1.(cid:32) इस िविनयमावली को भारतीय लघु उ(cid:7378)ोग िवकास ब(cid:7289)क ((cid:7021)टाफ) [संशोधन] िविनयमावली, 2017 कहा जाए।

2.(cid:32) यह िविनयमावली 01 अ(cid:7079)ैल, 2017 से (cid:7079)भावी होगी।

3.(cid:32) मूल िविनयमावली के अ(cid:7007)याय VI के िविनयम 80 म(cid:7286) वत(cid:6981)मान “(छ)” के प(cid:7391)ात् िन(cid:7388)िलिखत दो अवकाश (ज) एवं (झ) जोड़े जाएँगेः- “(ज) िशशु द(cid:7275)क-(cid:7061)हण अवकाश” “(झ) िपतृ(cid:7004)व अवकाश”

4.(cid:32) मूल िविनयमावली के अ(cid:7007)याय VI के िविनयम 95 म(cid:7286) िविनयम क(cid:7409) (cid:7079)थम पंि(cid:7334) और उप िविनयम 2(ii) क(cid:7409) अंितम पिं (cid:7334) म(cid:7286) (cid:7079)यु(cid:7334) “अ(cid:7007)य(cid:6979)” श(cid:7011)द (cid:7079)ित(cid:7021)थािपत होकर उसके (cid:7021)थान पर “स(cid:6979)म (cid:7079)ािधकारी” श(cid:7011)द का (cid:7079)योग होगा।

5.(cid:32) मूल िविनयमावली के अ(cid:7007)याय VI क(cid:7409) धारा 3 म(cid:7286) वत(cid:6981)मान िविनयम 101 के प(cid:7391)ात् दो नये िविनयम “101ए” एवं “101बी” जोड़े जाएँगे जो िन(cid:7388)वत ह(cid:7289): “िविनयम 101ए (1) िशशु द(cid:7275)क-(cid:7061)हण अवकाश ऐसी मिहला कम(cid:6981)चारी को (cid:7021)वीकृत (cid:7408)कया जाएगा, िजसके दो से कम जीिवत ब(cid:7340)े ह(cid:7298)। यह सवेतन अवकाश होगा और एक वष(cid:6981) से कम उ(cid:7083) के ब(cid:7340)े के वैध द(cid:7275)क-(cid:7061)हण पर, वैध द(cid:7275)क-(cid:7061)हण क(cid:7409) तारीख के तुर(cid:7008)त बाद अिधकतम छह माह क(cid:7409) अविध के िलए (cid:7021)वीकृत (cid:7408)कया जाएगा। ब(cid:7340)े का द(cid:7275)क-(cid:7061)हण उिचत वैध (cid:7079)(cid:7408)(cid:7059)या के अनु(cid:7272)प होना चािहए, िजसके िलए कम(cid:6981)चारी को ब(cid:7289)क म(cid:7286) द(cid:7275)क-(cid:7061)हण िवलेख (cid:7079)(cid:7021)तुत करना होगा। 3475 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(2) अवकाश (cid:7021)वीकृत करने म(cid:7286) स(cid:6979)म (cid:7079)ािधकारी कम(cid:6981)चारी को िशशु द(cid:7275)क-(cid:7061)हण अवकाश के साथ अिवराम (cid:7272)प से अथवा उससे िमलाकर, आकि(cid:7021)मक अवकाश, िवशेष आकि(cid:7021)मक अवकाश तथा िवशेष (cid:7271)(cid:6991)णता अवकाश को छोड़कर (cid:7408)कसी भी (cid:7079)कार का अ(cid:7008)य अवकाश (cid:7021)वीकृत कर सकता है। “101बी” (1) िपतृ(cid:7004)व अवकाश ऐसे पु(cid:7271)ष कम(cid:6981)चारी (जैिवक िपता) को (cid:7021)वीकृत (cid:7408)कया जाएगा, िजसके दो से कम जीिवत ब(cid:7340)े ह(cid:7298)। यह सवेतन अवकाश होगा और कम(cid:6981)चारी क(cid:7409) प(cid:7360)ी के ज(cid:7340)ागृह म(cid:7286) होने क(cid:7409) अविध म(cid:7286) प(cid:7008)(cid:7076)ह (cid:7408)दन या िशशु के ज(cid:7008)म क(cid:7409) तारीख से छह माह तक क(cid:7409) अविध म(cid:7286) प(cid:7008)(cid:7076)ह (cid:7408)दन के िलए (cid:7021)वीकृत (cid:7408)कया जाएगा;

(2) िपतृ(cid:7004)व अवकाश ऐसे पु(cid:7271)ष कम(cid:6981)चारी (द(cid:7275)क-(cid:7061)हणकता(cid:6981) िपता) को (cid:7021)वीकृत (cid:7408)कया जाएगा, िजसके दो से कम जीिवत ब(cid:7340)े ह(cid:7298)। यह सवेतन अवकाश होगा और एक वष(cid:6981) से कम उ(cid:7083) के ब(cid:7340)े के वैध द(cid:7275)क-(cid:7061)हण पर, वैध द(cid:7275)क-(cid:7061)हण क(cid:7409) तारीख के प(cid:7391)ात् प(cid:7008)(cid:7076)ह क(cid:7409) अविध के िलए (cid:7021)वीकृत (cid:7408)कया जाएगा। ब(cid:7340)े का द(cid:7275)क-(cid:7061)हण उिचत वैध (cid:7079)(cid:7408)(cid:7059)या के अनु(cid:7272)प होना चािहए, िजसके िलए कम(cid:6981)चारी को ब(cid:7289)क म(cid:7286) द(cid:7275)क-(cid:7061)हण िवलेख (cid:7079)(cid:7021)तुत करना होगा।

NOTIFICATION Lucknow, the 8th May, 2017 “The Small Industries Development Bank of India (Staff) [Amendment] Regulations, 2017” F. No. HRV No. L00141487 /Staff General (2).—In exercise of the powers conferred by sub-section (1) of

Section 52 of the Small Industries Development Bank of India Act, 1989 (39 of 1989), the Board of Directors of the Small Industries Development Bank of India hereby makes the following amendments to the Small Industries Development Bank of India (Staff) Regulations, 2001 (the Original Regulations), namely:-

1.(cid:32) These Regulations may be called the Small Industries Development Bank of India (Staff) [Amendment] Regulations,

2017.

2.(cid:32) These Regulations shall come into force with effect from April 01, 2017.

3.(cid:32) In Regulation 80 of Chapter VI of the Original Regulations the following two new leave shall be inserted as (h) and

(i) after the existing "(g)":- “(h) Child Adoption Leave” “(i) Paternity Leave”

4. In Regulation 95 of Chapter VI of the Original Regulations the words "the Chairman" appearing in the first line of the Regulation and the last line of sub-regulation 2(ii) shall stand substituted and replaced with the words "the Competent Authority".

5. In Section 3 of Chapter VI of the Original Regulations, after the existing Regulations 101, two new Regulations "101A" and "101B" shall be inserted to the following effect: “101A (1) Child Adoption Leave, which shall be on leave pay, may be granted to a female employee with less than two surviving children, for a period not exceeding six months on valid adoption of a child below the age of one year, immediately after the date of valid adoption. The adoption of a child should be through proper legal process and the employee shall produce the adoption deed to the Bank.

(2) The authority empowered to grant leave may grant leave of any other kind admissible to the employee other than Casual Leave, Special Casual Leave and Special Sick Leave in combination with, or in continuation of Child Adoption Leave."¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 "101B" (1) Paternity Leave, which shall be on leave pay, may be granted to a male employee (natural father) with less than two surviving children, for a period of fifteen days during the confinement of his wife for child birth, i.e., up to fifteen days before or up to six months from the date of delivery of the child;

(2) Paternity Leave, which shall be on leave pay, may be granted to a male employee (adoptive father) with less than two surviving children, for a period of fifteen days on valid adoption of a child below the age of one year, within a period of six months from the date of valid adoption. The adoption of a child should be through proper legal process and the employee shall produce the adoption deed to the Bank.

(3) The authority empowered to grant leave may grant leave of any other kind admissible to the employee other than casual Leave, Special casual Leave and Special Sick Leave in Combination with, or in continuation of Paternity Leave."
