L.-33004/99 vlk/kj.k EXTRAORDINARY Hkkx II—[k.M 3—mi&[k.M (i) PART II—Section 3—Sub-section (i) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 629] ubZ fnYyh] c`gLifrokj] flrEcj 8] 2016@Hkknz 17] 1938 No. 629] NEW DELHI, THURSDAY, SEPTEMBER 8, 2016/BHADRA 17, 1938 खान म(cid:7074)ं ालय अिधसचू ना नई (cid:7408)द(cid:7016) ली, 7 िसत(cid:7013)बर , 2016 सा.का.िन. 867(अ).—रा(cid:7398)पित, संिवधान के अन(cid:6994)ु छेद 309 के पर(cid:7008)तुक (cid:7367)ारा (cid:7079)द(cid:7275) शि(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए कोयला और खान मं(cid:7074)ालय, खान िवभाग, भारतीय खान (cid:7011)यरू ो, समूह ‘क’ और ‘ख’ पद भत(cid:7278) िनयम, 2003 को , उन बात(cid:7298) के िसवाय अिध(cid:7059)ा(cid:7008)त करत े (cid:7263)ए जहां तक उसका संबंध (मु(cid:6990)य खान िनयं(cid:7074)क, खान िनयं(cid:7074)क, (cid:6979)े(cid:7074)ीय खान िनयं(cid:7074)क, उप खान िनयं(cid:7074)क, व(cid:7407)र(cid:7399) सहायक खान िनयं(cid:7074)क, सहायक खान िनय(cid:7074)ं क और सहायक खनन इंजीिनयर) के पद(cid:7298) स े ह ै िज(cid:7008)ह (cid:7286) ऐसे अिध(cid:7059)मण से पहले (cid:7408)कया गया ह ै या करने का लोप (cid:7408)कया गया ह,ै भारतीय खान (cid:7011)यूरो, खान मं(cid:7074)ालय म(cid:7286) कितपय समूह ‘क’ और ‘ख’ पद(cid:7298) पर भत(cid:7278) क(cid:7409) प(cid:7373)ित का िविनयमन करन ेके िलए िनयम बनाते ह;ै अथा(cid:6981)त :- 1.सिं (cid:6979)(cid:7385) नाम और (cid:7079)ारं भ- (1) इन िनयम(cid:7298) का संि(cid:6979)(cid:7385) नाम खान मं(cid:7074)ालय, भारतीय खान (cid:7011)यूर(cid:7298), (मु(cid:6990)य खान िनयं(cid:7074)क, खान िनयं(cid:7074)क, (cid:6979)े(cid:7074)ीय खान िनयं(cid:7074)क, उप खान िनयं(cid:7074)क, व(cid:7407)र(cid:7399) सहायक खान िनयं(cid:7074)क, सहायक खान िनयं(cid:7074)क और सहायक खनन इंजीिनयर) समूह ‘क’ और ‘ख’ पद, भत(cid:7278) िनयम, 2016 ह।ै (2) राजप(cid:7074) म (cid:7286) (cid:7079)काशन क(cid:7409) तारीख को (cid:7079)वृ(cid:7275) ह(cid:7298)गे। 2. लाग ूहोना.–ये िनयम इससे उपाब(cid:7373) अनुसूची के (cid:7021) तंभ (1) म(cid:7286) िविन(cid:7416)द(cid:7020) ट पद(cid:7298) को लागू ह(cid:7298)गे । 3. पद स(cid:6990)ं या, वग(cid:7278)करण, वते न म(cid:7407)ै (cid:7069)(cid:6989)स म (cid:7286) लवे ल- पद स(cid:6990)ं या, उसका वग(cid:7278)करण, वेतन ब(cid:7289)ड और (cid:7061)डे वेतन या उससे संल(cid:7336) वेतनमान वह होगा जो इन िऩयम(cid:7298) से उपाब(cid:7373) अनुसूची के (cid:7021)तभं (2) से (cid:7021)तंभ (4) म(cid:7286) िविन(cid:7416)द(cid:7397) ह।(cid:7289) 4. भत(cid:7278) क(cid:7409) प(cid:7373)ित, आय-ु सीमा, अहत(cid:6981) ाएं आ(cid:7408)द.–उ(cid:7334) पद पर भत(cid:7278) क(cid:7409) प(cid:7373)ित, आय-ु सीमा, अहत(cid:6981) ाएं और उनसे संबंिधत अ(cid:7008)य बात(cid:7286) वे ह(cid:7298)गी जो पूव(cid:7299)(cid:7334) अनुसचू ी के (cid:7021)तंभ (5) से (cid:7021)तंभ (13) म(cid:7286) िविन(cid:7416)द(cid:7397) ह।(cid:7289) 5. िनहर(cid:6981) ता: वह (cid:7390)ि(cid:7334) - (क) िजसन ेऐसे (cid:7390)ि(cid:7334) से, िजसका पित या िजसक(cid:7409) प(cid:7360)ी जीिवत ह,ै िववाह (cid:7408)कया ह ैया िववाह क(cid:7409) संिवदा क(cid:7409) ह;ै या 4340 GI/2016 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) िजसन ेअपने पित या प(cid:7360)ी के जीिवत रहत े (cid:7263)ए (cid:7408)कसी (cid:7390)ि(cid:7334) से िववाह (cid:7408)कया ह ैया िववाह क(cid:7409) संिवदा क(cid:7409) ह,ै उ(cid:7334) पद(cid:7298) म(cid:7286) से (cid:7408)कसी पर िनयुि(cid:7334) का पा(cid:7074) नह(cid:7277) होगा। परंतु य(cid:7408)द के(cid:7008)(cid:7076)ीय सरकार का यह समाधान हो जाता ह ै (cid:7408)क ऐसा िववाह ऐसे (cid:7390)ि(cid:7334) और िववाह के अ(cid:7008)य प(cid:6979)कार को लाग ू (cid:7021)वीय िविध के अधीन अन(cid:6980)ु ेय ह ै और ऐसा करन े के िलए अ(cid:7008)य आधार ह ै तो वह (cid:7408)कसी (cid:7390)ि(cid:7334) को इस िनयम के (cid:7079)वतन(cid:6981) से छूट द ेसकेगी। 6. िशिथल करन ेक(cid:7409) शि(cid:7334) : जहां के(cid:7008)(cid:7076)ीय सरकार क(cid:7409) यह राय ह ै(cid:7408)क ऐसा करना आव(cid:7019)यक या समीचीन ह,ै वहां वह उसके िलए जो कारण ह,(cid:7289) उ(cid:7008)ह (cid:7286) लेखब(cid:7373) करके, तथा संघ लोक सेवा आयोग से परामश(cid:6981) करके, इन िनयम(cid:7298) के (cid:7408)कसी उपबंध को (cid:7408)कसी वग(cid:6981) या (cid:7079)वग(cid:6981) के (cid:7390)ि(cid:7334)य(cid:7298) क(cid:7409) बाबत, आदेश (cid:7367)ारा िशिथल कर सकेगी। 7. (cid:7390)ाविृ (cid:7275) : इन िनयम(cid:7298) क(cid:7409) कोई बात, ऐसे आर(cid:6979)ण(cid:7298), आय-ु सीमा म(cid:7286) छूट और अ(cid:7008)य (cid:7407)रयायत(cid:7298) पर (cid:7079)भाव नह(cid:7277) डालगे ी, िजनका के(cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा इस संबंध म(cid:7286) समय-समय पर जारी (cid:7408)कये गये आदेश(cid:7298) के अनुसार अनुसूिचत जाितय(cid:7298), अनुसूिचत जनजाितय(cid:7298), भूतपूव(cid:6981) सैिनक(cid:7298) और अ(cid:7008)य िवशेष (cid:7079)वग (cid:6981)के (cid:7390)ि(cid:7334)य(cid:7298) के िलए उपबंध करना अपेि(cid:6979)त ह।ै अनसु चू ी पद का नाम पद(cid:7298) क(cid:7409) वेतन मै(cid:7407)(cid:7069)(cid:6989)स म(cid:7286) लेवल- होता । 13क म(cid:7286) दो वष(cid:6981) का अनुभव हो । (cid:7407)ट(cid:7009)प ण 1 : िवभागीय अिधका(cid:7407)रय(cid:7298) को भारतीय खान (cid:7011)यूरो या (cid:7408)कसी मा(cid:7008)ता(cid:7079)ा(cid:7385) (cid:7079)िश(cid:6979)ण सं(cid:7021)थान से 4 स(cid:7385)ाह का सेवाकालीन (cid:7079)िश(cid:6979)ण काय(cid:6981)(cid:7059)म सफलतापूव(cid:6981)क पूण(cid:6981) करना होगा । (cid:7407)ट(cid:7009)प ण 2 : जहां ऐसे किन(cid:7399) (cid:7390)ि(cid:7334)य(cid:7298) के संबंध म(cid:7286) िज(cid:7008)ह(cid:7298)ने अपनी अहक(cid:6981) पा(cid:7074)ता सेवा पूरी कर ली ह,ै (cid:7079)ो(cid:7382)ित के िलए िवचार (cid:7408)कया जा रहा हो वहां उनके (cid:6996)ये(cid:7399) (cid:7390)ि(cid:7334)य(cid:7298) के संबंध म(cid:7286) भी िवचार (cid:7408)कया जायेगा परंतु यह तब जब (cid:7408)क उसके (cid:7367)ारा क(cid:7409) गई ऐसी अहक(cid:6981) /पा(cid:7074)ता सेवा , अपेि(cid:6979)त अहक(cid:6981) /पा(cid:7074)ता¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 सेवा के आधे से अिधक से या दो वष(cid:6981) से , इनम(cid:7286) से जो भी कम हो, कम न हो और उ(cid:7008)ह(cid:7298)ने अपने ऐसे किन(cid:7399) (cid:7390)ि(cid:7334)य(cid:7298) सिहत िज(cid:7008)ह(cid:7298)ने ऐसी अहक(cid:6981) /पा(cid:7074)ता सेवा पहले ही पूरी कर ली ह,ै अगली उ(cid:7340)तर (cid:7088)ेणी म(cid:7286) (cid:7079)ो(cid:7382)ित के िलए अपनी परीवी(cid:6979)ा क(cid:7409) अविध सफलतापूव(cid:6981)क पूरी कर ली ह।ै (cid:7407)ट(cid:7009)प ण 3 : (cid:7079)ो(cid:7382)ित के िलए (cid:7008)यूनतम अहक(cid:6981) सेवा को संगणना करने के (cid:7079)योजन के िलए, (cid:7408)कसी अिधकारी (cid:7367)ारा 1 जनवरी, 2016 से या उस तारीख से िजसको सातव(cid:7286) वेतन आयोग क(cid:7409) िसफा(cid:7407)रश(cid:7298) पर आधा(cid:7407)रत पुनरीि(cid:6979)त वेतन संरचना का िव(cid:7021)तार (cid:7408)कया गया ह,ै पूव(cid:6981) िनयिमत आधार पर क(cid:7409) गई सेवा को उ(cid:7334) आयोग क(cid:7409) िसफा(cid:7407)रश(cid:7298) के आधार पर िव(cid:7021)ता(cid:7407)रत त(cid:7004)(cid:7021)थानी वेतन मै(cid:7407)(cid:7069)(cid:6989)स म(cid:7286) क(cid:7409) गई सेवा समझा जायेगा। य(cid:7408)द िवभागीय (cid:7079)ो(cid:7008)न ित सिमित ह,ै तो उसक(cid:7409) सरं चना भत(cid:7278) करन ेम सरकार(cid:7298)/क(cid:7286)(cid:7076) शािसत (cid:7079)शासन(cid:7298)/पि(cid:7011)लक से(cid:6989)टर के उप(cid:7059)म(cid:7298)/ िव(cid:7393)िव(cid:7378)ालय(cid:7298)/मा(cid:7008)यता(cid:7079)ा(cid:7385) अनुसधं ान सं(cid:7021)था(cid:7312)/अ(cid:7373) (cid:6981)सरकारी अथवा (cid:7021)वाय(cid:7275) िनकाय(cid:7298) अथवा कानूनी संगठन(cid:7298) के अधीन ऐसे अिधकारी :- (क)(cid:32) (i) िज(cid:7008)ह(cid:7298)ने मूल काडर या िवभाग म(cid:7286) िनयिमत आधार पर सदशृ पद धारण (cid:7408)कया (cid:7263)आ है ; अथवा (ii) िज(cid:7008)ह(cid:7298)ने वेतन मै(cid:7407)(cid:7069)(cid:6989)स म(cid:7286) लेवल1-3 या समतु(cid:7016)य के वेतन मै(cid:7407)(cid:7069)(cid:6989)स म(cid:7286) िनयिमत आधार पर दो वष(cid:6981) सेवा (cid:7079)बंधन (cid:7021)तर पर अथवा खान और खिनज(cid:7298) से सबंिधत सरकारी िवभाग म(cid:7286) समूह ‘क’ राजपि(cid:7074)त अिधकारी के (cid:7271)प म(cid:7286) तेरह वष(cid:7300) का अनुभव । अथवा (i) (cid:7408)कसी मा(cid:7008)यता (cid:7079)ा(cid:7385) िव(cid:7393)िव(cid:7378)ालय/ सं(cid:7021)थान से खनन इंजीिनयरी म(cid:7286) एम.ई/ एम.टेक (ii) (cid:7408)कसी धातुमय (गैर कोयला) खान(cid:7298) म(cid:7286) खान (cid:7079)बंधन (cid:7021)तर पर अथवा खान और खिनज(cid:7298) से संबंिधत सरकारी िवभाग म(cid:7286) समूह ‘क’ राजपि(cid:7074)त अिधकारी के (cid:7271)प म(cid:7286) (cid:6991)यारह वष(cid:7300) का अनुभव । वाछं नीय :- (cid:7408)कसी मा(cid:7008)यता(cid:7079)ा(cid:7385) बोड(cid:6981)/सं(cid:7021)था से कं(cid:7009)यूटर अनु(cid:7079)योग म(cid:7286) ( कम से कम 6 माह का) िड(cid:7009)लोमा । (cid:7407)ट(cid:7009)प ण 1 : पोषक (cid:7079)वग(cid:6981) के ऐसे िवभागीय अिधकारी, जो (cid:7079)ो(cid:7382)ित क(cid:7409) सीधी पंि(cid:7334) म (cid:7286)ह (cid:7289)(cid:7079)ितिनयिु (cid:7334) पर िनयुि(cid:7334) के िलए िवचार (cid:7408)कये जाने के पा(cid:7074) नह(cid:7277) ह(cid:7298)गे। इसी (cid:7079)कार (cid:7079)ितिनयु(cid:7334) (cid:7390)ि(cid:7334) (cid:7079)ो(cid:7382)ित (cid:7367)ारा Short title and commencement.— (1) These rules may be called Indian Bureau of Mines, Ministry of Mines, (Chief Controller of Mines, Controller of Mines, Regional Controller of Mines, Deputy Controller of Mines, Senior Assistant Controller of Mines, Assistant Controller of Mines and Assistant Mining Engineer) Group ‘A’ and ‘B’ Posts Recruitment Rules, 2016. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules. 3. Number of posts, classification and LEVEL in the PAY MATRIX.— The number of posts, their classification and the LEVEL in the PAY MATRIX attached thereto shall be as specified in columns (2) to (4) of the said Schedule 4. Method of recruitment, age-limit, qualifications, etc.-— The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule. 5. Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Ex-service men and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. Note 3:- For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to the 1st January, 2016 or the date from which the revised pay structure based on the 7th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding level in the pay matrix extended based on the recommendations of the said Pay Commission. Deputation: (Including short term contract) Officers under the Central Government or the State Governments or Union Territory Administrations or Pubic Sector Undertakings or Universities or recognised Research Institutions or semi-Government or Autonomous bodies or statutory organizations, -- (cid:32) (A) (i) holding analogous post on a regular basis in the parent cadre or Department; or (ii) with five years’ service in the grade rendered after appointment thereto on a regular basis in posts in LEVEL¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 23 6 (six ) in the PAY MATRIX or equivalent in the parent cadre or Department; and (B)(cid:32) possessing the following qualifications and experiences : Essential: (1)(i) Bachelor of Engineering or/ Bachelor of Technology or Associates of Indian School of Mines (AISM) in Mining Engineering of a recognised University or Institution or Associate Member of Institute of Engineers (AMIE) in Mining Engineering having passed Section (A) and (B) of Institution of Engineers (India) Examination . (ii) two years’ experience in Metalliferous (non-coal) mines in mine management position or in the Government Department dealing with mines and minerals as Gazetted Officer; Or 2.(i) Diploma in Mining Engineering or in Mining and Mine Surveying from an institution recognised University or Institute; (ii) three years’ experience in Metalliferous (non-coal) mines in mine management position or in the Government Department dealing with mines and minerals as Gazetted Officer. Desirable: Diploma in Computer Applications (of minimum six months duration) from a recognised Board or institution. Note-1: The departmental Officers in the feeder grade who are in direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. Note 2: The period of deputation including short term contract in another ex-cadre post held immediately proceeding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed three years. Note 3: The maximum age-limit for appointment by deputation including short term contract shall be ‘not exceeding fifty six years’ as on the closing date of receipt of applications. [F.
