फा. स.ं बीएस/11/11/2021.—ब्यूरो, भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) की धारा 12
और 13 के साथ पठित धारा 39 द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, केन्द्रीय सरकार के पूिाानुमोिन से भारतीय
मानक ब्यूरो (अनुरूपता जनधाारण) जिजनयम, 2018 में और संिोधन करते हुए जनम्नजलजखत जिजनयम बनाता ह,ै अथाात्:
1. (1) इन जिजनयमों का संजिप्त नाम भारतीय मानक ब्यरू ो (अनरूु पता जनधाारण) िसू रा संिोधन जिजनयम, 2021 ह।ै
(2) ये रािपत्र म ेंइनके प्रकािन की तारीख से प्रिृत्त होंगे।
2. भारतीय मानक ब्यरू ो (अनरूु पता जनधाारण) जिजनयम, 2018 में, (जिसे इसमें इसके पश्चात् ‘उक्त जिजनयम’ कहा
िाएगा), जिजनयम 8 के, उप-जिजनयम (4) म,ें “जिजधमान्द्यता की तारीख” िब्ि के बाि “या अनुसूची- II म ें जिजनर्िष्टा लाग ू
स्ट् कीम में यथा-उपबंजधत” िब्ि िोडा िायेगा।

3. उक्त जिजनयम में, अनुसूची-II के, स्ट् कीम -I म,ें पैरा 9 म,ें उप-पैरा 5 के बाि, जनम्नजलजखत उप-पैरा िोडा िाएगा,
अथाात:् -
“(6) यदि एक जिजनमााता लाइसेंस-धारक का लाइसेंस निीकरण हते ु जनयत ह,ै और िह मानक मुहरांदकत उत् पािों की
मांग में कमी से उत् पन्द् न जित् तीय समस्ट्य ाओ क के कारण लाइससें के प्रचालन में सिम न होने के कारण लाइसेंस के
निीकरण की जतजथ से कम से कम एक माह पूिा लाइसेंस के आस्ट् थगन, िो दक एक िर्ा से अजधक अिजध का न हो, का
अनुरोध करता ह ै तो उसे आिेिन की अनुमजत िी िा सकती ह ै तथा निीकरण हते ु उस लाइसेंस के िेय होने की
तारीख स,े जिसकी अिजधक एक िर् ा से अजधक न हो, के जलए लाइसेंस की समाजप्त को स्ट्थगन म ें रखा िा सकता है,
िब दक िह िचनपत्र िें दक इस अिजध के िौरान जनर्मात उत्पािों पर मानक मुहर का प्रयोग नही करेगा और न्द्यनू तम
मुहरांकन िल्ु क का 10% या सात हिार रूपय े (िो भी अजधक हो) औचक्क जनगरानी लागत के रूप म ें िमा करेगा।
ऐसे लाइसेंसों को “जनजरक्रय” लाइसेंसों की श्रेणी म ेंरखा िायगे ा।
(7) लाइसेंस-धारक, जिसके लाइसेंस की समाजप्त को स्ट्थगन म ें रखा गया ह,ै जनर्िष्टा अिजध के भीतर दकसी भी समय
लाइसेंस के निीकरण हते ु, निीकरण की जनम्नजलजखत ितों एिं जनबंधनों के अनुसारण पर आििे न कर सकता ह,ै और
इसकी अनुमजत िी िायेगी तथा न्द्यूनतम मुहरांकन िुल्क की 10% राजि या सात हिार रुपय े (िो भी अजधक हो) को
अपेजित िल्ु क म ें समायोजित कर दिया िायगे ा। यदि जिजनर्िष्टा अिजध म ें निीकरण हते ु आिेिन करन े से लाइसेंस
धारक चूकता ह ैतो जिजनर्िष्टा अिजध की अंजतम जतजथ स ेलाइससें समाप्त हो िायेगा।
4. उक्त जिजनयम म,ें अनुसूची-II के, स्ट् कीम-I में, परै ा 5 के उप-पैरा (3) में ठिप्पण 2 के बाि, जनम्नजलजखत ठिप्पण िोडा
िायेगा, अथाात ्:-
“ठिप्पण 3: जिजनमााता के प्रत्येक पश्चात्िती अनुज्ञजप्त के जलए न्द्यूनतम मुहरांकन िल्ु क में 10% की छूि लाग ू होगी िबदक
सूक्ष्म, लघ ु एिं मध्यम उद्योगों के जलए रूपये सैंतीस हिार और बडे स्ट् तर की इकाइयों हते ु रूपये जछयालीस हिार का
न्द्यूनतम िुल्क लागू होगा तथा उच्चतम न्द्यूनतम मुहरांकन िल्ु क िाले लाइसेंस को पहला लाइसेंस माना िाएगा।”

NOTIFICATION
New Delhi, the 5th February, 2021
F. No. BS/11/11/2021.—In exercise of the powers conferred by section 39 read with sections 12
and 13 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Bureau, with prior approval of the
Central Government, hereby makes the following regulations further to amend the Bureau of Indian
Standards (Conformity Assessment) Regulations, 2018, namely:-
1. (1) These regulations may be called the Bureau of Indian Standards (Conformity Assessment) Second
Amendment Regulations, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3
2. In the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018 (herein after referred
to as said regulations), in regulation 8, in sub-regulation (4), after the words “the date of its validity”, the
words “or as provided in the applicable Scheme specified in Schedule - II” shall be inserted.
3. In the said regulations, in Schedule-II, in Scheme-I, in paragraph 9, after sub-paragraph (5), the
following sub-paragraphs shall be inserted, namely:-
“(6) If a manufacturer holding a licence, which is due for renewal, submits an application at least a
month before the date on which the renewal of the license becomes due, requesting for the expiry of
his license to be kept in deferment for a period not exceeding a year from that date, for his inability to
operate the license because of financial problems arising out of lack of demand for the Standard
Marked products, the request may be allowed, and the expiry of the license should be kept in
deferment for a specified period not exceeding one year from the date on which it became due for
renewal, subject to an undertaking that he must not use Standard Mark on the product manufactured
during this period and deposit ten per cent of the minimum marking fee or rupees seven thousand
(whichever is higher) as the cost of surprise surveillance. Such licenses shall be categorized as
“Dormant” Licenses.
(7) The license-holder, the expiry of whose license has been kept in deferment, can apply for the
renewal of the license any time within the specified period, following the terms and conditions for
renewal, and the same shall be allowed, and the amount of ten per cent of the minimum marking fee
or rupees seven thousand (whichever is higher) be adjusted against the requisite fee. If the licence-
holder fails to apply for renewal within the specified period, the license shall stand expired from the
last date of the specified period.”.
4. In the said regulations, in Schedule-II, in Scheme-I, in paragraph 5 in sub-paragraph (3), after Note
2, the following note shall be inserted, namely:-
“Note 3: For each subsequent license held by a manufacturer, a discount of ten percent in minimum
marking fee shall be applicable subject to minimum fees being rupees thirty seven thousand for micro,
small and medium enterprises and rupees fourty six thousand for large scale units and the licence with
highest minimum marking fee shall be considered as the first licence.”.
