## Policy Analysis Report: Amendment to the Union Public Service Commission Exemption from Consultation Regulations, 1958 **1. Executive Summary:** This report analyzes an amendment to the Union Public Service Commission (UPSC) Exemption from Consultation Regulations, 1958. The amendment, officially titled "Union Public Service Commission Exemption from Consultation, Second Amendment, Regulations, 2021," focuses on modifying Schedule II of the original regulations. The core purpose of this amendment is to alter the regulations regarding exemptions from UPSC consultation for filling specific positions within the National Institution for Transforming India (NITI) Aayog. The key finding is that the amendment changes the conditions under which NITI Aayog can fill certain adviser and officer positions without consulting the UPSC. **2. Introduction:** This report provides an informative analysis of the "Union Public Service Commission Exemption from Consultation, Second Amendment, Regulations, 2021," based solely on the provided government policy text. The analysis focuses on the changes introduced to the existing Union Public Service Commission Exemption from Consultation Regulations, 1958, and aims to inform stakeholders about the implications of these amendments. **3. Policy Overview:** * **Original Policy:** The Union Public Service Commission Exemption from Consultation Regulations, 1958. * **Core Objective(s) (inferred from text):** The original policy establishes regulations governing exemptions from consultation with the UPSC in specific appointment scenarios. The amendment's objective is to modify these exemptions, specifically regarding positions within NITI Aayog. **4. Background and Rationale:** The amendment likely addresses a need to streamline the appointment process for specific positions within NITI Aayog, facilitating quicker and more efficient hiring for roles crucial to its operation. The previous regulations regarding exemptions from UPSC consultation for these positions were deemed insufficient, necessitating this modification to enhance NITI Aayog's ability to attract and retain talent. **5. Key Provisions / Changes:** This amendment directly modifies Schedule II of the original regulations. Specifically, it substitutes item 19 HD and related entries. The key changes are: * **Specific Part Changed:** Item 19 HD in Schedule II of the Union Public Service Commission Exemption from Consultation Regulations, 1958. * **New Rule/Provision:** The new provision outlines the conditions for filling thirty-nine posts of Joint Adviser (level 13) or Deputy Adviser (level 12), and seventy-two posts of Senior Research Officer (level 11), Research Officer (level 10), or Economic Officer (level 7) within the Flexi Pool and Knowledge and Innovation Hub in NITI Aayog without requiring consultation with the UPSC. * **Difference/Effect of Change:** The change indicates a shift in the level of autonomy granted to NITI Aayog in staffing these specific positions. By exempting these appointments from mandatory UPSC consultation, the amendment aims to expedite the recruitment process. The specific previous requirements for these positions under Item 19HD cannot be determined without access to the pre-amendment text. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders are: * **NITI Aayog:** Specifically, the departments and personnel responsible for recruitment within the Flexi Pool and Knowledge and Innovation Hub. * **Potential candidates:** Individuals seeking positions as Joint Adviser, Deputy Adviser, Senior Research Officer, Research Officer, or Economic Officer within NITI Aayog. * **Union Public Service Commission (UPSC):** The amendment directly affects the UPSC's role in the recruitment process for the specified positions. **7. Implementation Aspects (Inferred):** * **Responsible agency/bodies:** NITI Aayog is responsible for implementing the amended regulations concerning the specified positions within its Flexi Pool and Knowledge and Innovation Hub. * **Timelines or procedures:** The amendment came into force on the date of its publication in the Official Gazette (June 11, 2021). Specific internal procedures for recruitment within NITI Aayog, consistent with the amended regulations, would likely need to be established or revised. However, this is not explicit in the text. **8. Expected Outcomes / Impact of Changes:** The intended outcome of this amendment is likely to be: * **Streamlined Recruitment:** A more efficient and timely recruitment process for the specified positions within NITI Aayog. * **Enhanced Flexibility:** Increased flexibility for NITI Aayog in selecting and appointing suitable candidates for key roles. * **Faster Deployment:** Quicker deployment of personnel to the Flexi Pool and Knowledge and Innovation Hub, potentially accelerating the implementation of NITI Aayog's initiatives. **9. Conclusion:** The "Union Public Service Commission Exemption from Consultation, Second Amendment, Regulations, 2021" represents a targeted adjustment to the existing regulations regarding exemptions from UPSC consultation. By specifically addressing the appointment process for certain positions within NITI Aayog, the amendment aims to enhance the organization's operational efficiency and facilitate the recruitment of qualified professionals. The amendment signifies a move towards granting NITI Aayog greater autonomy in staffing crucial roles, which is expected to lead to a more agile and responsive organization.
