Executive Summary & Key Takeaways

What it means

  • The gazette notification issued by the Insurance Regulatory and Development Authority of India (IRDAI) announces the 'Obligatory Cession' for the financial year 2023-24.
  • It specifies the percentage of sum insured on each general insurance policy that must be reinsured with Indian Re-insurers.
  • It defines the terms and conditions related to this obligatory cession, including commission rates and profit sharing arrangements.

Key Changes

  • For the financial year beginning April 1, 2023, to March 31, 2024, 4% of the sum insured on each general insurance policy must be reinsured with Indian Re-insurer(s).
  • Terrorism premium and premium ceded to the Nuclear pool are exceptions and will be 'NIL'.
  • The entire obligatory cession is to be placed with General Insurance Corporation of India (GIC Re) only.
  • There is no limit on the sum insured applicable for cessions made during the specified period.
  • Minimum commission rates are defined for different classes of business, including 5% for Motor TP and Oil & Energy insurance, 10% for Group Health insurance, 7.50% for Crop Insurance, Average Terms for Aviation insurance and 15% for all other classes of insurance business.
  • A profit commission sharing arrangement of 50%:50% is established between the Indian Re-insurer and the ceding insurer, based on the performance and surplus of the total obligatory portfolio, after factoring in incurred loss %, management expenses (2%), profit (5%), commission (15%), and loss ratio (50% to 78%). No profit commission is payable if the loss ratio exceeds 78%, and the profit commission shall not exceed 14%.

Impact Analysis

Insurers

  • Insurers need to track their incurred losses and other relevant financial metrics to participate in the profit commission sharing arrangement.

GIC Re (Indian Re-insurer)

  • GIC Re may require ceding insurers to provide immediate notice of underwriting information of any cession exceeding an amount as specified by them.

Policyholders

  • However, the notification aims to strengthen the reinsurance framework, which can ultimately benefit policyholders by ensuring the financial stability of insurers.

Action Items for Insurers

  • Establish a mechanism for tracking incurred losses and other relevant financial metrics for profit commission calculations.
