साथ परामिि के पश्चात, केंद्रीय जसजिल सेिा (पेंिन) जनयम, 1972 में संिोधन करने के जलए जनम्नजलजखत और जनयम बनाती ह,ै अथाित:
1. सजं क्षप्त नाम और प्रारंभ: - (1) इन जनयमों का संजक्षप्त नाम केंद्रीय जसजिल सेिा (पेंिन) संिोधन जनयम 2021 ह ै।
(2) ये रािपत्र में अपने प्रकािन की तारीख से प्रिृत्त होंगे।
2. केंद्रीय जसजिल सेिा (पेंिन) जनयम 1972 में (जिसे इसके पश्चात उि जनयम कहा गया ह)ै , जनयम 8 में, उप-जनयम (3 क) में, खंड
(क) के स्ट्थान पर, जनम्नजलजखत खंड को लागू दकया िाएगा, अथाित्:-
"(क) उप-जनयम (3) के उपबंधों पर प्रजतकूल प्रभाि डाले जबना, कोई सरकारी सेिक, िो दकसी भी आसूचना या सुरक्षा से संबंजधत
संगठन में कायि करते हुए िो सूचना का अजधकार अजधजनयम, 2005 (2005 का 22) की िसू री अनसु ूची में सजममजलत ह,ै संगठन के
प्रमुख से पूर्ििक अनापजत्त के जबना, जनम्नजलजखत से संबंजधत और उसके अंतगित दकसी भी सामग्री की सेिाजनिृजत्त के पश्चात कोई भी
प्रकािन नहीं करेगा:

(i) संगठन का अजधकार क्षेत्र, जिसके अंतगित दकसी कार्मकि और उसके पिनाम के बारे में संिभि या दकसी िानकारी, उस संगठन में काम
करने के आधार पर जििेषज्ञता या ज्ञान प्राप्त सजममजलत ह;ै
(ii) संिेिनिील सूचना, जिसका भारत की संप्रभुता और अखंडता पर प्रजतकूल प्रभाि पड़ता ह ैराज्य की सुरक्षा, सामररक, िैज्ञाजनक या
आर्थिक जहतों, या जिििे ी राज्यों के साथ संबंधो में या दकसी अपराध के उद्दीपन को बढ़ािा िगे ा प्रकािन नहीं करेगा।
3आ. संगठन के प्रमुख को जिजनश्चय करने का प्राजधकार ह ैदक क्या प्रकािन के जलए प्रस्ट्ताजित सामग्री संिेिनिील या असंिेिनिील है,
और क्या यह संगठन के अजधकार क्षेत्र में आती ह।ै ";

G.S.R. 360(E).—In exercise of the powers conferred by the proviso to article 309 and clause (5) of article
148 of the Constitution and, after consultation with the Comptroller and Auditor-General of India in relation to
persons serving in the Indian Audit and Accounts Department, the President hereby makes following rules further to
amend the Central Civil Services (Pension) Rules, 1972 namely:-
1. Short title and commencement :- (1)These rules may be called the Central Civil Services (Pension)
Amendment Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Civil Services (Pension) Rules 1972 (hereinafter referred to as the said rules), in rule 8, in sub-
rule (3A), for clause (a), the following clause shall be substituted, namely:-
“(a) Without prejudice to the provisions of sub-rule (3), no Government servant, who, having worked in
any Intelligence or Security-related organisation included in the Second Schedule of the Right to Information Act,
2005 (22 of 2005), shall, without prior clearance from the Head of the Organisation, make any publication after
retirement, of any material relating to and including:
(i) domain of the organisation, including any reference or information about any personnel and his
designation, and expertise or knowledge gained by virtue of working in that organisation;
(ii) sensitive information, the disclosure of which would prejudicially affect the sovereignty and
integrity of India, the security, strategic, scientific or economic interests of the State, or relation
with a foreign State or which would lead to incitement of an offence.
3B. The Head of the Organisation shall vest with the authority to decide as to whether the proposed material for
publication is sensitive or non-sensitive, and whether it falls in the domain of the organization.”;
3. In the said rules, for FORM 26, the following Form shall be substituted, namely:--
“FORM 26

UNDERTAKING
I, _________, who have worked in ___________ (Name of organisation), on the post of ______________ , for the
period from ____________to __________ ,do hereby solemnly declare that, save with the prior approval of the
Competent Authority, I shall not publish in any manner, while in service or after retirement, any information or
material or knowledge which is related to the domain of the organisation and obtained by virtue of my working in the
said organisation. This declaration is notwithstanding my responsibilities and liability, in terms of the relevant
conduct rules, pension rules, laws dealing with offences relating to official secrets or national security and the
Intelligence Organisations (Restriction of Rights) Act, 1985 (58 of 1985), as the case may be. I further agree that in[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5
the event of any failure of the above undertaking by me, the decision of the Government as to whether it was likely to
prejudicially affect the aspects stated above shall be binding on me.
2. I am aware that the pension which may be granted to me after retirement, in terms of the relevant pension
rules, can be withheld or withdrawn, in full or part, for any failure of this undertaking given.
