**Report on Constitution of State Level Environment Impact Assessment Authority and State Level Expert Appraisal Committee for Bihar**
**1. Executive Summary:**
This report provides an overview of a new policy notification issued by the Ministry of Environment, Forest and Climate Change, Government of India. The notification establishes the State Level Environment Impact Assessment Authority (SEIAA), Bihar, and the State Level Expert Appraisal Committee (SEAC), Bihar. The core purpose of this policy is to create bodies responsible for environmental impact assessment and appraisal within the state of Bihar, as mandated by the Environment Protection Act, 1986. Key findings include the defined composition, tenure, powers, and procedures for both the Authority and the Committee, as well as guidelines to avoid conflicts of interest.
**2. Introduction:**
This report aims to provide a comprehensive overview of the notification issued by the Ministry of Environment, Forest and Climate Change regarding the constitution of the State Level Environment Impact Assessment Authority (SEIAA) and the State Level Expert Appraisal Committee (SEAC) for Bihar. The analysis is based solely on the information provided in the given policy text.
**3. Policy Overview:**
* This is a *New Policy* establishing new entities.
* **Core Objective(s):** The core objective is to constitute and define the functions, membership, and operational procedures of the State Level Environment Impact Assessment Authority (SEIAA), Bihar, and the State Level Expert Appraisal Committee (SEAC), Bihar, for environmental regulation within the state. The objective is derived from the stated purpose of the notification ("In exercise of the powers conferred by subsection 3 of section 3 of the Environment Protection Act, 1986") and the constitution of the bodies themselves.
**4. Background and Rationale:**
* **Likely Problem/Issue Addressed (Inferred):** The policy likely addresses the need for a structured and localized environmental governance framework within Bihar. The Environment Protection Act, 1986 provides the legal basis, and the creation of state-level bodies suggests a need for localized assessment and appraisal of projects with potential environmental impacts within the state. The supersession of a previous notification (S.O. 1514(E), dated the 5th April, 2018) indicates a periodic need for updates or revisions to the structure and composition of these bodies.
**5. Key Provisions / Changes:**
* Since this is a *New Policy*, the key provisions are the components of the new structure itself:
* **Establishment of SEIAA and SEAC:** The policy establishes both the State Level Environment Impact Assessment Authority (SEIAA), Bihar and the State Level Expert Appraisal Committee (SEAC), Bihar.
* **Composition and Membership:** The policy explicitly lists the members of both SEIAA and SEAC, including their names, positions, and affiliations.
* **Tenure:** The Chairman and Members of both the Authority and the Committee will hold office for a term of three years from the date of publication of the notification in the Official Gazette.
* **Powers and Procedures:** The Authority, Bihar, shall exercise such powers and follow such procedures as specified in the notification S.O.1533E, dated the 14th September, 2006. The SEAC, Bihar, shall exercise such powers and follow such procedures as specified in the said notification.
* **Decision Making:** The Authority, Bihar, shall take its decision on the recommendations of the State Level Expert Appraisal Committee. The SEAC, Bihar shall function on the principle of collective responsibility and the Chairman shall endeavor to reach consensus in each case.
* **Conflict of Interest:** The policy outlines guidelines to avoid conflicts of interest, including requirements for members to declare associations with consulting organizations or project proponents and to recuse themselves from meetings when a conflict exists.
* **Secretariat:** The Government of Bihar shall notify an agency to act as Secretariat for the Authority, Bihar and SEAC, Bihar and the Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all their statutory functions.
* **Financial Provisions:** The sitting fee, travelling allowance and dearness allowance to the Chairman and Members of the Authority, Bihar and SEAC, Bihar shall be paid as per the rules of the State Government of Bihar.
**6. Target Audience and Stakeholders:**
The target audience and stakeholders directly affected by this policy include:
* Project proponents within the State of Bihar requiring environmental clearances.
* The members of the newly constituted SEIAA and SEAC, Bihar.
* The Bihar State Pollution Control Board.
* The Government of Bihar, particularly the Department of Environment, Forest and Climate Change.
* Consulting organizations involved in Environmental Impact Assessments in Bihar.
* Local communities within Bihar that may be affected by projects undergoing environmental review.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The primary responsible bodies are the State Level Environment Impact Assessment Authority (SEIAA), Bihar, and the State Level Expert Appraisal Committee (SEAC), Bihar, in coordination with the Department of Environment, Forest and Climate Change, Government of Bihar. A Secretariat designated by the Government of Bihar will provide administrative support.
* **Timelines/Procedures:** The notification specifies a three-year tenure for the members of both the Authority and the Committee. The notification refers to another notification, S.O.1533E, dated the 14th September, 2006, for powers and procedures to be followed.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of this policy are:
* A more structured and efficient environmental clearance process for projects within Bihar.
* Improved environmental governance through the expertise and oversight of the constituted Authority and Committee.
* Increased transparency and accountability in environmental decision-making due to the conflict of interest guidelines.
* Better environmental protection and sustainable development within the state.
**9. Conclusion:**
The constitution of the State Level Environment Impact Assessment Authority (SEIAA), Bihar, and the State Level Expert Appraisal Committee (SEAC), Bihar, is a significant step towards strengthening environmental governance in the state. This notification defines the structure, membership, and operational guidelines for these bodies, which are crucial for ensuring that development projects are environmentally sound and sustainable. The policy helps implement the Environment Protection Act, 1986, at the state level.
