Executive Summary & Key Takeaways

Executive Summary: This notification outlines the Indian Trade Service Group A Rules, 2019, which regulate the recruitment methods and service conditions for Group A posts within the Indian Trade Service. These rules, effective from the date of publication in the Official Gazette, supersede the 1977 rules, excluding actions already completed or omitted before this supersession. The notification details the service's structure, authorized strength, and procedures for appointments, promotions, and other service-related matters. Key Points / Main Content: General Provisions: * The rules are called the Indian Trade Service Group A Rules, 2019. * They come into force on the date of their publication in the Official Gazette. * These rules supersede the Indian Trade Service Group A Rules, 1977, except for actions taken or omitted before the supersession. Definitions: * Key terms such as "Authorised Strength," "Cadre Controlling Authority," "Commission," "Departmental Promotion Committee," and others are defined for clarity. Service Structure: * The Indian Trade Service, Group A, is established, comprising individuals appointed under these rules. * All posts within the service are classified as Group A posts. * Prior continuous service by officers is considered qualifying service for seniority, confirmation, promotion, and pension. Grades and Strength: * The authorized permanent strength of various grades is specified in Schedule I. * The government determines and reviews the authorized strength of service grades, subject to workload variations. * The Cadre Controlling Authority can adjust the number of posts with consultation from relevant bodies. Service Membership: * Individuals appointed to duty posts under Rule 6 (initial constitution) and Rule 7 (future maintenance) become members of the service. Future Appointments: * Vacancies are filled through direct recruitment (50%) via the Civil Services Examination and promotion (50%) of Foreign Trade Development Officers. * Appointments to Senior Time Scale and above are made via selection based on Departmental Promotion Committee recommendations. Seniority and Probation: * Relative seniority is generally based on existing seniority before these rules came into effect. * New recruits are subject to a probation period of two years. Non-Functional Upgradation: * Provisions are outlined for granting the same level in the pay matrix on a non-functional basis to officers when Indian Administrative Service officers are posted to certain grades at the Centre. Other Conditions: * Appointments to the service are made by the Cadre Controlling Authority. * Officers are liable to serve anywhere in India or abroad. * Service conditions not covered in these rules will align with those applicable to Central Civil Services officers. Disqualifications and Exceptions: * Conditions under which a person is ineligible for appointment. * The government retains the power to relax provisions and make exceptions for specific categories. Schedules: * Schedule I details the grades, designations, levels in the Pay Matrix, and authorized strength of duty posts. * Schedule II pertains to direct recruitment qualifications and age limits. * Schedule III outlines the method of recruitment and minimum qualifying service for promotions. * Schedule IV describes the composition of committees for promotions, confirmations, and screenings. Impact Analysis: Officers of the Indian Trade Service: Impact: The rules directly govern their recruitment, service conditions, promotions, seniority, and overall career progression.
