## Report on the Damodar Valley Corporation Conduct of Business Amendment Regulations, 2021 **1. Executive Summary:** This report analyzes the Damodar Valley Corporation Conduct of Business Amendment Regulations, 2021, which amends the Damodar Valley Corporation Conduct of Business Regulations, 1951. The core purpose of this amendment, as inferred from the text, is to modify the quorum requirements for meetings of the Damodar Valley Corporation. The key finding is a change in the composition required for a quorum, specifying minimum representation from whole-time members and representatives from the Central Government or the Governments of Jharkhand or West Bengal. **2. Introduction:** This report provides an informative overview of the Damodar Valley Corporation Conduct of Business Amendment Regulations, 2021, based solely on the provided policy text. It aims to clarify the changes introduced by this amendment and their potential impact. **3. Policy Overview:** * This document is an amendment to the Damodar Valley Corporation Conduct of Business Regulations, 1951. * The core objective, as stated in the text, is to amend the Damodar Valley Corporation Conduct of Business Regulations, 1951, to change the rules regarding the quorum needed for the Corporation's meetings. **4. Background and Rationale:** This amendment likely aims to ensure adequate representation from key stakeholders and full-time members during Corporation meetings. By specifying minimum representation from whole-time members and governmental representatives, the amendment seeks to enhance the decision-making process and ensure diverse perspectives are considered. The previous quorum rule may have been deemed insufficient in guaranteeing this, leading to this modification. **5. Key Provisions / Changes:** This amendment modifies regulation 4 of the Damodar Valley Corporation Conduct of Business Regulations, 1951, which pertains to the quorum. * **Specific Part Changed:** Regulation 4 concerning the quorum. * **New Rule/Provision:** "Half of the total Members of the Corporation shall form a quorum at a meeting of the Corporation out of whom, a. any two shall be whole time members; and b. any two shall be representative of the Central Government or Government of Jharkhand or Government of West Bengal." * **Difference/Effect of Change:** Previously, the text does not specify the specific requirements to form a quorum. The amendment now mandates that any quorum must include at least two whole-time members *and* at least two representatives from the Central Government, Government of Jharkhand, or Government of West Bengal. This raises the minimum number of participants who need to be present for a valid quorum. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders directly affected by this amendment are: * Members of the Damodar Valley Corporation. * Whole-time members of the Damodar Valley Corporation. * Representatives from the Central Government. * Representatives from the Government of Jharkhand. * Representatives from the Government of West Bengal. In essence, anyone involved in meetings of the Corporation. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Damodar Valley Corporation is responsible for implementing these amended regulations. The Central Government provided previous sanction. * **Timelines/Procedures:** The amendment came into force on the date of its publication in the Official Gazette (November 16, 2021, as indicated in the document). The Corporation must now adhere to the new quorum requirements for all subsequent meetings. The amended regulation will now need to be followed in order for a meeting to constitute a quorum. * Since this is a change related to a quorum, it could also influence the scheduling of future meetings. **8. Expected Outcomes / Impact of Changes:** The intended outcome of these changes is to ensure broader and more balanced representation in Corporation meetings. By requiring minimum representation from whole-time members and government representatives, the amendment likely aims to improve the quality of discussions, foster more informed decision-making, and enhance accountability. The impact will be that, theoretically, any meeting of the corporation will have the key voices involved. **9. Conclusion:** The Damodar Valley Corporation Conduct of Business Amendment Regulations, 2021, represent a significant adjustment to the quorum requirements for Corporation meetings. By mandating minimum representation from specific member categories, it is designed to enhance the Corporation's governance and decision-making processes. Stakeholders should be aware of these changes to ensure compliance and effective participation in future meetings.
