23) की धारा 52 की उपधारा (2) के खडं (छ), (ि) तथा (झ) के साथ पठित उसकी उपधारा (1) द्वारा प्रित्त िजियों का प्रयोग करते हुए, पेंिन जनजध जिजनयामक और जिकास प्राजधकरण एति ् द्वारा पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (राष्ट्रीय पेंिन प्रणाली के अतं गतच जनकास और प्रत्याहरण) जिजनयम, 2015 में संिोधन करत े हुए जनम्न जिजनयम बनाता ह,ै नामतः,-

1. इन जिजनयमों का नाम पिें न जनजध जिजनयामक और जिकास प्राजधकरण (राष्ट्रीय पेंिन प्रणाली के अंतगचत जनकास और प्रत्याहरण) (संिोधन) जिजनयम, 2023 ह ैI

2. यह जिजनयम िासकीय रािपत्र में उनके प्रकािन की जतजथ से प्रिृत्त होंगे I

3. पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (राष्ट्रीय पेंिन प्रणाली के अतं गतच जनकास और प्रत्याहरण) जिजनयम, 2015 म ें:- जिजनयम 4 के उप-जिजनयम (घ) के खडं (i) म,ें जनम्नजलजखत नए प्रािधान को िोड़ा िाएगा :- 1951 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “परन्त ु यह दक ऐसा प्रािधान दकसी कॉपोरेट जनकाय या अन्य इकाई िो दक या तो केंद्र सरकार या दकसी राज्य सरकार के स्ट्िाजमत्ि तथा जनयंत्रण में हो या एक सरकारी कंपनी, के अजभिाताओं पर लागू नहीं होगा तथा उनकी जनकासी जिजनयम 4 के अन्य उप-जिजनयमों, िो भी लाग ूहो, के अधीन होगी;” डॉ. िीपक महान्ती, अध्यक्ष [जिज्ञापन-III/4/असा./703/2022-23] पािलखे :

2. पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (राष्ट्रीय पेंिन प्रणाली के अंतगचत जनकास और प्रत्याहरण) (प्रथम संिोधन) जिजनयम, 2017, भारत के रािपत्र म ें 10 अगस्ट्त, 2017 को अजधसूचना सं. पीएफआरडीए/12/ आरिीएल/139/8 के माध्यम से प्रकाजित दकये गए थे I

3. पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (राष्ट्रीय पेंिन प्रणाली के अतं गतच जनकास और प्रत्याहरण) (िसू रा संिोधन) जिजनयम, 2017, भारत के रािपत्र में 6 अक्टूबर, 2017 को, अजधसूचना सं. पीएफआरडीए/12/ आरिीएल/139/8 के माध्यम से प्रकाजित दकये गए थे I

4. पिें न जनजध जिजनयामक और जिकास प्राजधकरण (राष्ट्रीय पेंिन प्रणाली के अंतगचत जनकास और प्रत्याहरण) (तृतीय संिोधन) जिजनयम, 2018, भारत के रािपत्र में 02 फरिरी, 2018 को, अजधसूचना सं. पीएफआरडीए/12 /आरिीएल/139/8 के माध्यम स ेप्रकाजित दकये गए थ े I

5. पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (राष्ट्रीय पेंिन प्रणाली के अतं गतच जनकास और प्रत्याहरण) (चतुथच संिोधन) जिजनयम, 2018, भारत के रािपत्र म ें 18 मई, 2018 को, अजधसूचना सं. पीएफआरडीए/12/ आरिीएल/139/8 के माध्यम से प्रकाजित दकये गए थे I

6. पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (राष्ट्रीय पेंिन प्रणाली के अंतगचत जनकास और प्रत्याहरण) (पांचिा संिोधन) जिजनयम, 2019, भारत के रािपत्र म ें 19 फरिरी, 2019 को, अजधसूचना सं. पीएफआरडीए/12/ आरिीएल/139/8 के माध्यम से प्रकाजित दकये गए थे I

7. पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (राष्ट्रीय पेंिन प्रणाली के अंतगचत जनकास और प्रत्याहरण) (छिा संिोधन) जिजनयम, 2019, भारत के रािपत्र म ें 20 जसतम्बर, 2019 को, अजधसूचना सं. पीएफआरडीए/12/ आरिीएल/139/8 के माध्यम से प्रकाजित दकये गए थे I

8. पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (राष्ट्रीय पेंिन प्रणाली के अंतगचत जनकास और प्रत्याहरण) (संिोधन) जिजनयम, 2020, भारत के रािपत्र में 29 जसतम्बर, 2020 को, अजधसूचना सं. पीएफआरडीए/12/ आरिीएल/139/8 के माध्यम से प्रकाजित दकये गए थ े I

9. पेंिन जनजध जिजनयामक और जिकास प्राजधकरण (राष्ट्रीय पेंिन प्रणाली के अंतगचत जनकास और प्रत्याहरण) (संिोधन) जिजनयम, 2021, भारत के रािपत्र में 14 िनू , 2021 को अजधसूचना सं. पीएफआरडीए/12/ आरिीएल/139/8 के माध्यम से प्रकाजित दकये गए थे I

NOTIFICATION New Delhi, the 23rd March, 2023 PENSION FUND REGULATORY AND DEVELOPMENT AUTHORITY (EXITS AND WITHDRAWALS UNDER THE NATIONAL PENSION SYSTEM) (AMENDMENT) REGULATIONS, 2023 No. PFRDA/12/RGL/139/8.—In exercise of the powers conferred by sub-section (1) of Section 52 read with sub-clause(g), (h), and (i) of sub-section 2 of Section 52 of the Pension Fund Regulatory and Development Authority Act, 2013 (Act No.23 of 2013), the Pension Fund Regulatory and Development Authority hereby makes the following regulations to amend the Pension Fund Regulatory and Development Authority (Exits and Withdrawals under the National Pension System) Regulations, 2015 namely, -

1. These regulations may be called the Pension Fund Regulatory and Development Authority (Exits and Withdrawals under the National Pension System) (Amendment) Regulations, 2023.

2. These shall come into force on the date of their publication in the official gazette.

3. In the Pension Fund Regulatory and Development Authority (Exits and Withdrawals under the National Pension System) Regulations, 2015: - In clause (i) of sub-regulation (d) of Regulation 4, following new proviso shall be added:

“Provided that such clause shall not be applicable to the subscribers of a body corporate or other entity under the ownership and control, either of the Central Government or any State Government or a Government Company and their exit shall be governed by other sub-regulations of Regulation 4, as may be applicable;” Dr. DEEPAK MOHANTY, Chairperson [ADVT.-III/4/Exty./703/2022-23]

7. The Pension Fund Regulatory and Development Authority (Exits and Withdrawals under the National Pension System) (Sixth Amendment) Regulations, 2019 were published in the Gazette of India on 20th September, 2019 vide notification No. PFRDA/12/RGL/139/8.

8. The Pension Fund Regulatory and Development Authority (Exits and Withdrawals under the National Pension System) (Amendment) Regulations, 2020 were published in the Gazette of India on 29th September, 2020 vide notification No. PFRDA/12/RGL/139/8.

9. The Pension Fund Regulatory and Development Authority (Exits and Withdrawals under the National Pension System) (Amendment) Regulations, 2021 were published in the Gazette of India on 14th June, 2021 vide notification No. PFRDA/12/RGL/139/8.
