## Report on the Competition Commission of India General Amendment Regulations, 2021
**1. Executive Summary:**
This report analyzes the Competition Commission of India General Amendment Regulations, 2021 (No. 3 of 2021), which amends the Competition Commission of India General Regulations, 2009. The core purpose of this amendment is to broaden the authorization powers related to the functions of the Commission, specifically by allowing the Chairperson to authorize other officers of the Commission beyond those initially specified. The key finding is that this amendment aims to enhance operational flexibility and efficiency within the Commission.
**2. Introduction:**
The purpose of this report is to provide an informative overview of the Competition Commission of India General Amendment Regulations, 2021 (No. 3 of 2021), based solely on the information contained within the provided policy text. This report outlines the background, key provisions, and likely impact of this amendment to the existing Competition Commission of India General Regulations, 2009.
**3. Policy Overview:**
* This document is an **Amendment** to the Competition Commission of India General Regulations, 2009.
* **Core Objective(s):** Based on the text, the core objective of *this amendment* is to broaden the scope of authorized officers who can perform specific functions within the Commission. This suggests an aim to increase flexibility and potentially expedite processes.
**4. Background and Rationale:**
* **Amendment Rationale:** The amendment focuses on Regulation 14, sub-regulation 3, of the 2009 Regulations. The addition of the proviso suggests that the original regulation may have been too restrictive in limiting which officers could be authorized for certain tasks. The rationale for this amendment appears to be to provide the Chairperson with greater discretion in delegating authority, potentially addressing bottlenecks or enhancing the efficiency of Commission operations.
**5. Key Provisions / Changes:**
This section details the changes introduced by the 2021 amendment:
* **Specific Part of Original Policy Changed:** Regulation 14, sub-regulation 3 of the Competition Commission of India General Regulations, 2009.
* **New Rule/Provision:** The amendment adds the following proviso after clause (a) in sub-regulation 3 of regulation 14: "Provided that the Chairperson may also authorize other Officers of the Commission for the purpose."
* **Difference/Effect of the Change:** The original regulation (without knowing the exact wording from the provided text) likely limited the officers who could be authorized for specific purposes. This amendment empowers the Chairperson to authorize *other* officers within the Commission to perform those same functions. This broadens the pool of individuals who can be delegated authority, offering the Chairperson greater flexibility in resource allocation and potentially speeding up decision-making processes.
**6. Target Audience and Stakeholders:**
Based on the provided text, the primary target audience and stakeholders are:
* The Chairperson of the Competition Commission of India
* Officers of the Competition Commission of India
* Entities subject to the Competition Act, 2002, as the amendment potentially affects the efficiency and speed of the Commission's processes.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Competition Commission of India is the responsible body.
* **Timelines/Procedures:** The regulations come into force on the date of their publication in the Official Gazette (September 6, 2021). The text does not specify further procedures. It is assumed that the Chairperson will implement this change through internal directives or guidelines.
* **Implementation Specific to Changes:** The chairperson now needs to implement a mechanism or policy for the authorization of officers.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this amendment is to:
* Increase the Chairperson's flexibility in assigning responsibilities.
* Potentially expedite the Commission's internal processes by broadening the pool of officers who can be authorized for specific tasks.
* Improve the efficiency of the Commission's operations by enabling more flexible resource allocation.
**9. Conclusion:**
The Competition Commission of India General Amendment Regulations, 2021, represent a refinement of the existing regulatory framework. By expanding the Chairperson's authority to delegate responsibilities to a wider range of officers, this amendment aims to enhance the operational efficiency and responsiveness of the Competition Commission of India. While the specific impact will depend on how the Chairperson implements this change, the amendment signals a commitment to streamlining internal processes and ensuring the effective enforcement of competition laws. The significance lies in the increase in efficiency that may come to the Commission with the broader authorization of officers.
