenty five thousand shall be charged for each additional year and fee shall be paid annually in advance for the validity period of the licence. (6) On and from the date of publication of the Bureau of Indian Standards (Conformity Assessment) Amendment Regulations, 2026 in the Official Gazette and upto the 31st May, 2029, the concession in processing fee shall be eighty per cent. in respect of micro enterprises or start-ups, fifty per cent. in respect of small enterprises and twenty per cent. in respect of medium enterprises, and with effect from the 1st day of June, 2029, the concession in processing fee in respect of micro, small and medium enterprises shall be twenty per cent. Explanation 1.- For the purpose of this sub-paragraph, the expression “micro, small and medium enterprises” shall have the same meaning assigned to it in the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006). Explanation 2.- A start-up shall have the same meaning as assigned to it in the Income-tax Act, 1961 (43 of 1961). (7) In case of application for inclusion of new varieties or models or extension of scope of licence, an amount of rupees thirty thousand shall be charged per application. (8) The cost of the samples and the testing fee of the samples drawn for surveillance or complaint investigation shall be paid by the applicant or the licensee, as the case may be. (9) After grant of licence, any service requests like change in name, address, management, Indian representative or e-mail or contact details or model withdrawal in the scope of the licence, updation of critical component of the models in the scope of the licence shall be made on payment of fee of rupees five thousand for each request.44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Labelling and marking requirements 6. (1) Each product or the package, or both, shall be marked with the Standard Mark as specified in the guidelines to use the Standard Mark annexed with this Scheme as Annexure-I or additional labelling and marking requirements specified by the Bureau. (2) The measurements of the Standard Mark shall be as specified in Annexure-II, annexed to this Scheme. (3) The colour scheme of the Standard Mark shall be in accordance with the Annexure-III, annexed to this Scheme. (4) The Standard Mark shall carry the licence number and reference to the Indian Standard or essential requirements notified for the product or both in a visible manner and shall be as specified in the licence. (5) In case the licence number cannot be placed below the Standard Mark, it shall be suitably placed close to the Standard Mark in a linear manner. (6) The product detail, as per the requirement of the Indian Standard or essential requirements notified for the product or both, which may include variety, model number, lot or batch number, date or week of manufacturing, complete address of manufacturer, shall be marked on either the product or the packaging or contained in a label attached to the product. (7) The marking details shall contain a reference to the website of the Bureau to verify the authenticity of the standard marked product. (8) If required by the Bureau, in addition to the Standard Mark, licensee shall mark either on the product or the package, the words “self-declaration of conformity to” followed by a reference to relevant Indian Standard number or essential requirements notified for the product or both. (9) For any specific product, additional labelling and marking requirements may be specified by the Bureau to which the licensee shall comply. Conditions of licence 7. The conditions of licence shall be as provided in regulation 6 of these regulations. Validity of licence 8. (1) The licence to use Standard Mark shall be granted initially for up to five years. (2) The licence may be renewed for a further period of up to five years. (3) The requisite fee shall be paid in advance on an annual basis before the due date. In case of non- payment of annual fee alongwith production statement before the due date, the relevant provision under regulation 8 shall be applicable. Renewal of licence 9. (1) An application for renewal of licence to use Standard Mark shall be made before three months of its expiration to the Bureau in Form –VI annexed to this Scheme. (2) The Bureau shall renew the licence in Form –VII annexed to this Scheme. (3) The renewal of licence shall be done in accordance with regulation 8 of these regulations.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 45 Change in scope of licence 10. (1) An application for change in scope of licence to use Standard Mark shall be made to the Bureau in Form –VIII A, B, as applicable, annexed to this Scheme. (2) For extension in scope of licence, an application may be considered based on complete test report of the product submitted by the licensee, which is issued by third party laboratory. (3) The Bureau may amend the scope of licence in Form –IX A, B, as applicable, annexed to this Scheme. Suspension 11. (1) The licensee on its own shall suspend the use of the Standard Mark under intimation to the Bureau, if, at any time there is difficulty in maintaining the conformity of the product to the Indian Standard or essential requirements notified for the product or both. (2) The marking may be resumed as soon as the deficiencies are removed and information of such resumption of the marking shall be sent to the Bureau immediately but not later than seven days from the date of resumption. (3) The licensee on its own shall suspend the use of the Standard Mark under intimation to the Bureau due to relocation of manufacturing unit to a new address. (4) After completion of all actions the Bureau shall be informed along with the requisite fee. (5) The revocation of suspension may be done by the Bureau after verification of the documents submitted and on deposit of requisite fee. (6) The Bureau may suspend the licence after issuing a notice of twenty-one days and direct the licensee not to use Standard Mark on its product when requisite fee is not paid by the applicant, except for the cases where licence shall stand suspended due to non-payment of annual fees for which the relevant provisions under regulation 8 shall apply. (7) The Bureau may revoke suspension issued under sub-paragraph (6) on receipt of dues. Cancellation of licence 12. (1) The Bureau shall cancel the licence in accordance with regulation 11 of these regulations. (2) If, at any time, the Bureau has sufficient evidence that the product bearing the Standard Mark is not conforming to the relevant Indian Standard or essential requirements notified for the product or both, the Bureau may cancel the licence after serving notice to the licensee, except for the cases where licence shall stand cancelled due to non-payment of annual fees alongwith production statement as per provisions under sub-regulation (11) of regulation 8. (3) The licensee or his representative shall stop the supply, import and sale of the product with the Standard Mark after the date of cancellation.46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] Annexure-I (Refer sub-paragraph (1) of paragraph 6 of Scheme II) Guidelines for use of Standard Mark The monogram of the ‘Standard Mark’ consists of the pictorial representation, drawn in the style as indicated in the figure in Annexure II and III and its photographic reduction and enlargement is permitted on the following conditions, namely:— (i) the ‘Standard Mark’ can be displayed in single colour or multi-colour as per the details given below. The colour scheme for the Standard Mark to be used in multi-colour shall be used as indicated below; (ii) the licensee shall display the 'Standard Mark' in a manner so as to be easily visible on the article or the packaging or as specified by the Bureau for a particular product; (iii) the Standard Mark shall be legible, indelible and non-removable and the durability of marking shall be as per the provisions of the relevant Indian Standard or essential requirements notified for the product or both, wherever applicable; (iv) the display of reference to Indian Standard or essential requirements notified for the product or both, registration number and words shall not be less than arial font size 6; and (v) a device with an integrated display screen may present the Standard Mark electronically (e- labelling) in lieu of a physical presentation on the product.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 47 Annexure-II (Refer sub-paragraph (2) of paragraph 6 of Scheme II) The IS number and licence number given above are examples only.
