(1) आन जिजनयम का संजिप्त नाम भारतीय मानक ब्यूरो (ऄनुपतपता जनधारव ण) (छिा संिोधन) जिजनयम, 2021 ह।ै (2) ये राजपत्र में ईनके प्रकािन की तारीख को प्रिृत्त ह गे। 2. भारतीय मानक ब्यरू ो (ऄनपतु पता जनधावरण) जिजनयम, 2018 म,ें ऄनुसूची - II म,ें स्ट्कीम VIII के पश्चात, जनम्नजलजखत स्ट्कीम को ऄंतःस्ट्थाजपत दकया जाएगा, ऄथावत:् - "स्ट्कीम – IX यथा जनर्ददष्ट भारतीय मानक के जलए प्रबंध पद्धजत की ऄनपतु पता एिं प्रदिया ऄपिे ाओं की ऄनुपतपता के साथ संयोजजत भारतीय मानक की ऄनपतु पता हते ु सामान एिं िस्ट्तुओं के जलए मानक जचन्द्ह प्रयोग करन े या अिेदन करन े के जलए ऄनुज्ञजप्त मंजूरी हते ु ऄनपतु पता जनधावरण स्ट्कीम 1. जिषयित्रे - (1) आस स्ट्कीम के ऄधीन जो ईत्पाद प्रमाणन और प्रबंधन प्रणाली के सयं ोजन के साथ-साथ प्रदिया अिश्यकताओं पर अधाठरत ह,ै यदद लाग ू हो, तो ब्यरू ो सामान या िस्ट्तु के जलए मानक जचह्न का ईपयोग करने या लाग ू 7117 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] करने के जलए ऄनुज्ञजप्त प्रदान कर सकता ह ै(आसके पश्चात ईत्पाद के पतप म ें संदर्भभत) एक जिजनमावण पठरसर में जनर्भमत ह ै जो ईस ईत्पाद के जलए भारतीय मानक की सभी अिश्यकताओं और प्रासंजगक भारतीय मानक के जलए प्रबंधन प्रणाली की ऄनुपतपता और यथा जनर्ददष्ट प्रदिया अिश्यकताओं के ऄनपतु प ह।ै स्ट्पष्टीकरण: "जिजनमावण पठरसर" स े ऄजभप्रेत ह,ै पठरसर, या तो जिजनमावता के स्ट्िाजमत्ि म ें या ऄन्द्यथा, जहां जिजनमावण गजतजिजध का एक जहस्ट्सा होता ह ै और आसम ें ऐस े पठरसर सजम्मजलत होते ह ैं जहां ऄंजतम जिजनमावण गजतजिजध की जाती ह ै और जहां मानक जचह्न का ईपयोग दकया जाना ह ैया ईसे लगाया जाना ह।ै (2) ऄनज्ञु जप्त प्रदान करना और ईसका संचालन पैरा 3 के ऄधीन प्रदिया जििरण के ऄनुसार दकया जाएगा। 2. पठरभाषाएँ - (1) "जनरीिण और परीिण स्ट्कीम" स े भारतीय मानक के ऄनुपालन के जलए ईत्पाद के ऄंजतम परीिण सजहत ईत्पादन प्रदिया म ें जिजभन्न चरण म ें प्रयोगिाला स्ट्थाजपत करन े और ईसे जनयंजत्रत करने के जलए जिजनमावता द्वारा ऄपनाइ गइ स्ट्कीम ऄजभप्रेत ह ैऔर ऐसी स्ट्कीम जनयंत्रण स्ट्तर और जनरीिण और परीिण की अिृजत्त जनर्ददष्ट करती ह ैजजससे यह सुजनजश्चत हो सके दक ऄंजतम ईत्पाद प्रासंजगक भारतीय मानक के ऄनुपतप ह।ै (2) "तीसरा पि प्रयोगिाला" स े ब्यूरो द्वारा स्ट्थाजपत, ऄनुरजित या मान्द्यता प्राप्त प्रयोगिाला या ब्यरू ो द्वारा पैनल में सजम्मजलत दकसी भी सरकारी प्रयोगिाला या ब्यूरो की कायवकारी सजमजत द्वारा तय की गइ कोइ ऄन्द्य प्रयोगिाला ऄजभप्रेत ह ै। 3. स्ट्कीम की प्रदियाएं- (1) चयन-(क) जिजनमावता जनम्नजलजखत की पहचान करेगा (i) ईत्पाद के जलए लागू भारतीय मानक, और लागू प्रबंधन प्रणाली, यथा ऄपेजित, भारतीय मानक जजसके जलए िह ऄनुज्ञजप्त प्राप्त करना चाहता ह।ै (ii) जिजनमावण पठरसर में ईपलब्ध मिीनरी और एक सूची तैयार करें और यदद जिजनमावण गजतजिजध का कोइ भाग अईटसोसव दकया जाता ह,ै तो ऐसे प्रयोग दकए गए जनयंत्रण का जििरण दिावया जाएगा। (iii) प्रासंजगक भारतीय मानक, संबंजधत जनरीिण और परीिण योजना के ऄनुसार परीिण करन े के जलए अिश्यक परीिण ईपकरण और ईपलब्ध ईपकरण की एक सचू ी तैयार करना; (iv) ईन परीिण के जलए जजन्द्ह ें ईप-ऄनुबंजधत करने की ऄनमु जत ह ै और जिजनमावता के पास ईपलब्ध नहीं ह,ैं िह कारखाने के बाहर परीिण सुजिधा की पहचान करेगा जहां ऐस ेपरीिण दकए जा सकते ह ैंऔर ब्यूरो को आसकी सूचना दगें ;े (ख) जिजनमावता जनरीिण और परीिण योजना प्रस्ट्ततु करेगा जजसका िह ऄपने दैजनक ईत्पादन में लागू करने का प्रस्ट्ताि करता ह ै जजसस े यह सुजनजश्चत हो सके दक ऄंजतम ईत्पाद प्रासंजगक भारतीय मानक के ऄनपतु प है; (ग) जिजनमावता यह सुजनजश्चत करेगा दक भारतीय मानक की सभी ऄपेिाओं के ऄनुपतप ईत्पाद का परीिण दकया गया ह;ै (घ) जहां दकसी भी परीिण की ऄिजध एक महीने से ऄजधक ह ै और जिजनमावता की नयी जिजनमावण आकाइ ह,ै ब्यूरो द्वारा संबंजधत ईत्पाद के जलए छूट की ऄनुमजत दी जा सकती ह;ै (ड) यथा ऄपेजित, जजस ऄनुज्ञजप्त के जलए अिेदन दकया गया है, ईससे संबंजधत भारतीय मानक के ऄनुसार प्रबंधन प्रणाली की ऄनुपतपता के जलए जिजनमावता ईत्तरदायी होगा और ब्यूरो द्वारा ऄपेजित होन े पर ऐसी ऄनुपतपता का साक्ष्य प्रस्ट्तुत करेगा; (च) जिजनमावता ब्यरू ो द्वारा जहां कहीं भी जनर्ददष्ट हो प्रदिया ऄपेिाओं के ऄनपु ालन के जलए ईत्तरदायी होगा; (छ) जिजनमावता आस स्ट्कीम स े जुडे प्रपतप -I के ऄनुसार सभी सुसंगत दस्ट्तािेज के साथ ऄनज्ञु जप्त की मंजूरी के जलए अिेदन कर सकता ह ै और ब्यूरो ऄनुज्ञजप्त प्रदान करन े के जलए जनम्नजलजखत में से दकसी एक प्रदिया या ईसके दकसी भी संयोजन का पालन करेगा, ऄथावत:् - (i) (I) जिजनमावता अिेदन के साथ ईत्पाद की परू ी परीिण ठरपोटव प्रस्ट्ततु करेगा जो दकसी तीसरे पि की प्रयोगिाला से जारी की गइ हो; (II) ब्यरू ो ईत्पादन प्रदिया के मूल्यांकन और प्रबंधन प्रणाली की लेखापरीिा के जलए अिश्यकता के ऄनुसार दौरे की व्यिस्ट्था करेगा, और तीसरे पि की प्रयोगिाला परीिण के जलए एक सत्यापन नमूना ल ेसकता है;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 (III) ब्यूरो, यदद ऄपेजित हो, तो आन-हाईस या बाहर, जनमावता के पास ईपलब्ध प्रयोगिाला सुजिधा में ईत्पाद का परीिण करा सकता ह;ै (IV) सत्यापन नमूने की परीिण ठरपोटव की प्रतीिा दकए जबना ऄनुज्ञजप्त प्रदान की जाएगी, यदद नमूना जलया गया ह ैऔर परीिण ठरपोटव प्राप्त होने पर ऄनुज्ञजप्त की समीिा की जाएगी; (ii) (I) ब्यूरो यथा ऄपेजित ईत्पादन प्रदिया के मल्ू यांकन और प्रबधं न प्रणाली की लेखा परीिा के जलए दौरे की व्यिस्ट्था करेगा, जब कारखान े में ईत्पाद के परीिण आन-हाईस या कारखाना स े बाहर जस्ट्थत जनमावता के पास पणू व परीिण सुजिधाएं ईपलब्ध ह ।; (II) कारखाने में नमून के परीिण के अधार पर ऄनज्ञु जप्त मंजरू की जाएगी; (iii) ब्यूरो ईत्पादन प्रदिया के मूल्यांकन और प्रबंधन प्रणाली की लेखा परीिा के जलए दौरे की व्यिस्ट्था करेगा, और तीसरे पि की प्रयोगिाला में परीिण के जलए नमनू ा लने े की व्यिस्ट्था करेगा और आस नमूने की परीिण ठरपोटव के माध्यम से ऄनुपतपता के प्रदिवन के बाद ऄनज्ञु जप्त प्रदान की जाएगी; (iv) (I) ब्यूरो, यथा ऄपेजित ईत्पादन प्रदिया के मल्ू यांकन और प्रबंधन प्रणाली की लेखा परीिा के जलए दौरे की व्यिस्ट्था करेगा, और कुछ अिश्यकताओं के जलए कारखान े म ें ईत्पाद का परीिण करेगा जजसके जलए जनमावता के पास आन-हाईस या कारखाने के बाहर परीिण सुजिधाएं ईपलब्ध ह ैं और िेष या सभी अिश्यकताओं के जलए तीसरे पि की प्रयोगिाला म ेंपरीिण के जलए नमून ेलेगा; (II) सुसंगत भारतीय मानक के ऄनुपतप जसद्ध होने िाले नमून के परीिण के अधार पर ऄनुज्ञजप्त प्रदान की जाएगी; (ज) जिदेिी जिजनमावताओं के मामले म,ें भारत म ेंजस्ट्थत एक ऄजधकृत भारतीय प्रजतजनजध को नाजमत दकया जाएगा। (2) जनधावरण- (क) ब्यरू ो अिदे न प्राप्त होन े पर, जांच करेगा दक क्या अिेदन के साथ सभी ऄपेजित दस्ट्तािेज जमा दकए गए ह,ैं और यदद अिेदन परू ा हो गया ह,ै तो यह यथा ऄपेजित ईत्पादन प्रदिया के मल्ू यांकन ऄनपतु पता जनमावता के परामि व से ईत्पाद, प्रबंधन प्रणाली और प्रदिया ऄपिे ाओं की लेखा परीिा की व्यिस्ट्था करेगा; (ख) दौरे के दौरान, ब्यरू ो द्वारा जनम्नजलजखत गजतजिजधयां की जाएंगी: (i) जनमावता द्वारा प्रस्ट्तुत दस्ट्तािेज का सत्यापन; (ii) जिजभन्न चरण में प्रयोग दकए गए जनयंत्रण के स्ट्तर के साथ संयंत्र लअे ईट और जनमावण प्रदिया का सत्यापन; (iii) जिजनमावण मिीनरी और परीिण ईपकरण, गुणित्ता जनयंत्रण के प्रभारी व्यजक्त की िमता, भंडारण सुजिधाओं और स्ट्िच्छ पठरजस्ट्थजतय सजहत ईपलब्ध बुजनयादी ढांचे का सत्यापन, यदद लागू हो; (iv) जनमावता द्वारा प्रस्ट्तुत जनरीिण और परीिण स्ट्कीम के ऄनपु ालन का सत्यापन; (v) परीिण ईपकरण ऄंिांकन जस्ट्थजत का सत्यापन; (vi) परीिण कर्भमय की िमता का सत्यापन; (vii) तीसरे पि की प्रयोगिाला से परीिण ठरपोट व के अधार पर या सभी संभाजित परीिण के जलए कारखान े में ईत्पाद के परीिण के सािी के अधार पर प्रासंजगक भारतीय मानक के ऄनुसार ईत्पाद की ऄनुपतपता का सत्यापन; (viii) ईत्पाद का नमूना लने ा और ईसे परीिण के जलए तीसरे पि की प्रयोगिाला म ेंभेजना; (ix) अिश्यकतानुसार प्रासंजगक भारतीय मानक के ऄनुसार, प्रबंधन प्रणाली की लेखा परीिा; (x) यथा जनर्ददष्ट, प्रदिया अिश्यकताओं के ऄनुपालन का सत्यापन; ग) मल्ू यांकन दौरे की ठरपोट व तयै ार की जाएगी और दौरे के दौरान पाइ गइ कोइ भी ऄपयावप्तता के बारे में जनमावता को जलजखत पतप में सूजचत दकया जाएगा और ब्यूरो दस्ट्तािेज की जांच के अधार पर या दकय े गये मल्ू यांकन दौर के अधार पर जिजनमावता से ऐस ेपठरितवन या पठरिधवन कराने की ऄपेिा रख सकता ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (3) समीिा- (क) ईप-पैरा (2) की ऄपेिाओं के साथ आसके ऄनुपालन के जलए मल्ू यांकन दौर की ठरपोटव की समीिा की जाएगी; (ख) ईत्पाद के परीिण पठरणाम की समीिा भारतीय मानक की ईनकी िुद्धता और ऄनुपतपता से की जाएगी; (ग) प्रासंजगक भारतीय मानक के ऄनुसार यथा अिश्यक प्रबंधन प्रणाली की ऄनपतु पता की भी समीिा की जाएगी। (4) जिजनश्चय - जब ब्यूरो संतष्टु हो दक जिजनमावता के पास जनरंतर अधार पर गणु ित्ता िाले ईत्पाद के जिजनमावण के जलए अिश्यक बुजनयादी ढाँचा ह,ै परीिण के पठरणाम जनर्ददष्ट अिश्यकताओं, और प्रबंधन प्रणाली के जलए ईत्पाद की ऄनुपतपता का संकेत देते ह ैं जैसा दक जनर्ददष्ट दकया गया ह,ै प्रासंजगक भारतीय मानक के ऄनपतु प ह ै और प्रदिया ऄनुपालन अिश्यक और जनर्ददष्ट के ऄनुसार ह ैतभी ऄनुज्ञजप्त प्रदान करने का जनणवय जलया जाएगा। (5) ऄनुप्रमाणन- ऄनज्ञु जप्त मंजूर करने का जनणवय लने े पर, ऄनुज्ञजप्त के जिषयिेत्र, ऄनुज्ञजप्त संख्या, जनमावता का पता, ऄनुज्ञजप्त की िैधता, प्रमाणन िल्ु क, भारतीय मानक का जििरण, मानक जचह्न की प्रजतकृजत का संकेत देते ुए जनमावता को आस स्ट्कीम के साथ संलग्न प्रपतप - II के ऄनुसार लाग ू ऄनुप्रमाणन जारी दकया जाएगा: परंत ु जिदेिी जिजनमावताओं के मामले म,ें ऄनुज्ञजप्त और िजतपर्भू त बांड प्रदान करने के जलए करार, एक सौ रुपए के जिजधित् जनष्पाददत, गैर-न्द्याजयक स्ट्टांप पेपर पर जिदेिी जिजनमावता या ईसके ऄजधकृत भारतीय प्रजतजनजध द्वारा जमा दकया जाएगा: परंत ु यह भी दक ऄनुज्ञजप्त के ऄनुदान या निीनीकरण की तारीख को भारत में भारतीय ठरजिव बैंक द्वारा ऄनुमोददत िाखा िाले दकसी भी बैंक द्वारा जारी दकए गए पच्चीस हजार ऄमेरीकी डॉलर के जलए कायवजनष्पादन बैंक गारंटी जिदेिी जिजनमावता द्वारा प्रस्ट्तुत की जाएगी या िैकजल्पक पतप से, जिदेिी जिजनमावता द्वारा पच्चीस हजार ऄमेठरकी डॉलर के जलए समकि भारतीय पतपय में कायवजनष्पादन बैंक गारंटी जमा की जाएगी। (6) जनगरानी - (क) ब्यरू ो जिजनमावण पठरसर में पूिव सूचना देकर या ईसेक जबना जनगरानी दौरा कर सकता ह ै और जनगरानी दौरा करन े की अिश्यकता को ईत्पाद से जुडे जोजखम को ध्यान में रखत े ुए तय दकया जा सकता है; (ख) आस तरह के दौरे के दौरान पाइ गइ दकसी भी जभन्नता को जिजनमावता को सूजचत दकया जाएगा और ब्यरू ो ऐस े दौरे के दौरान परीिण के जलए नमनू े ल ेसकता ह;ै (ग) ब्यरू ो बाजार से नमनू े ल े सकता ह ैऔर परीिण के ऄनरु ोध के साथ ऐसे नमून को परीिण के जलए दकसी तीसरे पि की प्रयोगिाला म ें भेज सकता ह ै और यदद दकसी कारण स े बाजार से नमूना लेना संभि न हो तो नमनू े प्रेषण बबद ु स े जलए जा सकते ह;ैं (घ) ब्यरू ो ऄजधमानतः सगं ठित खरीदार से प्रजतदिया प्राप्त कर सकता ह।ै 4. जिकायत.ें - (1) ब्यूरो ऄनज्ञु जप्त के ऄधीन अन े िाल े ईत्पाद की गणु ित्ता के संबंध म ें प्राप्त दकसी भी जिकायत को स्ट्िीकार करेगा और ईसकी जांच करेगा। (2) जिकायत को बंद करने की कारविाइ नब्ब े ददन के भीतर पूरी की जाएगी, जहां ईत्पाद का परीिण सजम्मजलत है िहा ँ परीिण समय को छोडकर ऐसा दकया जाएगा । (3) यदद जिकायत सही पाइ जाती ह ै तो ब्यरू ो ऄनुज्ञजप्तधारी को अिश्यक सुधारात्मक कारविाइ करन े का जनदिे द े सकता ह।ै 5. िल्ु क.- (1) अिेदन िल्ु क, लेखा परीिा िल्ु क और प्रमाणन िल्ु क ईपाबंध - I में जनर्ददष्टानुसार होगा। (2) ऄनुज्ञजप्तधारी द्वारा आकाइ दर के अधार पर िास्ट्तजिक प्रमाणन िुल्क या न्द्यनू तम प्रमाणन िुल्क, जो भी ऄजधक हो, प्रत्येक िषव देय होगा। ठटप्पण 1: पहल े िष व के जलए िास्ट्तजिक प्रमाणन िुल्क की गणना पहल े नौ महीन के दौरान मुहरांदकत आकाआय म ें मात्रा के साथ आकाइ दर को गुणा करके की जाएगी। ठटप्पण 2: बाद के िषों के जलए िास्ट्तजिक प्रमाणन िल्ु क की गणना पहल े नौ महीन के बाद िषव प्रजत िषव के अधार पर की जाएगी। (3) ऄनज्ञु जप्त रद्द करने के मामले म,ें ब्यूरो द्वारा प्रमाणन िल्ु क िापस नहीं दकया जाएगा:[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5 भारतीय मानक िापस जलए जाने पर परंतु दकसी ऄन्द्य भारतीय मानक द्वारा प्रजतस्ट्थाजपत न दकए जाने पर अनुपाजतक प्रमाणन िुल्क िापस दकया जाएगा। (4) जनगरानी या जिकायत की ऄंजतम जांच प्रयोजन के जलए दकए जाने िाल े दौर के ऄलािा दकसी भी यात्रा लागत का िहन जिजनमावता को करना होगा । (5) ऄनुज्ञजप्त के दायरे के जिस्ट्तार के मामल े म,ें नए ईत्पाद या दकस्ट्म या दकस्ट्म के समूह के जलए ऄनुज्ञजप्त के कायविेत्र म ें प्रत्येक पठरिधवन पर पांच हजार रुपय े की राजि प्रभायव होगी (जहां समूह ददिाजनदेि ईपलब्ध ह ैं या पद्धजत ह)ै और ऑजडट िुल्क जैसा ईपाबंध -I जनर्ददष्ट ह ैईसी प्रकार लाग ूहोगा। (6) अिेदक सत्यापन यात्रा, जनगरानी या जिकायत की जांच, जैसा भी मामला हो, के दौरान जलए गए नमून के ऄलािा ऄन्द्य नमून का परीिण िल्ु क जिजनमावता द्वारा िहन दकया जाएगा। (7) यदद िास्ट्तजिक प्रमाणन िल्ु क न्द्यूनतम प्रमाणन िुल्क से ऄजधक ह ै तो िल्ु क के ऄतं र का भुगतान िार्भषक पतप से दकया जाएगा। (8) ईत्पादन की मात्रा ऄजधक होने पर, ब्यूरो ऐस े ऄनुज्ञजप्तधारी को जतमाही अधार पर िास्ट्तजिक प्रमाणन िुल्क का भुगतान करन े का जनदेि दे सकता ह।ै 6. लबे बलग और महु राकं न ऄपिे ाऐं.- (1) ऄनुज्ञजप्त के ऄधीन प्रत्येक ईत्पाद या पैकेज या दोन को मानक जचन्द्ह के साथ जचन्द्हांदकत दकया जाएगा। (2) दधू और दग्ु ध ईत्पाद के जलए मानक जचन्द्ह का जडजाआन ईपाबंध - II में ददये ऄनुसार होगा और ऄन्द्य मामल म,ें मानक जचन्द्ह का जडजाआन योजना-I में ददय े ऄनुसार होगा, जब तक दक आस ईद्देश्य के जलए ब्यूरो द्वारा कोइ ऄन्द्य मानक जचन्द्ह ऄजधसूजचत न दकया गया हो। (3) मानक जचन्द्ह म ेंऄनुज्ञजप्त सख्ं या और ददखन े िाला मानक का संदभव होगा और ऄनज्ञु जप्त म ेंजनदरष् टानुसार होगा। (4) यदद ऄनुज्ञजप्त संख्या को मानक जचन्द्ह के नीचे नहीं रखा जा सकता है, तो आसे ईपयुक्त पतप से मानक जचन्द्ह के पास रखा जाए। (5) भारतीय मानक की ऄपेिा के ऄनुसार ईत्पाद जििरण, जजसमें जिजिधता, लॉट या बैच संख्या, जनमावण की तारीख या सप्ताह, जिजनमावता का पूरा पता अदद सजम्मजलत हो सकत े ह,ैं आन्द्ह ें ईत्पाद या पैकेबजग पर या तो मुहरांदकत दकया जाएगा या ईत्पाद से जुडे एक लेबल पर जलखना होगा। (6) जचन्द्हांकन जििरण म ें ब्यरू ो की िेबसाआट का संदभ व भी जनजहत होगा जजससे ईपभोक्ता, यदद चाह,ें तो ऄनुज्ञजप्त के ऄधीन सजम्मजलत दकए गए ईत्पाद की प्रामाजणकता सत्याजपत कर सके। (7) यदद मानक जचह्न ईत्पाद या पैकेबजग पर भौजतक पतप से लागू नहीं दकया जा सकता ह,ै तो आसे परीिण प्रमाण-पत्र पर ददया जा सकता ह।ै (8) दकसी जिजिष्ट ईत्पाद के जलए, ब्यूरो द्वारा जनर्ददष्ट ऄजतठरक्त लेबबलग और जचन्द्हांकन ऄपेिाओं का ऄनुपालन दकया जाएगा। 7. ऄनुज्ञजप्त की ित-ें जिजनयम 6 में दी गइ ऄनुज्ञजप्त की ितों का ईल्लेख ऄनुज्ञजप्त में दकया जाएगा और आसके ऄजतठरक्त, जनम्नजलजखत ित ें लागू ह गी, ऄथावत्: - (1) ऄनज्ञु जप्त धारक, - (क) हर समय, ईस पद्धजत का ऄनुपालन करने के जलए ईत्तरदायी होगा जजसके जलए ऄनुज्ञजप्त दी गइ ह;ै (ख) ऄनुज्ञजप्त का ईपयोग ऐसे दकसी भी तरीके से नहीं करेगा जो ब्यूरो के ऄनुसार भ्रामक हो या ब्यूरो द्वारा गैर- ऄनुमत मानक जचन्द्ह का ईपयोग नही कर सकता ह ै या लगा नहीं सकता ह;ै (ग) प्रबंधन या फम व के पत े या ितों म ें पूि व म ें घोजषत दकए गए दकसी भी बदलाि के बारे म ें ब्यरू ो को सूजचत करेगा;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (घ) भारतीय मानक या संिोजधत भारतीय मानक में ुए संिोधन के ईपबंधो को लागू करेगा, जैसा भी मामला हो साथ ही ब्यूरो द्वारा जनर्ददष्ट समय के भीतर ुए संिोधन या सिं ोधन जारी करन े पर भी आन्द्ह ेंलाग ूकरेगा; (ङ) समय-समय पर ब्यरू ो द्वारा जारी दकसी भी जनदेि का पालन करेगा; (2) िधै ता की ऄिजध समाप्त होने पर या ऄनुज्ञजप्त के जनलंबन या रद्द होने पर, ऄनुज्ञजप्त धारक- (क) आसके ईपयोग को तत्क ाल बंद कर द ें और सभी प्रचार और जिज्ञापन सामग्री को िापस ले लें जजसमें आसका कोइ संदभव हो; (ख) ऄनुज्ञजप्त ऄभ्यार्भपत या रद्द होने की जस्ट्थजत में ऄनुज्ञजप्त दस्ट्तािेज ब्यूरो को िापस कर दें; (ग) तीन महीन े से ऄजधक संचालन को बंद करने के बारे म ेंब्यरू ो को जलजखत पतप में सूजचत करेंगा; (3) ऄनुपतपता मल्ू यांकन योजना की ऄपेिाओं के ऄनुसार ब्यूरो द्वारा प्राजधकृत लेखा परीिक द्वारा ऄनुज्ञजप्त के ऄनुदान और संचालन से संबंजधत ऄनपतु पता मूल्यांकन गजतजिजधयाँ की जा सकती ह ैंया देखी जा सकती हैं। 8. ऄनज्ञु जप्त की िधै ता - (1) मानक जचह्न का ईपयोग करन े के जलए ऄनुज्ञजप्त सामान्द्य पतप से तीन िष व की ऄिजध के जलए प्रदान की जाएगी। (2) लागू भारतीय मानक के पनु रीिण या ऄजधिमण के मामले म ेंऄनुज्ञजप्त की ऄिजध को बढाया या घटाया जा सकता ह।ै (3) मानक जचह्न का ईपयोग करने की ऄनज्ञु जप्त अम तौर पर तीन साल की ऄिजध के जलए पुन: प्रमाजणत होती ह ै और अदेि में जनर्ददष्ट तारीख से प्रभािी होती ह।ै (4) पनु : प्रमाणन ऄिजध को पनु : प्रमाणन जनणवय या लाग ू भारतीय मानक के पुनरीिण या जिजनमावता के ऄनरु ोध के अधार पर बढाया या घटाया जा सकता ह।ै (5) ऄनुज्ञजप्त प्रदान करन े और पुन: प्रमाणन िुल्क सजहत सभी िल्ु क का भुगतान ऄनुज्ञजप्त की िैधता ऄिजध के जलए ऄजग्रम पतप से दकया जाएगा। 9. ऄनज्ञु जप्त का पनु प्रमव ाणीकरण-(1) मानक जचह्न का ईपयोग करने के जलए ऄनुज्ञजप्त के पुनप्रवमाणीकरण हते ु ब्यूरो को अिेदन आसकी समाजप्त से पांच माह पूिव करना होगा। (2) ऄनज्ञु जप्त का पनु : प्रमाणीकरण जिजनयम 8 के ऄनुसार दकया जाएगा। (3) मानक जचह्न का ईपयोग करने के जलए ऄनज्ञु जप्त का पनु : प्रमाणीकरण प्रदान दकया जाएगा, - (क) यदद पुन: प्रमाणीकरण का अिेदन पूण व पाया जाता ह;ै (ख) जनर्ददष्ट िुल्क के भगु तान पर; तथा (ग) संबंजधत भारतीय मानक के ऄनुसार ईत्पादन प्रदिया और प्रबंधन पद्धजत के सफल पुनमूवल्यांकन पर, जैसा भी लाग ूहो। 10. ऄनज्ञु जप्त के काय-व ित्रे म ें बदलाि - (1) ऄनुज्ञजप्त के काय-व िेत्र म ें जिस्ट्तार के जलए अिेदन या तो दकसी तीसरे पि की प्रयोगिाला द्वारा जारी ईत्पाद की परू ी परीिण ठरपोट व के साथ या ब्यूरो से नमूना लेन े के ऄनुरोध के साथ दकया जाएगा, जजससे दक आन-हाईस या जिजनमावता के पठरसर के बाहर ईसका परीिण दकया जा सकेगा। (2) जिजनमावता प्रबंधन प्रणाली और प्रदिया ऄपिे ाओं म ेंदकसी भी बदलाि का यथा लागू जििरण भी प्रस्ट्ततु करेगा । (3) ब्यूरो, यदद अिश्यक हो, मूल्यांकन दौरा कर सफल मल्ू याकं न के बाद ऄनुज्ञजप्त का कायव-िेत्र बदल सकता ह।ै (4) यदद जिजनमावण मिीनरी और परीिण ईपकरण सजहत जनरीिण और परीिण योजना या बुजनयादी ढांचे म ें कोइ बदलाि नहीं ह,ै और ऄनुज्ञजप्त के कायव-िेत्र में जिस्ट्तार नमूना ददिा-जनदेि के एक ही समूह में ह,ै तो ऄनुज्ञजप्त के काय-व िेत्र में जिस्ट्तार के जलए परीिण ठरपोटव की अिश्यकता नही होगी। 11. जनलबं न - (1) ऄनुज्ञजप्तधारी ऄपने प्रमाणपत्र के प्रयोग को ब्यूरो को सूजचत करते ुए स्ट्ितः जनलंजबत करेगा, यदद दकसी भी समय, ऄनुपतपता प्रमाणपत्र के ऄतं गतव अने िाल े ईत्पाद की जिजनर्ददष्ट ऄपेिाओं तक ईत्पाद की ऄनपतु पता के ऄनुरिण में कठिनाइ होती ह ै या कोइ भी परीिण ईपकरण खराब हो जाता ह ै या प्राकृजतक अपदाओं जैसे दक बाढ, अग, भूकंप[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 7 आत् यादद के कारण, या प्रबंधन द्वारा घोजषत तालाबंदी, या एक सिम ऄदालत या कानूनी प्राजधकारी के जनदेिन के कारण प्रचालन बंद दकया जाता ह।ै (2) कजमयां दरू दकए जान े और ऐसे आसकी सूचना तत्क ाल लेदकन ऐस े जनलंबन के सात ददन से पूिव ब् यरू ो को ददए जान े पर पर िीघ्र से िीघ्र जनलंबन िापस दकया जा सकता ह।ै (3) ऄनज्ञु जप्तधारी मानक मुहर का प्रयोग स्ट्ितः जनलंजबत करेगा ऄथिा जिजनमावण आकाइ नए पठरसर में स्ट्थानांतठरत दकए जाने पर ब् यरू ो को सूजचत करेगा। (4) ब्यूरो परु ाने पठरसर का सत्यापन और नए पठरसर में ईत्पादन प्रदिया, प्रबधं पद्धजत और ऄनुपालन प्रदिया का मल्ू यांकन करने के पश्चात ्जनलंबन िापस ले सकता ह।ै (5) (क) दकसी भी समय पयावप् त साक्ष्य होने पर दक मानक मुहर लगा ईत् पाद संबद्ध भारतीय मानक के ऄनुपतप नहीं है, ब् यरू ो एक या ईससे ऄजधक ईत् पाद पर मानक मुहर के प्रयोग को जनलंजबत कर सकता ह ै और आसका ईपयोग रोकने के जलए धारक को जनदेजित कर सकता ह,ै और साक्ष्य में जनम्नजलजखत एक या ऄजधक सजम्मजलत हो सकते ह,ैं ऄथावत: (i) संबद्ध भारतीय मानक, यथा लाग,ू के ऄनुसार ईत्पाद की गरै -ऄनुपतपता दिानव े िाली जनरंतर परीिण ठरपोट;व (ii) परीिण कार्भमक की ऄनुपलब्धता जबदक मानक जचन्द्ह का ईपयोग दकया जा रहा ह;ै (iii) गरै ऄनपतु पता ईत्पाद पर मानक जचन्द्ह का ईपयोग या मानक जचन्द्ह का ईपयोग ऄन्द्य तरीके से करना जो ब् यूरो द्वारा ऄनुमत न हो; (iv) जनर्ददष् ट जनरीिण और परीिण स्ट्कीम के कायावन्द्ियन म ें प्रमुख ऄंतर पाए जाने पर; (v) संबद्ध भारतीय मानक के ऄनुपतप प्रबंध पद्धजत की ऄपेिाओं के ऄनुपालन म ेंप्रमुख ऄंतर पाए जाने पर; (vi) जनर्ददष्ट प्रदिया ऄपेिाओं के ऄनुपालन में प्रमुख ऄतं र पाए जाने पर; (vii) ब्यरू ो के पूि-व मूल्यांकन के जबना जिजनमावण प्रदिया में बडे संिोधन; (viii) जबना सूचना ददए जिजनमावण आकाइ को नए पते पर स्ट्थानांतठरत करना; (ix) जबना सूचना ददए जिजनमावण आकाइ का छ: माह स ेऄजधक ऄिजध के जलए बंद होना; (x) ब्यूरो द्वारा जनधावठरत समय सीमा के भीतर सुधारात्मक कारविाइ न दकया जाना; (xi) ऄनुज्ञजप्त के संबंध में झूिी घोषणा करना या ऄजभलेख के जमथ्याकरण म ें या ऄनुजचत व्यापार रीजतय म ें जलप्त होना; (xii) ब्यरू ो द्वारा समय-समय पर जारी ऄनुदिे का ऄनुपालन न दकया जाना; (ख) िे ऄनज्ञु जप्तधारी जजनकी ऄनुज्ञजप्त सभी या जिजिष्ट ईत्पाद के जलए जनलंबनाधीन ह,ैरोक दें- (i) ऐसे ईत्पाद पर मानक जचन्द्ह का ईपयोग करना या लगाना; (ii) मानक जचन्द्ह लग ेऐसे ईत्पाद का प्रेषण। (ग) सुधारात्माक कायविाही की पुजष्ट करने के बाद यह सूचना ब्यूरो को तुरंत भेजी जाएगी और ब्यरू ो सुधारात्मक कायविाही के सत्यापन के जलए फैक्टरी के दौरे की व्यिस्ट्था कर सकता ह ै (घ) ब्यूरो द्वारा जनलंबन िापस लने े की कायविाही तभी की जाएगी जब ऄनुज्ञजप्तधारी नेः (i) अिश्यक सुधारात्मक कायविाही की हो; या (ii) संबद्ध भारतीय मानक से ईत्पाद की ऄनपतु पता के पयावप्त प्रमाण, संबद्ध मानक की प्रबधं पद्धजत और जनर्ददष् ट प्रदिया की ऄपेिाओं के ऄनुपालन के पयावप्त प्रमाण ईपलब्ध कराएं हो। (6) अिेदक द्वारा ऄपेजित फीस ि ऄन्द्य राजि का भुगतान न दकए जान े पर ब्यूरो आक्क ीस ददन का नोठटस जारी करके ऄनुजजप्त जनलजम्बत कर सकता ह ै और ऄनुज्ञजप्तधारी को ईत्पाद पर मानक जचन्द्ह का ईपयोग न करने के जनदेि द े सकता ह ै और आस तरह की बकाया राजि प्राप्त होने पर जनलंबन रद्द दकया जा सकता ह।ै 12 ऄनुज्ञजप्त रद्द करना- ब्यूरो आन जिजनयम के जिजनयम 11 के ऄनुसार ऄनुजजप्त को रद्द करेगा।8 THE GAZETTE OF No. BS/11/11/2021.—In exercise of the powers conferred by section 39 read with sections 12 and 13 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Bureau, with prior approval of the Central Government, hereby makes the following regulations further to amend the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018, namely:- 1. (1) These regulations may be called the Bureau of Indian Standards (Conformity Assessment) (Sixth Amendment) Regulations, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018, in Schedule – II, after Scheme VIII, the following scheme shall be inserted, namely:- ―Scheme - IX Conformity Assessment Scheme for Grant of licence to use or apply Standard Mark for goods and articles conforming to Indian Standard combined with conformity of management system to Indian Standard and conformity of process requirements, as specified – 1. Scope.- (1) Under this scheme which is based on combination of product certification and management system along with process requirements, if applicable, the Bureau may grant licence to use or apply Standard Mark for goods or article (hereinafter referred to as product) manufactured in a manufacturing premises which conform to all requirements of Indian Standards for that product and demonstrates conformity of management system to the relevant Indian Standards and conformity to process requirements, as specified. Explanation: ―Manufacturing premises‖ means premises, either owned by the manufacturer or otherwise, where a part of the manufacturing activity takes place and includes such premises where the final manufacturing activity is carried out and where Standard Mark is to be used or applied. (2) The grant of licence and its operation shall be done in accordance with the processes described under para 3. 2. Definitions.- (1) ―Inspection and Testing Plan‖ means a plan adopted by the manufacturer for establishing laboratory and exercising control at different stages in the production process including final testing of product for compliance to Indian Standard and such plan specifies the level of control and the[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 17 frequency of inspection and testing so as to ensure that the final product conforms to the relevant Indian Standard. (2) ―Third Party Laboratory‖ means a laboratory established, maintained or recognized by the Bureau or any of the Government laboratories empaneled by the Bureau or any other laboratory decided by the Executive Committee of the Bureau. 3. Processes of the scheme.- (1) Selection.- (a) The manufacturer shall identify- (i) the applicable Indian Standard for the product, and the applicable management system, as required, Indian Standard against which it intends to obtain a licence. (ii) the machinery available in manufacturing premises and prepare a list and if any part of the manufacturing activity is outsourced, details of controls exercised shall be indicated. (iii) the test equipment required to carry out testing in accordance with the relevant Indian Standard, relevant inspection and testing plan and prepare a list of the available equipment; (iv) for the tests which are permitted to be sub-contracted and not available with the manufacturer, he shall identify test facility outside the factory where such tests can be carried out and inform the same to the Bureau; (b) the manufacturer shall submit inspection and testing plan which it proposes to implement in its day to day production so as to ensure that the final product conforms to the relevant Indian Standard; (c) the manufacturer shall ensure that the product has been tested for conformity with all requirements of the Indian Standard; (d) in cases where duration of any test is more than one month and the manufacturer is a new manufacturing unit, the relaxation may be permitted by the Bureau for concerned product; (e) the manufacturer shall be responsible for the conformity of the Management System, as required, to the relevant Indian Standard for which the licence is applied for and shall furnish evidence of such conformity when so required by the Bureau; (f) the manufacturer shall be responsible for compliance to process requirements, wherever and as specified by the Bureau; (g) the manufacturer may apply for grant of licence with all relevant documents as per Form - I annexed to this Scheme and the Bureau shall follow any one of the following procedure or any combination thereof, for grant of licence, namely:- (i) (I) the manufacturer shall submit complete test report of the product which is issued from a third party laboratory along with the application; (II) the Bureau shall arrange visit for assessment of production process and audit of the management system, as required, and may draw a verification sample for third party laboratory testing; (III) the Bureau may carry out testing of the product in the laboratory facility available with the manufacturer, either in-house or outside, if required; (IV) the licence shall be granted without waiting for the test report of the verification sample, if drawn and review of the licence shall be made on receipt of the test report; (ii) (I) the Bureau shall arrange visit for assessment of production process and audit of the management system, as required, and testing of the product in the factory when complete testing facilities are available with the manufacturer, situated in-house or outside the factory; (II) the licence shall be granted based on the testing of the samples in the factory; (iii) the Bureau shall arrange visit for assessment of production process and audit of the management system, as required, and drawing of sample for testing in a third party laboratory and the licence shall be granted after demonstration of conformity through the test report of this sample;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (iv) (I) the Bureau shall arrange visit for assessment of production process and audit of the management system, as required, and testing of the product in the factory for some of the requirements for which testing facilities are available with the manufacturer either in-house or outside the factory and draw samples for testing in a third party laboratory for the remaining or all requirements; (II) the licence shall be granted based on the testing of the samples demonstrating conformity to relevant Indian Standard; (h) in case of foreign manufacturers, an authorized Indian representative based in India shall be nominated. (2) Determination.- (a) The Bureau shall, on receipt of the application, examine if all required documents have been submitted in the application, and if the application is complete, it shall arrange audit for assessment of production process, conformity of product, management system and process requirements, as required, in consultation with the manufacturer; (b) during the visit, the following activities shall be carried out by the Bureau: (i) verification of documents submitted by the manufacturer; (ii) verification of the plant layout and manufacturing process with levels of control exercised at various stages; (iii) verification of available infrastructure including manufacturing machinery and test equipment, competence of person in-charge of quality control, storage facilities and hygienic conditions, if applicable; (iv) verification of compliance to the inspection and testing plan submitted by the manufacturer; (v) verification of test equipment calibration status; (vi) verification of competence of testing personnel; (vii) verification of conformity of product to relevant Indian Standard based on test report from third party laboratory or witnessing the testing of product in the factory for all possible tests; (viii) drawing of sample of product and sending it to third party laboratory for testing; (ix) audit of the management system, as required, as per the relevant Indian Standard; (x) verification of compliance of process requirements, as specified; (c) the report of the evaluation visit shall be prepared and any inadequacy observed during the visit shall be communicated in writing to the manufacturer and the Bureau may require the manufacturer to carry out such alterations or additions on the basis of scrutiny of documents or on the basis of evaluation visits carried out. (3) Review.- (a) The report of the evaluation visit shall be reviewed for its compliance with the requirement of sub-paragraph (2); (b) the test result of the product shall be reviewed for their correctness and conformance to the Indian Standard; (c) the conformity of the management system, as required, to relevant Indian Standard and compliance to specified process requirements shall also be reviewed. (4) Decision.- The decision on grant of licence shall be taken when the Bureau is satisfied that the manufacturer has necessary infrastructure for manufacturing quality product on a continuous basis, the test results indicate conformity of the product to the specified requirements, management system, as specified, is in conformity with the relevant Indian Standard and the process compliance is as required and as specified. (5) Attestation.- On taking decision to grant a licence, attestation indicating the scope of the licence, licence number, address of the manufacturer, validity of licence, certification fee, details of the Indian Standard, facsimile of the Standard Mark, as applicable shall be issued to the manufacturer as per Form - II annexed to this Scheme: Provided that in case of foreign manufacturers, agreement for grant of licence and indemnity bond, duly executed on a non-judicial stamp paper of rupees one hundred, shall be submitted by the foreign manufacturer or his authorized Indian representative:[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 19 Provided further that a performance bank guarantee for US Dollars twenty-five thousand issued by any bank having Reserve Bank of India approved branch in India shall be submitted by the foreign manufacturer or alternatively, performance bank guarantee shall be submitted by the foreign manufacturer in equivalent Indian rupees for US Dollars twenty-five thousand as on the date of grant or renewal of licence. (6) Surveillance.- (a) The Bureau may carry out surveillance visit at manufacturing premises either with or without prior intimation and the need for carrying out the surveillance visit may be decided keeping in view the risk associated with the product; (b) any variation observed during such visit shall be communicated to the manufacturer and the Bureau may draw samples during such visit for testing; (c) the Bureau may draw samples from market and send such samples for testing to a third party laboratory along with the test request and in case drawing of market sample is not possible due to any reason, samples may be drawn from the despatch point; (d) the Bureau may obtain feedback preferably from organized buyers. 4. Complaints.- (1) The Bureau shall acknowledge and investigate any complaint received regarding quality of the product covered under licence. (2) The actions for closure of complaint shall be completed within ninety days, excluding the testing time, where testing of the product is involved. (3) If complaint is established, the Bureau may direct the licensee to take necessary corrective actions. 5. Fee.- (1) The application fee, audit fee and certification fee shall be as specified in Annexure-I. (2) The actual certification fee on unit rate basis or minimum certification fee, whichever is higher, shall be payable by the licensee every year. Note 1 : The actual certification fee for the first year shall be calculated by multiplying the unit rate with the quantity in units marked during the first nine months. Note 2 : The actual certification fee for subsequent years shall be calculated on year-to-year basis after the first nine months. (3) In case of cancellation of a licence, certification fee shall not be refunded by the Bureau: Provided that when an Indian Standard is withdrawn, but not superseded by any other Indian Standard, proportionate certification fee shall be refunded. (4) For any visit other than visit for surveillance or complaint end investigation purposes, cost shall be borne by the manufacturer. (5) In case of extension of scope of licence, an amount of rupees five thousand shall be chargeable per addition in scope of licence for new product or variety or group of varieties, where grouping guidelines are available, or system and the audit fee charges as specified in Annexure - I shall also be applicable. (6) The testing fee of samples, other than those which may be drawn during the applicant verification visit, surveillance or complaint investigation, as the case may be, shall be borne by the manufacturer. (7) If actual certification fee is more than minimum certification fee, the difference of the fee shall be paid annually. (8) Where volume of production is high, the Bureau may direct such licensees to pay actual certification fee on a quarterly basis. 6. Labelling and Marking requirements.- (1) Each product or the package or both under a licence shall be marked with the Standard Mark. (2) The design of Standard Mark for milk and milk products shall be as given in Annexure – II and in other cases, the design of Standard Mark shall be as given in Scheme-I, unless any other Standard Mark has been notified by the Bureau for this purpose. (3) The Standard Mark shall carry the licence number and reference to the Standard in a visible manner and shall be as specified in the licence. (4) In case the licence number cannot be placed beneath the Standard Mark, it shall be suitably placed close to the Standard Mark.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (5) Product details, as per the requirement of the Indian Standard, which may include variety, lot or batch number, date or week of manufacturing, complete address of manufacturer, etc., shall be marked on either the product or the packaging or contained in a label attached to the product. (6) The marking details shall also contain reference to the website of the Bureau so that consumer may, if wishes, verify the authenticity of the product covered under the licence. (7) If the Standard Mark cannot be applied on the product or the packaging physically, it can be given on the test certificate. (8) For any specific product, additional labelling and marking requirements as specified by the Bureau shall be complied with. 7. Conditions of Licence.- The conditions of licence, as given in regulation 6, shall be mentioned in the licence and in addition, the following conditions shall be applicable, namely:- (1) The holder of licence shall, - (a) at all times, remain responsible for conformance of the system in respect of which licence has been granted; (b) not use the licence in any manner which in the opinion of the Bureau may be misleading or use or apply the Standard Mark in any manner not permitted by the Bureau; (c) inform the Bureau of any changes in management or address of the firm or conditions which were declared earlier; (d) implement the provisions of amendment to Indian Standard or revised Indian Standard, as the case may be, upon issue of amendment or revision within the stipulated time as specified by the Bureau; (e) comply with any directions issued by the Bureau from time to time; (2) Upon expiry of the period of validity or upon suspension or cancellation of the licence, the holder of the licence shall - (a) discontinue its use forthwith and withdraw all promotional and advertising material which contains any reference thereto; (b) return the licence document to the Bureau in the event of licence being surrendered or cancelled; (c) inform the Bureau in writing of discontinuation of operations exceeding three months; (3) The conformity assessment activities relating to grant and operation of licence may be carried out or witnessed by the auditors authorized by the Bureau as per the requirements of conformity assessment scheme. 8. Validity of Licence.- (1) The licence to use Standard Mark shall normally be granted for a period of three years. (2) The period of licence may be extended or reduced in case of revision or superseding of applicable Indian Standard. (3) The licence to use Standard Mark is normally re-certified for a period of three years and shall be effective from the date specified in the order. (4) The re-certification period may be extended or reduced depending on the re-certification decision or revision of the applicable Indian Standard or on request of the manufacturer. (5) All the fee, including grant of licence and re-certification fee, shall be paid in advance for the validity period of the licence. 9. Re-certification of Licence.- (1) An application for re-certification of licence to use Standard Mark shall be made before five months of its expiration to the Bureau. (2) The re-certification of licence shall be done in accordance with regulation 8. (3) The re-certification of the licence to use the Standard Mark shall be granted, - (a) if the re-certification application is found to be complete; (b) on payment of fee as specified; and (c) on successful re-evaluation of the production process and the management system as per the relevant Indian Standard, as applicable.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 21 10. Change in scope of licence.- (1) For extension in scope of licence, application shall be made either along with a complete test report of the product issued by a third party laboratory or along with a request to Bureau to draw the sample for testing either in-house or outside the manufacturer premises. (2) The manufacturer shall also submit the details of any changes in the management system and process requirements, as applicable. (3) The Bureau may change the scope of licence after successful evaluation through evaluation visit, if required. (4) If there are no changes in inspection and testing plan or infrastructure including manufacturing machinery and test equipment and extension in scope of licence is in the same group of sampling guidelines, the test report may not be required for extension in scope of licence. 11. Suspension.- (1) The licensee on its own shall suspend the use of the Standard Mark or under intimation to the Bureau if, at any time, there is difficulty in maintaining either the conformity of the product to specified requirements or the conformity of the management system to the relevant Indian Standard or compliance to specified process requirements, or any test equipment goes out of order or due to natural calamities such as flood, fire, earthquake, etc., or a lock out declared by the management, or, closure of operations directed by a competent court or statutory authority. (2) The revocation of suspension may be done as soon as the deficiencies are removed and information shall be sent to the Bureau immediately but not later than seven days of such revocation. (3) The licensee on its own shall suspend the use of the Standard Mark or under intimation to the Bureau on relocation of manufacturing unit to a new premises. (4) The revocation of suspension may be done by the Bureau after verification of the old premises and evaluation of production process, management system and process compliance at new premises. (5) (a) The Bureau may suspend the licence for use of Standard Mark on one or more product and direct the licensee not to use Standard Mark on such product if, at any time, it has sufficient evidence that the product bearing the Standard Mark may not be conforming to the relevant Indian Standard and such evidence may include, but not limited to, one or more of the following, namely:- (i) consecutive test reports indicating non-conformity of the product to the relevant Indian Standard, as applicable; (ii) non-availability of testing personnel even as Standard Mark is being used; (iii) use of Standard Mark on the non-conforming product or using Standard Mark in a manner not permitted by the Bureau; (iv) major deviation observed in the implementation of inspection and testing plan; (v) major deviation observed in the compliance to management system requirements as per relevant Indian Standard; (vi) major deviation observed in the compliance to specified process requirements; (vii) major modification in the manufacturing process without prior evaluation of the Bureau; (viii) relocation of manufacturing unit to a new address without intimation; (ix) prolonged closure of manufacturing unit for more than six months without intimation; (x) corrective actions are not taken within the time frame specified by the Bureau; (xi) false declaration in relation to the licence or indulged in falsification of records or unfair trade practices; (xii) non-compliance of any instruction issued by the Bureau from time to time. (b) The licensee, whose licence has been put under suspension for all or specific product, shall stop – (i) using or applying Standard Mark on such product; (ii) the dispatches of such product bearing the Standard Mark.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (c) A confirmation in this regard shall be sent to the Bureau immediately followed by confirmation of having taken corrective actions and the Bureau may then arrange visit to the factory to verify the corrective actions. (d) The revocation of suspension may be done by the Bureau if the licensee, – (i) has taken necessary corrective actions; or (ii) has provided sufficient evidence of conformity of the product, management system to the relevant Indian Standard and compliance to specified process requirements. (6) The Bureau may suspend the licence after issuing a notice of twenty-one days and direct the licensee not to use Standard Mark on its product when necessary fee and other charges are not paid and such suspension may be revoked on receipt of the dues. 12. Cancellation of Licence.- The Bureau shall cancel the licence in accordance with the provisions of regulation 11. Annexure – I (refer sub-paragraph (1) of paragraph 5 of this Scheme) Fee Structure 1. Audit Fee: (for initial audit, re-certification and special audit) (a) For units located within India: (i) Large Industrial Enterprises- ₹. 12,000/- per manday (ii) Micro, Small and Medium Industrial Enterprises- ₹. 9,000/- per manday Travel limited to a distance of 250 km from the location of the unit and stay of auditors on actual basis shall be borne by the manufacturer. Relaxation in audit fee: If the Actual Travel Cost incurred during an audit is less, the regional Deputy Director Generals may grant relaxation upto ₹ 4,000/- per manday spent in travelling for Large Industrial Enterprises and ₹ 3,000/- per manday spent in travelling for Micro, Small and Medium Enterprises. (b) For units located outside India: (i) ₹ 12,000/-per manday shall be chargeable. (ii) The manufacturer shall bear all expenses on actual basis, including but not limited to cost to the Bureau for the man-days spent by auditor(s) in connection with the audit, resultant travel etc. 3. Certification fee The yearly certification fee shall be as specified in Table-A of this Annexure.
