(1) इि जियमों का संजिप् त िाम जर्जधक मापजर्ज्ञाि (साधारण) (संिोधि) जियम, 2021 ह।ै (2) य ेजियम, रािपत्र म ें इिके प्रकािि की तारीख को प्रर्ृत्त होंगे। 2. जर्जधक मापजर्ज्ञाि (साधारण) जियम, 2011 (जिसे इसम ेंपश्च ात ् उक्त जियम कहा गया ह)ै , के जियम 27 म,ें- (i) उप-जियम (1) के स्ट्थ ाि पर जिम् िजलजखत उप-जियम रखा िाएगा अथावत:्- “(1) प्रत्येक बाट या माप जिसे दकसी संव्यर्हार या िीजर्त प्राजणयों या र्स्ट्तओंु के संरिण के जलए जिन्द्ह ें धारा 2 के खडं (ट) म ें दिया गया ह,ै प्रयोग दकया िाता ह ै या प्रयोग दकए िाि े के जलए आिजयत ह,ै उसे जर्जिमावण या आयात करि े र्ाल े राज्य या उपजियम (5) के खंड (iv) म ें यथा जर्जिर्िष्टव संस्ट्थापि 1365 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] के स्ट्थाि के जर्जधक माप जर्ज्ञाि अजधकारी द्वारा सत्याजपत और स्ट्टाजम्पत दकया िाएगा और उस राज्य के जर्जधक माप जर्ज्ञाि अजधकारी द्वारा आर्जधक अंतरालों पर उसका पुिसवत्यापि और स्ट्टाम्पि दकया िाएगा जिसमें ऐस े बाट या माप का प्रयोग दकया िािा ह।ै ” (ii) उप जियम (2) म ें जिम्ि जलजखत परंतुक अंत:स्ट्थ ाजपत दकया िाएगा अथावत:्- “परंत ु ऐस े बाट और माप, जििका उपयोग, उद्योगों द्वारा अपिे आतं ठरक प्रयोग के जलए दकया िाता ह ै और िो ग्राहक को पठरित्त मात्रा पर प्रभार् ि डालते हों या जिन्द्ह ें दकसी संव्यर्हार या संरिण के जलए प्रयोग िहीं दकया िाता ह,ै के जलए ऐसा पिु : सत् यापि अपेजित िहीं होगा।” (iii) उप जियम (4) के पश्चात ् जिम्ि जलजखत उप-जियम अन्द् त:स्ट्थ ाजपत दकया िाएगा, अथावत्:- “(5) ििे भर म ें एक समाि प्रदिया अपिाि े के जलए और उन्द् हीं बाटों तथा मापों के िोबारा स्ट्टाजम्पत दकए िाि े स े बचिे के जलए, एक राज्य स े िसू रे राज्य म ें भेि े गए बाटों और मापों के पहली बार सत् यापि और स्ट्टाजम्पत दकए िािे के जलए जिम्ि जलजखत प्रदिया का अिुपालि दकया िाएगा, अथावत्:- (i) सभी प्रकार के बाट और माप तथा तोलि े और मापि े के ऐस े उपस्ट्कर, जििका प्रयोग दकए िािे के स्ट्थ ाि पर संस्ट् थापि या अिं ांकि दकया िािा आर्श् यक िहीं ह,ै का सत् यापि, जर्जिमावण या आयात करि े र्ाले राज्य म ें दकया िाएगा; (ii) घरेलू उपयोग स े संबंजधत सभी प्रकार के बाटों और मापों का सत् यापि, जर्जिमावण या आयात करि े र्ाल े राज्य म ें दकया िाएगा; (iii) 50 दकलोग्राम तक की िमता र्ाले, सभी अस्ट्र्चाजलत तोलि उपकरणों का सत् यापि, जर्जिमावण या आयात करि े र्ाल े राज्य म ें दकया िाएगा, यदि इस े खोला िहीं गया हो या इिके प्रयोग दकए िाि े स े पूर् व अंिांकि अपेजित ि हो; (iv) सभी अन्द् य बाट और माप तथा ऐसे तोलिे और मापिे र्ाले उपस्ट्कर, जििका प्रयोग दकए िािे र्ाले स्ट्थ ाि पर संस्ट्थ ाजपत या अंिांकि दकया िािा अपेजित हो, को संस्ट् थाजपत दकए िािे र्ाले स्ट् थाि पर सत्याजपत और स्ट्टाजम्पत दकया िाएगा।‘’ 3. उक्त जियमों की छिी अिुसूची म,ें - (i) भाग VI – कपडा या प्लाजस्ट्टक फीता माप परै ा 3 म ें “5 मी या मीटर के गुणि”, अंकों, अिरों या िब् िों के स्ट् थाि पर “5 मी, 7.5 मी, 10 मी या मीटर के गणु ि” अंक, अिर या िब् ि रख े िाएंगे।‘’ (ii) भाग VII – इस्ट्पात का फीता माप, पैरा 3 म ें “5 मी, 7.5 मी, 10 मी या मीटर के गणु ि’’ अंकों, अिरों या िब् िों के स्ट् थाि पर “5 मी, 7.5 मी, 10 मी या मीटर के गुणि’’ अंक, अिर या िब्ि रखे िाएंग।े ‘’ 4. उक्त जियमों म,ें सातर्ीं अिुसूची म,ें िीर्वक-ग के अधीि, भाग- II म,ें पैरा 2 के उप-पैरा (2) की, मि (i) म,ें उप-मि (क) का लोप दकया िाएगा। [फा. स.ं I-9/41/2020-डब्ल् य ूएंड एम] अिुपम जमश्रा, संयुक्त सजचर् ठटप्प ण:- मूल जियम, भारत के रािपत्र, असाधारण, भाग-II, खंड 3, उप-खंड (i) म ें अजधसूचिा संख्या सा.का.जि. 71 (अ) तारीख 7 फरर्री 2011 द्वारा प्रकाजित दकए गए थ े और अजधसूचिा संख्या सा.का.जि. 875 (अ), तारीख 9 जसतंबर, 2016 द्वारा अंजतम बार संिोजधत दकए गए थे।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 MINISTRY OF CONSUMER AFFAIRS, FOOD AND PUBLIC DISTRIBUTION (Department of Consumer Affairs) NOTIFICATION New Delhi, the 3rd March, 2021 G.S.R. 149(E).—In exercise of the powers conferred by sub-section (1) read with clauses (c), (f), (h), (i) and (s) of sub-section (2) of section 52 of the Legal Metrology Act 2009, (1 of 2010), the Central Government hereby makes the following rules further to amend the Legal Metrology (General) Rules, 2011, namely: - 1. (1) These rules may be called the Legal Metrology (General) (Amendment) Rules, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Legal Metrology (General) Rules, 2011 (hereinafter referred to as the said rules), in rule 27, - (i) for sub-rule (1), the following sub-rule shall be substituted, namely:- “(1) Every weight or measure used or intended to be used in any transaction or for protection of living beings or things in clause (k) of section 2 shall be verified and stamped by the legal metrology officer of the State of manufacture or import or at the place of installation as specified in clause (iv) of sub-rule (5) and be re-verified and stamped at periodical intervals by the legal metrology officer in the State in which such weight or measure is put to use.”; (ii) in sub-rule (2), the following proviso shall be inserted, namely:- “Provided that such weights or measures which are used by the industries for their internal use and which do not affect the quantity delivered to the consumers or are not used in any transaction or for protection, shall not require such re-verification.”, (iii) after sub-rule (4), the following sub-rule shall be inserted, namely: - “(5) For adopting a uniform procedure throughout the country and to avoid double stamping of the same weights and measures, the first time verification and stamping of weights and measures, sent from one State to another State, shall follow the following procedure, namely:- (i) all types of weights and measures and such weighing and measuring instruments which are not required to be installed or calibrated at the place of use shall be verified in the State of manufacture or import; (ii) all types of weights and measures meant for domestic use shall be verified in the State of manufacture or import; (iii) all non-automatic weighing instruments, upto maximum capacity of 50 kg shall be verified in the State of manufacture or import, if it is not dismantled or do not require calibration before putting into use; (iv) all other weights and measures and such weighing and measuring instruments which are required to be installed or calibrated at the place of use shall be verified and stamped at the place of installation.”. 3. In the said rules, in the SIXTH SCHEDULE,- (i) in Part VI- FABRIC OR PLASTIC TAPE MEASURE, in paragraph 3, for the figure, letter and words “5 m or multiples of”, the figures, letters and words “5 m, 7.5 m, 10 m or multiples of” shall be substituted. (ii) in Part VII- STEEL TAPE MEASURE, in paragraph 3, for the figure, letters and words “5 m or multiples of”, the figures, letters and words “5 m, 7.5 m, 10 m or multiples of” shall be substituted. 4.
