2. चाय (िवपणन) िनयं(ण आदशे , 2003 (िजसे इसम8 इसके प; चात उ(cid:28) त आदशे कहा गया है) म8 पैरा 2 म8, ख= ड (थ) के िलए
िन,न िलिखत खंड को रखा जाएगा, अथा/त् :-
‘(थ) “@(cid:15)त प(cid:24)त ी चाय कारखाना” से ऐसा चाय कारखाना अिभ(cid:22)ेत है जो चाय के िविनमा/ण के (cid:22)योजन के िलए Cकसी कैल8डर वष/ के
दौरान अनय ् चाय उपजकता/E से अपनी चाय प(cid:24)त ी क(cid:15) अपे3ा का कम से कम इ(cid:28) यावन (cid:22)ितशत Fोत करता ह;ै’ ।
3. उ(cid:28)त आदशे के पैरा 17 के Hथ ान पर िन, निलिखत पैरा रखा जाएगा, अथा/त् :-
“17. फ(cid:15)स - अनुKि4त जारी करने अथवा उसके रिजH Lीकरण अथवा नवीकरण के िलए (cid:22)(cid:24) येक आवेदन के साथ उस फ(cid:15)स को संलMन
Cकया जाएगा जोCक क8(cid:5)ीय सरकार के पूवा/नुमोदन के साथ अनुKापन (cid:22)ािधकारी अथवा रिजH Lीकरण (cid:22)ािधकारी (cid:21)ारा समय-समय पर

करना नीलामी हते ु अनुK4त (cid:22)ा4त चाय नीलामी आयोजक(cid:30) के िनयं(ण अथवा त(cid:24) वावधान म8 Cकया जाता ह ै:

Notification
New Delhi, the 1st October, 2015
S.O. 2688(E).––In exercise of the powers conferred by sub-sections (3) and (5) of section 30 of the Tea Act, 1953 (29 of
1953), the Central Government hereby makes the following amendments further to amend the Tea (Marketing) Control
Order, 2003, namely:-
1. (1) This order may be called the Tea (Marketing) Control (Second Amendment) Order, 2015.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. In the Tea (Marketing) Control Order, 2003 (hereinafter referred to as the said order), in paragraph 2, for clause
(q), the following clause shall be substituted, namely:–
‘(q) “Bought leaf tea factory” means a tea factory which sources not less than fifty-one per cent. of its tea
leaf requirement from other tea growers during any calendar year for the purpose of manufacture of tea;’.
3. For paragraph 17 of the said order, the following paragraph shall be substituted, namely:––
“17. Fees – Every application for the issue of a licence or registration or renewal thereof shall be accompanied
by such fees as may be prescribed from time to time by the Licensing Authority or the Registering Authority with
the prior approval of the Central Government.”.
4. In paragraph 21 of the said order, for sub-paragraph (1), the following sub-paragraph shall be substituted,
namely:––
“(1) Every registered tea manufacturer shall, on and from the date of commencement of this notification, sell not
less than fifty per cent. of the total tea manufactured in a calendar year through public tea auctions in India, held
under the control or auspices of organisers of tea auction licensed to do so under the provisions of this order:
Provided that the Registering Authority may, from time to time, revise such percentage with the prior approval
of the Central Government.”.
