## Policy Analysis Report: Notifications Regarding National Highways **1. Executive Summary:** This report analyzes three notifications (S.O. 514(E), S.O. 515(E), and S.O. 516(E)) issued by the Ministry of Road Transport and Highways on February 3, 2021, concerning National Highways. The notifications address delegation of authority to State Governments for executing works on specific National Highways, entrustment of new National Highways to the National Highways Authority of India (NHAI), and rescinding a previous notification. Key findings include the delegation of authority to Tamil Nadu and Gujarat state governments for specific stretches, the entrustment of several new and existing national highway sections to NHAI, and the nullification of notification S.O. 383(E) dated January 24, 2019. **2. Introduction:** This report provides an overview and analysis of three notifications (S.O. 514(E), S.O. 515(E), and S.O. 516(E)) regarding National Highways, based solely on the text provided within those notifications. The report aims to inform stakeholders about the changes, re-delegation of authority, and the entrustment of highways to NHAI as outlined in these notifications. **3. Policy Overview:** * **S.O. 514(E): Amendment:** This notification constitutes an amendment to the Government of India notification S.O. 1096(E), dated August 4, 2005, which likely established the framework for delegating authority over National Highways. * **Core Objective:** To further amend existing regulations regarding the execution of works on National Highways by delegating certain functions to specific State Governments. * **S.O. 515(E): New Policy:** This notification outlines which stretches of national highways are to be controlled by the National Highways Authority of India. * **Core Objective:** To entrust specific stretches of National Highways to the National Highways Authority of India (NHAI). * **S.O. 516(E): Policy Revocation:** This notification revokes an earlier notification. * **Core Objective:** To rescind notification S.O. 383(E), dated January 24, 2019, immediately. **4. Background and Rationale:** * **S.O. 514(E): Amendment:** The amendment likely addresses the need to adapt the management and execution of works on specific National Highway stretches. The modifications probably stem from updated project scopes, revised state government capabilities, or a desire to optimize infrastructure development efficiency in Tamil Nadu and Gujarat. * **S.O. 515(E): New Policy:** The entrustment of highway stretches to the NHAI probably reflects the Central Government's strategy to centralize control or management of national highways under a single, dedicated authority. This centralization potentially aims to streamline development, maintenance, and operation, ensure consistent standards, and accelerate infrastructure projects. * **S.O. 516(E): Policy Revocation:** Without access to the revoked notification S.O. 383(E), it's challenging to determine the precise reason for its rescission. Revocation could be due to redundancy, obsolescence, conflict with other policies, or the correction of errors within the original notification. **5. Key Provisions / Changes:** * **S.O. 514(E): Amendment:** * **Specific Change:** The notification amends the schedule in S.O. 1096(E), dated August 4, 2005, by substituting the entry for serial number 22. This change pertains to National Highway No. 45, and others, as it passes through Tamil Nadu, and National Highway No. 6, and others, as it passes through Gujarat. * **New Rule/Provision:** The State Governments of Tamil Nadu and Gujarat are now authorized to execute works pertaining to specific stretches of National Highways as described in the attached table. The Tamil Nadu stretches are primarily sections of NH 45 (new NH Nos. 32, 132, 38, 83 and 183), NH 45A (new NH Nos. 32 and 332), NH 47 (new NH No. 544), NH 49 (New NH No. 87 and 85), NH 67 (New NH No. 83, 81 and 181), new NH No. 136, No. 207 (New NH No. 648), No. 208 (New NH No. 744), No. 209 (New NH No. 83), No. 210 (New NH No. 336 and 536), No. 219 (New NH No. 42), No. 226 (New NH No. 135), No. 230 (New NH No. 85), No. 234 (New NH No. 75 and 38), No. 381 (ew NH No. 544H). The Gujarat stretches are primarily sections of Highways No. 6, 8A, 8B, 8D, 8E, New NH No. 51, No. 59, No. 113, No. 228, new NH No. 68, New NH No. 168, new No. 168A, new NH No. 251, New NH No. 341, New NH No. 351, New NH No. 754K, New NH No. 756, New NH No. 848, New NH No. 848A, New NH No. 848B, New NH No. 927D, and New NH No. 953. * **Difference/Effect:** The change delegates responsibility to the state governments for managing and executing works on those specific sections of the highways. However, the state governments must comply with the rules under the National Highways Act, 1956. * **S.O. 515(E): New Policy:** * The entirety of the indicated National Highways, or sections thereof, are entrusted to NHAI. This includes: 148N, NE 5, NE 5A, 152D, 148NA, 179A, 179B, 754K, 844, 344M, 344P, 344N, 148AE, 248BB, 716B, 116A, 754A, 754AD, 205K, and NE 6. * **S.O. 516(E): Policy Revocation:** The revocation of S.O. 383(E) means that the provisions within that notification are no longer in effect. **6. Target Audience and Stakeholders:** * **S.O. 514(E): Amendment:** The primary target audience includes the State Governments of Tamil Nadu and Gujarat, construction companies involved in National Highway projects, local communities along the specified highway stretches, and regulatory bodies overseeing highway development. * **S.O. 515(E): New Policy:** The target audience includes the National Highways Authority of India (NHAI), construction companies working on these highways, commuters using these stretches of National Highways, and state governments where these highways are located (Gujarat, Madhya Pradesh, Rajasthan, Haryana, Punjab, Tamil Nadu, Uttar Pradesh, Andhra Pradesh, and West Bengal). * **S.O. 516(E): Policy Revocation:** The stakeholders affected by the rescission of S.O. 383(E) would depend on the content of the original notification. It could affect government agencies, construction companies, or communities impacted by the policy detailed in the rescinded notification. **7. Implementation Aspects (Inferred):** * **S.O. 514(E): Amendment:** * **Responsible Agency:** The State Governments of Tamil Nadu and Gujarat are responsible for executing works, with oversight from the Central Government to ensure compliance with the National Highways Act, 1956. * No specific timelines or procedures are defined in the text. The implementation timeframe is implicit in the notification taking immediate effect. * **S.O. 515(E): New Policy:** * **Responsible Agency:** The National Highways Authority of India (NHAI) will be responsible for the development, maintenance, and operation of the entrusted highway stretches. * No specific timelines or procedures are defined in the text. * **S.O. 516(E): Policy Revocation:** * The rescission takes effect immediately, suggesting no transitional arrangements or procedures are required. **8. Expected Outcomes / Impact of Changes:** * **S.O. 514(E): Amendment:** Delegating authority to the state governments potentially leads to more efficient project execution and better alignment with local needs and priorities. The impact is dependent on the state governments' capacity and effectiveness in managing highway projects. * **S.O. 515(E): New Policy:** Entrusting highways to NHAI may streamline project management, ensure consistent standards across different states, and accelerate infrastructure development on the entrusted corridors. * **S.O. 516(E): Policy Revocation:** The impact depends entirely on the content of the rescinded notification. Revocation suggests that the previous policy was no longer aligned with current objectives or was deemed ineffective. **9. Conclusion:** The three notifications reflect ongoing efforts to optimize the management and development of National Highways in India. Delegating authority to state governments for specific sections (S.O. 514(E)) aims to enhance efficiency, while centralizing control under NHAI for other stretches (S.O. 515(E)) seeks to streamline development and maintenance. The rescission of S.O. 383(E) indicates an adaptive approach to policy-making, adjusting regulations based on evolving needs and priorities. These changes are significant for construction companies, state governments, NHAI, and communities that rely on the National Highway network.
