जनम्नजलजखत जवजनयम बनाता ह:ै-
1. सजं िप्त िीर्िक और प्रारंभण –(1) ये जवजनयम, राष्ट रीय आयुर्विज्ञान आयोग (जवििे ी आयुर्विज्ञान स्ट् नातक लाइसेंजसएट)
जवजनयमावली, 2021कह ेिाएंगे।
(2) ये भारत के सरकारी रािपत्र में उनके अंजतम प्रकािन की तारीख को प्रावृत् त होंगे।
2. पठरभार्ाएं– इन जवजनयमों म,ें िब तक संिभि से अन् यथा अपेजित न हो, -
(क) ''अजधजनयम'' से, राष्ट रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 (2019का 30) अजभप्रेत है;
(ख) ''आयोग'' से, अजधजनयम की धारा 3 के अंतगित गठित राष्ट रीय आयुर्विज्ञान आयोग अजभप्रेत ह;ै
(ग) ''जवििे ी आयुर्विज्ञान स्ट् नातक'' से कोई ऐसा व् यजि अजभप्रेत ह ैजिसके पास भारत में जचदकत् सा व् यवसाय के जलए लाइसेंस
प्राप्त करने के जलए भारत में दकसी जवश् वजव्ालय या मेजडकल कॉलेि या संस्ट् थान से मूल स्ट् नातक या प्राथजमक िैजिक योग्य ता
(स्ट् नातक-पूव िमेजडकल जडग्री) नहीं ह;ै
(घ) ''जचदकत् सा–िास्ट् त्र'' से अपनी सभी िाखाओं में आधुजनक वैज्ञाजनक जचदकत् सा-िास्ट् त्र अजभप्रेत ह ैऔर इसमें िल् य-जचदकत् सा
तथा प्रसूजत-जवज्ञान िाजमल ह,ै परंतु इसमें पिुजचदकत् सा-िास्ट् त्र और िल् यजचदकत् सा िाजमल नहीं ह।ै

(ङ) ''स्ट् थायी पंिीकरण'' अजधजनयम के अध्य ाय VI के उपबंधों के अंतगित यथा जवजनयजमत, दकसी जवजधवत् मान् यताप्राप्त
प्राथजमक आयुर्विज्ञान िैजिक योग्य ता वाले पात्र व् यजियों का पंिीकरण है, िो स्ट् थायी जचदकत् सा जवजनयमावली, 2021 के अंतगित यथा
जवजनयजमत, भारत में आधुजनक वैज्ञाजनक और्ध प्रणाली या ऐलोपैजथक में स्ट् वतंत्र रूप से प्रैजटटस करने की अनुमजत प्रिान करता ह ै या
लाइसेंस उपलब् ध कराता ह;ै
(च) ''अनुसूची'' से इन जवजनयमों से संबद्ध अनुसूची अजभप्रेत ह;ै
(छ) ''पयिवेजित इंटनिजिप'' से मेंटरों द्वारा दकसी इंटनि का प्रजििण अजभप्रेत ह ै तादक वह अनुकंपा के साथ स्ट् वतंत्र रूप से
सुरजित जनवारक, उन् नायक, उपचारात् मक, प्रिामक और हॉजलजस्ट्टक िखे भाल प्रिान करने के जलए दकसी प्राथजमक िखे भाल जचदकत् सक
के जलए समुजचत, और्ध की जभन् न-जभन् न जवधाओं में नैिाजनक और जचदकत् सीय कौिलों में जवश् वसनीय सिमताओं वाला जचदकत् सक बन
सके और सामान् य अजतपाजत आपातकाजलक जस्ट्थजतयां संभालने का जवश् वास वाला हो।
(2) इन जवजनयमों में इस्ट् तेमाल दकए गए और इसमें पठरभाजर्त न दकए गए परंतु अजधजनयम में पठरभाजर्त दकए गए िब् िों
और अजभव् यजियों का वही अथि होगा, िो अजधजनयम में उन् ह ेंदिया गया ह।ै
3. भारत म ेंजचदकत्स ा व्य वसाय करन ेके जलए, जवििे ी आयर्ु वज्ञि ान स्ट्न ातक का जनर्ेध –कोई भी जवििे ी आयुर्विज्ञान स्ट् नातक
भारत में जचदकत् सा व् यवसाय नहीं करेगा, िब तक उसे इन जवजनयमों के उपबंधों के अनुसार स्ट् थायी पंिीकरण प्रिान न कर दिया गया
हो।
4. जविेिी आयर्ु वज्ञि ान स्ट्न ातक को स्ट्थ ायी पंिीकरण प्रिान करना –दकसी भी जवििे ी आयुर्विज्ञान स्ट् नातक को स्ट् थायी
पंिीकरण प्रिान नहीं दकया िाएगा, िब तक उसने –
(क) (i) कोई ऐसा पाठ्यक्रम पूरा न कर दिया हो, जिसके पठरणामस्ट् वरूप 54 महीने की न् यूनतम अवजध वाली जवििे ी
आयुर्विज्ञान जडग्री के जलए तैयार हो;
(ii) उसी जवििे ी आयुर्विज्ञान संस्ट् थान में 12 महीने की न् यूनतम अवजध की इंटनिजिप पूरी न कर ली हो;
(iii) अंग्रेिी में जििण के माध्य म से जवििे ी आयुर्विज्ञान जडग्री प्राप्त न कर ली हो; और
(iv) अनुसूची-। में जवजनर्िष्टि ट अजनवायि जवर्यों में अध्य यन न दकया हो;
(ख) संबंजधत व् यावसाजयक जवजनयामक जनकाय में पंिीकरण न कराया हो या अन् यथा उस ििे के अपने संबंजधत िेत्राजधकार
में जचदकत् सा व् यवसाय करने के जलए लाइसेंस प्रिान दकए िाने के जलए सिम न हो, जिसमें आयुर्विज्ञान जडग्री प्रिान की गई हो और उस
ििे के नागठरक को दिए गए, जचदकत् सा व् यवसाय करने के जलए लाइसेंस के समतुल् य हो;
(ग) आयोग को इसके जलए आवेिन करने के पश् चात 12 महीने की न् यूनतम अवजध के जलए भारत में पयिवेजित इंटनिजिप पूरी
न कर ली हो; और
(घ) राष्ट रीय एजग्िट परीिा या ऐसी अन् य अजनवायि परीिा या आयोग द्वारा आयोजित परीिा उत् तीणि न कर ली हो।
5. इन जवजनयमों की अनप्रु योज्य ता - (1) जवजनयम 4 में िी गई दकसी बात के होते हुए भी, ये जवजनयम जनम् नजलजखत पर
लाग ूनहीं होंगे-
(क) ऐसे जवििे ी आयुर्विज्ञान स्ट् नातक, जिन् होंने, इन जवजनयमों के प्रवृत् त होने से पहले कोई जवििे ी आयुर्विज्ञान जडग्री या
प्राथजमक िैजिक योग्य ता, िैसा भी मामला हो, प्राप्त कर ली हो;
(ख) ऐसे अभ् यथी, िो इन जवजनयमों के प्रवृत् त होने से पहले जवििे ी संस्ट् थानों में अपनी जििा प्राप्त कर रह ेहैं; और
(ग) ऐसे जवििे ी आयुर्विज्ञान स्ट् नातक, िो अजधसूचना द्वारा आयोग या केंद्र सरकार द्वारा जविेर् रूप से छूट प्राप्त ह।ैं
(2) ऐसे जवििे ी आयुर्विज्ञान स्ट् नातक, जिन् होंने कोई जवििे ी आयुर्विज्ञान जडग्री या प्राथजमक िैजिक योग्य ता, िैसा भी मामला
हो, पूरी कर ली है और ऐसे अभ् यथी िो इन जवजनयमों के प्रवृत् त होने से पहले जवििे ी संस्ट् थानों में अपनी जििा प्राप्त कर रहे हैं, लाग ू
होने वाले तत् कालीन जवजनयमों द्वारा जवजनयजमत होंगे।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3
(3) इन जवजनयमों में दकसी बात के होते हुए भी, जचदकत् सा व् यवसाय करने के जलए दकसी स्ट् थायी पंिीकरण की स्ट् वीकृजत
िारी नहीं की िाएगी, यदि इससे सरकारी नीजत या राष्ट रीय सुरिा का उल् लंघन होता हो।

करन ेका मापिडं
1. भारत में जचदकत् सा व् यवसाय करने के जलए दकसी जवििे ी आयुर्विज्ञान स्ट् नातक को लाइसेंस िने े हते ु मागिििी जसद्धांत यह
सुजनजित करना ह ैदक जवििे ी आयुर्विज्ञान स्ट् नातक, दकसी भारतीय आयुर्विज्ञान स्ट् नातक के समतुल् य या अनुरूप जििा और प्रजििण की
ितें पूरी करता है।
2. भारत के बाहर के दकसी ििे म ेंप्राथजमक जचदकत्स ा िजै िक योग्य ता के जलए पात्रता-
(i) उन जवर्यों म ें पाठ्यक्रम और प्रजििण की अवजध जिसके पठरणामस्ट् वरूप प्राथजमक जचदकत्स ा िजैिक योग्य ता के जलए
तयै ार हो:
(क) कोई व् यजि, िो जवििे ी आयुर्विज्ञान जडग्री पाठ्यक्रम में अध्य यन करता ह,ै उसे भारत में आयुर्विज्ञान एव ं िल् यजचदकत् सा
स्ट् नातक (एमबीबीएस) के समतुल् य जसद्धांत, प्रयोगात् मक और नैिाजनक प्रजििण का पाठ्यक्रम पूरा दकया हुआ होना चाजहए; और
(ख) कम् युजनटी मेजडजसन, िनरल मेजडजसन, मनजिदकत् सा, बाल रोग, िनरल िल् यजचदकत् सा, संचेतनाहर-जवज्ञान, प्रसूजत-
जवज्ञान एव ं स्ट् त्रीरोग-जवज्ञान, अजस्ट्थरोग-जवज्ञान, कणि नाजसका कान-नाक-गला रोग-जवज्ञान, नेत्ररोग-जवज्ञान त् वचारोग-जवज्ञान,
आपातकाजलक या हताहत सेवाओं, प्रयोगिाला सेवाओं और उनकी उप-जविेर्ज्ञताओं सजहत परंतु इन् हीं तक सीजमत नहीं, नैिाजनक
जवर्यों में व् यावहाठरक प्रजििण के साथ-साथ, उसी जवििे ी संस्ट् थान में, िहां प्राथजमक जचदकत् सा िैजिक योग्य ता प्राप्त की गई ह,ै खंड
(क) में उजल्लजखत इस पाठ्यक्रम के अजतठरट त 12 महीने की इंटनिजिप पूरा दकया हुआ होना चाजहए।
(ii) उस पाठ्यक्रम या प्रजििण की जवर्य-वस्ट्त ु जिसके पठरणामस्ट्व रूप प्राथजमक जचदकत्स ा िजै िक योग्य ता के जलए तयै ार
हो:
(क) पाठ्यक्रम और इंटनिजिप या नैिाजनक ट लकिजिप, स्ट् नातक आयुर्विज्ञान जििा जवजनयमावली, 1977 और उसके उत् तरवती
संिोधनों के अनुसार भारत के एमबीबीएस पाठ्यक्रम के अनुरूप होगी और इनमें अजधजनयम की धारा 61 की उप-धारा (2) के अंतगित
आयोग द्वारा जवजधवत् मान् यताप्राप्त , इसमें उजल्लजखत जवर्य िाजमल होंगे;
(ख) पाठ्यक्रम का कॅठरकुलम, समुजचत प्राजधकाठरयों द्वारा और यदि आवश् यक हो, उस संस्ट् थान या जवश्व जव्ालय, िहां
पाठ्यक्रम म ेंिाजमल होने के समय पर पाठ्यक्रम में अध्य यन दकया िा रहा है, की वेबसाइट में समीिा के जलए उपलब् ध कराया िाएगा।
(iii) मजे डकल कॉलिे या सस्ट्ं थ ान का स्ट्थ ान और पाठ्यक्रम या प्रजििण का सचं ालन:
पूरा पाठ्यक्रम, प्रजििण और इंटनिजिप या ट लकिजिप, अध्य यन के पूरे पाठ्यक्रम में उसी जवििे ी आयुर्विज्ञान संस्ट् थान में भारत
के बाहर पूरी की िाएगी और जचदकत् सीय प्रजििण और इंटनिजिप का कोई भी भाग, भारत में या उस ििे , िहां प्राथजमक जचदकत् सा
िैजिक योग य् ता प्राप्त की गई है, के अलावा दकसी अन् य ििे में पूरा नहीं दकया िाएगा।
(iv) पाठ्यक्रम की अवजध:
जवििे ी आयुर्विज्ञान स्ट् नातक पाठ्यक्रम की कुल अवजध, पाठ्यक्रम में िाजमल होने की तारीख से 10 वर्ि के अंिर पूरी की
िाएगी।

NATIONAL MEDICAL COMMISSION
NOTIFICATION
New Delhi, the 18th November, 2021
No. UGMEB/NMC/Rules & Regulations/2021/.–––In exercise of the powers conferred by section 57 read
with sub-section (4) of section 15 of the National Medical Commission Act, 2019 (30 of 2019), the National Medical
Commission hereby makes the following regulations namely:-
1. Short title and commencement.––(1) These Regulations may be called the National Medical
Commission (Foreign Medical Graduate Licentiate) Regulations, 2021.
(2) They shall come into force on the date of their final publication in the Official Gazette of India.
2. Definitions.–– In these regulations, unless the context otherwise requires,––
(a) “Act” means the National Medical Commission Act, 2019 (30 of 2019);
(b) “Commission” means the National Medical Commission constituted under section 3 of the Act;
(c) “Foreign Medical Graduate” means a person who does not have basic graduation or primary
qualification (undergraduate medical degree) from any University or medical college or institution in India, to seek
license for medical practice in India;
(d) “Medicine” means modern scientific medicine in all its branches and includes surgery and obstetrics, but
does not include veterinary medicine and surgery;
(e) “Permanent Registration” is the registration of eligible persons with a duly recognised primary medical
qualification as regulated under the provisions of Chapter VI of the Act, which permits or provides license to an
individual to independently practice modern scientific system of medicine or allopathy in India, as regulated under the
Permanent Medical Regulations, 2021;
(f) “Schedule” means the Schedule annexed to these regulations;
(g) ”Supervised Internship” means training of an intern by mentors so that he becomes a clinician with
reliable competencies in diagnostic and therapeutic skills in different disciplines of medicine, appropriate for a
primary care physician, to independently provide safe preventive, promotive, curative, palliative and holistic care with
compassion and is confident of handling common acute emergencies.
(2) Words and expressions used in these regulations and not defined herein but defined in the Act, shall have
the respective meanings assigned to them in the Act.
3. Prohibition of foreign medical graduate to practice medicine in India.––No foreign medical graduate
shall practice medicine in India, unless he is granted permanent registration in accordance with the provisions of these
regulations.
4. Grant of permanent registration to Foreign Medical Graduate.––No foreign medical graduate shall
be granted permanent registration, unless he has–
(a) (i) undergone a course leading to foreign medical degree with minimum duration of fifty-four months;
(ii) Undergone an internship for a minimum duration of twelve months in the same foreign medical
institution;
(iii) Received a foreign medical degree with medium of instructions in English; and
(iv) studied the mandatory subjects specified in the Schedule-I;
(b) registered with the respective professional regulatory body or otherwise, competent to grant license to
practice medicine in their respective jurisdiction of the country in which the medical degree is awarded and at par with
the license to practice medicine given to citizen of that country;
(c) undergone supervised internship in India for a minimum term of twelve months, after applying for the
same to the Commission; and
(d) has cleared the National Exit Test or such other mandated test or tests conducted by the Commission.
5. Applicability of these regulations.––(1)Notwithstanding anything contained in regulation 4, these
regulations shall not be applicable––
(a) To foreign medical graduates who have acquired a foreign medical degree or primary qualification, as
the case may be, prior to the coming into force of these regulations;
(b) to candidates who are pursuing their education in foreign institutions prior to the coming into force of

(c) to such foreign medical graduates who are specifically exempted by the Commission or the Central
Government, as the case may be, by notification.
(2) The foreign medical graduates who have acquired a foreign medical degree or primary qualification, as
the case may be, and the candidates who are pursuing their education in foreign institutions, prior to the coming into
force of these regulations, shall be governed by the erstwhile applicable regulations.
(3) Notwithstanding anything contained in these regulations, no grant of permanent registration to practice
medicine shall be issued if the same infringes upon public policy or national security.
SCHEDULE-I

CRITERIA TO RECOGNISE FOREIGN MEDICAL GRADUATES APPLYING FOR LICENCE OR
PERMANENT REGISTRATION TO PRACTICE IN INDIA
1. The guiding principle for licensing a foreign medical graduate to practice in India is to ensure that the
Foreign Medical Graduate fulfils the requirements of education and training equivalent or commensurate with that of
an Indian medical graduate.
2. Eligibility for primary medical qualification in a country outside India:
(i) Duration of course and training in subjects leading to primary medical qualification:
(a) Any person who pursue the foreign medical degree should have undergone a course of theory, practical
and clinical training equivalent to Bachelor of Medicine and Bachelor of Surgery (MBBS) of India; and
(b) Should have been completed internship of twelve months in addition to such course referred to in clause
(a), in the same foreign institution where the primary medical qualification has been obtained, along with hands-on
training in clinical subjects including but not limited to Community Medicine, General Medicine, Psychiatry,
Paediatrics, General Surgery, Anaesthesia, Obstetrics and Gynaecology, Orthopaedics, Otorhinolaryngology,
Ophthalmology, Dermatology, Emergency or Casualty services, lab services and their sub-specialties.
(ii) Content of course or Training leading to primary medical qualification
(a) The course and internship or clinical clerkship shall commensurate with the MBBS course of India in
accordance with the Regulations on Graduate Medical Education, 1997and subsequent amendments thereto, and shall
include the subjects mentioned therein as are duly recognised by the Commission under sub- section (2) of section 61
of the Act;
(b) The course curriculum shall be made available for review by appropriate authorities, and if necessary, in
the website of the institution or university where the course is being pursued at the time of joining the course.
(iii) Location of medical college or institution and administration of the course or training:
The entire course, training and internship or clerkship shall be done outside India in the same foreign medical
institution throughout the course of study and no part of medical training and internship shall be done in India or in
any country other than country from where the primary medical qualification is obtained.
(iv) Duration of course:
The total duration of the foreign medical graduation course shall be completed within ten years from the date
of joining the course.
