आमेलन के आधार पर क( जाएगी । (iii) पद के िव+ापन के पूव 6 वै+ािनक एच या Tतर 15 क( (cid:25)^यके Qरि(cid:28) के िलए िनयुि(cid:28) क( िविशE प7ित के बारे म 3 िनयं*ण (cid:25)ािधकारी िविनिVत करेगा और इसे िनयम _णे ी म3 (cid:22)यूनतम रेजीड(cid:22)े सी अविध पूरा करन ेपर, उपांतQरत नमनीय अनुपूरक Tक(म के अधीन TवTथान ेक( जाएगी । (5) कोई भत- या पुिE िनयम 4 के उपिनयम (4) म 3 िविनDदE6 प7ित, िनयम 10 म3 िविनDदE6 सिमितय(cid:30) क( िसफाQरश पर क( जाएगी । (6) िनयम 4 के उपिनयम (5) म3 िविनDदE6 सिमितयां िनयम 4 के उपिनयम (4) के खंड (i) और खंड (ii) के अधीन भत- क( प7ित के अधीन भरे गए पद(cid:30) के िलए अHयथ- के साथ म3 िविनDदE6 ह ै। (2) (cid:25)ितिनयिु (cid:28) के आधार पर भरे गए वै+ािनक “एच” के पद के िलए ऊपरी आयुसीमा अठावन वष6 होगी । (3) आय-ु सीमा अवधाQरत करने के िलए िनणा6यक तारीख भारत म 3 अHयWथ6य(cid:30) स े आवेदन (cid:25)ा> करन े के िलए िनयत क( गई अंितम तारीख होगी । (न (cid:1)क वह अंितम तारीख जो असम, मघे ालय, अ\णाचल (cid:25)दशे , िमजोरम, मिणपुर, नागाल:ड, ि*पुरा, िस(cid:1)kम, ज(cid:7)म-ू कlमीर राmय के लnाख खंड, िहमाचल (cid:25)दशे के लाहोल और Tपीित िजल े तथा च(cid:7)बा-िजल े के पांगी उपमंडल, अंदमान और िनकोबार (cid:24)ीप या ल=(cid:24)ीप के अHयWथ6य(cid:30) के िलए िविहत क( गई ह।ै ) (4) िनयम 4 के उपिनयम (4) के खंड (i) और खंड (ii) म3 िविनDदE6 रीित म3 केवल भारतीय नागQरक वै+ािनक “सी” और वै+ािनक “एच” के पद पर िनयिु (cid:28) के िलए पा* ह(cid:30)गे । 6666.... ससससीीीीधधधधीीीी भभभभतततत"""":::: (1) िनयम 4 के उपिनयम (5) के अधीन और िनयम 10 के उपिनयम (1) म 3 यथािविनDदE6 गQठत सिमित क( िसफाQरश(cid:30) पर दसू री अनुसूची म 3 यथािविनDदE6 शिै =क अहत6 ाएं और अनुभव रखन े वाले अHयथ- िनयम 4 के उपिनयम (6) और उपिनयम (7) म3 िविनDदE6 रीित म 3सीधी भत- के िलए पा* ह(cid:30)गे ।¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3 (2) य(cid:1)द (cid:1)कसी िवभागीय अHयथ- का (cid:1)कसी पद पर िनयुि(cid:28) के िलए सीधी भत- (cid:24)ारा चयन हो जाता ह ैतो पद को सीधी भत- (cid:24)ारा भरा गया समझा जाएगा । (3) सीधी भत- के आधार पर वै+ािनक “सी” या वै+ािनक “एच” के \प म 3 िनयुि(cid:28) के िलए चयिनत अHयथ- एक वष6 क( अविध के िलए जाएगा । 7777.... आआआआममममललेेललेे नननन :::: क3Lीय सरकार या राmय सरकार के अHयथ- उ(cid:28) िनयम 4 के उपिनयम (4) के खंड (ii) और खंड (iii) के अधीन उ(cid:28) िनयम के उपिनयम (5), उपिनयम (6) और उपिनयम (7) म 3 िविनDद6E रीित म 3 आमेलन के िलए पा* ह(cid:30)ग े और िन8िलिखत शतq को पूरा करन ेके अrयधीन ह(cid:30)गी, अथा6त् :-- (क) अHयथ- दसू री अनसु ूची म 3यथािविनDद6E (cid:22)यूनतम शिै =क अहत6 ाए ंऔर अनभु व रखता हो ; और (ख) अHयथ- उस पद के सदशृ पद धारण करता हो, िजसके िलए उसने मलू काडर या िवभाग म3 िनयिमत आधार पर पद के िलए आवेदन (cid:1)कया हो । 8888.... (cid:28) पर िनयु(cid:28) (cid:1)कया जा सकेगा और जो िन8िलिखत शतq को पूरा करन ेके अrयधीन ह(cid:30)गे, अथा6त ्:-- (i) अHयथ- दसू री अनसु ूची म 3यथािविनDदE6 (cid:22)यूनतम शैि=क अहत6 ाएं और अनभु व रखते ह(cid:30) ; और (ii) अHयथ- उस पद के सदशृ पद धारण करता हो, िजसके िलए उसन ेआवेदन (cid:1)कया ह ैया उसने मलू काडर या िवभाग म3 इससे ठीक पहल ेके िनचले पद पर िनयिमत आधार पर कम से कम पांच वष6 काम (cid:1)कया हो अविध भी शािमल है, साधारणतया पांच वष6 होगी । (3) पदधारी के (cid:25)ितिनयुि(cid:28) या ल(cid:7)बी बीमारी या अrययन छुuी या (cid:1)कसी अ(cid:22)य पQरिTथितय(cid:30) म 3 एक वष6 या अिधक अविध के िलए बाहर रहन समय पर अिधसूिचत उपांतQरत ननननममममननननीीीीयययय अनपु ूरक Tक(म के अनसु ार िवभागीय वै+ािनक(cid:30) क( TवTथान े(cid:25)ोvित, केवल वै+ािनक ‘डी’, वै+ािनक ‘ई’, वै+ािनक ‘एफ’ और वै+ािनक ‘जी’, के iेड मे लाग ूहोगी । जो संबि(cid:22)धत वै+ािनक(cid:30) क( वैयि(cid:28)क (cid:25)ोvित मानी जाएगी| (2) य(cid:1)द यथािTथित, िनयम 10 के उपिनयम (2) और उपिनयम (3) म 3 िविनDदE6 सिमित को यह पता चलता ह ै (cid:1)क, यथािTथित, वै+ािनक ‘डी’ या वै+ािनक ‘ई’ या वै+ािनक ‘एफ’ या व+ै ािनक ‘जी’ के पदो पर (cid:25)ोvित के िलए उपयु(cid:28) ह ै और ऐसे पद उस समय Tवीकृत पद सPं या म 3उपलwध नहx ह,ै तो व+ै ािनक ‘सी’ स ेवै+ािनक ‘डी’, वै+ािनक ‘डी’ स े व+ै ािनक ‘ई’ या वै+ािनक ‘ई’ से वै+ािनक ‘एफ’ और वै+ािनक ‘एफ’ स ेवै+ािनक ‘जी’ के पद(cid:30) को उvत करके (cid:25)ोvित दी जा सकेगी । (3) पदधाQरय(cid:30) क( कुल संPया वै+ािनक ‘सी’, वै+ािनक ‘डी’, वै+ािनक ‘ई’, वै+ािनक ‘एफ’ और वै+ािनक ‘जी’ को शािमल करत े !ए पद(cid:30) क( कुल Tव ीकृत संPया स े अिधक नहx होगी इस (cid:25)ितब7ता के अलावा पद(cid:30) म 3पूण6त: अतं :संपQरवत6नीयता बनी रहगे ी । (4) उपांतQरत नमनीय अनुपूरक Tक(म के अधीन तीसरी अनसु ूची म3 यथािविनDदE6 (cid:22)यनू तम रेजीडस3 ी अविध अथा6त् अहक6 सेवा (cid:25)^यके _ेणी म 3(cid:25)ोvित के िलए अपेि=त होगी । (5) (cid:1)कसी वै+ािनक क( सेवािनवृि(cid:26) या पद^याग या मृ^य ु या अ(cid:22)य कारण से Qर(cid:28) !आ पद वै+ािनक ‘सी’ के िन8तम Tतर, िजस पर उस समय TपE Qरि(cid:28) िव’मान ह,ै पर (cid:25)^य ावWतत6 (cid:1)कया जाएगा ।4 THE GAZETTE अनुपूरक Tक (म के अधीन जनवरी स े जून के दौरान (cid:25)ोvित के िलए पQरपy मामल(cid:30) क( उस वष6 के अ(cid:25)ैल मास म3 समी=ा क( जाएगी, जब(cid:1)क जलु ाई से (cid:1)दसंबर मास के दौरान (cid:25)ोvित के िलए पQरपy मामल(cid:30) क( उसी वष6 के अSत ूबर मास म3 समी=ा क( जाएगी । (8) इस Tक(म के अधीन (cid:25)ोvित के िलए उपयु(cid:28) पाए गए Jि(cid:28)य(cid:30) क( (cid:25)ोvित क( तारीख स=म (cid:25)ािधकारी (cid:24)ारा अनमु ोदन क( तारीख या पदभार iहण करने क( तारीख, जो भी बाद म 3हो, मानी जाएगी| (9)(क) उपांतQरत नमनीय अनपु ूरक Tक(म के अधीन वै+ािनक(cid:30) का दो Tतरीय मू(cid:3)याकं न (cid:1)कया जाएगा । (ख) पहल े चरण म3 पहल े आतं Qरक Tत र पर जाचं होगी और दसू रे चरण म 3 बाt सिमित (cid:24)ारा जाचं क( जाएगी िजसम 3बा{य सदTय(cid:30) क( ब!लता होगी । (ग) (cid:25)ोvित के िलए उपयु(cid:28)ता का म(cid:3)ू य ांकन करने के िलए मू(cid:3) याकं न बोड 6म 3ऐस े सदTय अिधक संPया म3 ह(cid:30)ग,े जो इस =*े म 3 िवशेष+ता रखते ह(cid:30) और वQरeठ ता के बजाय स=म Jि(cid:28)य(cid:30) के समूह (cid:24)ारा उपलिwधय(cid:30) के T वतं* मू(cid:3)याकं न पर अिधक बल (cid:1)दया जाएगा । (घ) उपांतQरत नमनीय अनुपूरक Tक(म के फायद ेको िवभाग के वै+ािनक(cid:30) के िलए िवTताQरत (cid:1)कया जाएगा, जो नए वै+ािनक +ान के सृजन या नवीन इंजीिनयरी (cid:25)ो’ोिगक( या िच(cid:1)क^सा तकनीक से जुड़ े ह : या जो ~य ावसाियक अनसु धं ान और िवकास या व+ै ािनक +ान के अन(cid:25)ु योग म 3गहन \प से शािमल ह ै। (10) उपांतQरत नमनीय अनुपरू क Tक(म के अधीन 6Qरपोटq का मू(cid:3)याकं न करेगी। (ख) चौथी अनुसूची म 3 वाWषक6 काय 6 Qरपोट6 के भाग ‘ग’ म 3 िवभाग के वै+ािनक (cid:24)ारा (cid:1)कए गए काय6 क( वै+ािनक अंतव6Tत ु पर वाWषक6 काय6 Qरपोट6, बा{य मू(cid:3)य ांकन सिमित (िवभागीय मू(cid:3) याकं न सिमित या िवभागीय (cid:25)मखु समी=ा सिमित) को िनयम 4 के उपिनयम (5) और िनयम 10 के उपिनयम (2) म 3िविनDदE6 ानसु ार उपलwध कराएगी । (12) सभी उ^कृE _ेणी वाल े आपवा(cid:1)दक मधे ावी अHयथ- अथात6 ् अहक6 सेवा के अHयWथ6य(cid:30) क( काय6 अविध म3 छूट एक अवसर पर एक वष6 से अिधक नहx दी जाएगी और ऐसी छूट समTत सवे ा काल म3 अिधकतम दो वष6 तक सीिमत रहगे ी । (13) िनयम 10 के उपिनयम (2) म3 िविनDदE6 और िनयम 4 के उप िनयम (5) के अधीन गQठत बाt मू(cid:3) याकं न सिमित अथा6त ् िवभागीय मू(cid:3)य ाकं न सिमित वै+ािनक ‘सी’ और ‘डी’ क( दो Tतरीय बाt जांच करेगी और एक उपांतQरत नमनीय अ(cid:22)य छुuी ; (iii) मात^ृ व अवकाश क( अविध और एक वष6 क( अविध तक मात^ृ व अवकाश क( िनरंतरता म 3ली गई छुuी ; (iv) एक सौ अTसी (cid:1)दन तक अWज6त अवकाश क( अविध । (18) गैर वै+ािनक पद पर (cid:25)ितिनयुि(cid:28) या िवदशे सेवा पर Jतीत क( गई अविध और िच(cid:1)क^सीय आधार पर छुuी क( अविध जैस ेएक समय पर एक सौ अTसी (cid:1)दन से अिधक अविध के िलए अनमु ो(cid:1)दत अWज6त असाधारण छुuी या िविनDदE6 और िनयम 4 के उप िनयम (5) के अधीन गQठत बाt मू(cid:3)य ाकं न सिमित (cid:24)ारा समी=ा के पVात् (cid:25)ोvित के िलए उपयु(cid:28) नहx पाया जाता ह ै तो ऐसी समी=ा क( तारीख से एक वष6 के Jपगत हो जान ेके पVात अगली समी=ा के िलए पा* हो जाएगा । (21) य(cid:1)द कोई वै+ािनक तीन अन0ु िमक वषq के दौरान उपातं Qरत नमनीय अनुपूरक Tक(म के अधीन (cid:25)ोvित के िलए अWहत6 नहx होता ह ै तो वह उपातQं रत िनिVत कैQरयर छूट द े सकेगी । 12. इंजीिनयरी िडiी के साथ भत- (cid:1)कए जान ेवाल ेJि(cid:28)य(cid:30) के िलए र=ा सेवा(cid:133) म 3सेवा करन ेका दािय^व – इंजीिनयरी म 3 िडiी रखन े वाला कोई Jि(cid:28) इन िनयम(cid:30) के अधीन (cid:1)कसी पद पर िनयु(cid:28) होता ह,ै आवl यकता पड़ने पर भारत क( र=ा स े संबंिधत (cid:1)कसी र=ा सेवा या पद(cid:30) पर चार वष6 तक क( अविध क( सेवा करन े का दायी होगा िजसम3 (cid:25)िश=ण पर िबताई गई अविध, य(cid:1)द कोई हो, भी सि(cid:7)मिलत ह ै। बशतf ऐस ेJि(cid:28) स ेिन8िलिखत अपे=ा नहx क( जाएगी (i) िनयिु (cid:28) क( तारीख से दस वष6 क( समाि> के पVात ्उपयु6(cid:28) \प म 3सेवा करना, और (ii) साधारणतया चालीस वष6 क( आय ु(cid:25)ा> करन ेके पVात ्उपयु6(cid:28) \प म 3सेवा करना ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 13. भारत म 3और िवदशे म3 सवे ा करन ेका दािय^व – (1) इन िनयम(cid:30) के अधीन िनय(cid:28)ु (cid:1)कए गए वै+ािनक भारत म 3तथा िवदशे (cid:30) म 3कहx भी सेवा करन ेके दायी ह(cid:30)गे। (2) िनय(cid:28)ु (cid:1)कए गए वै+ािनक ऐसा (cid:25)िश=ण करन े के दायी ह(cid:30)गे और उ(cid:22)ह 3 भारत म 3 या िवदशे म3 िश=ा के ऐस े पा(cid:134)0म (cid:25)दान (cid:1)कए जाएंगे िजस ेिनयं*ण (cid:25)ािधकारी समय-समय पर िनिVत करते ह।: (3) (cid:25)िश=ण या पा(cid:134)0म के िलए भेज े गए (cid:1)कसी वै+ािनक स े िजसक( अविध छह मास या उसस े अिधक हो, भारत स े बाहर या भारत म 3 (cid:25)ाईवेट फमq या कारखान(cid:30) म 3 (cid:25)िश=ण के िलए भेजे गए (cid:1)कसी वै+ािनक के (cid:25)िश=ण क( अविध पर rयान (cid:1)दए िबना के(cid:22)Lीय सरकार म 3 (cid:22)यूनतम तीन वष6 क( अविध तक के िलए सेवा करने का एक बंधप* िनeपा(cid:1)दत करन े क( अप=े ा क( जाएगी और य(cid:1)द वह (cid:1)कसी कारण स ेिवभाग को अपनी सवे ा (cid:25)दान करना बंद कर दते ा ह ैतो ऐसे (cid:25)िश=ण के पूरा होन ेके पVात ्तीन वष6 के (cid:25)िश=ण क( अविध के िलए (cid:25)िश=ण क( पूरी लागत (cid:25)ितदाय करन ेका दायी होगा । 14. छूट दने े का अिधकार: जहा ं के(cid:22)Lीय सरकार का मत ह ै(cid:1)क ऐसा करना आवlयक या समीचीन है वहां वह उसके िलए जो कारण ह : उ(cid:22)ह 3लखे ब7 करके इन िनयम(cid:30) के (cid:1)कसी उपबंध(cid:30) को (cid:1)कसी वग 6या (cid:25)वग6 के Jि(cid:28)य(cid:30) के मामल ेम3 आदशे (cid:24)ारा छूट द ेसकेगी । 15. Definitions.- In these rules, unless the context otherwise requires,- (a) “age” means the upper age-limit as specified in column (4) Part II of the Second Schedule; (b) “candidate” means the person who is eligible for consideration for any post specified in the First Schedule;14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (c) “competent authority” means the authority specified by the Central Government as such, from time to time; (d) “controlling authority” means the Secretary in the Department of Biotechnology; (e) “Department” means the Department of Biotechnology; (f) “post” means a post of Scientist as specified in column (1) of the First Schedule; (g) “Schedule” means a Schedule appended to these rules. 3. Number of posts, classification and pay level in the pay matrix- The number of the said posts, their classification and the level in the pay matrix attached thereto shall be as specified in the First Schedule to these rules. 4. Educational qualifications, experience, method of recruitment, etc.- (1) The educational qualification for a post shall be as specified in Part-I of the Second Schedule and the specific area of biotechnology, as may be required for the post concerned shall be decided by the controlling authority and indicated in the advertisement. (2) The candidate for the post referred to in sub-rule (1) shall have the experience in research and development in industrial or academic institutions or an organisation of science and technology after obtaining the minimum educational qualifications as specified in Part-II of the Second Schedule. (3) (i) The candidate for the post of the level of Scientist H or Level-15 shall have the experience of a senior level Scientist capable of independently handling science and technology programme and as specified in Part-II of Second Schedule. (ii) The controlling authority shall decide the exact nature of experience required in the area of biotechnology which shall be indicated in the advertisement for the said post. (4) (i) The recruitment for the post of Scientist-‘C’ shall be made by direct recruitment. (ii) The recruitment for the post of Scientist H or Level-15, shall be made either by direct recruitment or on deputation or absorption basis. (iii) The controlling authority shall decide the particular method of appointment for each vacancy of Scientist H or Level-15 before advertising the post and shall be indicated in the advertisement in accordance with the provisions ofsub-rules (1) and(3) of rule4. (iv) The recruitment for the post of Scientists ‘D’,’E’,’F’ and Scientist ‘G’ shall be made by in- situ promotion under the Modified Flexible Complementing Scheme on completion of minimum residency period in the existing grade as specified in the Third Schedule. (5) Any recruitment or confirmation made by the method specified in sub-rule (4) of rule 4 shall be made on the recommendation of the Committees specified in rule 10. (6) The Committees referred to in sub-rule (5) of rule4 shall make their recommendations on the basis of interview held with candidates for all posts filled under method of recruitment under clauses (i) and (ii) of sub-rule (4) of rule 4 and on the basis of interview and evaluation of past performance of scientists in the Department for all posts filled by the method of recruitment under clause (iv) of sub-rule (4) of rule 4: Provided that for making recruitment to the posts, the Committee constituted under sub-rule (5) of rule 4 shall comply with the methodology of assessment or selection (including the number of candidates to be called against vacancies advertised) which has been duly approved by the competent authority before making advertisement for recruitment for the post. (7) The recommendation of the Committee as specified at sub-rule (5) of rule 4 shall be placed for approval of the competent authority and shall be effective from the date of approval of the competent authority or the date of joining of the candidate, whichever is later. 5. Age-limit and nationality.- (1) The upper age-limit for direct recruitment shall be as specified in column (4) of Part-II of the Second Schedule.¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 15 (2) The upper age-limit for post in Scientist ‘H’ filled on deputation basis shall be fifty eight years. (3) The crucial date for determining the age-limit shall be the closing date for receipt of applications from candidates (and not the closing date prescribed for those in Assam, Meghalaya, Arunachal Pradesh, Mizoram, Manipur, Nagaland, Tripura, Sikkim, Ladakh Division of Jammu and Kashmir State, Lahaul and Spiti District and Pangi Sub-division of Chamba District of Himachal Pradesh, the Union territory of the Andaman and Nicobar Islands and the Union territory of Lakshadweep). (4) Only an Indian citizen shall be eligible for appointment against posts of Scientists ‘C’ and ‘H’ filled in the manner specified in clauses (i) and (ii) of sub-rule (4) of rule 4. 6. Direct recruitment.- (1) The candidate possessing the educational qualification and experience as specified in the Second Schedule shall be eligible for appointment by direct recruitment in the manner specified in sub-rules (6) and (7) of rule 4, on the recommendations of the Committee constituted under sub-rule (5) of rule 4 and as specified in sub-rule (1) of rule 10. (2) If a Departmental candidate is selected for appointment to any post by direct recruitment, the post shall be deemed to have been filled by direct recruitment. (3) The candidate selected for appointment as Scientist ‘C’ or Scientist ‘H’ on direct recruitment basis shall be appointed on probation for a period of one year. (4) The confirmation of the candidate appointed on probation under sub-rule (3) shall be considered by the Departmental Confirmation Committee specified in sub-rule (5) of rule 10. 7. Absorption.- The candidate from the Central Government or the State Government shall be eligible for absorption under clause (ii) and (iii) of sub-rule(4) of rule 4 in the manner specified in sub-rules (5), (6) and (7) of the said rule and subject to fulfilment of the following conditions, namely :- (a) the candidate possesses the minimum educational qualification and experience as specified in the Second Schedule; and (b) the candidate holds a post analogous to the post applied for, on regular basis in the parent cadre or Department. 8. Deputation.- (1) The candidate from other Ministries or Departments of the Central Government or the State Governments or Union territories or Universities or Public Sector Undertakings or autonomous statutory bodies or Institutions and recognised research organisations or institutions funded by the Government may be appointed on deputation basis for positions specified in clause (ii) of sub-rule (4) of rule 4 in the manner specified in sub-rules (5), (6) and (7) of rule 4 and subject to the fulfilment of the following conditions, namely:- (i) the candidate possesses minimum educational qualification and experience as specified in the Second Schedule; (ii) the candidate holds a post analogous to the post applied for or has worked for at least five years on the immediate lower post on regular basis in the parent cadre or Department; (iii) provisions of sub-rule (1) of rule 5 regarding age-limit for candidates recommended for appointment on Deputation. (2) The period of deputation including the period of deputation in another ex-cadre post held immediately preceding the present appointment on deputation in the same or some other organisation or Department of the Central Government, shall ordinarily be five years. (3) The vacancies caused on account of the incumbents being away on deputation or on long illness or on study leave or due to any other reason for a duration of one year or more may be filled up on deputation basis from the officers of the Central Government in the manner specified in clause (ii) of sub-rule(4) of rule 4. 9. Promotion through the Modified Flexible Complementing Scheme (in situ promotion).- (1) The Modified Flexible Complementing Scheme as notified by the Department of Personnel and Training from16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] time to time shall apply in the matter of insitu promotions for the scientists in the Department in the grades of Scientists ‘D’, ‘E’, ‘F’, ‘G’ only, which shall be personal to the scientist concerned. (2) If the Committee specified in sub-rules(2) and (3) of rule 10, as the case may be, finds the scientist fit for promotion to the posts of Scientist ‘D’ or Scientist ‘E’ or Scientist ‘F’ or Scientist ‘G’, as the case may be, and such post is not available within the sanctioned strength at that time, the promotion may be given by upgrading the post of Scientist ‘C’ to Scientist ‘D’, Scientist ‘D’ to Scientist ‘E’, Scientist ‘E’ to Scientist ‘F’ and Scientist ‘F’ to Scientist ‘G’. (3) There shall be complete inter-changeability of posts without any restriction except that the total number of incumbents shall not exceed the total number of posts in Scientist ‘C’, Scientist ‘D’, Scientist ‘E’, Scientist ‘F’ and Scientist ‘G’ put together. (4) The minimum residency period, that is, the qualifying service required for promotion under the Modified Flexible Complementing Scheme for each grade shall be as specified in the Third Schedule. (5) On vacancy of a post by retirement or resignation or death or otherwise of a scientist, the post shall revert to the lowest level of Scientist ‘C’, at which clear vacancy exists at that time. (6) The competent authority shall review for promotion through the Modified Flexible Complementing Scheme twice a year. (7) The cases maturing for promotion under the Modified Flexible Complementing Scheme during January to June of the year shall be taken up for review from the month of April of that year and the cases maturing for promotion during July to December of a year shall be taken up for review from the month of October of that year. (8) The date of promotion for those found suitable for promotion under the scheme shall be the date on which the competent authority approves the promotion or the date of assumption of charge of the post, whichever is later. (9) (a) There shall be two level assessment for scientists considered under the Modified Flexible Complementing Scheme. (b) The First Level would be internal for screening purposes and the next level shall consist of majority of external members. (c) The assessment board for determining suitability for promotion shall have majority of members possessing expertise in the field and greater emphasis shall be placed on achievement as evaluated by the independent peer group rather than seniority. (d) The benefit of Modified Flexible Complementing Scheme shall be extended to Scientists in the Department who are involved in creating new scientific knowledge or innovative engineering technological or medical techniques or which are predominantly involved in professional research and development or application of scientific knowledge. (10) The scientist eligible for promotion under the Modified Flexible Complementing Scheme shall fill up the annual work report format (Part-A) specified in the Fourth Schedule along with the Annual Performance Appraisal Report and would get reported upon by the Reporting Officer. (11) (a) The scientist eligible for promotion under the Modified Flexible Complementary Scheme and who meets the benchmark ‘Very Good’ for Scientist ‘D’ and above would be screened in by the Internal (Screening)Committee as specified in clauses (a) and (b) of sub-rule(4) of rule10 which shall evaluate the annual work reports in relation to the criteria for upgradation under the Modified Flexible Complementing Scheme. (b) The annual work report on the scientific content of the work done by the Scientist of the Department in Part ‘C’ of the annual work report in the Fourth Schedule and the report shall be made available to the External Assessment Committee (Departmental Assessment Committee orDepartmental Peer Review Committee) as the case may be which is constituted under sub-rule (5) of rule 4 and specified in sub-rule (2) and (3) of rule 10.¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 17 (12) The exceptionally meritorious candidates with all outstanding grading, may be granted relaxation in the residency period, that is, qualifying service, the relaxation being not more than one year on any single occasion and such a relaxation shall be limited to a maximum of two occasions in their entire career. (13) The External Assessment Committee, namely, the Departmental Assessment Committee constituted under sub-rule (5) of rule4 and specified in sub-rule (2) of rule10 shall undertake level-2external screening in respect of Scientists ‘C’ and ‘D’ and report specifically through a summary of the specific content of the work done justifying the merit for consideration under Modified Flexible Complementing Scheme and certify that the Scientists recommended meets with all the criteria for in-situ upgradation under Modified Flexible Complementing Scheme. (14) The External Assessment Committee, namely, the Departmental Peer Review Committee constituted under sub-rule (5) of rule 4 and specified in sub-rule (3) of rule10 shall undertake level-2 external screening in respect of Scientists “E” and “F” and report specifically through a summary of the specific content of the work done justifying the merit for consideration under Modified Flexible Complementing Scheme and certify that the Scientists recommended meets with all the criteria for in-situ upgradation under Modified Flexible Complementing Scheme. (15) There shall be no consideration of retrospective grant of in situ promotion under the modified flexible complementing scheme. (16) In case of officers undergoing training or study leave or on deputation in India or abroad under FR 51 shall be considered for in-situ promotion under the Modified Flexible Complementing Scheme to the next higher grade with effect from the date they would have completed the minimum residency period, had they not proceeded on training or study leave or on deputation subject to fulfillment of following conditions, namely: - (i) the period of such training or study leave or on deputation is treated as on duty under FR 9 (6b); and, (ii) the Scientist have been approved for in-situ promotion under the Modified Flexible Complementing Scheme to the next higher grade. (17) The following periods of service shall count towards the minimum residency period necessarily required to be put up in the lower grade for promotion to the next higher grade, namely: - (i) the period spent on deputation or foreign service to another scientific post; or (ii) the period of study leave or any other leave taken for improving the academic accomplishments; (iii) the period of maternity leave and leave taken in continuation of maternity leave upto a period of one year; (iv) the period of earned leave upto one hundred and eighty days. (18) The period spent on deputation or foreign service to a non-scientific post and the period of leave on medical ground, leave such as earned leave sanctioned for the period exceeding one hundred and eighty days at a time, extraordinary leave, or any other leave as specified by the competent authority availed on personal grounds shall not count towards the minimum residency period. (19) The regular services rendered excluding ad hoc service, non-qualifying service in a post shall count for the purpose of review for promotion to the next higher grade under the Modified Flexible Complementing Scheme. (20) A scientist not found fit for promotion after a review by the External Assessment Committee constituted under sub-rule (5) of rule 4 and specified in sub-rule (2) and (3) of rule10 as the case may be, shall become eligible for the next review only after a lapse of one year from the date of such review. (21) In case a Scientist is not qualified for promotion under the Modified Flexible Complementing Scheme during three successive years, he shall be eligible for upgradation to the next higher18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] grade on completion of ten or twenty or thirty years of service subject to the provisions of Modified Assured Career Progression Scheme and after completion of the prescribed residency in the said grade, the Scientists shall again be considered for upgradation to the next higher grade under the Modified Flexible Complementing Scheme. (22) The criteria to be followed for considering promotion under the Modified Flexible Complementing Scheme shall be as specified in the Fifth Schedule. (23) The criteria for field experience for considering promotion under the Modified Flexible Complementing Scheme shall be as specified in the Sixth Schedule. 10. Composition of the Committees.-(1)The Expert Selection Committee constituted under sub-rule (5) of rule 4for making recommendation to posts specified in the First Schedule read with clause (f) of rule 2, clauses (i) and (ii) of sub-rule (4) ofrule4, rule 6, rule7 and rule 8 shall consist of the following persons, namely:- Sl. Member Administration- To be nominated by Secretary of the Department. (2) The External Assessment Committee, namely,- the Departmental Assessment Committee constituted under sub-rule (13) of rule 9shall consist of the following persons, namely:- Name of post. Composition of the Departmental Assessment Committee. (1) (2) Scientist ‘C’ to Scientist ‘D’ 1. Chairman- Secretary of the Department; and, 2. Members: Two eminent Scientists not below the rank of Joint Secretary specialised in the field of scientific activity to be nominated by Secretary of the Department; 4. Member Department of Personnel and Training: Joint Secretary rank officer to be nominated by Department of Personnel and Training. 1. Chairman: Secretary of the Department; 2. Member: Two Secretaries of the other Scientific Departments (or their representatives who are at least in Additional Secretary rank) to be nominated by the Secretary of the Department; 3. Member: Two eminent Scientists not below the rank of Additional Secretary specialised in the field of scientific activity; 4. Member Department of Personnel and Training: An officer not below the rank of Additional Secretary to be nominated by the Department of Personnel and Training. (4) The Internal shortlisting or screening committee for shortlisting of candidates specified in sub-rule (4) of rule 4 whose report shall be placed before committees referred into in sub-rules (1), (2), and (3) of rule 10 as the case may be shall consist of the following persons, namely:- Sl. Note 2.-Where officers of the Government, autonomous bodies and public sector undertakings are nominated as members of the committees, they shall be at least one level above the post to which the appointment is being recommended to be made under sub-rule (4) of rule 4. Note 3.-Chief Vigilance Officer of the Department shall not be member of any committee. (5) The Departmental Confirmation Committee constituted under sub-rule (4) of rule 6 consist of the following persons, namely:- Sl. Members- Two scientists working in the Government Departments in the rank of Secretary. 10. Disqualifications.-No person.- (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts: Provided that the Central Government may if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 12. Liability to serve in the defence services for recruits with engineering degree.– Any person with a degree in engineering appointed to any post under these rules shall, if so required, be liable to serve in any¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 21 defence services or posts connected with the defence of India for a period of not more than four years including the period, if any, spent on training: Provided that such person shall not be required.- (i) to serve as aforesaid after the expiry of ten years from the date of appointment; and (ii) ordinarily, to serve as aforesaid after attaining the age of forty years. 13. Liability to serve in India and outside.–(1) The Scientists appointed under these rules shall be liable to serve anywhere in India and outside India. (2) The Scientists appointed shall be liable to undergo such training and be detailed on such courses of instruction in India or abroad as the Central Government may decide from time to time. (3) A Scientist detailed for training or course, the duration of which is six months or more or a Scientist detailed for training outside India or with private firms or factories in India, irrespective of the duration of the training, shall be required to execute a bond to serve the Central Government for a minimum period of three years and shall be liable to refund in full the cost of the training, if, for any reason, during the training or within a period of three years after the completion of such training, he chooses to discontinue his service from the Department. 14. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 15. Saving.- Nothing in these rules shall affect reservation, relaxation of age- limit and other concessions required to be provided for the candidates belonging to the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and the other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. (B) For Scientist ‘H’: Doctor of Philosophy in Life Sciences or Master of Drugs or Master of Veterinary Science or Master of Technology in the field of Biotechnology or Medicine or Veterinary Science from a recognised University or Institute. Others (please specify) THE FIFTH SCHEDULE [See rule 9(22)] TERMS AND CONDITIONS FOR PROMOTION UNDER THE MODIFIED FLEXIBLE COMPLEMENTING SCHEME 1. The annual work report specified in the Fourth Schedule shall be filled in by the officer along with the Annual Performance Appraisal Report and would get reported upon by the Reporting Officer. 2. The internal screening committee would report on the scientific content of work done by the Scientist in Part ‘C’ of the annual work report which would be made available to the external assessment committee (Departmental Assessment Committee or Departmental Peer Review Committee, as the case may be) 3. The internal screening committees shall be constituted in terms of clauses (a) and (b) of sub-rule (4) of rule 10. 4. The external assessment committee shall be constituted in terms of sub-rule (5) of rule 4 and as specified in sub-rules (2) and (3) of rule 10. 5. If necessary, suitable amendment to the provisions for external assessment committee in these rules, and other provisions may be considered to bring the composition of the committees in tune with extant instructions of the Department of Personnel and Training. 6. The external assessment committee, namely, the Departmental Assessment Committee or Departmental Peer Review Committee as the case may be shall undertake level-two screening for assessment of Scientists considered for in-situ promotion. 7. The external assessment committee, that is, the Departmental Assessment Committee or Departmental Peer Review Committee, as the case may be, shall record specifically through one- page summary, the specific content of the work done justifying the merit for consideration under Flexible Complementing Scheme and shall certify that the scientists recommended meet with all the criteria for in-situ promotion under Modified Flexible Complimenting Scheme. THE SIXTH SCHEDULE [See rule 9 (23)] A. Field Experience 1. The candidate recruited to the posts in the Secretariat of the Scientific Ministries or Departments to higher grades under the Modified Flexible Complementing Scheme shall have the field experience in research and development and experience in implementation of scientific projects.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. For promotion to the grade of Scientist ‘F’, the officer shall have two years field experience and for promotion to the grade of Scientist ‘G’ the officer shall have field experience of five years. 3. The experience shall cover the aims and objectives of the institution or organisation, qualifications of the personnel, qualitative requirements for; performance of various types of activities. B. Scientific Activities and Services (a) Fundamental or Basic research: (i) The candidate shall have performed fundamental or basic research of original investigation to gain new scientific knowledge, not necessarily directed towards any specific practical aim or application; (ii) The candidate shall have experience of working in scientific laboratories or institutes, period spent on doctoral or post-doctoral degrees in basic research after joining an organisation and other research shall be considered as field experience for the purpose of the Modified Flexible Complementing Scheme. (b) Applied Research: (i) The candidate shall have done applied research of original investigation to gain new scientific or technical knowledge directed towards a specific practical aim or objective; (ii) The candidate shall have experience of working in scientific laboratories or institutes, period spent on doctoral or post-doctoral degrees in applied research after joining an organization and other research would constitute field experience for the purpose of the Modified Flexible Complementing Scheme. (c) Experimental Development: (i) The candidate shall have adequate scientific knowledge directed towards producing new or substantially improved materials, devices, products, processes, systems or services as per the mandate and work profile of the Department. (ii) The work of the candidate shall involve application of scientific knowledge for creation of new or innovative systems, practices and models and shall not reflect routine use of scientific knowledge. (d) Promotion of Science and Technology activities: (i) The candidate is involved in science and technology activities which are directly linked to research and development in terms of promoting the scientific activities and services. (ii) The candidate shall have coordinated research and development programs in biotechnology, national and international network projects in biotechnology, mission mode projects, biotechnology regulation and such other works.
