The primary action is the omission of a specific penalty provision regarding offenses punishable by imprisonment under section 68 of the Act. **Key Points / Main Content** **Administrative Details** * **Official Title:** The rules are titled the "Chandigarh Real Estate (Regulation and Development) (General) Amendment Rules, 2026." * **Effective Date:** The amendments become effective starting from the date of their publication in the Official Gazette (July 3, 2026). * **Legal Authority:** The rules are made in exercise of powers conferred by Section 84 of the Real Estate (Regulation and Development) Act, 2016, and in pursuance of the Jan Vishwas (Amendment of Provisions) Act, 2026. **Specific Amendments** * **Modification of Rule 33:** The amendment specifically targets Rule 33, sub-rule (1) of the Chandigarh Real Estate (Regulation and Development) (General) Rules, 2016. * **Omission of Penalty Provision:** A specific row in the table under Rule 33 has been omitted. This row previously addressed offenses "Punishable with imprisonment under section 68" which carried a penalty of "ten per cent. of the estimated cost of the plot, apartment or building." **Impact Analysis** **Real Estate Promoters and Developers (Chandigarh)** **Impact** The regulatory framework governing penalties for offenses under section 68 has changed. The specific rule-based penalty previously tied to imprisonment under this section has been removed to align with the Jan Vishwas Act. **Action Required** Promoters should update their legal and compliance records to reflect the changes in the penalty structure as per the 2026 amendment. **Real Estate Regulatory Authority (RERA), Chandigarh** **Impact** The Authority’s power to enforce the specific penalty of ten percent of the estimated cost under the omitted provision of Rule 33 is revoked. **Action Required** The Authority must ensure that all pending and future enforcement proceedings are conducted in accordance with the omitted provision and the overarching Jan Vishwas (Amendment of Provisions) Act, 2026. **Legal and Regulatory Practitioners** **Impact** Legal professionals must interpret the Chandigarh Real Estate Rules in conjunction with this omission. **Action Required** Advise clients regarding the decriminalization or rationalization of penalties resulting from the pursuit of the Jan Vishwas Act amendments.
