1. लघ ुिीर्कव और आरंभ.-

(1) इन जिजनयमों को राष्ट्रीय राजधानी क्षेत्र ददल्ली (अनजधकृत कॉलोजनयों में जनिाजसयों के संपजत्त अजधकारों की मान्यता) (संिोधन) जिजनयम, 2023 कहा जाएगा।

(2) ये जिजनमयराजपत्र म ेंइनके प्रकािन की जतजथ स ेलागू होंग।े

2. राष्ट्रीय राजधानी क्षेत्र ददल्ली (अनजधकृत कॉलोजनयों म ें जनिाजसयों के संपजत्त अजधकारों की मान्यता) जिजनयम, 2019 (इसके बाद उि जिजनयमों के रूप म ें संदर्भभत) केजिजनयम 3 के खंड (क) म ें जनम्नजलजखत परंतुक िाजमल दकया जाएगा, नामत :- "बिते दक इस खंड के अंतगवत खाली भूजम पर कोई अजधकार प्रदान नहीं दकया जाएगा या मान्यता नहीं दी जाएगी।" 3140 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

3. उि जिजनयमों के जिजनयम 4 म-ें

(i) उप-जिजनयम (6) के स्ट्थान परजनम्नजलजखत उप-जिजनयम को प्रजतस्ट्थाजपत दकया जाएगा, नामत: "(6) जिजनयम 3 के खडं (ख) में यथा जिजनर्ददष्ट श्रणे ी-2 भूजम के संबंध म ें जनर्भमत क्षेत्र के जलए िसूल दकए जान े िाल े प्रभारउप-जिजनयम (5)में यथा जिजनर्ददष्ट श्रणे ी-1 भूजम के जनर्भमत क्षेत्र पर लागू प्रभारोंके आध ेहोंगे।

(ii) उप-जिजनयम (7) के स्ट्थान पर जनम्नजलजखत उप-जिजनयम को प्रजतस्ट्थाजपत दकया जाएगा, नामत: "(7) जिजनयम 3 के खंड (ख) में यथा जिजनर्ददष्ट श्रेणी-2 भूजम में जस्ट्थत खाली प्लॉट के जलए िसूल दकये जाने िाल े प्रभार जनम्नानुसार होंग:े- क्रम स.ं जहां सभी अनजधकृत कॉलोजनयों में सभी संपजत्तयों प्रभार में जनिासी का संचयी खाली प्लॉट क्षेत्रफलप्रभार जनम्न प्रकार ह ै

1. 100 िगवमीटर से कम जिजनयम 4 केउप-जिजनयम 4 के संबंध म½ें x भूजम क्षेत्रफलx क्षेत्र की सर्दकल दर का0.5%

2. 100 िगवमीटर से अजधक (अथिा बराबर) लेदकन जिजनयम 4 केउप-जिजनयम 4 के संबंध म½ें x भूजम 250 िगवमीटर से कम क्षेत्रफलx क्षेत्र की सर्दकल दर का1%

3. 250 िगवमीटर से अजधक अथिा उसके बराबर जिजनयम 4 केउप-जिजनयम 4 के संबंध में ½ x भूजम क्षेत्रफलx क्षेत्र की सर्दकल दर का2.5%।”;

(iii) उप-जिजनयम (8) को हटा ददया जाएगा।

4. उि जिजनयमों म,ें जिजनयम 5 मेंउप-जिजनयम (2) और (3) के स्ट्थान परजनम्नजलजखत उप-जिजनयमों को प्रजतस्ट्थाजपत दकया जाएगा, नामत: "(2) जिजनयम 3 के खंड (क) म ें यथा जिजनर्ददष्ट श्रेणी -1 के अतं गवत आन े िाली भूजम के मामल े में, भिन के फुटप्रप्रट के अंतगतव भूजम के संबंध में अजधकार प्रदान दकए जाएंगे, भले ही भिन म ें दकसी भी तल का कुल क्षेत्रफल (कारपेट एररया और सर्भिस िाफ्ट, बालकनी, बरामदा, खुली छत और कारपेट एररया स े परे कोई भी बढा हुआअन्य क्षेत्र) जबप्रल्डग फुटप्रप्रट से अजधक हो:

बिते दक ऐसे अजधकार भिन फुटप्रप्रट के अंतगवत आने िाले क्षत्रे अथिाप्लॉट क्षेत्र,जो भी कम हो,से अजधक नहीं होंगे।

(3) जिजनयम 3 के खंड (ख) में यथा जिजनर्ददष्ट श्रेणी-2 के अंतगतव आने िाली भूजम के मामले म,ें खाली प्लॉट के साथ- साथ जनर्भमत क्षेत्र के जलए, जैसा भी मामला हो, अजधकारों को मान्यता प्रदान की जाएगी: बिते दक जहां दकसी भिन में एक तल का कुल कारपेट एररया प्लॉट क्षेत्र से अजधक हो या प्लॉट क्षेत्र से परे बढा हुआ हो, िहााँ अजधकार प्लॉट क्षेत्र की सीमा तक सीजमत होंगे।" डी. सरकार, आयुि एि ंसजचि [जिज्ञापन-III/4/असा./108/2023-24] नोट : मलू जिजनयम भारत के राजपत्र, असाधारण, भाग-II, खंड 3, उपखंड (i) में जी.एस.आर. 814(ई), ददनांक 29 अक्टूबर, 2019 द्वारा प्रकाजित दकए गए थ,ेजजन्ह ें बाद मएें फ.सं. एलएम/पीएम/0001/2020/उदय/एमओएम ददनांक 27 जुलाई, 2022द्वारासंिोजधत करके भारत के राजपत्र, भाग III, खंड 4में ददनांक 27 जुलाई, 2022 को प्रकाजित दकया गया था।[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 DELHI DEVELOPMENT AUTHORITY

NOTIFICATION New Delhi, the 15th May, 2023 F. No. LM/PM/0003/2021/UDAY/LGL/157.—In exercise of the powers conferred by section 57 of the Delhi Development Act, 1957 (61 of 1957), the Delhi Development Authority, with the previous approval of the Central Government, hereby makes the following regulations further to amend the National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Regulations, 2019, namely:-

1. Short title and commencement.-

(1) These regulations may be called the National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) (Amendment) Regulations, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Regulations, 2019 (hereinafter referred to as the said regulations), in regulation 3, in clause (a) the following proviso shall be inserted, namely:- “Provided that no right shall be conferred or recognised on vacant land under this clause.”

3. In the said regulations, in regulation 4,-

(i) for sub-regulation (6), the following sub-regulation shall be substituted, namely:- “(6) The charges for built-up area to be recovered in respect of category-2 land as specified in clause (b) of regulation 3 shall be half of the charges applicable to built up area in category-1 land as specified in sub- regulation (5).”

(ii) for sub-regulation (7), the following sub-regulation shall be substituted, namely:- “(7) The charges to be recovered for vacant plot situated in category-2 land as specified in clause (b) of regulation 3, shall be as follows: – Sl. 2. More than (or equalto) 100 sqm but lessthan 250 ½ x Land area x 1 % of circlerate of sqm locality in termsof sub-regulation 4 ofregulation 4.

3. Greater than or equalto 250 sqm ½ x Land area x 2.5% of circle rate of locality interms of sub- regulation 4of regulation 4.”;

(iii) sub- regulation (8) shall be omitted.

4. In the said regulations, in regulation 5, for sub-regulations (2) and (3), the following sub-regulations shall be substituted, namely:- “(2) In case of land falling under category-1, as specified in clause (a) of regulation 3, the rights shall be conferred in respect of the land under building footprint, even if the total area of any floor in the building (carpet area and any area under service shaft, balcony, veranda, open terrace and any other projections beyond carpet area) exceeds the building footprint:

Provided that such rights shall not exceed area under the building footprint or the plot area, whichever is less.

(3) In case of land falling under category- 2, as specified to in clause (b) of regulation 3, rights shall be recognised for vacant plot as well as built up area, as the case may be:4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

Provided that where the total carpet area of a floor in a building exceeds the plot area or having projections beyond plot area, rights shall be restricted to the extent of the plot area".
