## Policy Analysis Report: Amendment to Customs Notification No. 28/2021-Customs
**1. Executive Summary:**
This report analyzes an amendment to Notification No. 28/2021-Customs, as published in the Gazette of India on May 31, 2021. The amendment, issued by the Department of Revenue, Ministry of Finance, extends the validity of a provision within the original notification and adds an entry related to "Amphotericin B" to a specified table. The core purpose of this amendment appears to be to extend the timeframe for an existing customs-related provision and address a specific need related to Amphotericin B, likely related to import or duty considerations.
**2. Introduction:**
This report aims to provide an informative overview of the amendment to Notification No. 28/2021-Customs, based solely on the information provided in the official gazette notification dated May 31, 2021. This analysis focuses on the changes introduced by this specific amendment.
**3. Policy Overview:**
* **Original Policy:** This amendment refers to and modifies the original Notification No. 28/2021-Customs, dated April 24, 2021.
* **Core Objective(s) (Inferred):** Based on the provided text, the original notification likely deals with customs duties or exemptions as per the Customs Act, 1962. The amendment seeks to modify certain aspects of this existing framework.
**4. Background and Rationale:**
The amendment seems to address two distinct issues. Firstly, the extension of the timeframe suggests that the original provision, set to expire on July 31, 2021, requires continued application. Secondly, the inclusion of Amphotericin B indicates a specific need to address customs-related aspects (potentially import duties or exemptions) for this substance, possibly due to increased demand or supply chain considerations.
**5. Key Provisions / Changes:**
This section details the specific changes introduced by the amendment:
* **Change 1:** The amendment modifies paragraph 2 of the original notification.
* **Original Provision:** The original notification specified "31st July, 2021" as a key date.
* **New Provision:** The amendment replaces "31st July, 2021" with "31st August, 2021".
* **Effect of Change:** This change extends the applicability or validity of the provision associated with that date by one month, until August 31, 2021.
* **Change 2:** The amendment inserts a new entry into a "Table" within the original notification.
* **Original Provision:** The original notification included a table with numbered entries.
* **New Provision:** After S.No. 18, a new entry (S.No. 19) is added with the values "29 or 30" in columns 1 and 2, and "Amphotericin B" in column 3.
* **Effect of Change:** This addition likely subjects Amphotericin B to specific customs duties, exemptions, or regulations as defined by values "29 or 30" in columns 1 and 2 within the context of that table. *The specific meaning of '29 or 30' is not defined in this extract and would require reference to the original notification.*
**6. Target Audience and Stakeholders:**
Based on the provided text, the stakeholders directly affected by these changes include:
* **Importers and Exporters:** Specifically those dealing with Amphotericin B.
* **Customs Brokers and Agents:** Those involved in clearing shipments through customs.
* **Relevant Government Agencies:** Primarily the Department of Revenue and customs officials.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Central Board of Indirect Taxes and Customs (CBIC), as indicated by the F. No. CBIC190354372021TOTRUICBECPtI, is likely responsible for implementing and overseeing the changes.
* **Timelines:** The amendment clearly sets a new end date of August 31, 2021, for the provision modified in paragraph 2.
* **Procedures:** The insertion of Amphotericin B into the table likely triggers existing customs procedures associated with that table's framework. These procedures are not explicitly detailed in this amendment but are referenced through the Customs Act, 1962.
**8. Expected Outcomes / Impact of Changes:**
* **Extension Impact:** The extension until August 31, 2021, likely aims to provide continued relief, incentives, or regulatory measures related to the original provision.
* **Amphotericin B Impact:** The inclusion of Amphotericin B likely intends to address a specific need, potentially to expedite its import or regulate its export. The impact on cost and availability will depend on whether this inclusion grants an exemption or imposes a new duty. Further research into the original notification is needed to determine this impact accurately.
**9. Conclusion:**
The amendment to Notification No. 28/2021-Customs introduces two key changes: extending the validity of a provision until August 31, 2021, and adding Amphotericin B to a table, likely related to customs duties or exemptions. These changes impact importers, exporters, and customs officials. The extension suggests a continued need for the original provision, while the inclusion of Amphotericin B implies a targeted response to the substance's specific import or export requirements. Further analysis of the original Notification No. 28/2021-Customs and related customs regulations is crucial for a complete understanding of the implications of these changes.
