L.-33004/99 xxxGIDHxxx सी.जी.-डी.एलxx.x-GअI.D-E3x1x0x 82020-221461 CG-DL-E-31082020-221461 ऄसाधारण EXTRAORDINARY भाग II—खण्ड 3—ईप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 2626] नइ ददल्ली, सोमिार, ऄगस्ट्त 31, 2020/भाद्र 9, 1942 No. 2626] NEW DELHI, MONDAY, AUGUST 31, 2020/BHADRA 9, 1942 जित्त मत्रं ालय (अर्थथक काय यजिभाग) ऄजधसचू ना नइ ददल् ली, 31 ऄगस्ट्त, 2020 का.अ. 2957(ऄ).—केंद्रीय सरकार,ऄंतरायष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण ऄजधजनयम, 2019 (2019 का 50) की धारा 3 की ईप धारा (I) के खण्ड (घ) के ईप-खण्ड (vi)तथा खण्ड (ङ) के ईप-खण्ड (xiv) और धारा 12 की ईप धारा (2) के खण्ड (ख) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, कजतपय जित्तीय ईत्पादों और जित्तीय सेिाओं को ऄजधसूजचत करती ह ै और जनदिे देती ह ै दक प्राजधकरण की िजियों तथा कायों में ईि जित्तीय ईत्पादों और जित्तीय सेिाओं का जिजनयमन सजममजलत होगा,ऄथायत्, (क) जित्तीय ईत्पादः (i) बुजलयन हाजजर सौदा संजिदा ; और (ii) ऄतं र्थनजहत बुजलयन सजहत बुजलयन जनपक्षे ागारप्राजियां; (ख) जित्तीय सिे ाए:ं (i) बुजलयन हाजजर सौदासंजिदा के संबंध म ेंऄतं र्थनजहत बुजलयन के साथ बुजलयन जनपेक्षागार प्राजियों का व्यापार; (ii) बुजलयन हाजजर सौदा संजिदा और बुजलयन जनपक्षे ागार प्राजियों के संबंध म ें बुजलयन जित्तपोषण, बुजलयन अधाररत ऋण, समपार्थिक ऋणों के एिज में बुजलयन ऋण, बुजलयन िॉल्ल्िंग, समािोधन और जनपिंान सेिाओं के ईपबंध। 4019 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] स्ट्पष्टीकरण-आस ऄजधसचू ना के प्रयोजना के जलए- (i) "बुजलयन" से कीमती धातुएं जजसमें सोना, चांदी या कोइ कीमती धातु या गैर-अबंरिंत सोना, चांदी या कुछ ऐसी कीमती धातुओं के रूप म ें भी ह ैजो प्राजधकरण आस संबंध म ें बुजलयन व्यापार के संबंजधत ऄच्छी जडलीिरी, गुणित्ता, प्रमात्रा तथा दकसी ऄन्य पहलू के संबंध में समय-समय पर सगं त समझे, ऄजभप्रेत ह,ै (ii) "बुजलयन हाजजर सौदा संजिदा"सेऐसी संजिदा ऄजभप्रेत ह ैजजसमें जनम्नजलजखत का ईपबंध हो, (क) बुजलयन की िास्ट्तजिक जडलीिरी और मल्ू य का भगु तान या तो संजिदा की तारीख पर या ऄगल े ददन दकया जाता ह,ै यदद संजिदा के पक्षकार एक ही िहर या आलाके में जनिास नहीं करते ह ैं तो बुजलयन की जडलीिरी के जलए िास्ट्तजिक ऄिजध याईसके जलए धन के प्रषे ण को ईपयुयि ऄिजध की गणना में सजममजलत नहीं दकया जाता है; (ख) जब ऐसे बुजलयन की देखरेख आस प्रयोजनाथ य प्राजधकरण द्वारा ऄनुज्ञजि प्राि जनक्षेपागार द्वारा की जाती हो तो जनक्षेपागार द्वारा बुजलयन का ऄंतरण दकसी लाभाथी हकदार के खाते में से ऄन्य दकसी लाभाथी हकदार के खाते म ें दकया जाता ह;ै (iii) "ऄंतर्थनजहत बुजलयन के साथ बुजलयन जनपेक्षागारप्राजि"से ऐसी बुजलयन जनपेक्षागारप्राजि जो ऄंतरायष्ट्रीय जित्तीय सेिा केंद्र के भीतर प्रचालनरत ऄंतरायष्ट्रीय बुजलयन बाजार (अइबीइ) म ें सूचीबद्ध ह ै तथा जजसे ईि ऄजधजनयम के ऄतं गतय प्राजधकरण द्वारा ऄनुज्ञजि प्राि ह।ै 2. यह ऄजधसूचना ऄंतरायष्ट्रीय जित्तीय सेिा केंद्र प्राजधकरण ऄजधजनयम, 2019 के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों तथा जिजनयमों के ऄध्यधीन होगी। [फा. स.ं 3/7/2020-इएम] अनन् द मोहन बजाज, ऄपर सजचि MINISTRY OF FINANCE (Department of Economic Affairs) NOTIFICATION New Delhi, the 31st August, 2020 S.O. 2957(E).—In exercise of the powers conferred by sub-clause (vi) of clause (d)and sub-clause (xiv) of clause (e) of sub-section (1)of section 3 and clause (b) of sub-section (2) of section 12 of the International Financial Services Centres Authority Act, 2019 (50 of 2019), the Central Government hereby notifies certain financial products and financial services and directs that that the powers and functions of the Authority shall include regulating the said financial products and financial services,namely:– (A) Financial products: (i) bullion spot delivery contract; (ii) bullion depository receipt with underlying bullion; (B) Financial services: (i) trading in bullion depository receipts with underlying bullion in relation to bullion spot delivery contracts; (ii) provision of bullion financing, bullion based loans, bullion loans against collateral, bullion vaulting, clearing and settlement services in relation to bullion spot delivery contracts and bullion depository receipts. Explanation.–– For the purposes of this notification,–– (i) “bullion” shall mean precious metals including gold, silver or any other precious metal in the form of bars or unallocated gold, silver, or such other precious metals, as the Authority may consider relevant in this regard, relating to good delivery, quality, quantity, and any other aspect in relation to bullion trading , from time to time;[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 (ii) “bullion spot delivery contract” shall mean a contract which provides for- (a) actual delivery of bullion and the payment of a price therefor either on the same day as the date of the contract or on the next day, the actual period for the delivery of the bullion or the remittance money therefor being excluded from the computation of the period aforesaid if the parties to the contract do not reside in the same town or locality; (b) transfer of the bullion by the depositary from the account of a beneficial owner to the account of another beneficial owner when such bullion is dealt with by a depositary licensed by the Authority for this purpose; (iii) “bullion depository receipt with underlying bullion” shall mean such bullion depository receipt listed on the International Bullion Exchange (IBE) operating inside the International Financial Services Centre and is licensed by the Authority under the said Act. 2. This notification shall be subject to the provisions of the International Financial Services Centres Authority Act, 2019 and the rules and regulations made thereunder. [F.
