ददनांक 08 मई, 2009 की जुजाल अपील ुंख्य ा 2009 की 887 में पाररत माननीय उच् चतम ् यायालय के जनण य र उच् च् तर जि्षणण
ुंस्ट् थान में रिंगग का खतरा जनयंजित करने पर जाश् ाजा्ालय अनिदान ्य ग जाजनयमााली, 2009 के अनिुरण में, राष्ट रीय
्यिज्ञान आान ्य ग एतद्द्वारा जनम्नजलजखत जाजनयम बनाता ू:ि —
1. ुजं ्षणप्त िीीक र प्रारंभण –(1) ये जाजनयम, राष्ट रीय ्यिज्ञान आान ्य ग (मेजडकल कोलेज र ुंस्ट् थान में रिंगग की
र कथाम र जनीेध) जाजनयमााली, 2021कू ेजाएंगे।
(2) ये भारत के ुरकारी राजपि में उनके अंजतम प्रकािन की तारीख क प्रााृत् त ू गे।
2. पररभाीाएं– सन जाजनयम में, जब तक ुंदभ ुे अ् यथा अपेज्षणत न ू , -
(क) ''ििज्षणक ाी' ' ु,े उु ाी जािीे के अंत में परी्षणाओं, यदद क ई ू , ुजूत मेजडकल कोलेज या
ुंस्ट् थान में अ ययन के दकुी पा्यक्रमम में छाि के दाजखले के प्रारंभण ुे ििज्षणक अपे्षणाओं की
पूण ता तक की अाजध अजभप्रेत ू;ि
(ख) ''अजधजनयम'' ुे, राष्टर ीय ्यिज्ञान आान ्य ग अजधजनयम, 2019 (2019 का 30) अजभप्रेत ू;ि
(ग) ''्य ग'' ु,े अजधजनयम की धारा 3 के अंतग त गरठत राष्टर ीय ्यिज्ञान आान ्य ग अजभप्रेत ू;ि
(घ) ''नया जा्ाथी (फ्रेिर)'' ुे क ई ऐुा छाि अजभप्रेत ू,ि ज ुंस्ट् थान म ें दाजखल दकया गया ू ि र
ज उु ुंस्ट् थान में अ ययन के अपन ेप्रथम ाी म ेंअ ययन कर रूा ू;ि

(च) ''छािाााु'' ु,े मेजडकल कोलजे या ुंस्ट्थ ान द्वारा प्रिाजुत र ब डिंगडग जिुी ुिजाधाओं र
अपन ेुभी ुंबद्ध ्षणेि ााला छाि के जनााु का क ई स्ट् थान अजभप्रेत ू;ि
(छ) ''एमबीबीएु'' ु,े स्ट् नातक जचदकत् ुा जि्षणा जाजनयमााली, 1997 र अजधजनयम की धारा 61
की उप-धारा (2) के अंतग त राष्टर ीय ्यिज्ञान आान ्य ग द्वारा जाजधात् मा् यताप्राप् त उत् तराती
ुंि धन के अनिुार भारत के दकुी जाश् ाजा्ालय या अनिम ददत ुंस्ट् थान की ्यिज्ञान आान
स्ट् नातक र िल् यजचदकत् ुा स्ट् नातक की जडरी ी अजभप्रते ू;ि
(ज) ''मेजडकल कोलेज या ुंस्ट् थान'' ु,े भारत के अंदर क ई ऐुा ुस्ट्ं थान अजभप्रेत ू,ि ज ्यिज्ञान आान म ें
जडजरी यां, जडप् ल मे या लासुेंु प्रदान करता ू ि र सुमें ुंबद्ध कोलेज र ्य ग द्वारा यथा
अनिम ददत र अजधजनयम की धारा 24, 25 र 35 के अंतग त स्ट्न ातक-पूा ्यिज्ञान आान जि्षणा
ब ड या स्ट् नातक त् तर ्यिज्ञान आान जि्षणा ब ड के ुाथ ुूचीबद्ध माजनत जाश् ाजा्ालय िाजमल ू ि
र सुमें ुभी ्षणेि जिु े जाभाग, ुभी अ यापन र न आानाज न ुिजाधाएं, अस्ट् पताल र सुके
ुभी पररुर, चाू े ाे ििज्षणक, ्ााुीय, खेल के मिदान या कैंटीन ू , चाू े ाे पररुरके अंदर
जस्ट्थत ू या अंदर र अपना अ ययन करन े म ें छाि द्वारा सस्ट् तेमाल दकए गए ुरकारी या जनजी
परराून के ुभी ुाधन िाजमल ू,ैं परंति यू स् ूीं तक ुीजमत नूीं ू;ि
(झ) ''जचदकत् ुा–िास्ट् ि'' ुे अपनी ुभी िाखाओं में ्धिजनक ान आि ाजनक जचदकत् ुा-िास्ट् ि अजभप्रेत ू ि
र सुम ें िल् य-जचदकत् ुा तथा प्रुूजत-जान आान िाजमल ू,ि परंत ि सुम ें पििजचदकत् ुा-िास्ट् ि र
िल् यजचदकत् ुा िाजमल नूीं ू।ि
(ञ) ''अजधुूचना'' ुे, ुरकारी राजपि में प्रकाजित अजधुूचना अजभप्रेत ू ि र ''अजधुूजचत करें''
अजभव् यजतिय का अथ तदनिुार लगाया जाएगा;
(ट) ''स्ट् थायी पंजीकरण'' अजधजनयम के अ याय VI के उपबंध के अंतग त यथा जाजनयजमत, दकुी
जाजधात् मा् यताप्राप् त प्राथजमक ्यिज्ञान आान ििज्षणक य ् यता ााल े पाि व् यजतियय का पंजीकरण
ू,ि ज स्ट् थायी जचदकत् ुा जाजनयमााली, 2021 के अंतग त यथा जाजनयजमत, भारत में ्धजि नक
ािन आाजनक ीध प्रणाली या ऐल पिजथक म ें स्ट् ातंि रूप ु े प्रिजटिटु करने की अनिमजत प्रदान करता
ू िया लासुेंु उपलब्ध कराता ू;ि
(ठ) ''रिंगग'' ुे, जाजनयम 4 में यथापररभाजीत एक दुू रे के प्रजत छाि के कदाचार का कृत् य अजभप्रेत
ू;ि
(ड) ''ाररष्टठ '' ुे, क ई ऐुा छाि अजभप्रेत ू,ि ज उु ुंस्ट् थान में अपना अ ययन कर रूा ू ि र
जपछल े ििज्षणक ाी म ें या दकुी जपछल े ाी में ुंस्ट्थ ान म ें दाजखल दकया गया ू ि र सुजलए
जनजूताथ ू िदक ाू दकुी फ्रेिर के बिच ुे पूले ुंस्ट्थ ान म ेंिाजमल ए ् ू;ि
(ढ) ''छाि'' ु,े नामांदकत र ्य ग द्वारा यथा अनिम ददत दकुी मेजडकल कोलेज में दकुी पा्यक्रमम
में अ ययन कर रूा क ई व् यजतिय अजभप्रेत ू;ि
(ण) सन जाजनयम के उद्देश् य के जलए ''जाश् ाजा्ालय'' का अथ जाश् ाजा्ालय अनिदान ्य ग
अजधजनयम, 1956 (1956 का 3) की धारा 2 के खंड (च) म ें सुे ददया गया अथ ू गा र सुम ें
भारत म ें क ई ऐुा स्ट् ाास्ट् ् य जाश् ाजा्ालय, ज दकुी केंद्रीय अजधजनयम, दकुी प्रांतीय
अजधजनयम या दकुी राज्य अजधजनयम द्वारा या के अंतग त स्ट्थ ाजपत या अजधजनगजमत दकया गया
ू , उटित अजधजनयम की धारा 3 के अतं गत माजनत जाश् ाजा्ालय ू ने ााला क ई ुंस्ट् थान या
जडजरी यां प्रदान या स्ट् ाीकृत करन े के जलए ुंुद के दकुी अजधजनयम द्वारा जािेी रूप ुे िजतियप्राप् त
क ई ुंस्ट् थान िाजमल ू;ि
(त) ''जाश् ाजा्ालय अनिदान ्य ग'' ुे, जाश् ाजा्ालय अनिदान ्य ग अजधजनयम, 1956 (1956
का 3) की धारा 4 के अतं गत स्ट्थ ाजपत जाश् ाजा्ालय अनिदान ्य ग ू;ि
(थ) ''ााड न'' ु,े ुंस्ट् थान प्रमिख द्वारा छािाााु के नित्य क प्रिाुन र काय चालन ुपपे गए क ई
पदाजधकारी अजभप्रेत ू।ैं[भाग III—खण् ड 4] भारत का राजपि : अुाधारण 3
(2) सन जाजनयम में सस्ट् तेमाल दकए गए र सुमें पररभाजीत न दकए गए परंति अजधजनयम में पररभाजीत दकए गए
िब्द र अजभव् यजतियय का अपना-अपना ाूी अथ ू गा, ज अजधजनयम में उ् ू ेंददया गया ू।ि
3. उद्देश्य - सन जाजनयम का उद्देश् य, सन जाजनयम के अंतग त रिंगग के जनीेघ द्वारा, सुके ू ने की र कथाम करके
र सन जाजनयम में यथा उपबंजधत प्राृत् त प्रचजलत र लागू ू ने ााले कानून के अनिुार रिंगग में जलप्त व् यजतियय के
जारुद्ध दडं ात् मक उपाय करके, दिे में मेजडकल कोलेज र ुंस्ट् थान ुे सुके ुभी रूप में रिंगग का उ् मूलन करना ूि।

3. रिंगग की पररभाीा –रिंगग का अथ ू गा क ई उत् पाती ्चरण, चाू ेाू ब ले गए या जलजखत िब् द द्वारा ू या दकुी ऐुे
कृत् य द्वारा जजुका प्रभाा दकुी अ् य छाि क जच़ााने, रुखेपन के ुाथ व् याूार करने या ूैंडल करने ााला ू , उपद्राी या
अनििाुनूीनगजतजाजधय में जलप्त ू ना, जजुके कारण कष्ट ट पए ंचता ू या कष्ट ट पए चं ने की ुंभााना ू , करठनाई या मन ािन आाजनक
ूाजन ू या दकुी फ्रेिर या कजनष्टठ के मन में डर या उुकी ्िंका उत् प् न करना या छाि ुे क ई ऐुा काय करने या किछ ऐुा करन े
क कूना, ज ुामा् यत: ाू छाि नूीं करेगा र जजुका प्रभाा, िम या लज्ज ा की भााना उत् प् न करने ााला ू ज दकुी फ्रेिर
या दकुी कजनष्ट ठ छाि के िरीर या मन क प्रजतकूलत: प्रभाजात करती ू ।
4. काय ज रिंगग ू ुकत ेूैं –जनम् नजलजखत काय उन काययों में िाजमल ू गे ज रिंगग ू ुकते ूैं, नामत:
(क) दकुी छाि या छाि द्वारा क ई ्चरण, चाू े ाू ब ले गए या जलख े गए िब्द द्वारा ू या दकुी ऐुे
कृत् य द्वारा जजुका प्रभाा दकुी फ्रेिर या दकुी अ् य छाि पर जच़ााने, रुखेपन के ुाथ व् याूार या ूडें ंलग
ू ;
(ख) दकुी छाि या छाि द्वारा उपद्राी या अनििाुनूीन गजतजाजधय में जलप् त ू ना, जजुुे कष्ट ट पए चं ता ू
या पए चं ने की ुंभााना ू , करठनाई ू , िारीररक या मन ािन आाजनक ूाजन ू या दकुी फ्रेिर या दकुी
अ् य छाि के मन म ेंडर या उुकी ्िंका उत् प्न करना;
(ग) दकुी छाि क ऐुा काय करन े क कूना ज ाू छाि ुामा्य त: नूीं करेगा र जजुका प्रभाा, िम या
यातना या लज्ज ा की भााना उत् प् न करन े ााला ू , ज उु फ्रेिर या दकुी अ् य छाि के िरीर या मन क
प्रजतकूलत: प्रभाजात करती ू ;
(घ) दकुी ाररष्टठ छाि द्वारा क ई ऐुा काय , ज दकुी अ् य छाि या दकुी फ्रेिर के जनयजमत ििज्षणक
द्रमयाकलाप क र कता ू , भंग करता ू या उुमें बाधा उत् प्न करता ू ;
(ङ) दकुी व् यजतिय या छाि के दकुी ुमूू क ददए गए ििज्षणक काय पूरे करने के जलए दकुी फ्रेिर या दकुी
अ् य छाि की ुेााओं का दरुि पय ग करना;
(च) छाि द्वारा दकुी फ्रेिर या दकुी अ् य छाि पर जबरदस्ट् ती जात् तीय भार डालने या जात् तीय खु ट का
क ई काय;
(छ) सुके ुभी रूप ुजूत िारीररक दव्ि य ाूार का क ई काय जिुे यनन दव्ि य ाूार, ुमंलगकामी प्रूार, कपडे
उतरााना, अश्ल ील र कामिक कृत् य के जलए दबाा डालना, सिारे, स्ट् ाास्ट् ् य या व् यजतिय क िारीररक ूाजन,
क ई अ् य खतरा पए चं ाना;
(ज) ब ले गए िब् द , ई-मेल , डाक, स्ट् नेल-मेल , ब् लोग , ुाा जजनक अपमान द्वारा क ई कृत् य या दरुि पय ग
जजनमें फ्रेिर या दकुी अ् य छाि क पराजय में ुद्रमय रूप ुे या जनजष्ट्रमय रूप ुे भाग लेने ुे जाकृत
्नंद, प्रजतजनजधक या परपीडन कामिक र मांच प्राप् त करना भी िाजमल ू गा;
(झ) रंग, नस्ट् ल, जाजत, मानाजातीय, जडें र (रांुजेंडर ुजूत) यनन अजभमिखीकरण, ददखााट, राष्टर ीयता, ्षणेिीय
उत् पजयय , भाीायी पूचान, ज् म स्ट्थ ान, जनााु स्ट् थान या ्ज्ञथक पृष्टठ भूजम के ्धार पर अ् य छाि
(फ्रेिर या अ् यथा) पर लज्षणत िारीररक या मानजुक दव्ि य ाूार (डरान-े धमकाने र बजूष्ट कार ुजूत) का
क ई कृत् य;
(ञ) क ई ऐुा कृत् य ज अपमान के जररए या अ् यथा माना प्रजतष्टठ ा र ुम् मान क कम करता ू ;
(ट) क ई ऐुा कृत् यि ज कामिक ्नदं लने े की मंिा ुे या के जबना दकुी फ्रेिर या दकुी अ् य छाि के मानजुक
स्ट् ाास्ट् ् य र ्त् मजाश् ााु क प्रभाजात करता ू या दकुी फ्रेिर या दकुी अ् य छाि पर दकुी छाि

(ठ) ऊपर स्ट् पष्टट रूप ु े उल् लेख न दकया गया क ई अ् य कृत् य परंति जजुुे जाजनयम 3 र 4 के अतं गत यथा
उपबंजधत रिंगग के जलए पररभाीा के ुूी अथ म ेंरिंगग का कृत्य बनता ू ।

ुस्ट्ं थ ान द्वारा रिंगग का जनीधे र र कथाम करन ेके उपाय
5. ुस्ट्ं थ ान के कत्त व् य र जजम्म दे ाररया ं –रिंगग क जनयंजित करने र उुके उ् मूलन के जलए ुभी स्ट् टेकू ल् डर नामत:
ाररष्ट ठ , फ्रेिर , अय ापक , माता-जपता र व् यापक रूप ुे ु य ुमाज के प्रयाु की ्ाश् यकता ू ती ू ि र सु अय ाय के
उपबंध में उपबंजधत उपाय, ुंस्ट् थान द्वारा रिंगग का जनीेध र र कथाम करने के जलए म टे तनर पर ददिाजनदि ू।ैं
6. रिंगग का जनीधे करने के जलए मजेडकल कोलजे र ुस्ट्ं थ ान द्वारा दकए जान े ााल े उपाय- रिंगग का जनीेध करने के जलए
मेजडकल कोलेज या ुंस्ट् थान द्वारा जनम् नजलजखत उपाय दकए जाएंगे, नामत:-
(क) क ई भी ुंस्ट् थान, दकुी भी तरीके ुे रिंगग की घटना की अनमि जत नूीं दगे ा या दकुी भी रूप में रिंगग की
ुूजचत की गई दकुी घटना क माफ नूीं करेगा; र ुभी ुंस्ट् थान, ुंस्ट् थान के अंदर या बाूर रिंगग का
उ् मलू न करने का उद्देश् य प्राप् त करने के जलए सन जाजनयम के उपबंध ुजूत ुभी ्ाश् यक र अपेज्षणत
उपाय करेंग ेपरंति य ेउपाय स् ूीं उपबंध तक ुीजमत नूीं ू ग;े
(ख) प्रत् यके मेजडकल कोलेज या ुंस्ट्थ ान, रिंगग करने या ुद्रमय अथाा जनजष्ट्रमय रूप ुे रिंगग के जलए उकुान े
या रिंगग क बढाृाा देन े की ुाजजि का भाग ू न े का द ीी पाए जान े ााल े व् यजतियय के जारुद्ध सन
जाजनयम के अनिुार कार ााई करेंगे।
7. रिंगग की र कथाम करन ेके जलए मजे डकल कोलजे या ुस्ट्ं थ ान द्वारा दकए जान ेााले उपाय- (1) रिंगग की र कथाम करने के
जलए दाजखल प्रद्रमया ुे पूले मेजडकल कोलेज या ुंस्ट् थान द्वारा जनम् नजलजखत उपाय दकए जाएंगे, नामत:
(i) दकुी सलेटिर ोजनक, द़श् य-श्रव् य या ंप्रट या दकुी अ् य मीजडया में घ जीत दकुी पा्यक्रमम में दाजखले ु े
ुंबंजधत, मेजडकल कोलेज या ुंस्ट् थान की ुभी ुाा जजनक अजधुूचनाओं में अजभव् यटित रूप ुे यू ददया
जाएगा दक-
(क) रिंगग एक गंभीर अपराध ू िज मेजडकल कोलेज या ुंस्ट् थान म ेंपूण त: जनजीद्ध ू।ि
(ख) रिंगग करन े या रिंगग के जलए उकुाने, चाू े यू ुद्रमय रूप ुे ू या जनजष्ट्रमय रूप ु,े या रिंगग क
ब़ाााा देने की ुाजजि का भाग ू ने का द ीी पाए गए दकुी व् यजतिय क , सन जाजनयम के अनिुार
र ुमय-ुमय पर लाग ूदकुी दांजडक कानून के उपबंध के अंतगत दडं ददया जा ुकेगा;
(ii) ंप्रट, जडजजटल या दकुी अ् य रूप में दाजखला ् िर या प्रोस्ट्प िटि् ु या ुूचना बिलेरटन में ये जाजनयम िाजमल
दकए जाएंगे;
(iii) प्राेि या एज्जट या मूल् यांकन के दकुी अ् य रूप के जलए परी्षणा ्य जजत करने र उन कोलेज या
ुंस्ट् थान , जजन पर ये जाजनयम लागू ू ते ू,ैं ुे ुंबंजधत काउंुंलग या ुीट ्बंटन करने ााले ुभी ुंगठन
के जलए यू अजनााय ू गा दक ा े अपन े ुूचना बिलेरटन म ें य े जाजनयम उुी रूप म ें िाजमल करें जजु रूप म ें
उपलब् ध ू,ैं जिुेदक नीचे ददए गए ू:ैं
(क) राष्टर ीय परी्षणा एजेंजुयां (एनटीए), एमबीबीएु के जलए राष्टर ीय पािता ा प्राेि परी्षणा [नीट
(यूजी)] में ये जाजनयम िाजमल करेंगी;
(ख) राष्टर ीय परी्षणा ब ड (एनबीई) स्ट् नातक त् तर [नीट (पीजी)] र राष्टर ीय पािता ा प्राेि परी्षणा के
ुूचना बिलेरटन म ेंये जाजनयम िाजमल करेगा;
(ग) स्ट् नातक-पूा मेजडकल या स्ट् नातक त् तर या अजत जािेीन आता पा्यक्रमम ऑनलासन ुीट ्बंटन प्रद्रमया
(ऑनलासन काउंुंलग) ्य जजत करन े ााल े मूाजनदेिालय, स्ट् ाास्ट् ् य ुेााए,ं स्ट् ाास्ट् ् य एा ं परराार
कल् याण मंिालय, भारत ुरकार कीमेजडकल काउंुंलग ुजमजत (एमुीुी), ुंबंजधत काउंुंलग
प्रद्रमयाओं के जलए अपनी ाेबुासट पर ये जाजनयम प्रदज्ञित करेंगी;
(घ) अजधजनयम की धारा 15 के अंतग त ्य जजत की जान े ााली राष्टर ीय एज्जट परी्षणा (नेटिस्ट् ट) के जलए
ुूचना बिलेरटन म ेंये जाजनयम उपलब् ध ू ग;े
(ङ) मेजडकल कोलेज या ुंस्ट्थ ान यू ुिजनज त करेंगें दक यदद दाजखला प्रद्रमया ु े ुंबंजधत अपने मल्ू यांकन
या परी्षणाओं या काउंुंलग म ें ुे क ई उनके अधीन दकुी ुंगठन द्वारा ्य जजत की जाती ू ि या
उनका बाह्य स्र तीकरण दकया जाता ू ित ुूचना बिलेरटन में ये जाजनयम िाजमल ू गे।[भाग III—खण् ड 4] भारत का राजपि : अुाधारण 5
(iv) मेजडकल कोलेज या ुंस्ट्थ ान, परी्षणा की तारीखें सु प्रकार जभ् न-जभ् न ुमय पर रखगें े तादक ाररष्टठ बिच
के नए ुि के प्रारंभण ुे पूल ेनया बिच दाजखल दकया जा ुके;
(v) दकुी मेजडकल कोलेज या ुंस्ट्थ ान म ें ििज्षणक ुि के प्रारंभण ु े पूल े ुंस्ट् थान प्रमिख रिंगग क जनयंजित
करने ूते ि उपाय पर चचा करने के जलए जाजभ् न पदाजधकाररय या एजेंजुय जिुे छािाााु ााड न, छाि
के प्रजतजनजधय , माता-जपता या अजभभााक , ुंकाय ुदस्ट् य , जजला प्रिाुन जजुमें पिजलु िाजमल ू,ि की
एक बिठक ्य जजत करेगा र उुे ुंब जधत करेगा;
(vi) ुंस्ट् थान प्रमिख, रिंगग-प्रजतर धी ुजमजतयां, रिंगग-प्रजतर धी दस्ट् ते र अ् य ऐुी ुजमजतयां गरठत करेगा

(vii) मेजडकल कोलेज या ुंस्ट् थान, रिंगग में जलप् त व् यजतियय के प्रजत ुंस्ट् थान के दजृ ोक ण र रिंगग के
अपमानजनक प्रभाा ुे पूरे ुमिदाय क , जािेी रूप ु े जागरूक करेगा, यूां तक दक व् यापक प्रुार करने के
जलए मीजडया का सस्ट् तेमाल करके भी र रिंगग की घटनाओं पर दांजडक कानून के उपबंध र सन
जाजनयम के उपबंध दिा न े ााले प स्ट् टर ुिस्ट्प ष्टट रूप ुे ुस्ट्ं थान के पररुर, जािेी रूप ुे छािाााु में
प्रदज्ञित करेंग;े
(viii) रिंगग-प्रजतर धी गजतजाजधय ुे ुंबंजधत काययों र ुंपक नंबर, जनयंिण क्षण के ब् य रे, ूल्े पलासन ुिस्ट्प ष्टट
रूप ुे प्रदज्ञित दकए जाएगं ,े उपलब् ध कराए जाएंगे र फ्रेिर तथा ुभी ुंबंजधत क ्ुानी ुे उपलब्ध
ू गे तादक जब कभी ्ाश् यकता ू , तत्क ाल ुंपक स्ट्थ ाजपत दकया जा ुके;
(ix) दाजखला प्रद्रमया ्रंभ ू न े ुे पूल े के अाकाि की अाजध का उपय ग, सन जाजनयम के उद्देश् य र
उपबंध का प्रचार करन े के जलए दकया जा ुकता ू;ि
(x) ुंस्ट् थान, रिंगग की घटना घरटत ू न े के जलए अुिरज्षणत के रूप में न आात ुभी स्ट्थ ान की पूचान करेगा,
उ् ू ें उजचत ढंग ु ेप्रकािाान बनाएगा र उन पर जनकटता ु ेजनगरानी रखेगा;
(xi) यू ुिजनज त दकया जाना चाजूए दक ऐुे स्ट्थ ान क छ डकर, जूां अपररूाय ू , छािाााु र अ् य
्षणेि ुजूत मेजडकल कोलेज या ुंस्ट्थ ान के अंदर म बासल फ न सस्ट् तेमाल करन े के जलए जिंमग ्दद द्वारा
क ई बाधा नूीं ू गी;
(xii) यू जुफाररि की जाती ू ि दक पररुर, कम ुे कम रिंगग की घटनाओं के जलए अुरि ज्षणत ्षणेि की
मोनीटररग ाीजडय -जनगरानी के जररए की जाए;
(xiii) मेजडकल कोलेज या ुंस्ट्थ ान के ुंकाय ुदस्ट् य र स्ट् टाफ, सन जाजनयम के उद्देश् य क ब़ाााा देने के ल्य
ु,े ििज्षणक ाी के ्रंभ ुे पूले ु े ूी, छाि के दकुी जाजिष्टट भाग की क ई जािेी ्ाश्य कताएं पूरी
करने के जलए प्राेि व् यास्ट् थाए,ं जजनमें ाे िाजमल ू,ैं ज पूाा निमान लगाती ू,ैं पूचान करती ू ि र
य जना बनाती ू,ि मनजूद रखगें ;े
(xiv) प्रत् यके मेजडकल कोलेज या ुंस्ट्थ ान, काउंुंलग छाि के जलए उपलब् ध रून े ूते ,ि ििज्षणक ुि के प्रारंभण ु े
पूल े व् यााुाजयक काउंुलर या ्तं ररक काउंुलर , ज मनज दकत् ुा जाभाग म ें उपलब् ध ू , क
अजभजनय जजत करेगा या उनकी ुूायता प्राप् त करेगा;
(xv) मेजडकल कोलेज या ुंस्ट् थान, पूल े ुे ूी ऐु े ुंकाय ुदस्ट् य मटें र ुमनदि ेजित करने की प्रणाली तियार करेगा
ज छाि र उनके माता-जपता या अजभभााक के ुाथ जनयजमत रूप ुे ुंााद करेंगे;
(xvi) स्ट् थानीय पिजलु र प्राजधकाररय क , दाजखले की तारीख के ब् य रे र मेजडकल कोलेज या ुंस्ट् थान म ें
नामांदकत छाि द्वारा ्ााुीय उद्देश् य के जलए सस्ट् तेमाल दकए जाने ााल े प्रत् येक जनजी रूप ुे ााजणजज्यक
रूप म ेंप्रबंजधत छािाााु या लोज के पते उपलब्ध कराए जाएगं ;े
(xvii) रिंगग-प्रजतर धी दस्ट्त ा, छाि क दाजखल दकए जाने के पश् चात जनगरानी रखने म ें पया प् तत: ु्षणम बनने के
जलए पया प् त अ याु करेगा;
(xviii) ुंपक ब् य र के ुाथ एक रिंगग-प्रजतर धी जनयंिण क्षण स्ट्थ ाजपत दकया जाए तादक छाि, रिंगग की घटनाए ं
ुूजचत करन े र ्ाश् यकतानुि ार ुूायता प्राप् त करन े के जलए ददन या रात में दकुी भी ुमय जनयंिण

(xix) पया प् त र ुिद़ाृ ुंचार तंि लाग ू दकया जाएगा तादक यदद ्ाश् यकता पडती ू ि त मेजडकल कोलेज या
ुंस्ट् थान तत्क ाल र ुाथ ूी ुाथ ुंपक कर ुके र ुमिजचत पदाजधकाररय , जजला पदाजधकाररय र
पिजलु क ुंस्ट्थ ान के अंदर ुूचना पिन: प्रुाररत कर ुके;
(xx) ुांस्ट् थाजनक ाेबुासट में, रिंगग-प्रजतर धी अजधुूचनाएं, गजतजाजधयां र रिंगग की घटनाओं की ररप टें भी
तथा उन पर की गई कार ााई जनता के अजधकार ्षणेि के अंतग त प स्ट् ट करने की व् यास्ट् था ू नी चाजूए।
(2) दाजखला प्रद्रमया के ुमय मेजडकल कोलेज या ुंस्ट् थान द्वारा जनम् नजलजखत उपाय दकए जाएंगे, नामत:
(i) दाजखले के ुमय, जनम्न जलजखत अनिबंध म ें ददए गए प्रपि पर यू ाचनपि जलया जाएगा दक छाि दकुी
भी तरीके ुे रिंगग म ेंिाजमल नूीं ू गा:
(क) फाम । पर छाि द्वारा ाचनपि;
(ख) फाम ।। पर माता-जपता या अजभभााक द्वारा ाचनपि।
(ii) ज छाि, मेजडकल कोलेज या ुंस्ट् थान के पररुर के अंदर या पररुर के बाूर छािाााु में दाजखला
चाूते ू,ैं ाे जनम्न जलजखत अनबि ंध में ददए गए प्रपि पर यू ाचनपि दगें े दक छाि दकुी भी तरीके ु े
रिंगग म ेंिाजमल नूीं ू गा-
(क) फाम । पर छाि द्वारा ाचनपि;
(ख) फाम ।। पर माता-जपता/अजभभााक द्वारा ाचनपि।
(iii) दाजखले की ितयों म ें स्ट् कूल छ डने का प्रमाणपि या स्ट्थ ानांतरण प्रमाणपि या मासरी ेिन प्रमाणपि या चररि
प्रमाणपि, जिुा भी मामला ू , के रूप म ें क ई दस्ट् तााे श िाजमल ू गा, जजुमें ्ाेदक के व्य ाूार ुंबंधी
पिटन पर एक ररप ट िाजमल ू गी तादक सुके पश् चात मेजडकल कोलेज या ुंस्ट् थान दकुी ऐुे छाि पर
गून जनगरानी रख ुके जजुकी सु ुंबंध म ेंनकारात् मक प्रजाजो ू;ि
(iv) अपने पंजीकरण के ुमय प्रत् येक छाि, अ ययन के पा्यक्रमम में अ ययन करते ुमय, ्ााु के अपने स्ट् थान
के बारे में मेजडकल कोलेज या ुंस्ट् थान क ुूजचत करेगा र यदद छाि न े ्ााु का अपना स्ट् थान तय नूीं
दकया ू ि या सुे बदलने की सच्छ ा रखता ू ि त सुे तय करन े परतत्क ाल ्ााु के अपन े स्ट्थ ान के ब् य रे
उपलब् ध कराए जाएगं े र जािेी रूप ु े जनजी ााजणजज्यक रूप ुे प्रबंजधत लजज या छािाााु के ुंबंध
म,ें जूां उुने ्ााु जलया ू;ि
(v) ुंस्ट् थान म ेंदाजखल दकए गए प्रत्य ेक नए छाि क जनम्न जलजखत उपलब् ध कराए जाएगं े:
(क) दकुी भी ुमय ुूायता र माग दि न, यदद र जब कभी ्ाश् यक ू , के जलए उन व् यजतियय के
ब् य रे, जजनुे ुंपक दकया जा ुकता ू ि जिुे सन जाजनयम म ें उजल्लजखत रिंगग-प्रजतर धी ूल्े प लासन
या जनयंिण क्षण, ााड न, ुंस्ट् थान प्रमिख, रिंगग-प्रजतर धी दस्ट्त र ुजमजतय के ुदस्ट् य, ुंबंजधत
जजला र पिजलु प्राजधकारी;
(ख) उनके प्राेि र अजभमिखीकरण के जलए की गई व् यास्ट्थ ाओं के ब् य रे ज जपछले ाीयों में ुंस्ट्थ ान के
पूल े ुे दाजखल दकए गए छाि के ुाथ छाि के रूप म ें उ् ू ें पूरी तरू एकीकृत करन े के द्षण र
प्रभााी मा यम क ब़ाााा देती ू;ैं
(ग) मेजडकल कोलेज या ुंस्ट्थ ान के अुली छाि के रूप म ेंउनके अजधकार;
(घ) सु ुंबंध म ें स्ट् पष्टट जनद ि दक उ् ू ें अपनी सच् छा ुे या के जारुद्ध किछ करने ु े बाज ्ना चाजूए,
यदद ाररष्टठ छाि द्वारा ्देि भी ददया जाए र दक रिंगग करन े का क ई प्रयाु, तिरंत रिंगग-
प्रजतर धी दस्ट् ते या ााड न या ुंस्ट्थ ान प्रमिख, जिुा भी मामला ू , क ुूजचत दकया जाएगा;
(ङ) सु ुंबंध में जनद ि दक कम ुे कम एक जाजनर्ददष्ट ट अाजध के जलए उनके ुाथ क ई जाएगा र उ्ू ें
ुमिजचत ढंग ु े मोनीटर दकया जाएगा, यदद ाे दकुी ब डिंगडग ुिजाधा या भ जनालय या कैंटीन या
दकुी मन रंजन ुिजाधा जिुे व् यायामिाला में जान े के जलए अपने छािाााु पररुर छ डत े ूैं,
जािेी रूप ुे िाम क या रात में;
(च) ुभी फ्रेिर पूा अनिमजत प्राप् त करेंगे र ुंपक ब् य रे तथा छ डन े का ुमय र छािाााु म ें
प्रत् याजित ाापुी र सु प्रकार जाने के कारण उपलब् ध कराएंग,े यदद ाे दकुी कारण ुे जिु े
स्ट् थानीय अजभभााक के पाु जाना ्दद छािाााु र ुंस्ट् थान पररुर छ डत े ू।ैं[भाग III—खण् ड 4] भारत का राजपि : अुाधारण 7
3. दाजखला प्रद्रमया के पश् चात मेजडकल कोलेज या ुंस्ट् थान द्वारा जनम् नजलजखत उपाय दकए जाएंगे, नामत:
(i) फ्रेिु क , जूां तक ुंभा ू , एक अलग छािाााु ब् लोक या ंाग म ें ठूराया जाएगा र मेजडकल
कोलेज या ुंस्ट् थान यू ुिजनज त करेगा दक फ्रेिु क ्बंरटत ्ााु में ाररष्टठ छाि के प्रािे क , ााड न,
ुिर्षणा स्ट् टाफ र ुंस्ट् थान के अ् य स्ट् टाफ द्वारा ुख् ती ु ेमोनीटर दकया जाए;
(ii) मेजडकल कोलेज या ुंस्ट्थ ान, उु मेजडकल कोलेज या ुंस्ट् थान के ििज्षणक ााताारण ु े नए छाि क अागत
र पररजचत कराने ूते ि उनके जलए अलग अजभमिखीकरण काय ्रमम ्य जजत करेगा;
(iii) नए छाि क ्गमी जीान के जलए तियार करन े ूते ि उनकी काउंुंलग की जाएगी, जािेी रूप ुे
छािाााु में जीान के ुंबंध में र यथाुंभा, माता-जपता र अ यापक क भी सु काउंुंलग में
िाजमल दकया जाएगा;
(iv) मेजडकल कोलेज या ुंस्ट् थान, जनम्न जलजखत के जररए ाररष्टठ छाि के ुाथ अजभमिखीकरण काय ्रमम
बनाएगा-
(क) ुंयिटि त ुंरी ाूीकरण काय ्रमम र दकुी व् यााुाजयक काउंुलर द्वारा नए र ाररष्टठ छाि द न
की काउंुंलग;
(ख) ुांस्ट् कृजतक र खेलकूद द्रमयाकलाप के रूप म ेंाररष्टठ छाि के ुाथ ुंयिटि त जाचार-जामि;
(ग) ुद्रमय मोनीटररग, ुंकाय ुदस्ट् य , छाि ुलाूकार , ााड न र सुके ुदस्ट् य के रूप म ें किछ
ाररष्टठ छाि ुजूत ुमिजचत ुजमजतय द्वारा फ्रेिु , कजनष्टठ छाि र ाररष्टठ छाि के बीच
स्ट् ास्ट् थ जाचार-जामि क ब़ाााा देना र जाजनयजमत करना।
(v) फ्रेिु क ुंकाय ुदस्ट् य ्बंरटत दकए जाएंगे, ज मेंटु के रूप में काय करेंगे, जिुादक जाजनयम 14 के
अंतगत दिा या गया ू;ि
(vi) मेजडकल कोलेज या ुंस्ट्थ ान, अपनी स्ट् ायं की जनम्न जलजखत अजतररटित पद्धजतयां तियार कर ुकते ू ैं र
रिंगग का जनीेध र र कथाम करन े के जलए सु अ याय के जाजभ् न उपबंध म ें उपबंजधत र ुभी
्ाश् यक उपाय लागू करेगा, जजुुे, तत्ु मय प्राृत् त, ज लाग ू ू , ुंबंजधत कानून ुजूत उच् चतर जि्षणण
ुंस्ट् थान में रिंगग के खतरे क जनयंजित करने पर जाश् ाजा्ालय अनदि ान ्य ग जाजनयमााली, 2009
र सन जाजनयम के उपबंध का उद्देश् य परू ा ू ुके:
(क) ुभी ्ाश् यक ुजमजतयां, कमी, उपाय र य जनाएं लागू की जाएंगी र ितें काया ज्ात करने के
जलए परू ी तरू काया त् मक ू गी तथा एक-दुू रे के ुाथ ुम्ा य करेंगी;
(ख) छाि , फ्रेिु र ाररष्टठ छाि , माता-जपता, ुंकाय ुदस्ट् य र अ् य ुभी स्ट् टाफ क , रिंगग-
प्रजतर धी जाजनयम के उपबंध की पया प् तत: ुूचना दी जाएगी;
(ग) छािाााु र कैंटीन ्षणेि पर जािेी बल देन े के ुाथ, ुभी ुंबंजधत द्वारा ूर ुमय ुख् त
जनगरानी रखी जाएगी;
(घ) 24 घंटे चक जांच,ें गिप् त ुा्षण ण र अनििाुजनक उपाय क ुख् ती ुे लाग ूदकया जाएगा;
(ङ) प्रत् य्षण रूप ु े या जनयंिण क्षण अथाा ूल्े पलासन के जररए ुंस्ट् थान प्रमिख, ुंकाय ुदस्ट् य, रिंगग-
प्रजतर धी दस्ट् त,े रिंगग-प्रजतर धी ुजमजत के ुदस्ट् य , छािाााु ााड न र अ् य स्ट् टाफ के ुंपक
नंबर की उपलब् धता के जररए रिंगग की घटनाएं र अजप्रय घटनाएं, ुंकट, फ्रेिु की करठनासयां
ुूजचत करने की ्ुान ुिगम् यता ू गी;
(च) जजला प्रिाुन र पिजलु के िीघ्र र तत्क ाल ूस्ट्त ्षणपे , यदद ्ाश् यकता पडती ू,ि के जलए उनके
ुाथ एक स्ट्थ ाजपत ुंुूचन प्रचालनरत प्र ट क ल ू गा;
(छ) यू ुंदेि र मंिा ुिस्ट्प ष्टट ू गी दक ुंस्ट् थान के ुभी छाि र स्ट् टाफ के जलए, रिंगग की प्रत् येक
घटना की ुूचना दने ा अजनााय ू ि र दक रिंगग के प्रत् येक मामले पर, सन जाजनयम के उपबंध
र तत्ु मय प्राृत् त लागू ू न ेााले कानून के अनिुार कार ााई की जाएगी;
(vii) मेजडकल कोलेज र ुंस्ट्थ ान, पूल े ु े जनज त दकए गए अंतराल पर, ज छाि के दाजखल े के पश् चात
पूले तीन मूीन े के जलए ुाप् ताजूक ू ुकते ू,ैं जाश् ाजा्ालय क ुभी रिंगग-प्रजतर धी उपाय , रिंगग8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
की घटनाओं, ् यायालय के जनद ि के ुंबंध में ररप ट उपलब्ध कराएंग,े जिुादक जाजनयम 17 में उपबंजधत
ू;ि
(viii) मेजडकल कोलेज या ुंस्ट् थान, ्य ग क , फाम ।।। में ददए गए प्रपि पर अनपि ालन ररप टें, रिंगग-प्रजतर धी
उपाय , रिंगग की घटनाओं, उन पर की गई कार ााई ् यायालय के जनद ि के ुंबंध म ें ररप टें उपलब् ध
कराएगा, जिुादक जाजनयम 18 में उपबंजधत ू;ि
(ix) ऊपर उजल्लजखत उपाय न त व्य ापक ू ैं र न ूी पूण र मजे डकल कोलेज या ुंस्ट्थ ान, सन जाजनयम के
जभ् न-जभ् न उपबंध म ें यथा उपबंजधत उपाय का उपय ग कर ुकता ू ि र उनके अलााा, केाल ना
पररात न लाने र ऐुे उपाय तियार करन े के जलए ूी प्र त् ुाजूत नूीं करता ज रैंंगग की घटनाओं का
जनीेध करन,े र कथाम करने र पूचान करने म ें ुूायता करन े के प्रयाु में ाृजद्ध करेंगे, बजल्क अ् य
मेजडकल कोलेज या ुंस्ट् थान म ेंकाया ् ायन ूते ि अपन े ुंबद्ध जाश् ाजा्ालय क उजचत ुिझाा भी देंगे।
(4) ििज्षणक ाी के अंत में मेजडकल कोलेज या ुंस्ट् थान द्वारा जनम् नजलजखत उपाय दकए जाएंगे, नामत:-
(i) प्रत् यके ििज्षणक ाी के अंत म,ें ुंस्ट् थान प्रमिख या डीन ऐुे छाि के माता-जपता या अजभभााक क एक पि
भेजेगा ज अपना प्रथम ाी परू ा कर रू ेू,ैं जजुमें उ् ू,ें अगल े ििज्षणक ुि के ्रंभ में मेजडकल कोलेज या
ुंस्ट् थान में लनटने पर रिंगग में जलप् त ू ने ुे उनके ्जश्रत छाि क बाज ्ने पर ज र देने के जलए, सन
जाजनयम र तत्ु मय लागू दकुी अ् यकानून का स्ट् मरण ददलाया गया ू;ि
(ii) प्रत् यके ििज्षणक ाी के अतं म ें मेजडकल कोलेज या ुंस्ट् थान एक मेंटररग ुजमजत या मेंटररग क्षण गरठत करेगा,
जजुमें ्गमी ििज्षणक ाी के जलए मेंटु ू ग,े जिुादक जाजनयम 14 म ेंउपबंजधत ू।ि
8. मासरी िे न प्रमाणपि, स्ट्थ ानातं रण प्रमाणपि र ्चरण प्रमाणपि जारी करना –मेजडकल कोलेज या ुंस्ट् थान द्वारा छाि क
जारी दकए गए मासरी ेिन प्रमाणपि, स्ट् थानांतरण प्रमाणपि या ्चरण प्रमाणपि, जिुा भी मामला ू , में ुामा् य ्चरण र
व् याूार ुे ुंबंजधत प्रजाजो के अलााा सु ुंबंध में प्रजाजो ू गी दक टि या उु छाि क रिंगग करने या उुके जलए उकुाने के जलए
दजं डत दकया गया ू िया नूीं र सु ुंबंध में भी प्रजाजो ू गी दक टि या छाि ने जनरंतर ंूुक या ््रमामक व् याूार या अ् य क ूाजन
पए चं ाने की प्राृजय दिा यी ू।ि
9. फ्रेिु र ाररष्ट ठ के बीच स्ट्ा स्ट् थ जाचार-जामि प्र त्ु ाजूत करन ेके जलए उपाय –फ्रेिु र ाररष्ट ठ के बीच स्ट् ास्ट् थ जाचार-
जामि प्र त् ुाजूत करने के जलए मेजडकल कोलेज या ुंस्ट् थान द्वारा जनम् नजलजखत उपाय दकए जाएंगे, नामत:-
(i) ुंस्ट् थान, फ्रेिु र ाररष्टठ छाि के बीच स्ट् ास्ट्थ जाचार-जामि क ुद्रमय रूप ु े मोनीटर करने, ब़ाााा
देने र जाजनयजमत करन े के जलए निदाजनक-पूा ाीयों ु े ुंकाय ुदस्ट् य , छाि के प्रजतजनजधय , ााड न र
किछ ाररष्टठ छाि क िाजमल करते ए ए ुमिजचत ुजमजतयां गरठत करेगा;
(ii) फ्रेिु स्ट् ाागत पाटियटया,ं एक-दुू रे के ुाथ उजचत पररचय के जलए ारीयत: ििज्षणक ुि ्रंभ ू ने के पूल े
द ुप् ताू के अंदर ाररष्टठ छाि र ुंकाय ुदस्ट् य द्वारा एक ुाथ ुांस्ट्थ ाजनक या जाभागीय स्ट्त र पर
्य जजत की जाएंगी र जूां फ्रेिु की प्रजतमाएं, ुंकाय ुदस्ट् य की मनजूदगी में उजचत ढंग ुे ुामन े
लाई जाएगं ी, सु प्रकार ूीन भााना, यदद क ई ू,ि छ ड देन े र अंतबा धा दरू करन े म ें उनकी ुूायता
करेंगी;
(iii) ुंस्ट् थान, मेजडकल कोलेज र ुंस्ट् थान के ुमिजचत मामल म ें फेिु र ाररष्टठ छाि द न क िाजमल
करके छाि-ुंकाय ुदस्ट् य जाचार-जामि म ें ाृजद्ध करेगा जिुे पा्यकचया तियार करना, पा्यकेतर द्रमयाकलाप
र ुांस्ट् थाजनक ुमार ू, तादक छाि यू मूुूु कर ुकें दक ाे ुंस्ट्थ ान के मामल का प्रबंधन करने म ें
जजम् मदे ार ुाझेदार ू।ैं
10. रिंगग के प्रजत ुस्ट्ं थ ान के कमच ाररय र स्ट्ट ाफ का ुां ेदीकरण –रिंगग के प्रजत ुंस्ट् थान के कम चाररय र स्ट् टाफ के
ुंाेदीकरण के जलए मेजडकल कोलेज या ुंस्ट् थान द्वारा जनम् नजलजखत उपाय दकए जाएंगे, नामत:-
(i) मेजडकल कोलेज या ुंस्ट्थ ान के ुंकाय ुदस्ट् य र कम चाररय , चाू े ाे जनयजमत ू या अस्ट् थायी, र
ुंस्ट् थान के अदं र ुेाा प्रदान करने ााले ुेाा प्रदाता के कम चाररय ुजूत ुभी स्ट् तर र प्राजधकरण के
ागयों तथा काय कता ओं की यू ुामान् य ुामूजूक जजम् मेदारी ू गी दक ाे रिंगग घरटत ू ने या रिंगग की

श्रजमक , चाू े ाे कैंटीन चलाने के जलए ू या जनगरानी या ुरि ्षणा स्ट् टाफ ू या भान या लोन की ुफाई
या अनरि ्षणण के जलए ू र मजे डकल कोलेज या ुंस्ट्थ ान के अदं र ुेााएं प्रदान करन े ााल े ुाे ा प्रदाताओं[भाग III—खण् ड 4] भारत का राजपि : अुाधारण 9
के कम चाररय क रिंगग के प्रभाा र रिंगग-प्रजतर धी ु े ुंबंजधत सन जाजनयम के जाजभ् न उपबंध
र ुंबंजधत मानााजधकार के गणि -द ी जााेचन तथा िारीररक दडं के प्रजत ुंाेदीकरण ु े ुंबंजधत
जाीय पर सनपिट र छाि के बीच डराने-धमकाने क र कने के ुंबंध में ुेाेदनिील बनाएगा तादक
प्रत् यके अ यापक, काउंुंलग दजृ ोक ण के कम ुे कम मूल तत्ा पर कार ााई करन े के जलए ुाधन ुम् प् न
ू ुके;
(iii) कैंटीन या भ जनालय के जनय टित ाओं या कम चाररय क ्ाश् यक जनदि ददए जाएंग े दक ाे रिंगग की
घटनाओं पर ुख् त जनगरानी रखें र कोलेज प्राजधकाररय क सनकी ुूचना दें;
(iv) छािाााु के ुंजादात् मक कम चाररय र जनगरानी या ुिर्षणा स्ट् टाफ ुजूत ुभी ुांस्ट् थाजनक कम चाररय
र स्ट् टाफ क , रिंगग जनयंजित करने की ुांस्ट्थ ाजनक य जनाओं ुे उपयिटि तत: अागत कराया जाएगा र
ुपपी गई ड्यूरटयां स्ट् पष्टट की जाएंगी.
(v) ुंजादात् मक कम चाररय ुजूत ुभी ुांस्ट् थाजनक कम चाररय र स्ट् टाफ के जलए यू अजनााय ू गा दक ाे
एक ाचनपि द ें दक ाू रिंगग के दकुी मामले, ज उुकी जानकारी में ्ता ू,ि की ुूचना तरि ंत दगे ा;
(vi) मेजडकल कोलेज या ुंस्ट्थ ान के ुभी कम चाररय क जनद ि ददया जाएगा दक ा े काय के अपन े ्षणेि म ें ुख् त
जनगरानी रखें र ्ाश् यकता के अनिुार रिंगग की घटनाओं की ुूचना ुमिजचत प्राजधकाररय क दें;
(vii) मेजडकल कोलेज या ुंस्ट् थान, प्रिंुा प्रमाणपि जारी करके, उ् ू ें ुम् माजनत करके र उनके ुेाा ररकाडयों
में उजचत प्रजाजोयां करके, रिंगग की घटनाओं की ररप र्टटग जिुे रिंगग-प्रजतर धी द्रमयाकलाप क
प्र त् ुाजूत करने के जलए कम चाररय का ुम् मान करन े र उ्ू ें पिरस्ट् कृत करने की व् यास्ट् था करें।
11. ुास्ट्ं थ ाजनक ुजमजतया ं र ुबं जं धत उपाय:- (1) प्रत् येक मेजडकल कोलेज या ुंस्ट् थान, जनम् नजलजखत ुजमजतयां गरठत करेगा
र उच् चतर जि्षणण ुंस्ट् थान में रिंगग के खतरे क जनयंजित करने पर जाश् ाजा्ालय अनिदान ्य ग जाजनयमााली, 2009 के
जाजनमय 6.3 र सन जाजनयम में उपबंजधत ुंबंजधत उपाय करेगा।
(2) मेजडकल कोलेज या ुंस्ट् थान एक रिंगग-प्रजतर धी ुजमजत गरठत करेगा।
(3) रिंगग-प्रजतर धी ुजमजत में म टे तनर पर जनम् नजलजखत ुदस्ट् य ू गे। यू ुंस्ट् थान प्रमिख द्वारा जाजधात् गरठत ू गी र सुमें
जभ् न-जभ् न स्ट्त र र जेंडर के व् यजतियय का एक जाजाध जमश्रण ू गा, नामत:
(i) ुंस्ट् थान प्रमिख;
(ii) ुंकाय ुदस्ट्य के प्रजतजनजध;
(iii) फ्रेिु श्रणे ी ुंबंजधत छाि के प्रजतजनजध;
(iv) ाररष्टठ छाि के प्रजतजनजध;
(v) माता-जपता के प्रजतजनजध;
(vi) गिर-अ यापन स्ट् टाफ के प्रजतजनजध;
(vii) जुजाल र पिजलु प्रिाुन के प्रजतजनजध;
(viii) स्ट् थानीय मीजडया के प्रजतजनजध;
(ix) यिााओं के द्रमयाकलाप म ेंिाजमल गिर-ुरकारी ुंगठन।
(4) रिंगग-प्रजतर धी ुजमजत की ड्यूरटय में जनम् नजलजखत ड्यूरटयां िाजमल ू गी, परंति ये स् ूीं तक ुीजमत नूीं ू गी:-
(i) मेजडकल कोलेज या ुंस्ट्थ ान के रिंगग-प्रजतर धी द्रमयाकलाप की ुमरी मोनीटररग;
(ii) सन जाजनयम र तत्ु मय लागू दकुी अ् य कानून द न के रिंगग ुे ुंबंजधत उपबंध का अनिपालन
ुजि नज त करना;
(iii) रिंगग-प्रजतर धी दस्ट्त े के द्रमयाकलाप की मोनीटररग;
(iv) रिंगग, यदद क ई ू , की ररप टयों की जांच-पडताल करना या सु उद्देश् य के जलए गरठत ुजमजतय का
अनिम दन करना;
(v) रिंगग का जनीधे र र कथाम करन े के जलए मेजडकल कोलेज या ुंस्ट् थान द्वारा दकए गए उपाय के ुिधार

12. रिंगग-प्रजतर धीदस्ट्त ा –(1)ुंस्ट् थान एक रिंगग-प्रजतर धी दस्ट् ताा गरठत करेगा।
(2) ुंस्ट् थान प्रमिख द्वारा गरठत रिंगग-प्रजतर धी दस्ट् ते में म टे तनर पर ााड न र अ् य स्ट् टाफ, ज ्ाश् यक ू , ुजूत ुंकाय
ुदस्ट् य र छािाााु का स्ट् टाफ ू गा र मजूला छािाााु के जलए जनधा ररत ुदस्ट् य के ुाथ रिंगग-प्रजतर धी दस्ट् ते में जेंडर का एक
जााेकपूण जमश्रण ू गा।
(3) रिंगग-प्रजतर धी दस्ट् ते की ड्यूरटय में जनम् नजलजखत ड्यूरटयां िाजमल ू गी परंति ये स् ूीं तक ुीजमत नूीं ू गी:-
(i) ड्यूटी र स्ट् टर का पालन करना, यदद तियार दकया गया ू;ि
(ii) ूर ुमय ुतक र फिरतीला बने रूना र ्ाश् यक ब् य रे भी उपलब् ध कराना तादक ुदस्ट्य , फ्रेिु र
अ् य छाि द्वारा भी ्ुानी ु ेपए चं य ् य ू ुके;
(iii) जाीम ुमय पर भी छािाााु , ब डिंगडग ्षणेि , खेल के मिदान र परराून ुिजाधाओं तथा अ् य ्षणेि म ें
चक जांच करना, जजुके जलए रिंगग-प्रजतर धी दस्ट् त े क जाजधात् िजतिय प्रदान की जाएगी;
(iv) ाररष्टठ छाि द्वारा सन जाजनयम के अनपि ालन के ुंबंध में जााेकपूण जांच करना;
(v) मेजडकल कोलेज या ुस्ट्ं थान द्वारा बनाई गई रूपरेखा के अनिुार रिंगग की ररप ट न दकए जाने की
ुंभााना ााली घटनाओं का पता लगान े के जलए गिप् त ुा ्षणण करना ज यादजृ च्छक ू ;
(vi) ुंभाजात रिंगग के अप्रत्य ्षण ुा्य या दकुी च ट के जलए फ्रेिु की जांच करना, जिुे ददन के दनरान
जागते रून े म ें अुमथत ा जजुुे पूरी रात रिंगग की ुंभााना का ुंकेत जमलता ू या रिंगग के डर के
कारण ु ने म ेंअुमथ ता;
(vii) अुिरज्षणत ्षणेि , जिुे फ्यूज ू गए बल् ब ्दद के कारण अधं ेरे स्ट् थान , क ठीक करने के जलए ुंबंजधत
प्राजधकाररय क ुूजचत करना;
(viii) रिंगग की घटनाओं पर तत्क ाल र अ् य ्ाश् यक जांच करना र रिंगग-प्रजतर धी ुजमजत क ुूजचत
करना;
(ix) ुंस्ट् थान प्रमिख र अ् य प्राजधकाररय क रिंगग के ुभी मामल की ुूचना देना, जिुा भी अपेज्षणत ू ;
(x) दकुी रजजस्ट् टर म ें अ यिजतियय या जनष्टक ीयों , यदद क ई ू , ुजूत जांच करन े के ुमय र ब् य र के ुंबंध म ें
प्रजाजोयां करना।
13. रिंगग-प्रजतर धी जनयिं ण क्षण या ूल्े प लासन –(1) मेजडकल कोलेज या ुंस्ट् थान, सन जाजनयम के उपबंध का अनिपालन
ुिजनज त करने के उद्देश् य के जलए रिंगग-प्रजतर धी जनयंिण क्षण या ूल्े पलासन स्ट् थाजपत करेगा।
(2) यू बेूतर ूि दक रिंगग-प्रजतर धी जनयंिण क्षण छािाााु पररुर के अंदर या जनकट जस्ट्थत ू , जजुमें 24 घंटे व् यजतिय मनजूद
ू र दाजखले के ुमय ुभी छाि र उनके माता-जपता क ुंपक नंबर उपलब् ध कराए जाएंगे।
(3) रिंगग-प्रजतर धी जनयंिण क्षण या ूल्े पलासन, रिंगग की घटनाओं ुे उत् प् न ुभी ्पातकाजलक जस्ट्थजतय के जलए एक एकल
स्ट् थान ुंपक स्ट् थान ू ुकती ू ि र कोल प्राप्त ू ने पर ्ाश् यक ुूचना, ुिर्षणा र पिजलु ुजूत ुमिजचत कज्ञमय क तिरंत प्रुाररत
की जाएगी र ुाथ ूी ुाथ पिन: प्रुाररत की जाएगी।
14. मटें ररग ुजमजत या मटें ररग क्षण –(1) मेजडकल कोलेज या ुंस्ट् थान, सन जाजनयम के उद्देश् य क ब़ाााा दने े की दजृो ुे, प्रत् येक
ििज्षणक ुि के अंत में एक मेंटररग ुजमजत या मेंटररग क्षण गरठत करेगा।
(2) मेंटररग ुजमजत या मटें ररग क्षण ऐुे ुंकाय ुदस्ट् य की एक ुूची तियार करेगा, ज मेंटररग प्रद्रमया में ाालंरटयर ू ुकते ू।ैं
(3) यदद ऐुी सच् छा ू या कजनष्ट ठ मेंटर के एक ुमूू के ुाथ मेंटररग की प्रणाली की क जिि की जा ुकती ू ि या श्रेणीकरण
दकया जा ुकता ूि, जजुका पय ाे्षणण या जनगरानी एक एकल ाररष्ट ठ मेंटर द्वारा की जा ुकती ू।ि
(4) प्रत् येक मेंटर के अधीन छाि की ुंख्य ा, मेजडकल कोलेज या ुंस्ट् थान द्वारा ुमिजचत ढंग ुे तय की जा ुकती ूि परंति जूां तक
ुंभा ू , यू ुंख् या 6 ुे अजधक नूीं ू नी चाजूए।
(5) मेंटर के काय म टे तनर पर जनम् नजलजखत ू गे, नामत:
(i) मेजडकल कोलेज या ुंस्ट्थ ान म ें फ्रेिर द्वारा ुामना की जा रूी ुमस्ट्य ाओं या करठनासय , यदद क ई ू , का
पता लगान े के जलए ूर ददन मटें ी फ्रेिर छाि के ुाथ एक एक करके जाचार-जामि करेगा;
(ii) सन पर पार पान े में फ्रेिर क ्ाश् यक ुूायता प्रदान करेगा;[भाग III—खण् ड 4] भारत का राजपि : अुाधारण 11
(iii) छािाााु के कमर के अचानक दनरे करेगा, जूां ुमूू का/के ुदस्ट् य ठूरा ए ्/ठूरे ए ए ू;ैं
(iv) छाि द्वारा ुामना की जा रूी ुमस्ट्य ाओं पर चचा करने र ुमाधान उपलब् ध करान े के जलए मेंटी के
माता-जपता या अजभभााक के ुाथ जाचार-जामि करेगा;
(v) अपन ेजनयंिणाधीन फ्रेिर के ुाथ अपने जाचार-जामि की एक डायरी रखेगा;
(vi) ुंकाय ुदस्ट्य मेंटर के पय ाे्षणणाधीन ाररष्टठ छाि की मेंटररग प्रद्रमया म ेंिाजमल दकया जा ुकता ू।ि
15. छाि मामल े या छािाााु ुजमजत –(1) मेजडकल कोलेज या ुंस्ट् थान, दकुी ाररष्ट ठ ुंकाय ुदस्ट् य के अधीन छािाााु के
मामल की दखे भाल करने के जलए एक अलग छाि मामले या छािाााु ुजमजत रखेगा ज छािाााु के मामल पर न शर रखेगा।
(2) जाजनयम 16 में उजल्लजखत नामजद ााड न छाि मामले या छािाााु ुजमजत के अधीन काय कर ुकते ू ैं ज छािाााु ुे
ुंबंजधत ुभी रिंगग प्रजतराधी उपाय क काया ज्ात र ुम् ाय करने में एक मूत् ापूण भूजमका जनभाएगी।
16. ााड न –(1)छािाााु ााड न, छािाााु में छाि के प्रिाुजनक काययों की दखे भाल करने, ब डिंगडग र लोंजग का पय ाे्षणण
करने र यू ुिजनज त करने के जलए जनयिटित या नामजद दकया गया एक व् यजतिय ू ि दक लागू ू ने ााले जनयम र जाजनयम का
पालन दकया गया ूि।
(2) ााड न, जाश् ाजा्ालय अनिदान ्य ग या ुंबंजधत जाश् ाजा्ालय या राज्य ुरकार या मेजडकल कोलेज या ुंस्ट् थान द्वारा
जाजनधा ररत पािता मापदडं के अनिुार जनयिटित दकए जाएंगे।
(3) ााड न की ुूायता, उप-ााड न या ुूायक ााड न द्वारा की जा ुकती ूि, ज ााड न के पय ाे्षणणाधीन उुी प्रकार की
ड्यूरटयां करेंगे।
(4) ााड न, छाि मामले या छािाााु ुजमजत के अधीन या मेजडकल कोलेज या ुंस्ट् थान द्वारा यथा अनिम ददत तरीके ुे काय कर
ुकता ू।ि
(5) ााड न की, मेजडकल कोलेज या ुंस्ट् थान के रिंगग-प्रजतर धी प्रयाु में जनभाने के जलए एक अजनााय र मूत् ापूण भूजमका
ू गी टि य दक छािाााु अुिरज्षणत ्षणेि ूि, जािेी रूप ुे ुामा् य जि्षणण ुमय के पश् चात, जब छािाााु म ेंफ्रेिु र ाररष्ट ठ छाि
की एक-दुू रे का ुामना करने की ुंभााना ू ती ू।ि
(6) ााड न ूर ुमय पए चं य ्य ू गे र उ् ू ेंम बासल फ न उपलब् ध कराए जाएंगे।
(7) मेजडकल कोलेज या ुंस्ट् थान, ााड न र रिंगग के खतरे क जनयंजित करने में िाजमल ााड न र प्राजधकाररय की िजतियय
की ुमी्षणा करेगा र उनमें उपयिटि तत: ाृजद्ध करेगा।
(8) मेजडकल कोलेज या ुंस्ट् थान, रिंगग-प्रजतर धी उपाय के जलए छािाााु में ुिर्षणा कज्ञमय क जनयंजित करने के जलए ााड न
क ुिटित करेगा।
17. जाश्ा जा्ालय के कत्त व् य र जजम्म ेदाररया ं –(1) मेजडकल कोलेज या ुंस्ट् थान का ुंचालन करने ााला प्रत् येक
जाश् ाजा्ालय, उच् चतर जि्षणण ुंस्ट् थान में रिंगग का खतरा जनयंजित करने पर जाश् ाजा्ालय अनिदान ्य ग जाजनयमााली, 2009
में ददए गए उपबंध के ्धार पर रिंगग क जनयंजित करने के जलए अपने स्ट्ा यं के जाजनयम बना ुकता ू।ि
(2) ुमरी मोनीटररग, ुमी्षणा करने र ुंबद्ध कोलेज में रिंगग के जनीेध र र कथाम के जलए ुभी ुिुंगत जाजनयम र
तत् ुमय लागू अ् य कानून का अनिपालन ुिजनज त करने के जलए जजम् मेदार ू ने के नाते प्रत् येक जाश्ा जा्ालय, उन मेजडकल कोलेज
या ुंस्ट् थान की न डल एजेंुी के रूप में काय करेगा ज उुुे ुंबद्ध ू।ैं
(3) प्रत् येक जाश् ाजा्ालय में एक मोनीटररग ुजमजत ू गी ज ुंबद्ध मेजडकल कोलेज या ुंस्ट् थान की ुभी रिंगग-प्रजतर धी
द्रमयाकलाप के काया ् ायन पररााूक ू गी।
(4) उप-जाजनयम (3) में उजल्लजखत मोनीटररग ुजमजत –
(i) ुूी अथ म ेंजनयजमत रूप ुे सन जाजनयम के उपबंध का अनपि ालन ुिजनज त करेगी;
(ii) जनम्न जलजखत ुे ुंबंजधत द्रमयाकलाप की जनगरानी र मोनीटररग करेगी:
(क) रिंगग-प्रजतर धी ुजमजत, रिंगग-प्रजतर धी दस्ट् त े र मेंटररग ुजमजत या मेंटररग क्षण;
(ख) रिंगग-प्रजतर धी जाजनयम र कानून का प्रुार;
(ग) अजभमिखीकरण काय ्रमम का ्य जन;

(ङ) ुंघटक कोलेज या ुंस्ट्थ ान ुे प्राप् त रिंगग ु े ुंबंजधत जांच-पडताल की ररप टयों की ुमी्षणा र
अनिम दन करना;
(च) अ याय IV के उपबंध के अंतग त यथा उपबंजधत, मेजडकल कोलेज या ुंस्ट् थान द्वारा रिंगग की
घटनाओं की जांच-पडताल;
(छ) मेजडकल कोलेज या ुंस्ट्थ ान द्वारा ुिधार के जलए ुिझाा का काया ् ायन; र
(ज) क ई अ् य ऐुा द्रमयाकलाप, ज ुमय-ुमय पर ्ाश् यक ू ।
(5) प्रत् येक जाश् ाजा्ालय अपने ुंबद्ध मेजडकल कोलेज या ुंस्ट् थान के ुंबंध में रिंगग की घटनाओं ुे ुंबंजधत ुभी जनण य या
्दिे के जलए एक अपीलीय जनकाय के रूप में काय करेगा, जिुादक जाजनयम 25 के अंतग त उपबंजधत ू।ि
(6) जाश् ाजा्ालय, अपने ुंबद्ध मेजडकल कोलेज या ुंस्ट् थान के रिंगग-प्रजतर धी उपाय की जनयजमत रूप ुे ुमी्षणा करेगा।
(7) जाश् ाजा्ालय, ्य ग र राज्य ुरकार या केंद्र ुरकार, ज भी ुमिजचत ू , क ुूजचत करते ए ए ऐुे अनिपालन के जलए,
सुुे ुंबद्ध चूककता मेजडकल कोलेज या ुंस्ट् थान के जारुद्ध उजचत कार ााई, ज ्ाश् यक ू , करेगा जजुमें जनम् नजलजखत िाजमल
कार ाासयां िाजमल ू ुकती ूैं, परंति स् ूीं तक ुीजमत नूीं ू:ैं-
(i) ुंबद्धता या मा् यता या प्रदान दकया गया जािेीाजधकार की ाापुी; या
(ii) ऐुे मेजडकल कोलेज या ुंस्ट्थ ान का, जाश् ाजा्ालय की क ई जडरी ी या जडप् ल मा प्रदान करने के जलए उुम ें
अ ययन के दकुी काय ्रमम में उु ुमय अ ययनरत दकुी छाि या छाि क उपजस्ट्थत ू ने ुे जनीेध
करना; या
(iii) मेजडकल कोलेज या ुंस्ट्थ ान क ददए जाने ााल ेअनदि ान की ाापुी; या
(iv) रिंगग की घटनाओं र मेजडकल कोलेज या ुंस्ट् थान द्वारा उन पर की गई कार ाासय ुजूत अनिपालन क
ाेबुासट पर डालना; या
(v) उु जाश् ाजा्ालय के जनयम र जाजनयम के अतं गत उपबजं धत क ई अ् य कार ााई, ज उजचत ुमझी
जाए।
(8) जाश् ाजा्ालय, एक ुिुाय कता की भूजमका जनभाएंगे र मेजडकल कोलेज या ुंस्ट् थान में रिंगग के जनीेध र र कथाम
क अजधक प्रभााी बनाने के जलए उपाय काया ज्ात करने ूते ि, उनुे ुंबि मेजडकल कोलेज या ुंस्ट् थान क ुिझाा प्रदान करेंगे।
(9) रिंगग की घटनाओं ुे ुंबंजधत ुभी ररप टें र उनकी अपीलें, ्य ग क उपलब् ध कराई जाएंगी।
(10) प्रत् येक जाश् ाजा्ालय, ्य ग के ुाथ ुम् ाय रखेगा, जािेी रूप ुे जब ुंस्ट् थान , पा्यक्रमम र जडजरी य की जामा् यता
ुे ुंबंजधत दंडात् मक उपाय ुे सुका ुंबंध ू टि य दक जचदकत् ुा जि्षणा र प्रजि्षणण के किछ पूलू, अजधजनयम के उपबंध के अंतग त
जाजनयजमत ू ते ू।ैं
18. ्य ग के कत्त व् य र जजम्म दे ाररया ं –(1) ्य ग, उन जाजनयम के उपबंध के काया ् ायन र अनिपालन के ुंबंध में, उन
जाश् ाजा्ालय , जजनुे ाे ुंबद्ध ूैं, के जररए मेजडकल कोलेज या ुंस्ट् थान क मोनीटर करेंगे।
(2) प्रत् येक मेजडकल कोलेज या ुंस्ट् थान, फाम ।।। में ददए गए प्रपि पर ूर ाी ्य ग क एक अनिपालन ररप ट प्रस्ट् तित करेगा।
(3) ्य ग, मेजडकल मूल् यांकन एां रेरटग ब ड द्वारा मा् यता जनरी्षणण या मूल् यांकन के दनरान अनिपालन की ुमी्षणा करेगा।
(4) ् यायालय ुे अपील के पररणाम र जनदि , यदद क ई ू , ुजूत रिंगग की ुभी घटनाएं र उनकी ररप टें, मेजडकल
कोलेज या ुंस्ट् थान द्वारा र उु जाश् ाजा्ालय, जजुुे ाे मेजडकल कोलेज या ुंस्ट् थान ुंबद्ध ूैं, द्वारा ्य ग क उपलब् ध कराई
जाएगी।
(5) यदद क ई मेजडकल कोलेज या ुंस्ट् थान, सन जाजनयम का अनिपालन करने र रिंगग क जनयंजित करने में जाफल रूता ू ित
्य ग, ुमिजचत कार ााई, ज उजचत ुमझी जाए, करेगा, जजुमें जनम् नजलजखत िाजमल ू िपरंति स्ू ीं तक ुीजमत नूीं ूि, नामत:-

19. ्य ायालय –् यायालय, यू ुिजनज त करने का प्रयाु कर ुकते ूैं दक रिंगग ााले मामले प्राथजमकता के ्धार पर जलए
जाएं तादक ुूी ुंदिे भेजा जा ुके दक रिंगग क केाल ूत त् ुाजूत ूी नूीं दकया जाना चाजूए बजल्क सु पर कठ रता ुे कार ााई
की जानी चाजूए।

रिंगग की घटनाओं पर कार ााई करना
20. अनिि ाुजनक मामल का ुमाधान ुस्ट्ं थ ान के पररुर के अदं र दकया जाना चाजूए –अनििाुन के ुभी मामल का
ुमाधान, उु मजेडकल कोलजे या ुस्ट्ं थ ान के पररुर के अदं र दकया जाना चाजूए, जुााय ऐु ेमामल के, जजनम ेंकाननू र व्य ास्ट्थ ा
का अजत्रममण ू या िांजत अथाा ल क िांजत भंग ू ती ू जजु पर तत् ुमय लागू दांजडक कानून के अंतग त कार ााई की जा ुकती ूि।
21. रिंगग की घटनाओं की ररप र्टटग– (1) रिंगग की प्रत् येक घटना की ुूचना दने ा ुभी ुंबंजधत के जलए अजनााय ू।ि
(2) यूां तक दक दकुी फ्रेिर द्वारा भी रिंगग की दकुी घटना की ुूचना न दने े क गंभीरता ुे जलया जाएगा र सुका अथ
रिंगग के जलए उकुाना ू ुकता ू।ि
(3) रिंगग की दकुी घटना की ररप ट जिकायत, जनम् नजलजखत द्वारा की जा ुकती ू:ि-
(i) क ई फ्रेिर या माता-जपता या अ् य छाि; या
(ii) छािाााु के प्राजधकारी, ुिर्षणा कमी या क ई अ् य स्ट् टाफ जिुे कैंटीन स्ट् टाफ; या
(iii) ुंस्ट् थान प्रमिख, ुंकाय ुदस्ट् य या अचानक जांच करने पर रिंगग-प्रजतर धी दस्ट् त े या रिंगग-प्रजतर धी ुजमजत के
ुदस्ट् य; या
(iv) अ् य जिु ेस्ट् थानीय पिजलु या जजला प्राजधकाररय क ुीधे जिकायत।
(4) ुभी मामल में, दकुी अपााद के जबना, जिकायतकता जािेी रूप ुे छाि के नाम गिप् त रखे जाएंगे, जब तक अ् य
अनिमजतय ्य न ू ।
(5) रिंगग की घटनाओं ुे ुंबंजधत प्रत् येक ुूचना या जिकायत, या त प्रत् य्षण रूप ुे या जनयंिण क्षण या रिंगग-प्रजतर धी
ूल्े पलासन के जररए तिरंत र ुाथ ूी ुाथ ुंस्ट् थान प्रमिख क ुंुूजचत की जाएगी।
(6) मेजडकल कोलेज या ुंस्ट् थान के अ् य पदाजधकाररय , ज पूले ुे ूी जनज त दकए जाएंगे, जिुे रिंगग-प्रजतर धी दस्ट् ते या
रिंगग-प्रजतर धी ुजमजत के ुदस्ट् य , छािाााु ााड न, ुिर्षणा स्ट्ट ाफ र अ् य क भी ुाथ ूी ुाथ ुूजचत दकया जाएगा।
(7) रिंगग की घटनाओं के ुंबंध में ुूचना, जाश् ाजा्ालय, जजला प्राजधकाररय , पिजलु प्राजधकाररय क तिरंत पिन: प्रुाररत करने
के जलए मेजडकल कोलेज या ुंस्ट् थान द्वारा ्ाश् यक तंि लागू दकया जाएगा।
22. तत्क ाल कार ााई –(1) रिंगग की दकुी घटना की ुूचना प्राप्त ू ने पर, रिंगग-प्रजतर धी दस्ट् ता या ुमिजचत प्राजधकारी तिरंत
तत् काल जांच करेगा र ुंस्ट् थान प्रमिख क एक ररप ट या जुफाररि प्रस्ट् तित करेगा।
(2) ऐुी ुूचना या जुफाररि की प्राजि पर ुंस्ट् थान प्रमिख जाजनयम 23 में जाजनर्ददष्ट ट जांच के पश् चात तिरंत जनधा ररत करेगा दक
टि या दांजडक कानून के अंतग त मामला बनता ूि, ऐुी ुूचना या जुफाररि की प्राजि के 24 घंटे के अदं र या त अपनी ओर ुे स्ट् ायं या
रिंगग-प्रजतर धी ुजमजत के ुदस्ट् य या सु ुंबंध में उुके द्वारा जाजधात् प्राजधकृत प्राजधकारी के जररए, ुमिजचत दांजडक उपबंध के
अंतग त पिजलु र स्ट्थ ानीय प्राजधकरण में एक प्रथम ुूचना ररप ट दज कराने की काय ााूी करेगा।
(3) यदद क ई माता-जपता या छाि, पिजलु में प्रथम ुूचना ररप ट ुीधे दज कराता ू ि त मजे डकल कोलेज या ुंस्ट् थान का प्रमिख,
प्रथम ुूचना ररप ट दज कराने की जजम् मेदारी ुे मिटि त नूीं ू जाता।
(4) ुंस्ट् थान प्रमिख, उु जाश् ाजा्ालय, जजुुे मेजडकल कोलेज या ुंस्ट् थान ुंबद्ध ू,ि क र जजले के न डल रिंगग-प्रजतर धी
प्राजधकारी तथा ्य ग क भी ुूजचत करेगा।
23. ुास्ट्ं थ ाजनक जाचं या जाचं -पडताल र ररप ट –(1) ुंस्ट् थान प्रमिख, दकुी अ् य प्राजधकारी की ररप ट की प्रती्षणा दकए जबना,
रिंगग की घटना की जांच या जांच-पडताल करने के जलए एक जाजिष्ट ट ुजमजत गरठत करेगा, चाू े सुकी जांच-पडताल, पिजलु या

(2) जांच या जांच-पडताल, दकुी प्षणपात या दभि ा ाना के जबना, निुज्ञगक ् याय के जुद्धांत क कायम रखते ए ए र रिंगग की
घटना ुे ुंबंजधत ुा् य , दस्ट् तााेज र जाचार क उुके ुम्षण रखने के जलए रिंगग के ्र पी छाि या छाि तथा अ् य ुाज्षणय
क पया प्त अाुर प्रदान करते ए ए तथा ऐुी अ् य ुूचना, ज अपेज्षणत ू , पर जाचार करते ए ए, जनष्ट प्षण र पारदिी तरीके ुे, स्ट् थल
या स्ट्थ ान क िाजमल करते ए ए गूनता ुे की जाएगी।
(3) रिंगग की घटना की ुूचना या ररप र्टटग के ुात ददन के अंदर पूरी प्रद्रमया पूरी कर ली जाएगी र ररप ट जाजधात् प्रस्ट् तित
कर दी जाएगी।
(4) यू ररप ट ुंस्ट् थान प्रमिख या रिंगग-प्रजतर धी ुजमजत के ुम्षण प्रस्ट् तित की जाएगी।
(5) रिंगग-प्रजतर धी ुजमजत ररप ट की जांच करेगी, उु पर जनण य लेगी र ुंस्ट् थान प्रमिख क अगली प्रिाुजनक कार ााई की
जुफाररि करेगी।
24. ुास्ट्ं थ ाजनक प्रिाुजनक र दाजं डक कार ाासया ं –(1) प्रत् येक मेजडकल कोलेज या ुंस्ट् थान, जाजनयम 23 के अंतग त रिंगग-
प्रजतर धी ुजमजत की जुफाररिें प्राप्त करने के पश् चात ्ाश् यक प्रिाुजनक कार ााई करेगा, ज उजचत ुमझी जाए।
(2) ुमिजचत ुजमजत द्वारा की गई ुांस्ट् थाजनक जांच या जांच-पडताल की ररप ट स्ट् ाीकार कर लेने पर रिंगग-प्रजतर धी ुजमजत,
अय ाय ।। के उपबंध के अंतग त ददए गए रिंगग के कृत् य के जुद्ध ए ए द ी के स्ट् ारूप, गूनता र गंभीरता पर जनभ र करते ए ए उप-
जाजनयम (5) र (6) के अंतग त उपबंजधत एक या एक ुे अजधक कार ााई की जुफाररि करेगी, बााजूद सुके दक यू कार ााई, ऐुी
घटनाओं की पिनरााृजय के जारुद्ध जनाारक के रूप में उदाूरणात् मक र ् यायुंगत रूप में कठ र ू गी।
(3) जूां ुांस्ट् थाजनक जांच या जांच-पडताल के जनष्ट कीयों र उुकी उत् तराती जुफाररि के ्धार पर, रिंगग का कृत् य करने या
उुके जलए उकुाने ााले व् यजतिय की पूचान नूीं ू ती ू ि त मेजडकल कोलेज या ुंस्ट् थान, ुंभाजात रिंगग कता ओं पर ुामिदाजयक
दबाा ुिजनज त करने के जलए जनाारक के रूप में, एक ुे अजधक व् यजतियय के या व् यजतियय के एक ुमूू के ुामूजूक दडं का ुूारा
लेगा।
(4) म टे तनर पर उन ुंघटक , जजन ुे जुफाररि की प्राजि र अनिम दन पर दडं ात् मक कार ााई ्ाश् यक ू जाती ूि, म ें
जनम् नजलजखत ुंघटक िाजमल ू,ैं परंति ये स् ूीं तक ुीजमत नूीं ू:ैं-
(i) रिंगग के जलए उकुाना;
(ii) रिंगग के जलए ्पराजधक ुाजजि;
(iii) रिंगग करते ुमय जाजध जारुद्ध जमाा र उपद्रा;
(iv) रिंगग के दनरान ुृजजत ल क-कंटक;
(v) रिंगग के जररए िालीनता र धिय का उल्ल घं न;
(vi) िारीररक र मन ािन आाजनक अपमान;
(vii) िारीररक च ट पए चं ाना, च ट या गंभीर च ट मारना;
(viii) ुद ी अार ध;
(ix) ुद ी पररर ध;
(x) ्पराजधक बल प्रय ग;
(xi) प्रूार र यनन अपराध या यूां तक दक प्रकृजत जारुद्ध अपराध;
(xii) दकुी भी रूप में खु ट;
(xiii) ्पराजधक अजभिाु;
(xiv) ्पराजधक अजतचार;
(xv) ुंपजय के प्रजत अपराध;
(xvi) दकया गया क ई अ् य कृत् य ज जाजनयम 3 र 4 के अंतग त उपबंजधत ू।ि
(5) उन दडं ात् मक कार ाासय , जजनका जनण य जलया जा ुकता ूि, के स्ट् ारूप में जनम् नजलजखत कार ाासयां िाजमल ू गी परंति ये,
की जाने ााली सन दंडात् मक कार ाासय में ुे एक या एक ुे अजधक, ज भी उजचत ुमझी जाए, तक ुीजमत नूीं ू गी, नामत:-
(i) क्षणाओं में भाग लेन े र ििज्षणक जािेीाजधकार ुे जनलंबन;[भाग III—खण् ड 4] भारत का राजपि : अुाधारण 15
(ii) छािाृजय या फेल जिप या अ् य लाभ र क लेना या ाापु लेना;
(iii) दकुी टेस्ट् ट या परी्षणा या अ् य मूल् यांकन प्रद्रमया म ेंभाग लेन ेुे जााज्ञजत कर देना;
(iv) पररणाम र क लने ा;
(v) ुम् मले न र अ् य ििज्षणक काय ्रमम में भाग लेन े ुे जााज्ञजत कर देना;
(vi) दकुी ्षणेिीय, राष्टर ीय या अंतरा ष्टर ीय बिठक, टूना मेंट, यिाा पा ्दद म ेंभाग लेन े ुे जााज्ञजत कर देना;
(vii) छािाााु ुे जनलंबन या ज्काुन;
(viii) पच् चीु ूजार रुपए ु ेएक लाखरुपए तक की रेंज में जिमा ना लगाना;
(ix) दाजखले का जनरस्ट् तीकरण;
(x) मेजडकल कोलेज या ुंस्ट्थ ान ुे एक ुेमेस्ट्ट र ु ेचार ुेमेस्ट्ट र तक की रेंज म ेंअस्ट् थायी बजूष्ट कार;
(xi) मेजडकल कोलेज या ुंस्ट्थ ान ुे जनष्टक ाुन र पररणामत: एक जाजनर्ददष्ट ट अाजध के जलए दकुी अ् य
ुंस्ट् थान म ेंदाजखले ु ेजााज न।
(6) जाजनयम 8 के उपबंध पर प्रजतकूल प्रभाा डाले जबना, मेजडकल कोलेज या ुंस्ट् थान के जलए यू अजनााय ू गा दक ाू छाि
क जारी दकए गए मासरी ेिन प्रमाणपि या स्ट् थानांतरण प्रमाणपि म ें यू प्रजाजो करे दक टि या छाि क रिंगग करने या रिंगग के जलए
उकुाने के अपराध के जलए दजं डत दकया गया ू िया नूीं र छाि ने जनरंतर ंूुक या ््रमामक व् याूार या अ् य क ूाजन पए चं ान े
की प्राृजय दिा ई ूि।
(7) ् यायालय द्वारा यथा जनदज ित दकुी अ् य उपाय का भी मेजडकल कोलेज या ुंस्ट् थान द्वारा पालन दकया जाएगा।
(8) ुंस्ट् थान प्रमिख, ुांस्ट् थाजनक स्ट् तर की जांच या जांच-पडताल के जनष्ट कीयों र उन पर की गई कार ााई ुे ुंबंजधत ररप ट के
ुाथ, जाजनयम 22 के उप-जाजनयम (4) के अंतग त उपबंजधत रिंगग की घटना के ुंबंध में ुूचना का अनिात न उु जाश् ाजा्ालय के
ुाथ करेगा जजुके ुाथ मेजडकल कोलेज या ुंस्ट् थान ुंबद्ध ू।ि
(9) ुंस्ट् थान प्रमिख, जाजनयम 22 के उप-जाजनयम (4) के उपबंध के अनिुार, पूले ुूजचत करके, रिंगग की घटना र उु पर की
गई कार ाासय ुे ुंबंजधत एक ररप ट ्य ग क उपलब् ध कराएगा।
25. अपीलीय प्राजधकारी –प्रत् येक व् यजतिय, जजु पर दंडात् मक कार ााई की गई ूि या जजुे दडं ददया गया ूि, क निुज्ञगक ् याय के
जुद्धांत क य ान में रखते ए ए, जनम् नजलजखत के पाु अपील करने का अजधकार ू गा, नामत:-
(क) मेजडकल कोलेज या ुंस्ट्थ ान के स्ट् तर पर जनण य या ्देि के जलए:
(i) उु जाश् ाजा्ालय का किलपजत, जजुके ुाथ मेजडकल कोलेज या ुंस्ट् थान ुंबद्ध ू;ि
(ii) राष्टर ीय मूत् ा के ुंस्ट् थान के मामले में जनदेिक या मिख्य कायक ारी अजधकारी;
(ख) जाश् ाजा्ालय के स्ट् तर पर जनणय या ्दिे के जलए:
(i) उु जाश् ाजा्ालय का किलाजधपजत, जजुके ुाथ मेजडकल कोलेज या ुंस्ट्थ ान ुंबद्ध ू;ि
(ii) राष्टर ीय मूत् ा के ुंस्ट् थान के मामले में ुभापजत।
26. जजम्म दे ारी जनधार रत करना –(1) रिंगग की घटना की जांच या जांच-पडताल के अलााा, सुकी उपयिटि तत: जांच की जाएगी,
यदद ऐुी घटना की र कथाम करने र कार ााई करने में मेजडकल कोलेज या ुंस्ट् थान द्वारा क ई कत् त व् यत् याग या चूक की गई ूि।
(2) ुंस्ट् थान प्रमिख, ऐुे प्रत् येक व् यजतिय के जारुद्ध तिरंत र ुमिजचत कार ााई करेगा, जजुके कत् त व् यत् याग के पररणामस्ट् ारूप घटना
ए ई।
(3) यदद चूक ुंस्ट् थान प्रमिख की ओर ुे ए ई ू ि त उुके बदले ुंस्ट् थान प्रमिख क जनयिटित करने के जलए नामजद प्राजधकारी तिरंत
र ुमिजचत कार ााई करेगा।
(4) ुमिजचत दांजडक पररणाम के अलााा, ऐुे ुंस्ट् थान प्रमिख या प्रिाुन के ुदस्ट् य या ुंकाय ुदस्ट् य या गिर-जि्षणण स्ट् टाफ या
अ् य जज् ू ने रिंगग की जिकायत के प्रजत ुूानिभूजत या अुंाेदनिील मन ाृजय दिा ई ूि, के जारुद्ध जाभागीय जांच ्रभ की जा
ुकती ू।ि
(5) अनिभा के ्धार पर मेजडकल कोलेज या ुंस्ट् थान द्वारा उपचारात् मक उपाय स्ट् थाजपत दकए जाएंगे।
(6) सु जाजनयम के उपबंध के अंतग त की गई कार ाासय के ुंबंध में जाश् ाजा्ालय र ्य ग क ुूजचत दकया जाएगा।16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
27. ुबं द्ध जाश्ा जा्ालय के काय –(1) जाश् ाजा्ालय, जजुके ुाथ मेजडकल कोलेज या ुंस्ट् थान ुंबद्ध ूि, क जाजनयम 21 के
उप-जाजनयम (7) के अंतग त यथा अपेज्षणत उु मेजडकल कोलेज या ुंस्ट् थान द्वारा रिंगग की घटना ुूजचत की जाएगी।
(2) जाश् ाजा्ालय, मेजडकल कोलेज या ुंस्ट् थान ुे जांच या जांच-पडताल र की गई कार ााई ुे ुंबंजधत ररप ट प्राप्त करेगा।
(3) जाश् ाजा्ालय, जाजनयम 25 के अंतग त यथा उपबंजधत अपीलीय प्राजधकारी के रूप में काय करेगा।
(4) जाश् ाजा्ालय, जाजनयम 17 के उपबंध के अनिुार ऐुी कार ााई करेगा, ज उजचत ुमझी जाए।
(5) जाश् ाजा्ालय, ् यायालय ुे जारी दकए गए ्दिे या जनदि , यदद क ई ू , का अनिपालन ुिजनज त करेगा।
28. ्य ग के काय –(1) ्य ग क , जाजनयम 21 के उप-जाजनयम (7) के अंतग त यथा अपेज्षणत, मेजडकल कोलेज या ुंस्ट् थान
द्वारा रिंगग की घटना ुूजचत की जाएगी।
(2) ्य ग, मेजडकल कोलेज या ुंस्ट् थान र जाश् ाजा्ालय ुे, अपील के पररणाम ुजूत जांच या जांच-पडताल र की गई
कार ााई के ुंबंध में ररप ट प्राप्त करेगा।
(3) ्य ग, ररप टयों की ुमी्षणा करने के पश् चात, जाजनयम 18 के उपबंध के अनिुार ुमिजचत कार ााई करेगा।
(4) उप-जाजनयम (1) ुे (3) के उपबंध पर प्रजतकूल प्रभाा डाले जबना, ्य ग जनम् नजलजखत कार ाासयां कर ुकता ूि, यदद ाू
उजचत ुमझे, नामत:-
(क) ुमिजचत ुरकार, जिुा भी मामला ू , द्वारा नामजद दकए गए ऐुे प्राजधकारी क , गलती करन े ााल े
मेजडकल कोलेज या ुंस्ट् थान द्वारा भिगतानय ् य, रिंगग की प्रत् येक घटना के जलए एक लाख रुपए का
उदाूरणात् मक जिमा ना लगाना; या
(ख) गलती करन े ााल े मेजडकल कोलेज या ुंस्ट्थ ान या जाश् ाजा्ालय क ् यनू तम ििज्षणक मानक न रखने ााल े
के रूप में घ जीत करना र ुाा जजनक ुूचना के जररए र जाश् ाजा्ालय की ाेबुासट पर डाल कर,
उु मेजडकल कोलेज या ुंस्ट्थ ान या जाश् ाजा्ालय में दाजखले के जलए ुंभाजात अ यज्ञथय क चेताानी
देना; या
(ग) राष्टर ीय ्यिज्ञान आान ्य ग अजधजनयम, 2019 के अ याय VI के उपबंध के अंतग त एक ाी की ् यूनतम
अाजध, ज ्य ग द्वारा उतनी मािा तक जास्ट् तारणय ् य ू गी, ज गलती के अनरूि प ू , के जलए, क ई
्ाेदनपि प्रस्ट् तति करने के जलए अपाि के रूप में घ जीत करना।

NOTIFICATION
New Delhi, the 18th November, 2021
No. UGMEB/NMC/Rules & Regulations/2021.–––In exercise of the powers conferred by Section 57 of the
National Medical Commission Act, 2019 (30 of 2019) and in pursuance of the Judgment of the Hon'ble Supreme
Court of India passed in Special Leave Petition (SLP) No. 24295 of 2006, dated the 16th May, 2007 and in Civil
Appeal No. 887 of 2009 dated the 8th May, 2009, and the UGC Regulations on Curbing the Menace of Ragging in
Higher Educational Institutions, 2009, the National Medical Commission hereby makes the following regulations
namely:-
1. Short title, extent and commencement.–– (1) These regulations may be called the National Medical
Commission (Prevention and Prohibition of Ragging in Medical Colleges and Institutions) Regulations, 2021.
(2) They shall come into force on the date of their final publication in the Official Gazette.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
2. Definitions.–– (1) In these regulations, unless the context otherwise requires,––
(a) ―Academic Year‖ means the period from the commencement of admission of students to any course of
study in the medical college or institution to the completion of academic requirements, including
examinations if any, at the end of that particular year;
(b) ―Act‖ means the National Medical Commission Act, 2019 (30 of 2019);
(c) ―Commission‖ means the National Medical Commission constituted under section 3 of the Act;
(d) ―Fresher‖ means a student who has been admitted to an institution and who is undergoing his first year
of study in such institution;
(e) ―Head of the Institution‖ means the Dean or Principal or Director or any other appropriate authority
responsible for administration including academic and affairs related to students, residents and fellows
of the concerned medical college or institution;
(f) ―Hostel‖ means any place of residence of students with all its associated areas and facilities such as
boarding and administered by the medical college or institution;
(g) ―MBBS‖ means the degree of Bachelor of Medicine and Bachelor of Surgery of a University or an
approved institution from India in accordance with the Regulations on Graduate Medical Education,
1997 and subsequent amendments duly recognised by the National Medical Commission under sub-
section (2) of section 61of the Act;
(h) ―Medical College or Institution‖ means any institution within India which grants degrees, diplomas or
licences in medicine and include affiliated colleges and deemed to be Universities as approved by the
Commission and listed with the Undergraduate Medical Education Board or Postgraduate Medical
Education Board under the provisions of sections 24, 25 and 35of the Act; and includes but not limited
to all areas such as departments, all teaching and learning facilities, hospitals and all its premises
whether academic, residential, playgrounds or canteen whether located within or outside the campus
and all means of transportation, public or private, used by students in pursuit of their studies;
(i) ―Medicine‖ means modern scientific medicine or allopathy in all its branches and includes surgery and
obstetrics, but does not include veterinary medicine and surgery;
(j) ―Notification‖ means notification published in the Official Gazette and the expression ―notify‖ shall be
construed accordingly;
(k) ―Permanent Registration‖ is the registration of eligible persons with a duly recognised primary medical
qualification as regulated under the provisions of Chapter VI of the Act, that provides license to an
individual to independently practice modern scientific system of medicine or allopathy in India;
(l) ―Ragging‖ means the act of misconduct of students towards one another as defined in regulation 4;
(m) ―Senior‖ means a student who is undergoing his study in such institution and has been admitted to an
institution in the previous academic year or in an earlier year and therefore implies that he has joined
the institution prior to the batch of a fresher;
(n) ―Student‖ means any person enrolled and pursuing a course in any medical college or institution as
approved by the Commission;
(o) ―University‖ for the purpose of these regulations shall have the meaning assigned to it in clause (f) of
section 2 of the University Grants Commission Act, 1956 (3 of 1956) and includes a health University
in India that is established or incorporated by or under a Central Act, a Provincial Act or a State Act, an
institution deemed to be University under section 3 of the said Act, or an institution specially
empowered by an Act of Parliament to confer or grant degrees;
(p) ―University Grants Commission‖ means the University Grants Commission established under section 4
of the University Grants Commission Act, 1956 (3 of 1956) ;
(q) ―Warden‖ means an official or officials entrusted with the routine administration and functioning of the

(2) Words and expressions used in these regulations and not defined herein but defined in the Act shall have the
respective meanings assigned to them in the Act.
3. Objective.––The objective of these regulations is to root out ragging in all its forms from medical colleges
and institutions in the country, by prohibiting it under these regulations, preventing its occurrence, and instituting
punitive measures against those who indulge in ragging as provided for in these regulations and in accordance with
prevailing and applicable laws in force.
CHAPTER II
RAGGING
3. Definition of Ragging.––Ragging shall mean any disorderly conduct, whether by words spoken or written or
by an act which has the effect of teasing, treating or handling with rudeness any other student, indulging in rowdy or
undisciplined activities which causes or is likely to cause annoyance, hardship or psychological harm or to raise fear
or apprehension thereof in a fresher or a junior student or asking the students to do any act or perform something
which such student will not in the ordinary course and which has the effect of causing or generating a sense of shame
or embarrassment so as to adversely affect the physique or psyche of a fresher or a junior student.
4. Actions that may constitute ragging.––The following actions shall be included but not limited to those that
may constitute ragging, namely:––
(a) any conduct by any student or students whether by words spoken or written or by an act which has the
effect of teasing, treating or handling with rudeness a fresher or any other student;
(b) indulging in rowdy or undisciplined activities by any student or students which causes or is likely to
cause annoyance, hardship, physical or psychological harm or to raise fear or apprehension thereof in
any fresher or any other student;
(c) asking any student to do any act which such the student will not in the ordinary course do and which
has the effect of causing or generating a sense of shame, or torment or embarrassment so as to
adversely affect the physique or psyche of such fresher or any other student;
(d) any act by a senior student that prevents, disrupts or disturbs the regular academic activity of any other
student or a fresher;
(e) exploiting the services of a fresher or any other student for completing the academic tasks assigned to
an individual or a group of students;
(f) any act of financial extortion or forceful expenditure burden put on a fresher or any other student by
students;
(g) any act of physical abuse including all variants of it, such as, sexual abuse, homosexual assaults,
stripping, forcing obscene and lewd acts, gestures, causing bodily harm or any other danger to health or
person;
(h) any act or abuse by spoken words, emails, post, snail-mails, blogs, public insults which would also
include deriving perverted pleasure, vicarious or sadistic thrill from actively or passively participating
in the discomfiture to fresher or any other student;
(i) any act of physical or mental abuse (including bullying and exclusion) targeted at another student
(fresher or otherwise) on the ground of colour, race, religion, caste, ethnicity, gender (including
transgender), sexual orientation, appearance, nationality, regional origins, linguistic identity, place of
birth, place of residence or economic background;
(j) any act that undermines human dignity and respect through humiliation or otherwise;
(k) any act that affects the mental health and self-confidence of a fresher or any other student with or
without an intent to derive a sadistic pleasure or showing off power, authority or superiority by a
student over any fresher or any other student;
(l) any other act not explicitly mentioned above but otherwise construed as an act of ragging in the letter
and spirit of the definition for ragging as provided under regulations 3 and 4.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
CHAPTER III
MEASURES TO PROHIBIT AND PREVENT RAGGING BY INSTITUTIONS
5. Duties and responsibilities of institutions.––Curbing and eradication of ragging requires the efforts of all
stake holders’ , namely, seniors, freshers, teachers, parents and the civic society at large and the measures provided in
the provisions of this Chapter form the broad guidelines for prohibiting and preventing ragging by the Institution.
6. Measures to be taken by medical college or institution to prohibit ragging.–– The following measures
shall be taken by the medical colleges or institutions for prohibiting ragging, namely:––
(a) no institution, shall not in any manner permit or condone any reported incident of ragging in any form;
and all institutions shall take all necessary and required measures, including but not limited to the
provisions of these regulations, to achieve the objective of eliminating ragging, within the institution or
outside;
(b) every medical college or institution shall take action in accordance with these regulations against those
found guilty of ragging or abetting ragging, actively or passively, or being part of a conspiracy to
promote ragging.
7. Measures to be taken by medical college or institution to prevent ragging.––(1) The following measures
shall be taken by the medical college or institution before the admission process for preventing ragging, namely:––
(i) All public notifications of the medical college or institution related to admission of students to any
course as declared in any electronic, audio-visual or print or any other media shall expressly provide
that––
(a) Ragging is a serious offence that is totally prohibited in the medical college or institution
(b) anyone found guilty of ragging or abetting ragging, whether actively or passively, or being a
part of a conspiracy to promote ragging, is liable to be punished in accordance with these
regulations as well as under the provisions of any penal law for the time being in force;
(ii) the admission brochure or prospectus or information bulletins, in print, digital or any other form shall
include these regulations;
(iii) it hall be incumbent on all organisations conducting examinations for the purpose of entrance or exit or
any other form of assessment and counseling or seat allotment related to the colleges or institutions, to
which these regulations apply, to include these regulations in their Information Bulletin in whichever
forms these are available as given below:
(a) the National Testing Agency (NTA) shall include these regulations in the National Eligibility
cum Entrance Test [NEET (UG)] for MBBS;
(b) the National Board of Examinations (NBE) shall include these regulations in the Information
Bulletin of the National Eligibility cum Entrance Test for Postgraduate [NEET (PG)] and Super-
specialty [NEET(SS)] Courses;
(c) the Medical Counseling Committee (MCC) of the Directorate General of Health Services,
Ministry of Health and Family Welfare, Government of India, conducting Online Under
Graduate Medical or Postgraduate or Super-specialty courses Seat Allotment process (Online
Counseling), shall display these regulations on their website for the respective counseling
processes;
(d) these regulations shall be available in the Information Bulletin for the National Exit Test (NExT)
to be held under section 15 of the Act;
(e) medical colleges or institutions shall ensure that if any of their assessments or examinations or
counseling related to admission process is conducted by any organisation under them or
outsourced thereof, the Information Bulletin shall contain these regulations;
(iv) medical colleges or institutions shall stagger the dates of admission such that the fresh batch is
admitted before the commencement of new sessions of senior batches;[भाग III—खण् ड 4] भारत का राजपि : अुाधारण 23
(v) before the commencement of the academic session in any medical college or institution, the Head
of the Institution shall convene and address a meeting of various functionaries or agencies, such as
Hostel Wardens, representatives of students, parents or guardians, faculty, district administration
including the police, to discuss the measures for curbing ragging;
(vi) the Head of the Institution shall constitute Anti-Ragging Committees, Anti-Ragging Squads and
other such committees or assign duties to fulfill the provisions of these regulations;
(vii) the medical college or institution shall, to make the community at large and the students in
particular aware of the dehumanizing effect of ragging, and the approach of the institution towards
those indulging in ragging, even utilising the media to give wide publicity and prominently display
posters depicting the provisions of penal law applicable to incidents of ragging, and the provisions of
these regulations in the premises of the institutions, especially hostels;
(viii) the contact numbers, details of control room, helpline and the personnel related to anti-ragging
activities shall be prominently displayed, provided and easily available to freshers and all concerned so
that immediate contact can be established whenever necessary;
(ix) the vacation period before the start of the admission process may be used to publicise the
objectives and provisions of these regulations;
(x) the institution shall identify, properly illuminate and keep a close watch on all locations known to
be vulnerable to occurrences of ragging incidents;
(xi) it should be ensured that except in those areas where unavoidable, there shall be no hindrance, by
way of jamming, etc., to the use of mobile phones, within the medical college or institution including
hostels and other areas;
(xii) it is recommended that monitoring of the campus, or at least areas vulnerable to incidents of
ragging be done through video-surveillance;
(xiii) the Faculty and staff of the medical college or institution shall have induction arrangements,
including those which anticipate, identify and plan to meet any special needs of any specific section of
students, in place well in advance of the beginning of the academic year with an aim to promote the
objectives of these regulations;
(xiv) every medical college or institution shall engage or seek the assistance of professional counselors
or in-house counselors as may be available in the Department of Psychiatry before the commencement
of the academic session, to be available for counseling students;
(xv) the medical college or institution may form a system of assigning faculty mentors before-hand
who would communicate and regularly with students and their parents or guardians;
(xvi) the local police and authorities shall be provided with details of the dates of admission and the
addresses of the every privately commercially managed hostels or lodges used for residential purposes
by students enrolled in the medical college or institution;
(xvii) the Anti-Ragging Squad shall have adequate drills to be adequately competent to conduct vigil
after students are admitted;
(xviii) an Anti-Ragging Control Room may be established with contact details so that students are able
to contact the control room at any time of the day or night to report incidents of ragging or seek such
assistance as may be needed;
(xix) adequate and robust communication mechanisms shall be put in place so that should the need
arise, the medical college or institution can immediately and simultaneously contact and relay
information within the institution to appropriate officials, the district authorities and the police;
(xx) the institutional website shall have provision for posting anti-ragging notifications, activities, and
also the reports of incidents of ragging and the action taken thereof under public domain.
(2) The following measures shall be taken by the medical college or institution at the time of the

(i) at the time of admission, an undertaking shall be taken that the student shall not involve in
ragging in any manner whatsoever in the format given in the following Annexure, namely:––
(a) Undertaking by the Student in Form I;
(b) Undertaking by the Parent or Guardian in Form II;
(ii) those who seek admission in hostels either within the premises or outside the premises of the
medical college or institution shall give an undertaking that the student shall not be involved in
ragging in any manner whatsoever in the format given in the following Annexures, namely:––
(a) Undertaking by the Student in Form I;
(b) Undertaking by the Parent / Guardian in Form II;
(iii) the admission requirements shall include a document in the form of the School Leaving
Certificate or Transfer Certificate or Migration Certificate or Character Certificate, as the case may be,
which shall include a report on the behavioural pattern of the applicant, so that the medical college or
institution can thereafter keep intense watch upon a student who has a negative entry in this regard;
(iv) every student at the time of his registration shall inform the medical college or institution about
his place of residence while pursuing the course of study, and in case the student has not decided his
place of residence or intends to change the same, the details of his place of residence shall be provided
immediately on deciding the same; and specifically in regard to a private commercially managed lodge
or hostel where he has taken up residence;
(v) every fresh student admitted to the institution shall be provided with––
(a) details of those who could be contacted such as of the Anti-Ragging Helpline or control room
referred to in these regulations, wardens, Head of the institution, members of the Anti-Ragging
Squads and Committees, relevant district and police authorities; for help and guidance at any
time, if and when required;
(b) the details of arrangements made for their induction and orientation which promote efficient and
effective means of integrating them fully as students with those already admitted of the
institution in earlier years;
(c) their rights as bona fide students of the medical college or institution;
(d) clear instructions that they should desist from doing anything, with or against their will, even if
ordered to by the seniors students, and that any attempt of ragging shall be promptly reported to
the Anti-ragging Squad or to the Warden or to the Head of the institution, as the case may be;
(e) instructions that at least for a specified period that they would be accompanied and monitored
appropriately should they leave their hostel premises to a boarding facility or mess or canteen or
to a recreational facility such as the gymnasium, especially in the evening or at night;
(f) all freshers shall seek prior permission and provide contact details and timings of leaving and
expected return to hostels and reasons for such visit should they for any reason leave the hostel
and institutional premises, such as to visit local guardians, etc.
(3) The following measures shall be taken by the medical college or institution after the admission process,
namely:––
(i) freshers shall be lodged, as far as may be, in a separate hostel block or wing and the medical college or
institution shall ensure that access of seniors to accommodation allotted to freshers is strictly monitored
by wardens, security guards and other staff of the institution
(ii) the medical college or institution shall conduct separate orientation programmes for fresh students to
apprise and familiarise them with the academic environment of such medical college or institution;
(iii) the freshers shall be counseled to prepare them for the life ahead, particularly in regard to the life in
hostels and to the extent possible, also involve parents and teachers in the counseling sessions
(iii) the medical college or institution shall schedule orientation with seniors through––[भाग III—खण् ड 4] भारत का राजपि : अुाधारण 25
(a) joint sensitisation programme and counseling of both freshers and senior students by a
professional counselor;
(b) joint interactions with seniors in the form of cultural and sports activities;
(c) active monitoring, promoting and regulating healthy interaction between the freshers, junior
students and senior students by appropriate committees, including the faculty, student advisors,
wardens and some senior students as its members;
(iv) Freshers shall be allotted faculty members who shall act as mentors as indicated under regulation14;
(v) the medical college or institution may device its own following additional methods and put into place
all measures necessary and provided in various provisions of this Chapter to prohibit and prevent
ragging thereby fulfilling the provisions of these regulations and the UGC Regulations on Curbing the
Menace of Ragging in Higher Educational Institutions, 2009including the related laws for the time
being in force which may be applicable:
(a) all necessary Committees, personnel, measures and plans shall be put into place and completely
functional and co-ordinate with each other to implement the requirements;
(b) students, freshers and seniors, parents, faculty and all other staff shall be adequately informed of
the provisions of anti-ragging regulations;
(c) strict vigil shall be enforced at all times by all concerned with special emphasis on hostels and
canteen areas;
(d) surprise checks round the clock, anonymous surveys and strict enforcement of disciplinary
measures shall be put in force;
(e) there shall be easy accessibility to report incidents of ragging as well as untoward incidents,
distress, difficulties of freshers through availability of contact numbers of Heads of Institution,
faculty, Anti Ragging Squad, members of Ant Ragging Committee, hostel wardens and other
staff directly or through control room or helplines;
(f) there shall be established communication or operating protocols with district administration and
police for their swift and prompt intervention should the need arise;
(g) the message and the intent shall be loud and clear that reporting every incident of ragging is
mandatory for all students and staff of the institution and that every case of ragging shall be dealt
with according to the provisions of these regulations and the applicable laws for the time being in
force;
(vi) the medical college or institution shall provide reports of all regarding Anti-Ragging measures,
incidents of ragging, directions of the courts to the University at pre-decided intervals, which may be
weekly for the first three months after admission of students as provided in regulation 17;
(vii) the medical college or institution shall provide compliance reports in the format provided in Form III,
reports regarding anti-ragging measures, incidents of ragging, actions taken thereof , directions of the
courts to the Commission as provided in regulation 18;
(viii) the above mentioned measures are neither meant to be comprehensive nor complete and the medical
college or institution may utilise measures as provided in different provisions of these regulations; and
in addition to them, encourage not only to innovate and devise measures that would enhance efforts to
prohibit, prevent and help identify incidents of ragging but also make suitable suggestions to their
affiliated Universities for implementation in other medical colleges or institutions.
(4) The following measures shall be taken by the medical college or institution at the end of the academic year,
namely:––
(i) at the end of each academic year, the Head of the Institution or Dean shall send a letter to the parents or
guardians of the students who are completing their first year reminding them of the provisions of these
regulations and any other law for the time being in force to impress upon their wards to desist from
indulging in ragging on their return to the medical college or institution at the beginning of the next

(ii) at the end of every academic year, the medical college or institution shall form a Mentoring Committee
or Mentoring Cell consisting of mentors for the succeeding academic year as provided in regulation 14.
8. Issue of migration certificates, transfer certificates and conduct certificates.––The migration certificate
or transfer certificate or conduct certificate , as the case may be, issued to the student by the medical college or
institution shall have an entry, apart from those relating to general conduct and behaviour as to whether the student has
been punished for the offence of committing or abetting ragging, or not, as also whether the student has displayed
persistent violent or aggressive behaviour or any inclination to harm others
9. Measures for encouraging healthy interaction between freshers and seniors.––The following measures
shall be taken by the medical college or institution for encouraging healthy interaction between freshers and seniors,
namely:––
(i) the institution shall set up appropriate committees including the faculty from pre-clinical years ,
representatives of students, warden and some senior students to actively monitor, promote and regulate
healthy, interaction between the freshers and senior students;
(ii) freshers' welcome parties shall be organised at the institutional or departmental level by senior students
and faculty together, preferably within the first two weeks of the beginning of the academic session, for
proper introduction to one another and where the talents of the freshers are brought out properly in the
presence of the faculty, thus helping them to shed their inferiority complex, if any, and remove their
inhibition;
(iii) the institution shall enhance the student-faculty interaction by involving both fresher and senior
students in appropriate matters of the medical college or institution, such as curriculum design,
extracurricular activities and institutional celebrations so that the students feel that they are responsible
partners in managing the affairs of the institution.
10. Sensitisation of institutional employees and staff towards ragging.––The following measures shall be
taken by the medical college or institution for sensitisation of institutional employees and staff towards ragging,
namely:––
(i) it shall be the general collective responsibility of all levels and sections of authorities or functionaries
including members of the faculty and employees of the medical college or institution, whether regular
or temporary, and employees of service providers providing service within the institution, to prevent or
to act promptly against the occurrence of ragging or any incident of ragging which comes to their
notice;
(ii) the medical college or institution shall sensitise all teaching and non-teaching members of staff,
contract labour employed in the premises either for running canteen or as watch and ward or security
staff or for cleaning or maintenance of the buildings or lawns and employees of service providers
providing services within the medical college or institution regarding the effects of ragging and various
provisions of these regulations relating to anti-ragging and the appreciation of the relevant human
rights, as well as inputs on topics regarding sensitisation against corporal punishments and checking of
bullying amongst students, so that every teacher is equipped to handle at least the rudiments of the
counseling approach;
(iii) the employers or employees of the canteens or mess shall be given necessary instructions to keep strict
vigil and to report the incidents of ragging to the college authorities, if any;
(iv) all institutional employees and staff, including contractual employees of the hostels and the watch and
ward or security shall be apprised of institutional plans to curb ragging, as appropriate, and clarify
duties assigned;
(v) all institutional employees and staff, including contractual employees shall be required to give an
undertaking that he shall report promptly any case of ragging which comes to his notice;
(vi) all employees of the medical college or institution shall be instructed to keep a strict vigil in the area of
their work and to report the incidents of ragging to the appropriate authorities, as may be required;
(vii) the medical college or institution shall make provision for recognising and rewarding employees and
other staff for furthering anti-ragging activities such as reporting incidents of ragging by way of issuing[भाग III—खण् ड 4] भारत का राजपि : अुाधारण 27
certificates of appreciation, felicitating them and make suitable entries in their service records.
11. Institutional committees and related measures.––(1) Every medical college or institution shall constitute
the following committees and related measures as provided in regulation 6.3 of the UGC Regulations on Curbing the
Menace of Ragging in Higher Educational Institutions, 2009 and under these regulations.
(2) The medical college or institution shall constitute an Anti-Ragging Committee.
(3) The Anti-Ragging Committee shall broadly comprise of the following members duly constituted by the
Head of the Institution and shall have a diverse mix of persons of different levels and gender, namely:–
–
(i) Head of the Institution;
(ii) representatives of faculty members;
(iii) representatives of students belonging to the freshers' category;
(iv) representatives of senior students;
(v) representatives of parents;
(vi) representatives of non-teaching staff;
(vii) representatives of civil and police administration;
(viii) representatives of local media; and
(ix) Non-Government Organizations involved in youth activities.
(4) The duties of the Anti-Ragging Committee include but is not limited to––
(i) overall monitoring of Anti-Ragging activities of the medical college or institution;
(ii) ensuring compliance with the provisions concerning ragging both of these regulations as well as
the provisions of any law for the time being in force;
(iii) monitoring the activities of the Anti-Ragging Squad;
(iv) investigate reports of ragging, if any, or approve committees formed for this purpose;
(v) make suggestions for improvement of measures taken by the medical college or institution for
prohibiting and preventing ragging.
12. Anti-Ragging Squad.––The institution shall constitute an Anti-Ragging Squad.
(1) The Anti-Ragging Squad constituted by the Head of the Institution shall broadly comprise of faculty and staff
of the hostels including wardens and other staff, as may be necessary and there shall be a judicious mix of gender in
the Anti-Ragging Squad with lady members assigned to ladies hostels.
(2) The duties of the Anti-Ragging Squad include but is not limited to––
a. Adhering to a duty roster if so prepared;
b. Remaining vigilant and agile at all times and also provide necessary details so that the members are
easily reachable even by freshers and other students;
c. Making surprise checks in the hostels, boarding areas, playgrounds and transport facilities and other
areas even at odd hours for which the Anti-Ragging Squad shall be duly empowered;
d. Making discreet enquiries regarding compliance and adherence of these regulations by seniors;
e. Conducting anonymous surveys that may be random, to identify possibly unreported incidents of
ragging as designed by the medical college or institution;
f. checking freshers for any injuries or indirect evidences of possible ragging such as inability to stay
awake during the day indicating possible ragging throughout the night or inability to sleep due to fear
of ragging;
g. informing the authorities concerned to rectify vulnerable areas such as dark stretches due to fused

h. making on the spot and other necessary enquiries on incidents of ragging and report to the Anti-
Ragging Committee;
i. reporting all cases of ragging to the Head of the Institution and other functionaries, as may be required;
j. making entries regarding timings and details of checking including remarks or findings, if any, in a
register.
13. Anti-Ragging Control Room or helpline.–– (1) The medical college or institution shall establish an Anti-
Ragging Control Room or helpline for the purpose of ensuring compliance of the provisions of these regulations.
(2) It is preferable to house Anti-Ragging Control Rooms within or near the hostel premises, which shall be
manned round the clock and the contact number or numbers shall be provided to all students and their parents at the
time of admission.
(3) The Anti-Ragging Control Room or helpline maybe a single-point contact for all emergencies arising out of
incidents of ragging, and on receiving calls, the necessary information shall be simultaneously relayed and
disseminated immediately to appropriate personnel including the security and police.
14. Mentoring Committee or Mentoring Cell.–– (1) The medical college or institution shall, at the end of each
academic year, in order to promote the objectives of these regulations, constitute a Mentoring Committee or
Mentoring Cell.
(2) The Mentoring Committee or Mentoring Cell shall draw a list of faculty members who may volunteer to the
mentoring process.
(3) The system of mentoring, if so desired may be tried or graded with a group of junior mentors being
supervised or overseen by a single senior mentor.
(4) The number of students under each mentor may be decided appropriately by the medical college or institution
but as far as possible, not exceeding six.
(5) The broad functions of mentors shall be the following , namely:––
(i) interact individually with the mentee fresher student every day for ascertaining the problems or
difficulties, if any, faced by the fresher in the medical college or institution;
(ii) extend necessary help to the fresher in overcoming the same;
(iii) coordinate with the wardens of the hostels and to make surprise visits to the rooms in such hostels,
where a member or members of the group are lodged;
(iv) interact with the parents or guardians of the mentees to discuss and provide solutions to problems faced
by the student;
(v) maintain a diary of his/her interaction with the freshers under his charge;
(vi) senior students may be inducted into the mentoring process under supervision by faculty mentors.
15. Student Affairs or Hostel Committee.–– (1) The medical college or institution may choose to have a
separate Student Affairs or Hostel Committee to look after the affairs of the hostel under a senior faculty member who
shall oversee the affairs of the hostels.
(2) The designated warden referred to in regulation 16 may function under the Student Affairs or Hostel Committee,
which shall play an important role in co-coordinating and implementing all anti-ragging measures related to hostels.
16. Warden.–– (1) The hostel warden is a person employed or designated to take care of administrative affairs,
supervise boarding and lodging of students in hostels and ensure that the rules and regulations as applicable are
obeyed.
(2) Wardens shall be appointed as per the eligibility criteria laid down by University Grants Commission or any
other competent authority of the concerned University or the State Government or the medical college or institution.
(3) Wardens may be assisted by deputy wardens or assistant wardens, who shall perform similar duties under the
supervision of the warden.
(4) The warden may function under a Student Affairs or Hostel Committee or in any manner as approved by the

(5) The warden shall have an essential and important role to play in the anti-ragging efforts of the medical
college or institution, since the hostels are vulnerable areas, especially after normal academic hours when freshers and
senior students are likely to face each other in the hostels.
(6) The wardens shall be accessible at all hours and shall be provided with mobile phones.
(7) The medical college or institution shall review and suitably enhance the powers and perquisites of the warden
and authorities involved in curbing the menace of ragging.
(8) The medical college or institution shall empower the warden to control security personnel in hostels for anti-
ragging measures.
17. Duties and responsibilities of Universities.––(1) Every University administering medical colleges or
institutions may formulate its own regulations to curb ragging on the basis of the provisions contained in the UGC
Regulations on Curbing the Menace of Ragging in Higher Educational Institutions, 2009.
(2) Every University shall act as the nodal agency of the medical colleges or institutions which are affiliated with
it, being responsible for overall monitoring, reviewing and ensuring compliance to all relevant regulations and other
applicable laws for the time being in force, for prohibiting and preventing ragging in the affiliated colleges.
(3) Every University shall have a Monitoring Committee which shall be the prime-mover of implementation of
all anti-ragging activities of the affiliated medical colleges or institutions.
(4) The Monitoring Committee referred to in sub-regulation (3) shall––
(i) ensure compliance to the provisions of these regulations in letter and spirit, regularly;
(ii) oversee and monitor activities related to––
(a) Anti-Ragging Committee, Anti-Ragging Squads and Mentoring Committees or Mentoring Cells;
(b) publicity of anti-ragging regulations and laws;
(c) conduct of orientation programmes;
(d) conduct of orientation and counseling sessions;
(e) reviewing and approving reports of investigations related to ragging received from constituent colleges
or institutions;
(f) investigation of incidents of ragging by the medical colleges or institutions as provided under the
provisions of Chapter IV;
(g) implementation by medical colleges or institutions of suggestions for improvement; and
(h) any other such activity that may be necessary from time to time.
(5) Every University shall act as the Appellate Body for all decisions or orders related to incidents of ragging in
respect of its affiliated medical colleges or institutions as provided under regulation 25.
(6) The Universities shall regularly review the anti-ragging measures of its affiliated medical colleges or
institutions.
(7) The Universities shall take suitable action, as deemed fit, against defaulting medical colleges or institutions
affiliated with it for such non-compliance under intimation to the Commission and the State Governments or Central
Government as may be appropriate, which may include but is not limited to––
(i) withdrawal of affiliation or recognition or other privileges conferred; or
(ii) prohibiting such medical college or institution from presenting any student or students then undergoing
any programme of study therein for the award of any degree or diploma of the University; or
(iii) withdrawal of grants to the medical college or institution; or
(iv) hosting on the website the non-compliance, including incidents of ragging and the actions taken thereof
by the medical college or institution; or
(v) any other action as may deem fit, provided under the rules or regulations of such University.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
(8) The Universities shall play a facilitatory role and provide suggestions to the medical colleges or institutions
affiliated with them to make implementation of measures to prohibit and prevent ragging in such medical colleges or
institutions more effective so as to eradicate the menace altogether.
(9) All reports related to incidents of ragging and appeals thereof shall be provided to the Commission.
(10) Every University shall co-ordinate with the Commission, especially when punitive measures related to de-
recognition of institutions, courses and degrees are concerned, since several aspects of medical education and training
are regulated under the provisions of Act.
18. Duties and responsibilities of Commission.–– (1) The Commission shall monitor the medical colleges or
institutions through the Universities with which they are affiliated with regard to implementation and compliance of
the provisions of these regulations.
(2) Every medical college or institution shall submit a compliance report to the Commission annually in the
format provided in Form III.
(3) The Commission shall review compliance during recognition inspections or assessments by the Medical
Assessment and Rating Board.
(4) All incidents of ragging and reports thereof including outcome of appeals and directions from courts, if any,
shall be provided to the Commission by the medical college or institution and by the University with which such
medical college or institution is affiliated to.
(5) If an medical college or institution fails to comply with these regulations and curb ragging, the Commission
shall take appropriate action as it may deem fit which includes but is not limited to the following, namely:––
(i) initiate de-recognition process against such medical college or institution;
(ii) reduce the admission capacity of that medical college or institution to such extent to which the
Commission may deem fit;
(iii) stop further admission in that medical college or institution until further orders;
(iv) stop renewal of permission for undergraduate, postgraduate and super specialty medical courses;
(v) post the information regarding penalties so imposed on the concerned medical college or institution on
the website of the Commission for information of all concerned; and
(vi) any other exemplary measure, as may be necessary.
19. Courts.––Courts may make effort to ensure that cases involving ragging are taken up on priority basis to
send the correct message that ragging is not only to be discouraged but also to be dealt with sternness.
CHAPTER IV
DEALING WITH INCIDENTS OF RAGGING
20. Disciplinary matters to be resolved within the camps of institutions.––All matters of discipline within
medical college or institution shall be resolved within the campus of such medical college or institution, except those
impinging on law and order or breach of peace or public tranquility, which may be dealt with under the penal laws for
the time being in force.
21. Reporting incidents of ragging.–– (1) It shall be mandatory for all concerned to report every incident of
ragging.
(2) Not reporting an incident of ragging even by a fresher shall be viewed seriously and may amount to abetment
of ragging.
(3) The report or complaint of an incident of ragging may be made by––
(i) a fresher or a parent or other student; or
(ii) authorities of the hostel, security personnel or any other staff such as canteen staff; or
(iii) Head of the Institution, faculty member, or members of the Anti-Ragging Squad or Anti-Ragging

(iv) Others such as direct complaint to local Police or District Authorities.
(4) In all instances, without exception, the name of the complainant, especially students, unless otherwise
permissible, shall be kept confidential.
(5) Every information or complaint regarding incident of ragging shall be immediately and simultaneously
conveyed to the Head of the Institution either directly or through the Control Room or anti-ragging helpline.
(6) Other officials of the medical college or institution, as shall be previously decided upon, such as the members
of the Ant-Ragging Squad and Anti-Ragging Committee, hostel warden, security staff and others shall also be
simultaneously informed.
(7) Necessary mechanisms shall be kept in place by the medical colleges or institutions for immediately relaying
information regarding incidents of ragging to the University, district authorities, police officials.
22. Immediate action.–– (1) On receiving the information of an incident of ragging, the Anti- Ragging Squad or
an appropriate authority shall make an immediate on-the-spot enquiry and submit a report or recommendations to the
Head of the Institution.
(2) The Head of institution shall, immediately on receipt of such information or recommendation, determine if a
case under the penal laws is made out after inquiry as specified in regulation 23, proceed to file a First Information
Report within twenty-four hours of receipt of such information or recommendation either on his own or through a
member of the Anti-Ragging Committee or an official authorized by him in this behalf, with the police and local
authorities, under the appropriate penal provisions.
(3) If a parent or student directly files a First Information Report with the police, the Head of the medical college
or institution is not absolved of the responsibility of filing a First Information Report.
(4) The Head of the Institution shall also inform the University to which such medical college or institution is
affiliated and the Nodal Anti-Ragging Authority of the District and the Commission.
23. Institutional inquiry or investigation and report.–– (1) The Head of the Institution shall constitute a
specific committee to inquire into or investigate the incident of ragging without waiting for the report of any other
authority, even if this is being investigated by the police or local authorities.
(2) The inquiry or investigation shall be conducted thoroughly including on-the-spot or site of the incident in a
fair and transparent manner, without any bias or prejudice, upholding the principles of natural justice and giving
adequate opportunity to the student or students accused of ragging and other witnesses to place before it the facts,
documents and views concerning the incident of ragging, and considering such other relevant information as may be
required.
(3) The entire process shall be completed and a report duly submitted within seven days of the information or
reporting of the incident of ragging.
(4) The report shall be placed before the Head of the Institution or the Anti-Ragging Committee.
(5) The Anti-Ragging Committee shall examine the report, decide on and recommend further administrative
action to the Head of the Institution.
24. Institutional administrative and penal actions.–– (1) Every medical college or institution shall, after
receiving the recommendations of the Anti-Ragging Committee under regulation 23, take necessary administrative
action as it may deem fit.
(2) The Anti-Ragging Committee, on accepting the report of the institutional inquiry or investigation by the
appropriate committee, shall recommend one or more of the actions provided under sub-regulations(5) and (6)
depending on the nature, gravity and seriousness of the guilt established of the act of ragging as given under the
provisions of Chapter II with the understanding that the action shall be exemplary and justifiably harsh to act as a
deterrent against recurrence of such incidents:
(3) Where the individual person committing or abetting an act of ragging is not identified on the basis of the
findings of the institutional inquiry or investigations, and the subsequent recommendations thereof, the medical
college or institution thereof shall resort to collective punishment of more than one or a group of persons, as deemed
fit, as a deterrent to ensure community pressure on the potential raggers.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
(4) The broad ingredients that may call for punitive actions on receipt and approval of the recommendations
include but is not limited to––
(i) abetment to ragging;
(ii) criminal conspiracy to ragging;
(iii) unlawful assembly and rioting while ragging;
(iv) public nuisance created during ragging;
(v) violation of decency and morals through ragging;
(vi) physical or psychological humiliation;
(vii) causing injury to body, causing hurt or grievous hurt;
(viii) wrongful restraint;
(ix) wrongful confinement;
(x) use of criminal force;
(xi) assault as well as sexual offences or even unnatural offences;
(xii) extortion in any form;
(xiii) criminal intimidation;
(xiv) criminal trespass;
(xv) offences against property;
(xvi) any other act construed as provided under regulations3 and 4.
(5) The nature of punitive actions that may be decided shall include the following, but shall not be limited to one
or more of these actions that may be imposed, as deemed fit, namely:––
(i) suspension from attending classes and academic privileges;
(ii) withholding or withdrawing scholarship or fellowship and other benefits;
(iii) debarring from appearing in any test or examination or other evaluation process;
(iv) withholding results;
(v) debarring from attending conferences, and other academic programmes;
(vi) debarring from representing the institution in any regional, national or international meet, tournament,
youth festival, etc. ;
(vii) suspension or expulsion from the hostel;
(viii) imposition of a fine ranging from twenty-five thousand rupees to one lakh rupees;
(ix) cancellation of admission;
(x) rustication from the medical college or institution for a period ranging from one to four semesters;
(xi) expulsion from the medical colleges or institutions and consequent debarring from admission to any
other institution for a specified period.
(6) Without prejudice to the provisions of regulation 8, it shall be mandatory upon the medical college or
institution to enter in the Migration Certificate or Transfer Certificate issued to the student as to whether the student
has been punished for the offence of committing or abetting ragging, or not, as also whether the student has displayed
persistent violent or aggressive behaviour or any inclination to harm others.
(7) Any other measure as directed by Courts of law shall be followed by the medical college or institution.
(8) The Head of the Institution shall follow-up the information regarding the incident of ragging provided under
sub-regulation (4) of regulation 22, to the University to which the medical college or institution is affiliated with a
report regarding the findings of the institutional level inquiry or investigation and the actions taken thereof.[भाग III—खण् ड 4] भारत का राजपि : अुाधारण 33
(9) The Head of the Institution shall provide a report regarding the incident of ragging and the actions taken
thereof to the Commission having informed earlier according to the provisions of sub-regulation (4) of regulation 22.
25. Appellate authorities.––Every person who have been awarded punitive measures or punishments shall, in
view of the principles of natural justice, have the right to appeal with the following, namely:––
(a) for decisions ororders at the level of the medical college or institution:
(i) theVice Chancellor of the University to which the such medical college or institution is affiliated;
(ii) the Director orChief Executive Officer,in the case of institutions of national importance;
(b) for decisions or orders at the level of the University:
(i) the Chancellor of the University to which the medical college or institutionis affiliated;
(ii) thePresident in the case of institutions of national importance.
26. Fixing of responsibility.–– (1) In addition to the inquiry or investigation of the incident of ragging, it shall
be appropriately inquired as to if there has been any dereliction of duty or lapse bythe medical college or institutionin
preventing and handling suchincident.
(2) The Head of the Institution shall take prompt and appropriate action against each person whose dereliction of
duty led to the incident.
(3) In case the lapse is on the part of the Head of the Institution, the authority designated to appoint the Head of
the Institution shall, in its turn, take prompt and appropriate action.
(4) In addition to appropriate penal consequences, departmental enquiries may be initiated against such Heads of
Institutions or members of the administration or faculty members or non-teaching staff and others who display an
apathetic or insensitive attitude towards complaints of ragging.
(5) Remedial measures shall be instituted by the medical college or institution based on experiences.
(6) The University and the Commission shall be informed regarding the actions taken under the provisions of
this regulation.
27. Functions of affiliated University.–– (1) The University to which the medical college or institution is
affiliated shall be informed of the incident of ragging by such medical college or institution as required under sub-
regulation (7) of regulation 21
(2) The University shall receive the report regarding the inquiry or investigation and action taken from the
medical college or institution.
(3) The University shall act as the Appellate Authority as provided under regulation 25.
(4) The University shall take action as it may deem fit in accordance with the provisions of regulation17.
(5) The University shall ensure compliance of orders or directions, if any, from the Court of law.
28. Functions of Commission.–– (1) The Commission shall be informed of the incident of ragging by the
medical college or institution as required under sub-regulation (7) of regulation 21.
(2) The Commission shall receive the report regarding the inquiry or investigation and action taken including the
outcome of appeals, if any, from the medical college or institution and the University.
(3) The Commission shall, on review of the reports, take appropriate action as in accordance with the provisions
of regulation18.
(4) Without prejudice to the provisions of sub-regulations (1) to (3), the Commission may take the following
actions, if it deems fit, namely:––
(a) impose an exemplary fine of one lakh rupees for each incident of ragging payable by the erring medical
college or institution to such authority as may be designated by the appropriate Government, as the
case may be; or
(b) declare the erring medical college or institution or University, as not having the minimum academic
standards and warning the potential candidates for admission at such medical college or institution or
University through public notice and posing on the Commission’s website; or34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
(c) declare the erring medical college or institution or University to be ineligible for preferring any
application under the provisions of Chapter VI of the National Medical Commission Act, 2019 for a
minimum period of one year, extendable by such quantum by the Commission as would be
commensurate with the wrong.
