Executive Summary & Key Takeaways

**Executive Summary** The Ministry of Housing and Urban Affairs issued the Dadra and Nagar Haveli Real Estate (Regulation and Development) (General) Amendment Rules, 2026, to align local regulations with the Jan Vishwas (Amendment of Provisions) Act, 2026. These rules, which come into force on July 3, 2026, specifically omit certain penalty provisions related to imprisonment under Section 68 of the RERA Act. The amendment simplifies the compounding table by removing specific financial penalties previously tied to these offences. **Key Points / Main Content** **General Provisions** * **Title:** The rules are cited as the Dadra and Nagar Haveli Real Estate (Regulation and Development) (General) Amendment Rules, 2026. * **Effective Date:** The amendments became effective upon their publication in the Official Gazette on July 3, 2026. * **Legal Authority:** The notification is issued under the powers conferred by Section 84 of the Real Estate (Regulation and Development) Act, 2016, and the Jan Vishwas (Amendment of Provisions) Act, 2026. **Specific Amendments to Rule 33** * **Omission of Penalties:** In the table under sub-rule (1) of Rule 33 of the 2016 Rules, the row pertaining to offences "Punishable with imprisonment under section 68" has been entirely omitted. * **Removal of Financial Compounding:** The associated penalty of "ten per cent. of the estimated cost of the plot, apartment or building" for these specific offences is no longer applicable under this rule. **Impact Analysis** **Real Estate Promoters and Developers** **Impact** The removal of the specific row in Rule 33 modifies the framework for compounding offences related to Section 68 of the Act. This changes the predefined financial penalty previously calculated as 10% of the project's estimated cost for such violations. **Action Required** Promoters must update their legal compliance manuals to reflect the changes in penalty structures and ensure they are aware of the revised legal consequences for non-compliance with Section 68. **Real Estate Regulatory Authority (RERA) and Legal Practitioners** **Impact** Regulatory authorities must adjust their enforcement and compounding processes in Dadra and Nagar Haveli to match the amended table in Rule 33. **Action Required** Authorities and legal professionals must ensure that any ongoing or future proceedings regarding Rule 33(1) do not apply the omitted provisions and utilize the updated regulatory framework.
