## Policy Analysis Report: Land Acquisition for National Highway No. 144A in Jammu & Kashmir **1. Executive Summary:** This report analyzes a government notification concerning the acquisition of land for the building, widening, maintenance, management, and operation of National Highway No. 144A in the State of Jammu & Kashmir. The core purpose is to declare the government's intention to acquire land for this infrastructure project and outline the process for affected parties to raise objections. The key finding is that the notification specifies particular land parcels in the Rajouri district, detailing their survey numbers, type, nature, and area in hectares, signaling a concrete step towards project implementation. **2. Introduction:** The purpose of this report is to provide an informative analysis of a government notification regarding land acquisition for the development of National Highway No. 144A in Jammu & Kashmir. This analysis is based solely on the provided text of the notification. **3. Policy Overview:** This is a *new policy* announcement related to land acquisition. * **Core Objective(s):** The primary objective is to facilitate the building, widening (2-Laning with paved shoulder), maintenance, management, and operation of National Highway No. 144A. Specifically, the notification declares the intention to acquire land for this purpose in the stretch from Km 28300 to 236780 Km (Akhnoor to Poonch Road) and also details land to be acquired within the stretch of Km 90150 to 116980. **4. Background and Rationale:** As a new policy announcement regarding land acquisition, this notification addresses the necessity to obtain land for infrastructure development. It suggests that the existing National Highway No. 144A requires improvement through widening, maintenance, and better management, presumably to enhance connectivity, transportation efficiency, and economic activity in the region. The notification is issued under the National Highways Act, 1956, indicating a legal framework for addressing such land acquisition needs. **5. Key Provisions / Changes:** As a new policy announcement regarding land acquisition, the key provisions of the notification are as follows: * **Declaration of Intent:** The Central Government declares its intention to acquire specific land parcels for the stated purpose. * **Land Details:** The notification includes a schedule detailing the survey plot numbers, type of land (private/government/forest), nature of land (non-irrigated), and area (in hectares) of the land to be acquired. This specificity applies to land in the Rajouri district, within specified villages and survey numbers. * **Objection Mechanism:** The notification provides a mechanism for persons interested in the said land to object to its use for the intended purpose. They have twenty-one days from the date of publication to submit their objections in writing to the Competent Authority. * **Competent Authority:** The Deputy Commissioner Land Acquisition Rajouri H Q., Rajouri District Rajouri, is designated as the Competent Authority to receive and address objections. * **Hearing and Enquiry:** The Competent Authority is required to provide objectors with an opportunity to be heard, either in person or through a legal practitioner. The Authority can conduct further inquiry before allowing or disallowing objections. * **Finality of Order:** Any order made by the competent authority is final. * **Availability of Land Plans:** The land plans and other details are available for inspection at the office of the competent authority. **6. Target Audience and Stakeholders:** The target audience and stakeholders directly affected by this notification include: * Landowners in the Rajouri district whose land falls within the specified survey plot numbers and areas, including both private and government land. * Residents and businesses relying on the existing National Highway No. 144A who may experience disruptions during the construction and widening process. * The Deputy Commissioner Land Acquisition Rajouri, Rajouri District, as the competent authority responsible for handling objections. * Communities in the Jammu, Reasi, Rajouri, and Poonch districts who will benefit from the improved National Highway. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways and the Deputy Commissioner Land Acquisition Rajouri are responsible for implementing the policy. * **Timelines and Procedures:** * Interested parties have twenty-one days from the date of publication (January 14, 2021) to file objections. * The Competent Authority will conduct hearings and inquiries before making a decision on the objections. **8. Expected Outcomes / Impact of Changes:** The expected outcomes of this policy are: * Acquisition of land parcels necessary for the building, widening, maintenance, management, and operation of National Highway No. 144A. * Improved infrastructure, leading to enhanced connectivity and transportation efficiency in the region. * Potential economic benefits due to better transportation links. * Potential for disputes and delays due to objections raised by landowners. **9. Conclusion:** The government notification analyzed represents a critical step in the development and improvement of National Highway No. 144A in Jammu & Kashmir. By formally declaring the intent to acquire land and outlining the process for addressing objections, the notification sets the stage for the infrastructure project's implementation. Its success depends on a fair and transparent acquisition process, effective communication with affected stakeholders, and timely resolution of any disputes. The project holds significant potential for improving connectivity, transportation, and economic growth in the region.
