(1) इन िविनयम5 का संि@A नाम िव(cid:22)ान और इंजीिनयरी अनुसंधान बोड (cid:12) (सिचव, सेवा के िनबंधन और शत: तथा भत<) (संशोधन) िविनयम, 2018 ह ै। (2) ये राजपB मC उनके 1काशन क& तारीख को 1वृ2 ह5गे । 2. िव(cid:22)ान और इंजीिनयरी अनुसंधान बोड (cid:12) (सिचव, सेवा के िनबंधन और शत: तथा भत<) िविनयम, 2014 (िजसे इसमC इसके पGात् उ4 िविनयम कहा गया ह)ै मC, िविनयम 2 के Iथान पर िन=िलिखत िविनयम रखा जाएगा, अथा(cid:12)त:्- “(2) पद5 क& संJया, वग<करण, वेतन मै*LMस मC लेवल या वेतनमान : पद5 क& संJया, उनका वग<करण, वेतन मै*LMस मC लेवल या वेतनमान वे ह5गे जो इन िविनयम5 से उपाबN सूची के IतOभ (2) से IतOभ (4) मC िविनPदQ(cid:12) ह R।”। 1344 GI/2018 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] 3.उ4 िविनयम5 मC, िविनयम 4 को िविनयम 4(1) के Sप मC पुनसTJयां(cid:4)कत (cid:4)कया जाएगा और – (क) इस 1कार पुनसTJयां(cid:4)कत उप-िविनयम (1) मC “उन Iथान5 पर तैनात अिधका*रय5 के तUIथानी वेतन बRड और Vेड वेतन अथवा वेतनमान” अ(cid:15)त मC आने वाले शXद5 के Iथान पर “उन Iथान5 पर तैनात अिधका*रय5 के वेतन मै*LMस मC तUIथानी Iतर या वेतनमान” शXद रखे जाएंगे ; (ख) उप-िविनयम (1) के पGात् िन=िलिखत उप-िविनयम अ(cid:15)तःIथािपत (cid:4)कया जाएगा, अथा(cid:12)त्:- “(2) बोड (cid:12)का सिचव पांच वष(cid:12) क& अविध के िलए या अिधव[ष(cid:12)ता क& आय ु1ाA करने तक, जो भी पहले हो, तब तक पद धारण करेगा, जब तक के(cid:15)(cid:16)ीय सरकार के परामश(cid:12) से बोड (cid:12)0ारा उस अविध को बढ़ा नह] (cid:4)दया जाता ह ै।”। 4. उ4 िविनयम5 मC, िविनयम 6 के Iथान पर िन=िलिखत िविनयम रखा जाएगा, अथा(cid:12)त्:- “िनरहत(cid:12) ा - कोई ‘ि4,- (क) जो भारतीय नाग*रक नह] है या िजसक& भारतीय नाग*रकता का Uयाग कर (cid:4)दया ह ै; या (ख) जो िवकृतिच2 का ह ै; या (ग) िजसने ऐसे ‘ि4 से, िजसका पित या िजसक& पbी जीिवत ह,ै िववाह (cid:4)कया ह ै; या (घ) िजसने अपने पित या पbी के जीिवत रहते 7ए (cid:4)कसी ‘ि4 से िववाह (cid:4)कया ह ै। उ4 पद पर िनयुि4 के िलए पाB नह] होगा । परंतु बोड (cid:12) का यह समाधान हो जाता है (cid:4)क ऐसा िववाह उस ‘ि4 और उस िववाह के अ(cid:15)य प@कार को लागू Iवीय िविध के अधीन अनु(cid:22)ेय है और ऐसा करने के िलए अ(cid:15)य आधार ह Rतो वह (cid:4)कसी ‘ि4 को इस िविनयम के 1वत(cid:12)न से छूट द ेसकेगा। 5. उ4 िविनयम5 मC, िविनयम 7 के Iथान पर, िन=िलिखत िविनयम रखा जाएगा, अथा(cid:12)त्:- “(7) खोज-सह-चयन सिमित – बोड(cid:12), के(cid:15)(cid:16)ीय सरकार के परामश(cid:12) से, िन=िलिखत से िमलकर बनी खोज-सह-चयन सिमित क& िसफा*रश पर अपने सिचव क& िनयुि4 कर सकेगा :- (क) मंिBमंडल सिचव –अhय@ (ख) 1धानमंBी का अपर 1धान सिचव –सदIय (ग) सिचव, िव(cid:22)ान और 1ौjोिगक& िवभाग –सदIय (घ) सिचव, जैव 1ौjोिगक& िवभाग –सदIय (ङ) सिचव, का[म(cid:12)क और 1िश@ण िवभाग –सदIय ।”। 6. उ4 िविनयम5 क& अनुसूची मC,- (क) IतOभ (4) और उससे सOबि(cid:15)धत 1िविQय5 के Iथान पर िन=िलिखत रखा जाएगा, अथा(cid:12)त्:- “वेतन मै*LMस मC लेवल या वेतनमान (4) वेतन मै*LMस मC लेवल 17 (2,25,000/- kपए)।”; (1) These regulations may be called the Science and Engineering Research Board (Secretary, Terms and Conditions of Service and Recruitment) (Amendment) Regulations, 2018. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Science and Engineering Research Board (Secretary, Terms and Conditions of Service and Recruitment) Regulations, 2014 (herein after referred to as the said regulations), for regulation 2, the following regulation shall be substituted, namely:–– “2. Number of post, classification, level in pay matrix or pay scale.– The number of post, its classification, level in the pay matrix or pay scale attached to the said post shall be as specified in columns (2) to (4) of the Schedule annexed to these regulations.”. 3. In the said regulations, regulation 4 shall be re-numbered as regulation 4 (1) and –– (a) in sub-regulation (1) as so re-numbered, for the words “corresponding pay band and grade pay or pay scale stationed at those places” occurring at the end, the words “corresponding level in the pay matrix or pay scale” shall be substituted; (b) after sub-regulation (1), the following sub-regulation shall be inserted, namely:–– “(2) The Secretary to the Board shall hold office for a period of five years or till attaining the age of superannuation, whichever is earlier, unless extended by the Board in consultation with the Central Government.” 4. In the said regulations, for regulation 6, the following regulation shall be substituted, namely:–– “ Disqualification.–– No person,–– (a) who is not an Indian citizen or have given up the Indian citizenship; or (b) who is of unsound mind; or (c) who has entered into or contracted a marriage with a person having a spouse living; or (d) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post: Provided that the Board may, if satisfied that the marriage referred to in clauses (c) and (d) is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this regulations.”. 5. In the said regulations, for regulation7, the following shall be substituted, namely:–– “7. Search-cum-Selection Committee.–– The Board may, in consultation with the Central Government, appoint its Secretary on the recommendations of the Search-cum-Selection Committee consisting of:–– (a) Cabinet Secretary –Chairman; (b) Additional Principal Secretary to the Prime Minister – Member; (c) Secretary, Department of Science and Technology –Member; (d) Secretary, Department of Biotechnology – Member; (e) Secretary – Department of Personnel and Training – Member.”. 6. In the said regulations, in the Schedule,–– (a) for column (4) and the entries relating thereto, the following shall be substituted, namely:–– “Level in pay matrix or pay scale. (4) Level-17 in the pay matrix (Rs.225000/-).”; (b) for columns (6) and (7) and the entries relating thereto, the following shall be substituted, namely:––¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5 “Age-limit for direct recruits. Educational and other qualifications required for direct recruits. (6) (7) Not exceeding 56 years. (c) in column (10),–– (i) in Note 1, for the words “not to exceed three years” occurring at the end, the words “not to exceed five years” shall be substituted; (d) for column (11) and the entries relating thereto, the following shall be substituted, namely:– “In case of recruitment by promotion or deputation/absorption, grades from which the promotion or deputation/absorption to be made. (11) Deputation (including short term contract): Officer of the Central Government or State Governments or Union territory Administrations or Public Sector Undertakings or faculty member or scientist of universities or recognised research institutions or semi-Government or statutory or autonomous organisations— (a) (i) holding analogous post on a regular basis in the parent organisation; or (ii) with one year service in a post in level 16 in the pay matrix (Rs.205400-224400/-); or (iii) with two years, service in a post in level 15 in the pay matrix (Rs.182200-224100/-); and (b) possessing the qualifications prescribed for direct recruits under column (7). Note 1: The period of deputation, including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not to exceed five years or superannuation whichever is earlier. Note 2: The maximum age-limit for appointment by deputation shall not exceed fifty-six years as on the date specified under column (6).
