Executive Summary & Key Takeaways

**Executive Summary** The Ministry of Housing and Urban Affairs issued the National Capital Territory of Delhi Real Estate (Regulation and Development) (General) Amendment Rules, 2026, to align with the Jan Vishwas (Amendment of Provisions) Act, 2026. These rules, which came into force on July 3, 2026, amend existing regulations regarding the compounding of offenses. The primary change is the omission of specific penalty provisions related to imprisonment under section 68 of the Act. **Key Points / Main Content** **Administrative Authority and Title** * The notification is issued under the powers conferred by section 84 of the Real Estate (Regulation and Development) Act, 2016. * The rules are officially titled the National Capital Territory of Delhi Real Estate (Regulation and Development) (General) Amendment Rules, 2026. * The amendments were made in pursuance of the Jan Vishwas (Amendment of Provisions) Act, 2026, specifically regarding changes to section 68 of the original Act. **Rule Amendments and Omissions** * The amendment targets Rule 32, sub-rule (1) of the 2016 General Rules for the National Capital Territory of Delhi. * A specific row in the table under Rule 32 has been omitted. * The omitted provision previously specified that offenses punishable with imprisonment under section 68 could be compounded at a rate of ten per cent of the estimated cost of the plot, apartment, or building. **Impact Analysis** **Real Estate Promoters and Developers in NCT Delhi** **Impact** Stakeholders are affected by the removal of the specific compounding fee structure (10% of estimated cost) previously linked to offenses punishable by imprisonment under section 68. This reflects legislative shifts toward the amendment of penal provisions. **Action Required** Promoters must review the updated penalty and compounding framework to ensure their project management and legal compliance strategies align with the omitted provisions. **Real Estate Regulatory Authority (RERA) Delhi** **Impact** The Authority is now required to adjudicate offenses without the specific compounding provision that has been removed from Rule 32. **Action Required** The Authority must update its administrative processes, internal guidelines, and legal templates to reflect the omission of the 10% estimated cost penalty for section 68 violations as per the 2026 Amendment.
