और संशोधन करन े के िलए एतद-् ारा िन9िलिखत िनयम बनाती ह,ै अथा=त:्-
1. (1) इन िनयम1 का संि@A नाम भारतीय पशुिच(cid:4)क(cid:28)सा प(cid:30)रषद ्(संशोधन) िनयम, 2019 ह।ै
(2) य े िनयम इनके राजपD म E.काशन क( तारीख को .वृ/ ह1गे।
2. भारतीय पशुिच(cid:4)क(cid:28)सा प(cid:30)रषद ्िनयम, 1985 म E (िजसे इसम E इसके पGात ् उ0 िनयम कहा गया ह)ै िनयम 16 के Iथान
पर िन9िलिखत िनयम रखा जाएगा, अथात= -्
‘‘‘‘‘‘‘‘11116666 ममममततततददददाााानननन....————(1) य(cid:4)द िनवाच= न के िलए स(cid:10)यक Jप से नामिनKदL अMयNथय1 क( संOया िनवा=िचत होने वाले सदIय1
क( संOया से अिधक नहP ह ैतो (cid:30)रटRनग ऑ(cid:4)फसर उसी समय ऐसे अMयNथय1 को स(cid:10)यक Jप स े िनवा=िचत घोिषत करेगा।
(2) य(cid:4)द ऐसे अMयNथय1 क( संOया िनवा=िचत होने वाले सदIय1 क( संOया से अिधक ह ै तो िनवा=चन अिधकारी
ऑनलाइन मतदान के माWयम से सदIय1 के चुनाव के िलए सात (cid:4)दन1 स े अनिधक अविध िनिGत करेगा।
(3) ऑनलाइन मतदान के िलए पाD मतदाता को िन9िलिखत .(cid:4)Yया का अनुपालन करना होगा अथा=त् -

वह भारतीय पशुिच(cid:4)क(cid:28)सा Zवसायी रिजI[ र म E अपने रिजI[ीकृत संOयाकं के साथ लॉग इन कर सकेगा ।

लॉिगन करन े के पGात,् भारतीय पशुिच(cid:4)क(cid:28)स ा प(cid:30)रषद या रा]य पशुिच(cid:4)क(cid:28)स ा प(cid:30)रषद पर अपने रिजI[ीकृत
(ii)
मोबाइल नंबर पर वन टाइम पासवड= (ओटीपी) .ाA करेगा।

5. उ0 िनयम1 म,E िनयम 20 और िनयम 21 के Iथान पर िन9िलिखत िनयम1 को रखा जाएगा, नामतः

जाएगा (cid:4)क वह िनवा=िचत हो गया ह,ै (cid:30)रटRनग ऑ(cid:4)फसर -ारा, ऐसी रीित से जो वह अवधा(cid:30)रत करे, िनकाल े जाने वाल े

NOTIFICATION
New Delhi, the 29th November, 2019
G.S.R. 888(E).—In exercise of the powers conferred by section 64 read with section 4 of the Indian
Veterinary Council Act, 1984 (52 of 1984), the Central Government hereby makes the following rules further
to amend the Indian Veterinary Council Rules, 1985, namely:-
1. (1) These rules may be called the Indian Veterinary Council (Amendment) Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Indian Veterinary Council Rules, 1985 (hereinafter referred to as the said rules), for rule 16, the
following rule shall be substituted, namely:-¹Hkkx IIµ[k.M 3(i)] Hkkjr dk jkti=k % vlk/kj.k 3
“16. Voting.—(1) If the number of duly nominated candidates for election does not exceed the
number of members to be elected, the Returning Officer shall forthwith declare such candidates duly
elected.
(2) If the number of such candidates exceed the number of members to be elected, the Returning
Officer shall fix a period of not exceeding seven days for election of members through online voting.
(3) For online voting, the eligible voter has to follow the following procedure, namely:-
(i) he may login with his registered number in the Indian veterinary practitioners register ;
(ii) after login, he shall receive one time password (OTP) on his mobile number registered with the
State veterinary council or the Veterinary council of India ;
(iii) on entering such one time password, the voter shall be able to see a list of contesting candidates
and then he may vote by ticking () as many candidates as there are seats to be filled by the
election;
(iv) after voting, voter shall get an acknowledgment that he has completed the voting process
successfully;
(v) after voting, voter shall be automatically logged out and re-voting is not possible.”;
3. In the said rules, rules 17 and 18 shall be omitted.
4. In the said rules, for rule 19, the following rule shall be substituted, namely,-
“19. Counting of votes. —(1) The Returning Officer shall, on the date and time fixed by him for this
purpose, enter the password and get the number of votes received by each contesting candidates.
(2) Any contesting candidate or his representative duly authorised in writing by him may remain
present in person to watch the process of counting.
5. In the said rules, for rules 20 and 21, the following rules shall be substituted, namely,-
“20. Declaration of result. —(1) The Returning Officer shall draw up a list of candidates in order of
highest votes polled and declare the candidates elected, in that order according to the number of seats
to be filled up.
(2) When there is equality of votes among any two or more candidates, the candidate who shall be
deemed to have been elected shall be determined by lots to be drawn by the Returning Officer in such
manner as he may decide.
(3) The Returning Officer shall, as soon as the result is declared, inform each successful candidate
of his being elected to the Council.
(4) If any candidate declared elected under sub-rule (1) refuses to act as member, then in the place
of that candidate, one of the remaining unsuccessful candidate to whom the next largest number of
votes have been polled, shall be deemed to have been elected and the same procedure shall be adopted
as often as any vacancy is caused in this way.
“21. Retaining of Election documents.—After declaration of results, the Returning Officer shall
preserve all the documents relating to election for a period of six months and shall not destroy, after
this period, without the previous concurrence of the Central Government.”
