## Policy Analysis Report: National Institute of Technology, Meghalaya Amendment Statute, 2025 **1. Executive Summary:** This report analyzes the National Institute of Technology, Meghalaya Amendment Statute, 2025, as published in the Gazette of India on April 11, 2025. This amendment modifies the National Institute of Technology, Meghalaya Statutes, 2017. The key changes address potential vacancies in the office of the Chairperson of the Board of Governors and the removal of substatute 15 from Statute 17. This analysis is based solely on the provided text. **2. Introduction:** This report aims to provide a comprehensive overview of the National Institute of Technology, Meghalaya Amendment Statute, 2025. The analysis is based exclusively on the text of the provided gazette notification, focusing on the changes introduced and their potential implications. **3. Policy Overview:** This document is an amendment to the National Institute of Technology, Meghalaya Statutes, 2017. The core objective, as inferred from the provided text, is to ensure continuity of leadership within the Board of Governors during vacancies of the Chairperson and to modify Statute 17 by removing substatute 15. **4. Background and Rationale:** The amendment regarding the Chairperson vacancy likely addresses a potential gap in governance during transitions. Without a mechanism to temporarily fill the Chairperson's role, decision-making and institutional oversight could be hampered. The amendment provides a contingency plan to mitigate this risk. The reason for omitting substatute 15 from statute 17 is not specified and cannot be inferred from the text provided. **5. Key Provisions / Changes:** This amendment introduces two key changes: * **Chairperson Vacancy Provision:** * **Original Policy Part Changed:** Statute 14 of the National Institute of Technology, Meghalaya Statutes, 2017. * **New Rule/Provision:** After substatute iv of Statute 14, a new substatute v is inserted. This new substatute allows the Chairperson of an Institute of National Importance, with the Visitor's approval, to discharge the functions of the NIT Meghalaya Chairperson for up to six months or until a regular Chairperson is nominated. This provision applies in cases of expiry of tenure, death, resignation, inability to discharge duties due to absence, illness, or any other cause. The Visitor may extend the tenure of an incumbent Chairperson for six months, or until a permanent replacement is nominated, in the case of tenure expiry. * **Difference/Effect:** This change provides a mechanism to ensure leadership continuity during a Chairperson vacancy. It establishes a clear line of authority and prevents potential disruption to the institute's operations. * **Removal of Substatuute 15:** * **Original Policy Part Changed:** Statute 17 of the National Institute of Technology, Meghalaya Statutes, 2017. * **New Rule/Provision:** Substatuute 15 is omitted. * **Difference/Effect:** Substatuute 15 is removed but the effect this has is unknown without the context of what the removed substatuute was. **6. Target Audience and Stakeholders:** The primary stakeholders directly affected by these changes are: * The Board of Governors of the National Institute of Technology, Meghalaya. * The Chairperson and potential acting Chairpersons of the Board of Governors. * The Visitor of the National Institute of Technology, Meghalaya. * Potentially, the faculty, staff, and students of the National Institute of Technology, Meghalaya, as the changes address leadership continuity and amendments to the statutes of the institiute. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Board of Governors of NIT Meghalaya is responsible for implementing the amendment. The Visitor plays a role in approving the acting Chairperson. * **Timelines/Procedures:** The amendment comes into force upon publication in the Official Gazette (April 11, 2025). The duration of the acting Chairperson's term is limited to six months or until a regular Chairperson is nominated, whichever is earlier. The visitor may extend the term of the incumbent Chairperson for six months, or until a permanent replacement is nominated, in the case of tenure expiry. * **Specific Implementation aspects:** * **Chairperson Vacancy Provision:** The Board of Governors must seek approval from the Visitor to install a chairperson of an Institute of National Importance as the acting chair. * **Removal of Substatuute 15:** The substatuute is immediately removed. **8. Expected Outcomes / Impact of Changes:** * **Chairperson Vacancy Provision:** The likely intended outcome is to ensure a smooth transition during periods of leadership vacancy, preventing potential delays in decision-making and maintaining institutional stability. This addition ensures the continuation of functions assigned to the Chairperson under Section 16 of the Act. * **Removal of Substatuute 15:** The intended outcome is unknown due to the substatuute not being specified in the text. It may have a tangible impact on policy but the effect is unknown. **9. Conclusion:** The National Institute of Technology, Meghalaya Amendment Statute, 2025, addresses potential governance gaps by providing a contingency plan for Chairperson vacancies and removing substatuute 15 from statute 17. The amendment aims to ensure leadership continuity and institutional stability during transitions. The impact of removing substatuute 15 is currently unknown.
