## Policy Analysis Report: Amendment to National Highways Act, 1956 Regarding Fee Collection on NH-6 (Chhattisgarh)
**1. Executive Summary:**
This report analyzes an amendment to a pre-existing policy concerning the collection of fees on a section of National Highway No. 6 in Chhattisgarh. The amendment, effective from the date of its publication in the Official Gazette, modifies the existing notification related to toll collection. Key changes include substituting the existing paragraph and Toll Plaza locations in Schedule and redefining "Local Personal Traffic" and "Local Commercial Traffic". This analysis is based solely on the provided government policy text and aims to inform stakeholders about the nature and implications of these changes.
**2. Introduction:**
This report aims to provide a comprehensive overview of an amendment to an existing policy related to the National Highways Act, 1956, specifically concerning fee collection on a section of National Highway No. 6 in the State of Chhattisgarh. The analysis is based exclusively on the provided policy text.
**3. Policy Overview:**
* **Original Policy:** The amendment modifies the "Notification of the Government of India in the Ministry of Road Transport and Highways Department of Road Transport and Highways No. S.O. 651 E dated 4th March 2014" concerning fee collection on National Highway No. 6 (Chhattisgarh).
* **Core Objective(s):** The core objective of the original policy, and this amendment, is to enable the Central Government to levy and collect fees for the use of the specified section of National Highway No. 6 to cover the costs associated with its building, maintenance, management, and operation, including interest on capital invested and reasonable returns for the concessionaire. The amendment ensures the continued and appropriate fee collection process.
**4. Background and Rationale:**
This document presents an amendment to a previous tolling policy. This amendment likely intends to update or clarify operational details of existing tolling arrangements.
**5. Key Provisions / Changes:**
This section focuses specifically on the changes introduced by the provided amendment text.
* **Change 1: Paragraph Substitution:** The original notification's existing paragraph is being substituted. The new paragraph clarifies that the Authority (National Highways Authority of India) entrusted the stretch of NH-6 to the Authority based on section 11 of the National Highways Authority Act, 1988, and that the Authority entered into an agreement with Ms. Raipur Expressway Ltd. for the improvement, operation, and maintenance of a section of the highway. *Effect*: This substitution primarily clarifies the contractual relationship between the involved parties (Authority and Concessionaire). The change does not appear to significantly alter the underlying principles of fee collection but rather provides updated information about the agreements in place.
* **Change 2: Toll Plaza Location Substitution:** The Toll Plaza location in Schedule shall be substituted as under. *Effect*: This substitution clarifies the exact point at which toll is to be collected. The change does not appear to significantly alter the underlying principles of fee collection but rather is changed for the precise distance for which fee is payable.
* **Change 3: Definition of Local Traffic:** Notes 1(iii) and 1(iv) of the Schedule are substituted, changing the definitions of "Local Personal Traffic" and "Local Commercial Traffic." Local Personal Traffic is now defined as a person vehicle which is registered with the Concessionaire, by any person who normally resides or works at a place that can normally be approached only by using a part of the said section and such person is, therefore, required to use such vehicles for commuting on a part of the said section, in the course of normal travel to and from his place of the work or residence; Local Commercial Traffic means any commercial vehicles including buses, trucks, light motor vehicles or taxis engage in carrying goods and passengers registered with the Concessionaire as plying routinely on the said section. *Effect*: This change refines the criteria for defining local traffic, likely impacting who is eligible for exemptions or discounted rates, if any, under the existing tolling policy (though the existence of such discounts isn't confirmed in the text).
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders affected by these changes are:
* **Ms. Raipur Expressway Ltd. (the Concessionaire):** The entity responsible for collecting and retaining the fees. The changes in definitions of "Local Traffic" will directly impact their operations and revenue collection.
* **Users of the specified section of National Highway No. 6 in Chhattisgarh:** Particularly, local residents and businesses that regularly use the highway. The changes to "Local Personal Traffic" and "Local Commercial Traffic" definitions directly impact them.
* **The National Highways Authority of India (the Authority):** As the entity overseeing the highway's management and the concessionaire's activities.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Central Government, the National Highways Authority of India, and Ms. Raipur Expressway Ltd. are the key bodies involved.
* **Timelines/Procedures:** The amendment comes into force on the date of publication in the Official Gazette. The Concessionaire is authorized to collect and retain the fees from the date of commercial operation (or publication in the Gazette, whichever is later) until the termination date specified in their agreement. The amendment necessitates the Concessionaire to adjust its toll collection procedures to align with the new definitions of local traffic.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of these specific changes are:
* **Clarification of Contractual Obligations:** Substitution of existing paragraphs to reinforce existing agreement with Concessionaire.
* **More Precise Toll Plaza Location:** Substitution of Toll Plaza locations in Schedule likely intends to create a more fair and even distribution of tolling.
* **Refined Eligibility for Local Exemptions/Discounts (If Applicable):** The revised definitions of "Local Traffic" will likely result in a more precise categorization of highway users, potentially leading to adjustments in the number of users eligible for local exemptions or discounted rates. The goal is likely to ensure that intended beneficiaries (genuine local residents and businesses) are appropriately classified, while preventing abuse of any such exemptions.
**9. Conclusion:**
The analyzed amendment modifies the existing notification concerning fee collection on a specific section of National Highway No. 6 in Chhattisgarh. The amendment introduces key changes to the definition of "Local Traffic" and clarifies contractual obligations. These changes appear primarily aimed at refining the operational aspects of toll collection and ensuring that it is implemented in accordance with existing agreements and the intent of the original policy. This amendment is significant as it impacts the revenue of the concessionaire and toll expenses of local residents.
