4. प्राजधकरण, दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षेत्र, इस अजधसूचना के पैरा-5 के अधीन
गरित राज्य स्ट्तरीय जविेर्ज्ञ मल्ू यांकन सजमजत (एसईएसी) की जसफाररिक के आधार पर अपन े जवजनश्चय करेगा ।
5. प्राजधकरण, दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षेत्र की सहायता के जलए केंद्रीय सरकार,
दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षत्रे की राज्य सरकार के परामिा से, संघ राज्यक्षेत्र जविेर्ज्ञ
मूल् यांकन सजमजत, दादरा और नागर हवले ी तथा दमण और दीव संघ राज्यक्षेत्र (जजसे इसके पश् चात् यूटीईएसी, दादरा और
नागर हवेली तथा दमण और दीव कहा गया ह)ै का गिन करेगी, ज जनम्न जलजखत सदस्ट् यक से जमलकर बनेगी, अथाात ् :--

काया करेगी और अध्यक्ष प्रत्येक मामले में सवासम्मजत पर पए चं ने का प्रयास करेगा और यदद सवासम्मजत पर नहीं पए चं ा जा
सकता ह ैत बए मत का मत अजभभावी ह गा ।
9. जहतक के टकराव से बचन े के जलए,-
(क) यूटीईआईएए और यूटीईएसी, दादरा और नागर हवेली तथा दमण और दीव के अध् यक्ष और सदस्ट् य यह घ र्णा करेंग े
दक वे दकस परामिी सगं िन से सहबद् ह ैंतथा पररय जना के प्रस्ट् तावक भी ह;ैं
(ख) यूटीईआईएए तथा यूटीईएसी दादरा और नागर हवले ी तथा दमण और दीव सघं राज्यक्षेत्र का अध्यक्ष और सदस्ट्य
अपन े कायाकाल के दौरान, ऐसी पररय जना के जलए पयाावरण समाघात जनधाारण (ईआईए) तथा पयाावरण प्रबंध य जना
तैयार करने के जलए क ई परामिा नहीं करेंग े या सहबद् नहीं हकगे, जजसका मूल् यांकन यूटीआईएए और यूटीईएसी तथा
यूटीईएसी, दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षेत्र द्वारा दकया जाना ह;ै और
(ग) यदद जपछले पांच वर्ों म,ें यूटीईआईएए तथा यूटीईएसी दादरा और नागर हवले ी तथा दमण और दीव का अध्यक्ष और
सदस्ट्यक में से दकसी सदस्ट्य ने दकसी पररय जना प्रस्ट् तावक के जलए परामिी सेवाएं प्रदान की ह ैं या पयाावरण समाघात
जनधाारण (ईआईए) अध् ययन दकए ह,ैं त उस जस्ट्थ जत म ें वे ऐसे प्रस्ट् तावकक द्वारा प्रस्ट्त ाजवत की जा रही दकसी पररय जना के
मूल् यांकन की प्रदिया म ें यूटीईआईएए और यूटीईएसी दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षेत्र की

10. दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षेत्र प्रिासन प्राजधकरण और यूटीईएसी दादरा और नागर
हवेली तथा दमण और दीव सघं राज्यक्षेत्र के जलए सजचवालय के रूप म ें काय ा करन े के जलए दकसी अजभकरण क अजधसूजचत
करेगा और उक्त सजचवालय सभी जवत्तीय और संभार तंत्र समथान, जजसके अंतगात स्ट्थान, पररवहन भी ह ै और प्राजधकरण
और यूटीईएसी दादरा और नागर हवेली तथा दमण और दीव संघ राज्यक्षेत्र के सभी कानूनी कृत्यक के संबंध म ें ऐसी अन्य
सुजवधाएं भी ह,ैं उपलब्ध कराएगा ।
11. प्राजधकरण, दादरा और नागर हवेली तथा दमण और दीव सघं राज्यक्षेत्र के अध्यक्ष और सदस्ट्य और यूटीईएसी
दादरा और नागर हवले ी तथा दमण और दीव संघ राज्यक्षेत्र के अध्यक्ष और सदस्ट्यक क फीस, यात्रा भत् ता और मंहगाई
भत् ता जनयमक के अनुसार संदत्त दकया जाएगा ।

NOTIFICATION
New Delhi, the 1st March, 2021
S.O. 974(E).—In exercise of the powers conferred by sub-section (3) of Section 3 of the Environment
(Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile
Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to
as the said notification), the Central Government hereby constitutes the Union Territory Level Environment Impact
Assessment Authority (UTEIAA), Union Territory of Dadra and Nagar Haveli and Daman and Diu, (hereinafter
referred to as the Authority, Union Territory of Dadra and Nagar Haveli and Daman and Diu) comprising of the
following three Members, namely:—
1. Dr. M.R.G. Reddy, Chairman;
Indian Forest Service (Retired),
Flat No. 304, E-44, Vaishnavi Siri Sampada Apartments, Madhuranagar, Hyderabad- 38
2. Prof. EDA Udaya Bhaskar Reddi, Retd. Member;

2. The Chairman and Members of the Authority, Union Territory of Dadra and Nagar Haveli and Daman and
Diu shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
3. The Authority, Union Territory of Dadra and Nagar Haveli and Daman and Diu shall exercise such powers
and follow such procedures as enumerated in the said notification.
4. The Authority, Union Territory of Dadra and Nagar Haveli and Daman and Diu shall take its decision on the
recommendations of the State level Expert Appraisal Committees (SEACs) constituted under paragraph 5 of this
notification.
5. To assist the Authority, Union Territory of Dadra and Nagar Haveli and Daman and Diu, the Central
Government in consultation with the State Government of Union Territory of Dadra and Nagar Haveli and Daman and
Diu, hereby constitutes the Union Territory Expert Appraisal Committee, Union Territory of Dadra and Nagar Haveli
and Daman and Diu (hereinafter referred to as the UTEAC, Union Territory of Dadra and Nagar Haveli and Daman
and Diu) comprising of the following Members, namely:-
1. Dr. V.P. Upadhyay, Scientist (Advisor), (Retired), Chairman;
B1- 303, New Jeevan Bima Nagar Housing Society, MaitriVihar, PO. Rail
Vihar, Chandrasekharpur, Bhubaneswar- 23
2. Shri Arvind Vispute, Member;
Chief Conservator of Forests (Retd.) Maharashtra,

6. The Chairman and Members of the UTEAC, Union Territory of Dadra and Nagar Haveli and Daman and Diu
shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
7. The UTEAC, Union Territory of Dadra and Nagar Haveli and Daman and Diu shall exercise such powers and
follow such procedures as enumerated in the said notification.
8. The UTEAC, Union Territory of Dadra and Nagar Haveli and Daman and Diu shall function on the principle
of collective responsibility and the Chairman shall endeavor to reach a consensus in each case, and if consensus
cannot be reached, the view of the majority shall prevail.
9. In order to avoid any conflict of interest,-
(a) the Chairman and Members of the UTEIAA and UTEAC, Union Territory of Dadra and Nagar Haveli and
Daman and Diu shall as declare to which consulting organisation they have been associated with and also the project
proponents;
(b) the Chairman and Member of the UTEIAA and UTEAC, Union Territory of Dadra and Nagar Haveli and
Daman and Diu shall not undertake any consultation or associate with preparation of Environment Impact Assessment
(EIA) and Environment Management Plan for a project, which is to be appraised by the UTEIAA and UTEAC, Union
Territory of Dadra and Nagar Haveli and Daman and Diu during their tenure; and
(c) if in the past five years, the Chairman or any of the Members of the UTEIAA and UTEAC, Union Territory
of Dadra and Nagar Haveli and Daman and Diu have provided consultancy services or conducted EIA studies for any
project proponent, in that event they shall recuse themselves from the meetings of the UTEIAA and UTEAC, Union
Territory of Dadra and Nagar Haveli and Daman and Diu in the process of appraisal of any project being proposed by
such proponents.
10. The Union Territory of Dadra and Nagar Haveli and Daman and Diu Administration shall notify an agency to
act as Secretariat for the Authority and the UTEAC, Union Territory of Dadra and Nagar Haveli and Daman and Diu
and the said Secretariat shall provide all financial and logistic support including accommodation, transportation and
such other facilities in respect of all its statutory functions of the Authority and UTEAC Union Territory of Dadra and
Nagar Haveli and Daman and Diu.
11. The sitting fees, travelling allowances and dearness allowances to the Chairman and Member of the
Authority, Union Territory of Dadra and Nagar Haveli and Daman and Diu and the Chairman and Members of the
UTEAC, UnionTerritory of Dadra and Nagar Haveli and Daman and Diu shall be paid as per rules of the Union
Territory of Dadra and Nagar Haveli and Daman and Diu.
