1. (1) इन िनयम" का संि34 नाम भारत का (cid:7)ित(cid:9)पधा (cid:12)आयोग (साधारण) सशं ोधन िविनयम, 2019 ह ै।
(2) य ेउनके राजप8 म 9(cid:7)काशन क(cid:27) तारीख को (cid:7)वृ ह"गे ।
2. भारत का (cid:7)ित(cid:9)पधा(cid:12) आयोग (साधारण) िविनयम, 2009 म,9--
(1) िविनयम 10 के उपिविनयम (2) म,9 खंड (घ) के प?ात् िन(िलिखत खंड अतं :(cid:9)थािपत @कया जाएगा, अथा(cid:12)त् :--
“(घक) सूचना देन े वाल े Cि! और प3कार" के बीच सूचना क(cid:27) िवषय-व(cid:9)तु के संबंध म 9 @कसी Fयायालय,
अिधकरण, काननू ी (cid:7)ािधकरण या मGय(cid:9)थ के सम3 लंिबत मकु दम ेया िववाद के Hयौरे ;”;
(2) िविनयम 35 म,9--
(क) उपिविनयम (1) के प?ात् िन(िलिखत परंतुक अतं :(cid:9)थािपत @कया जाएगा, अथा(cid:12)त् :--
“परंत ु जहा ं अिधिनयम के (cid:7)योजन" के िलए सूचना दने े वाल े Cि! क(cid:27) पहचान करना समीचीन ह,ै
वहां आयोग सूचना देने वाले Cि! को सनु वाई का अवसर दने े के प?ात् उसक(cid:27) पहचान का (cid:7)कटन
करेगा ।”;

(ख) @कसी गैर-सरकारी संगठन (एनजीओ) या उपभो!ा संगम या @कसी सहकारी सोसाइटी या
Fयास क(cid:27) दशा म 910,000 (दस हजार) Uपए, या
(ग) @कसी फम(cid:12) ((cid:9)वािमQव, भागीदारी अथवा सीिमत दाियQव भागीदारी सिहत) या ऐसी कंपनी

NOTIFICATION
New Delhi, the 20th November, 2019
The Competition Commission of India (General) Amendment Regulations, 2019
No. L-3(2)/Regln-Gen. (Amdt.)/2019/CCI.—In exercise of the powers conferred by section 64 of the
Competition Act, 2002 (12 of 2003), the Competition Commission of India hereby makes the following regulations further to
amend the Competition Commission of India (General) Regulations, 2009, namely :—
1. (1) These regulations may be called the Competition Commission of India (General) Amendment Regulations,
2019.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Competition Commission of India (General) Regulations, 2009,--
(1) in regulation 10, in sub-regulation (2), after clause (d), the following clause shall be inserted, namely :-
“(da) Details of litigation or dispute pending between the informant and parties before any court,
tribunal, statutory authority or arbitrator in respect of the subject matter of information ;";¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3
(2) in regulation 35,-
(a) after sub-regulation (1), the following proviso shall be inserted, namely:-
“Provided that where it is expedient to disclose the identity of the informant for the purposes of the
Act, the Commission shall do so after giving an opportunity to the informant of being heard.";
(b) in sub-regulation (10), after the words “regarding confidential treatment” the following words and
figures shall be inserted, namely:-
“within a period not exceeding 30 days from the receipt of the order passed by the Director
General.”;
(3) in regulation 49, for sub-regulation (1), the following sub-regulation shall be substituted, namely :-
“(1) Each information received under clause (a) of sub-section (1) of section 19 of the Act from any
person shall be accompanied by proof of having paid the fee as under,—
(a) rupees 5,000 (five thousand) in case of individual or Hindu Undivided Family (HUF), or
(b) rupees 10,000 (ten thousand) in case of Non-Government Organisation (NGO), or Consumer
Association, or a Co-operative Society, or Trust, or
(c) rupees 40,000 (forty thousand) in case of firm (including proprietorship, partnership or
Limited Liability Partnership) or company (including one person company) having turnover
in the preceding year upto rupees two crore, or
(d) rupees 1,00,000 (one lac) in case of firm (including proprietorship, partnership or Limited
Liability Partnership) or company (including one person company) having turnover in the
preceding year exceeding rupees two crore and upto rupees 50 crore
(e) rupees 5,00,000 (five lacs) in the cases not covered under clause (a) or (b) or (c) or (d).".
