(1) इन जवजनयमों का संजक्षप्त नाम भारतीय दिवाला और िोधन अक्षमता बोडड (दिवाला व्यावसाजयक) (िसू रा संिोधन) जवजनयम, 2023 ि ै। (2) य े रािपत्र म ेंप्रकािन की तारीख को प्रवतत्त िोंग े । 2. भारतीय दिवाला और िोधन अक्षमता बोड ड(दिवाला व्यावसाजयक) जवजनयमन, 2016 (जिन्ि ेंइसमें इसके पश्चात् “मूल जवजनयम” किा गया ि)ै म,ें (1) जवजनयम 5 के खंड (ख) में, “नामांकन के पश्चात ् स”े िब्िों के पश्चात ् “जवजनयम 6 के अधीन अप्रजतिेय आवेिन फीस के संिाय की तारीख से बारि मास के भीतर” िब्ि अतं ःस्ट्थाजपत दकए िाएगं े । (2) जवजनयम 6 म,ें - 5925 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (i) उप-जवजनयम (1) के स्ट्थान पर, जनम्नजलजखत उप-जवजनयम रखा िाएगा, अथाडत:् - “(1) दकसी दिवाला व्यावसाजयक एिेंसी के पास व्यावसाजयक सिस्ट्य के रूप म ें नामांदकत कोई व्यजि, उस दिवाला व्यावसाजयक एिेंसी के माध्यम से, जिसका वि सिस्ट्य ि,ै बोडड को बीस ििार रूपए की अप्रजतिेय आवेिन फीस के साथ इन जवजनयमों की िसू री अनुसूची के प्ररूप क के भाग-II में आवेिन कर सकेगा ।” (ii) उप-जवजनयम (1क) के स्ट्थान पर, जनम्नजलजखत उप-जवजनयम रखा िाएगा, अथाडत:् - “(1क) जवजनयम 4 के उप-जवजनयम (2) के अधीन दिवाला व्यावसाजयक के रूप म ें रजिस्ट्रीकरण के जलए पात्र कोई दिवाला व्यावसाजयक संस्ट्था, ऐसी दिवाला व्यावसाजयक संस्ट्था के माध्यम से, जिसकी वि सिस्ट्य ि,ै बोड ड को, इन जवजनयमों की िसू री अनुसूची के प्ररूप कक के भाग-II में, िो लाख रूपए की अप्रजतिेय आवेिन फीस सजित, आवेिन कर सकेगी।” (iii) उप-जवजनयम (2) म ें“बोडड” िब्ि के स्ट्थान पर “दिवाला व्यावसाजयक एिेंसी” िब्ि रखे िाएगं ;े (iv) उप-जवजनयम (2) के पश्चात,् जनम्नजलजखत उप-जवजनयम अंतःस्ट्थाजपत दकया िाएगा, अथाडत्:- “(2क) दिवाला व्यावसाजयक एिेंसी, यथाजस्ट्थजत, उप-जवजनयम (1) या उप-जवजनयम (1क) के अधीन फीस का संिाय करन े की तारीख स े तीस दिन के भीतर आवेिन को सत्याजपत और उस े बोड ड को अग्रेजित करेगी, जिसमें से दिवाला व्यावसाजयक एिेंसी द्वारा व्यावसाजयक सिस्ट्य को यथाजस्ट्थजत, अजतठरि िस्ट्तावेज़, िानकारी या स्ट्पिीकरण प्रस्ट्ततु करने के जलए दिया गया समय छोड़ दिया िाएगा ।” (3) जवजनयम 7 से उप-जवजनयम (1) म,ें “साि दिन” िब्िों के स्ट्थान पर “तीस दिन” िब्ि रखे िाएंगे; (4) जवजनयम 8 के उप-जवजनयम (2) म,ें “45 दिन” अंकों और िब्ि के स्ट्थान पर “तीस दिन” िब्ि रख ेिाएंग;े (5) जवजनयम 10 म,ें (क) उप-जवजनयम (1) म,ें खडं (घ) के पश्चात,् जनम्नजलजखत खंड अंतःस्ट्थाजपत दकए िाएंग,े अथाडत्:- “(ङ) सिस्ट्यता के अभ्यपडण के जलए आवेिन स्ट्वीकार करती ि ैऔर अपन े रजिस्ट्टरों म ें व्यावसाजयक सिस्ट्य का नाम काटती ि;ै (च) व्यावसाजयक सिस्ट्य को जनष्काजसत करती ि;ै या (छ) दकसी व्यजि की मतत्य ु या कंपनी, सीजमत िाजयत्व भागीिारी या रजिस्ट्रीकतत फमड के समापन या जवघटन की सूचना प्राप्त करती ि ैऔर अपन ेरजिस्ट्टरों में स,े व्यावसाजयक सिस्ट्य का नाम काटती ि ै।” (ख) उप-जवजनयम (2) म,ें “नोट करेगा” िब्िों के पश्चात,् “और वि उसके खंड (ङ), खंड (च) और खडं (छ) म ें जनर्ििड मामलों के जलए, यदि ऐसा करना समीचीन समझा िाए तो जवजनयम 10ख के अनुसार कायडवािी करेगा” िब्ि अंतःस्ट्थाजपत दकए िाएगं े । (6) जवजनयम 10 के पश्चात,् जनम्नजलजखत जवजनयम अंतःस्ट्थाजपत दकए िाएंग,े अथाडत्:- “10क. रजिस्ट्रीकरण प्रमाणपत्र का अभ्यपणड (1) कोई दिवाला व्यावसाजयक, बोडड को, मूल रजिस्ट्रीकरण प्रमाणपत्र सजित जलजखत में अनरु ोध करके अपन े रजिस्ट्रीकरण प्रमाणपत्र का अभ्यपडण कर सकेगा ।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (2) यदि बोडड का समाधान िो िाता ि ै तो वि उसकी प्राजप्त के तीस दिन के भीतर रजिस्ट्रीकरण प्रमाणपत्र के अभ्यपणड के जलए अनुरोध को स्ट्वीकार कर सकेगा और स्ट्वीकार कर लेन े पर ऐस े दिवाला व्यावसाजयक का रजिस्ट्रीकरण रद्द िो िाएगा । (3) रजिस्ट्रीकरण प्रमाणपत्र के रद्दकरण की तारीख से संबंजधत व्यजि ऐसे दियाकलाप करने के जलए, जिसके जलए ऐसा प्रमाणपत्र अनुित्त दकया गया था, अपने आप को प्रमाणपत्र के धारक के रूप म ेंप्रस्ट्तुत निीं करेगा । 10ख. अभ्यपणड , जनष्कासन आदि पर कारडवाई के जलए जवििे प्रदिया (1) बोड,ड इस जवजनयम के अधीन मामले का जनपटारा करते समय, जवजनयम 11 में जवजनर्ििड प्रदिया द्वारा आबद्ध निीं िोगा । (2) बोडड, जवजनयम 10 के उप-जवजनयम (1) के खंड (ङ) और खंड (च) के अधीन सूचना प्राप्त िोने पर, यदि अपेजक्षत िो, ऐसे व्यावसाजयक सिस्ट्य से यि मांग करत े हुए नोठटस िारी कर सकेगा दक वि स्ट्पि करे दक जवजनयमों के अधीन अनुित्त रजिस्ट्रीकरण प्रमाणपत्र को रद्द क्यों निीं दकया िाना चाजिए । (3) व्यावसाजयक सिस्ट्य, नोठटस की तामील की तारीख से इक्कीस दिन से अनजधक अवजध के भीतर जलजखत जनवेिन कर सकेगा । (4) बोडड, उप-जवजनयम (3) के अधीन दकए गए जनवेिन स े संतुि िोन े पर, रजिस्ट्रीकरण को रद्द करन े या चालू असाइनमेंट को पूरा करन े के जनिेि िारी करने, लंजबत अनुपालनों, जिसके अंतगडत फीस का संिाय भी ि,ै आदि का जवजनश्चय कर सकेगा। (5) बोडड, उप-जवजनयम (4) के अधीन अपना जवजनश्चय, उप-जवजनयम (3) के अधीन जलजखत जनवेिन प्राप्त िोने की तारीख से तीस दिन के भीतर ससं ूजचत करेगा । (6) जवजनयम 10 के उप-जवजनयम (1) के खंड (छ) के अधीन सूचना प्राप्त िोन े पर, ऐस े दिवाला व्यावसाजयक का बोडड के पास रजिस्ट्रीकरण, यथाजस्ट्थजत, िस्ट्तांतरण या समापन या जवघटन की तारीख से रद्द िो गया समझा िाएगा । (7) इस जवजनयम के अधीन रजिस्ट्रीकरण प्रमाणपत्र के रद्दकरण की तारीख से, दिवाला व्यावसाजयक के जवजधक वाठरस या समनुिेजिती, ऐस े दकसी अजभलेख या िस्ट्तावेज़ या आजस्ट्तयों के पठरिान के जलए, िो दक उसकी अजभरक्षा या जनयंत्रण म ें िो सकत े ि,ैं उस समय अवजध के भीतर और उस रीजत म,ें िो सुसंगत जवजनयमों के अधीन अपेजक्षत िो या िैसा बोडड द्वारा जनििे दिया िाए, उजचत किम उिाएगं े ।” 3. मलू जवजनयमों की िसू री अनसु ूची में, प्ररूप क के स्ट्थान पर जनम्नजलजखत प्ररूप रखा िाएगा, अथाडत् :- “प्ररूप क एकीकतत नामाकं न और रजिस्ट्रीकरण आविे न पत्र [भारतीय दिवाला और िोधन अक्षमता बोड ड(दिवाला व्यावसाजयक) जवजनयमन, 2016 के जवजनयम 6 और भारतीय दिवाला और िोधन अक्षमता (आिि ड जवजधयां और दिवाला व्यावसाजयक एिेंजसयों का िासी बोडड) जवजनयमन, 2016 के जवजनयम 10 के अधीन] भाग-I [आविे क द्वारा प्रस्ट्ततु दकया िाए] कतपया िाल िी का पासपोटड सेवा में, प्रबंध जनिेिक, आकार का फोटो (दिवाला व्यावसाजयक एिेंसी का नाम) जचपकाए ं जविय: व्यावसाजयक सिस्ट्य के रूप म ेंनामाकं न और दिवाला व्यावसाजयक के रजिस्ट्रीकरण के जलए आविे न । मिोिय/मिोिया, मैं, (क) भारतीय दिवाला और िोधन अक्षमता (आििड जवजधयां और दिवाला व्यावसाजयक एिेंजसयों का िासी बोडड) जवजनयमन, 2016 के जवजनयम 10 के अधीन (दिवाला व्यावसाजयक एिेंसी का नाम) म ें व्यावसाजयक सिस्ट्य के रूप में नामांकन; September 2023 Insolvency and Bankruptcy Board of India (Insolvency Professionals) (Second Amendment) Regulations, 2023 No. IBBI/2023-24/GN/REG104.—In exercise of the powers conferred by sections 196, 206, 207 and 208 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy Board of India hereby makes the following regulations further to amend the Insolvency and Bankruptcy Board of India (Insolvency Professionals) Regulations, 2016, namely: - 1. (1) These regulations may be called the Insolvency and Bankruptcy Board of India (Insolvency Professionals) (Second Amendment) Regulations, 2023. (2) They shall come into force on the date of publication in the Official Gazette. 2. In the Insolvency and Bankruptcy Board of India (Insolvency Professionals) Regulations, 2016 (hereinafter referred to as ‘the principal regulations’), (1) in regulation 5, in clause (b), after the words “pre-registration educational course”, the words “within twelve months from the date of payment of non-refundable application fee under regulation 6”, shall be inserted. (2) in regulation 6, (i) for sub-regulation (1), the following sub-regulation shall be substituted, namely: - “(1) An individual enrolled with an insolvency professional agency as a professional member may make an application to the Board through the insolvency professional agency of which he is a member, in Part – II of Form A of the Second Schedule to these Regulations, along with a non- refundable application fee of twenty thousand rupees to the Board.” (ii) for sub-regulation (1A), the following sub-regulation shall be substituted, namely: - “(1A) An insolvency professional entity eligible for registration as an insolvency professional under sub-regulation (2) of regulation 4 may make an application to the Board through the insolvency professional agency of which it is a member, in Part – II of Form AA of Second Schedule to these Regulations, along with a non-refundable application fee of two lakh rupees to the Board.” (iii) in sub-regulation (2), for the word “Board,” the words “insolvency professional agency” shall be substituted. (iv) after sub-regulation (2), the following sub-regulation shall be inserted, namely: - “(2A) The insolvency professional agency shall verify and forward the application to the Board within thirty days from the date of payment of fee under sub-regulations (1) or (1A), as the case may be, excluding the time given by the insolvency professional agency to the professional member for submitting additional documents, information, or clarification, as the case may be.” (3) in regulation 7, in sub-regulation (1) for the words “sixty days” the words “thirty days” shall be substituted. (4) in regulation 8, in sub-regulation (2) for the words “forty five days” the words “thirty days” shall be substituted. (5) in regulation 10, (a) in sub-regulation (1), i. in clause (c), the word “or” shall be omitted. ii. after clause (d), the following clauses shall be inserted, namely: - “(e) accepts the application for surrender of membership and strikes the name of the professional member from its registers; (f) expels the professional member; or (g) receives intimation of demise of an individual or winding up or dissolution of a company, limited liability partnership or registered partnership firm and strikes the name of the professional member from its registers.”[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15 (b) in sub-regulation (2), after the words, bracket and figure “sub-regulation (1)”, the words “and for cases referred to in clauses (e), (f) and (g) thereof, it may, if deems expedient to do so, proceed in accordance with regulation 10B”, shall be inserted. (6) After regulation 10, the following regulations shall be inserted, namely: - “10A. Surrender of certificate of registration. (1) An insolvency professional may surrender its certificate of registration by making a request to the Board, in writing along with the certificate of registration in original. (2) If the Board is satisfied, it may accept the request for surrender of certificate of registration within thirty days of its receipt and upon acceptance, the registration of such insolvency professional shall stand cancelled. (3) On and from the date of cancellation of certificate of registration, the concerned person shall not represent itself to be a holder of the certificate for carrying out the activity for which such certificate had been granted. 10B. Special procedure for action on surrender, expulsion, etc. (1) While disposing of the matter under this regulation, the Board shall not be bound by the procedure specified in regulation 11. (2) On receipt of information under clause (e) and (f) of sub-regulation (1) of regulation 10, the Board may issue a notice, if required, to such professional member, calling upon it to explain as to why the certificate of registration, granted under the regulations, should not be cancelled. (3) The professional member may make written submission(s), if any, within a period not exceeding twenty-one days from the date of service of notice. (4) On being satisfied with the submission(s) made under sub-regulation (3), the Board may decide to cancel the registration or issue directions to complete the ongoing assignments, make pending compliances including payment of fee, etc. (5) The Board shall communicate its decision under sub-regulation (4) within thirty days from date of receipt of written submissions under sub-regulation (3). (6) On receipt of information under clause (g) of sub-regulation (1) of regulation 10, the registration of such insolvency professional with the Board shall be deemed to have been cancelled from the date of demise or winding up or dissolution, as the case may be. (7) On and from the date of cancellation of the certificate of registration, under this regulation, the legal heirs or assignee of the insolvency professional shall take steps for delivery of any record(s) or document(s) or assets that may be in its custody or control, within the time period and in the manner, as may be required under the relevant regulations or as may be directed by the Board.” 3.
