1. इन जिजनयमों को पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (न् यायजनणाायक अजधकारी द्वारा िांच की प्रदिया) (संिोधन) जिजनयम, 2026 कहा िायेगा।

3. पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (न् यायजनणाायक अजधकारी द्वारा िांच की प्रदिया) जिजनयम, 2015, समय-समय पर यथासंिोजधत (इसके पश् चात 'मूल जिजनयम' के रूप में संिर्भात) में जनम्नजलजखत संिोधन दकए िाते ह ैं- I. मलू जिजनयमों के जिजनयम 2 के खडं (च) म,ें न्यायजनणाया क अजधकारी िब्ि के िीक बाि आन े िाल े िब्ि "या" को िब्ि "और" स ेप्रजतस्ट्थाजपत दकया िाएगा। II. मलू जिजनयमों के जिजनयम 3 म,ें “धारा 28" के िब्ि और आकं डों को, "धारा 16 की उप-धारा (7) अथिा धारा 28” के िब्ि, कोष्ठक और आकं डों स ेप्रजतस्ट्थाजपत दकया िाएगा। III. मलू जिजनयम 4 के उप-जिजनयम 1 म,ें “धारा 28" के िब्ि और आकं डों को, "धारा 16 की उप-धारा (7) अथिा धारा 28” के िब्ि, कोष्ठक और आकं डों स े प्रजतस्ट्थाजपत दकया िाएगा। IV. जिजनयम IV. मलू जिजनयमों के जिजनयम 7 को जनम्नानसु ार प्रजतस्ट्थाजपत दकया िाएगा:

“जिजधक प्रजतजनजधत्ि का अजधकार-व्यजथत व्यजि न्यायजनणाया क अजधकारी या सिस्ट्य के समक्ष या तो स्ट्िय ं पिे हो सकता ह ै अथिा एक या अजधक चार्डा ा एकाउन्र्ेर्ों या कंपनी सजचिों या लागत लखे ाकारों या जिजध व्यिसाजययों या अपन े अजधकाठरयों म ें स े दकसी को उसका पक्षकथन रखन े हते ु प्राजधकृत कर सकता ह।ै प्राजधकरण न्यायजनणाया क अजधकारी और सिस्ट्य के समक्ष अपना पक्षकथन रखन े हते ु इस जिजनयमन म ें उजल्लजखत एक प्रस्ट्ततु कता ाअजधकारी या दकसी अन्य उपयिु पिे िे र को जनयिु कर सकता ह।ै ” V. मलू जिजनयम 10 के उप-जिजनयम 2 म,ें “धारा 28" के िब्ि और आकं डों को, "धारा 16 की उप-धारा (7) अथिा धारा 28” के िब्ि, कोष्ठक और आकं डों स े प्रजतस्ट्थाजपत दकया िाएगा। VI. मौििू ा जिजनयम 11 के उप-जिजनयम (3) को जनम्न ानसु ार प्रजतस्ट्थ ाजपत दकया िाएगा :

“(3) सिस्ट्य, अजधजनयम की धारा 30 की उप-धारा (2) के उपबधं ों को ध्य ान म ें रखत े हुए अजधमानत: अजं तम सनु िाई के समापन के साि दिनों के भीतर, ऐसा आिेि, िाजस्ट्त अजधरोपण, यदि कोई हो, जिस े िह उजचत समझ,े पाठरत कर सकेगा” श्री जििसुब्रमाजणयन रमण, अध्यक्ष [जिज्ञापन-III/4/असा./318/2026-27] ठर्प्प णी :

1.पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (न् यायजनणाायक अजधकारी द्वारा िांच की प्रदिया) जिजनयम, 2015 को अजधसूचना संख्या: पीएफआरडीए/12/आरिीएल/139/1 के माध्यम से भारत के रािपत्र म ें दिनांक 6 िनिरी, 2015 को प्रकाजित दकया गया था।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 PENSION FUND REGULATORY AND DEVELOPMENT AUTHORITY

NOTIFICATION New Delhi, the 8th September, 2026 PENSION FUND REGULATORY AND DEVELOPMENT AUTHORITY (PROCEDURE FOR INQUIRY BY ADJUDICATING OFFICER) (AMENDMENT) REGULATIONS, 2026 No. PFRDA/16/16/03/0002/2017-EnA.— In exercise of the powers conferred by sub-section (1) of Section 52 read with clause (q) of sub-section (2) thereof and section 30 of the Pension Fund Regulatory and Development Authority Act, 2013 (23 of 2013), the Pension Fund Regulatory and Development Authority hereby makes the following regulations, namely:-

1. These regulations may be called the Pension Fund Regulatory and Development Authority (Procedure for Inquiry by Adjudicating Officer) (Amendment) Regulations, 2026.

2. These shall come into force on the date of their publication in the official gazette.

3. In the Pension Fund Regulatory and Development Authority (Procedure for Inquiry by Adjudicating Officer) Regulations, 2015, as amended from time to time (hereinafter referred to as ‘the principal regulations’), the following amendments are made.

I. In clause (f) of regulation 2 of the principal regulations, the words “or” appearing immediately after the word adjudicating officer, shall be replaced with the words “and”.

II. In regulation 3 of the principal regulations, for the words and figures “section 28”, the words, brackets and figures “sub-section (7) of section 16 or section 28” shall be substituted.

III. In sub-regulation 1 of regulation 4 of the principal regulations, for the words and figures “section 28”, the words, brackets and figures “sub-section (7) of section 16 or section 28” shall be substituted.

IV. In regulation 7, immediately after the words “to present its case” the words “before the adjudicating officer and the member” shall be added.

V. In sub-regulation 2 of regulation 10 of the principal regulations, for the words and figures “section 28”, the words, brackets and figures “sub-section (7) of section 16 or section 28” shall be substituted.

VI. Existing sub-regulation (3) of regulation 11, shall be substituted as follows: “(3) The member may pass an order, imposing penalty, if any, as shall be deemed fit, preferably within a period of sixty days of the conclusion of the final hearing having regard to the provisions of sub-
