1. सजं िप्त नाम और प्रारंभ,- इन जनयमों का संजिप् त नाम रेल भूजम जवेकास प्राजधकरण (गिन) संिोधन
जनयम, 2020 ह ै।
2. ये जनयम रािपत्र म ें इनके प्रकािन की तारीख को प्रवृत् त होंगे ।
3. रेल भूजम जवकास प्राजधकरण (गिन) जनयम, 2007 (जिसे इसम ें इसके पश् चात् उक्त जनयम कहा गया ह)ै के
जनयम 8 के उपजनयम (2) म ें “सिस्ट् य (योिना, अवसंरचना और जवकास), सिस्ट् य (योिना रेल यातायात
समन्दव य), सिस्ट् य- जवत् त और सिस्ट् य (संपिा और िहरी योिना) “िब् िों और कोष्ि कों के स्ट् थान पर
जनम्न जलजखत िब् ि और कोष्ि क रख े िाएंग,े - “सिस्ट् य (पठरयोिना), सिस्ट् य (कारबार जवकास), सिस्ट् य
(रािस्ट् व) और सिस्ट् य (योिना)” ।
4. उक्त जनयमों के जनयम 12 के उपजनयम (3) के ठिप् पण म ें "वार्षिक बिि उपाािनों” िब् िों के स्ट्थ ान पर
जनम्न जलजखत िब् ि "पंचविीय योिना के अनुसार औसत वार्षिक बिि उपािानों जिसके अंतगता सृजित
आजस्ट्तयों का मल्ू य भी ह”ै िब् ि रखे िाएंग े ।

5. उक्त जनयमों के जनयम 16 के उप-जनयम (3)के स्ट् थान पर जनम्न जलजखत उप-जनयम रखा िाएगा, अथाता ्:—
“(3) प्राजधकरण एक पृथक एस्ट्र ो खाता रखेगा, जिसम ें सभी उपािानों, जिसके अंतगात रॉयल् िी, ठरयायत
फीस, अनुज्ञजि फीस और प्राजधकरणों की पठरयोिनाओं स े प्राप् त लाभ भी ह,ैं को िमा दकया िाएगा और
इसके पश् चात ् उपािान के ऐसे प्रजतित को प्रजतधाठरत करने के पश् चात िो प्राजधकरण वार्षिक बिि प्रदरया
के अनुसार जवजनश् चय करे, जवजनयमों म ें अजधकजथत बिि प्रदरया के अनुसार उन्द ह ें केंरीय सरकार को पूण ा
रूप स ेिे दिया िाएगा ।
(4) प्राजधकरण द्वारा उपािान का प्रजतधारण केरीय सरकार द्वारा तीन विीय पुनर्षवलोकन की िता के अधीन
होगा”

NOTIFICATION
New Delhi, the 13th January, 2020
G.S.R. 32(E).— In exercise of the powers conferred by section 4A read with section 198 of the
Railways Act, 1989 (24 of 1989), the Central Government hereby makes the following rules further to amend
the Rail Land Development Authority (Constitution) Rules, 2007 namely:—
1. Short title and commencement: These rules may be called in the Rail Land Development
Authority (Constitution) Amendment Rules, 2020.
2. They shall come into force on the date of their publication in the Official Gazette.
3. In the Rail Land Development Authority (Constitution) Rules, 2007 (hereinafter referred to as the
said rules), in rule 8, in sub-rule(2) for the words and brackets “Member (Planning, Infrastructure
and Development), Member (Planning, Rail Traffic Co-ordination), Member finance and Member
(Real Estate and Urban Planning)”, the following words and brackets “Member (Projects),
Member (Business Development), Member (Revenue) and Member (Planning) shall be
substituted.”
4. In the said rules, in rule 12, in sub-rule (3) in Note, for the words “annual budgeted earnings.” the
following words “average annual budgeted earning as per five year plan including value of assets
created.” shall be substituted.
5. In the said rules, in rule 16, for sub-rule (3), the following sub-rules shall be inserted, namely:—
“ (3) The Authority shall maintain a separate Escrow account to which all earnings, including
royalties, concession fees, license fees and profits out of Authority’s Projects shall be credited
and thereafter shall be passed in full after retaining such percentage of earning which the
Authority may decide as per the annual budgetary process, on to the Central Government as per

(4) Retention of earning by Authority shall be subject to three year review by Central
Government. ”
6. In the said rules, in rule 24, the words “with approval of Central Government” shall be omitted.
