L.-33004/99 सी.जी.-डी.एल.-अ.-23022023-243851 xxxGIDHxxx CG-DL-E-23022023-243851 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 108] नई ददल्ली, बृहस्ट्प जतवार, फरवरी 23, 2023/फाल्ग न 4, 1944 No. 108] NEW DELHI, THURSDAY, FEBRUARY 23, 2023/PHALGUNA 4, 1944 भारतीय उपचया ापररषद ् प्रत्याहार आदेि नई ददल् ली, 22 फरवरी, 2023 फा. स.ं 18-05/9525-आईएनसी.—भारतीय उपचयाा पररषद ् अजधजनयम, 1947 (1947 का XLVIII) की धारा 14 के तहत प्रदत्त िजियों का प्रयोग करते हुए, भारतीय उपचयाा पररषद ्एतद्द्वारा जनम्नजलजखत आदिे िारी करती ह:ै - िबदक, मा ं मड ं ेश्वरी परै ामजे डकल एडं नर्सगिं रेननगं सस्ट्ं थान, गावं -ओदर, पीओ-ओदर, पीएस-सोहन, जिला कैमरू (भभआ ) - 821108, जबहार, जबहार राज्य सरकार और कनााटक नसेंस एडं रजिस्ट्रेिन काउंजसल द्वारा एएनएम कोस ा चलाने के जलए मान्यता प्राप्त ह।ै वहीं, प्रधान सजचव, (H&FW) स्ट्वास्ट््य जवभाग,जबहार सरकार, जवकास भवन, नया सजचवालय, जबहार को भारतीय उपचयाा पररषद ् अजधजनयम, 1947 की धारा 14 के तहत मान्यता वापस लेन े के जलए एक नोरटस सं. 18- 5/9525-आईएनसी/11919 ददनांक 9/02/2021 िारी दकया गया था। नोरटस ददनांक 9/02/2021 की एक प्रजत मा ं मड ं ेश्वरी परै ामजे डकल एंड नर्सगिं रेननगं सस्ट्ं थान, गावं -ओदर, पीओ-ओदर, पीएस-सोहन, जिला कैमरू (भभआ ) - 821108, जबहार को भी भेिी गई थी। िारी नोरटस में राज्य सरकार से नर्सिंग संस्ट्थान की उपय िता के संबंध में पररषद ् को अपनी जसफाररिें प्रस्ट्त त करन े का अनर ोध दकया गया था। िबदक, मा ं मड ं ेश्वरी परै ामजे डकल एंड नर्सगिं रेननगं सस्ट्ं थान के मामल े म ें पररषद राज्य सरकार स े कोई जसफाररि नहीं जमली ह।ै और मा ंमड ं ेश्वरी परै ामजे डकल एंड नर्सगिं रेननगं सस्ट्ं थान न े भी िारी नोरटस का कोई िवाब नहीं ददया ह।ै 1194 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] वहीं, पररषद ् ने इस मामले पर समग्र जवचार दकया ह।ै भारतीय उपचयाा पररषद ् अजधजनयम 1947 की धारा 13 के तहत वैधाजनक जनरीक्षण से इनकार करना एक गंभीर म द्दा ह।ै केवल जनरीक्षणों के आधार पर ही पररषद ् नर्सिंग कोस ा संचाजलत करन े के जलए नर्सिंग संस्ट्थान की उपयि ता के बारे में जनणाय लेन े की जस्ट्थजत म ें होगी। जनरीक्षण से इंकार करन े का वास्ट्तजवक अथ ायह होगा दक संस्ट्थान के पास अपेजक्षत जिक्षण, नैदाजनक या आधारभूत स जवधाएं नहीं ह।ैं अतः इसजलए, भारतीय उपचयाा पररषद ् धारा 14(3)(बी) के तहत प्रदत्त अजधकारों का प्रयोग करत े हुए पररषद ् यह घोषणा करती ह ै दक 25/06/2022 से आग े मा ं मड ं ेश्वरी परै ामजे डकल एंड नर्सगिं रेननगं सस्ट्ं थान, गावं -ओदर, पीओ- ओदर, पीएस-सोहन, जिला कैमरू (भभआ ) - 821108, जबहार से एएनएम की योग्यता प्राप्त करन े वाला हर एक व्यजि जबहार राज्य सरकार के आदेिों के अधीन केवल जबहार राज्य में पंिीकृत होन े का हकदार होगा। ले. कनाल (डॉ.) सवािीत कौर, सजचव [जवज्ञापन-III/4/असा./635/2022-23] INDIAN NURSING COUNCIL WITHDRAWAL ORDER New Delhi, the 22nd February, 2023 F. No. 18-05/9525-INC.— In exercise of the powers conferred under Section 14 of Indian Nursing Council Act, 1947 (XLVIII of 1947), the Indian Nursing Council hereby issues the following order:— Whereas, Maa Mundeshwari Paramedical & Nursing Training Sansthan situated at Village – Odar, PO – Odar, PS – Sonhan, Distt. Kaimur (Bhabhua) – 821108, Bihar was recognized by State Government of Bihar and Bihar Nurses & Registration Council to conduct ANM Course. Whereas, a notice no. 18-05/9525-INC/11919 dated 09/02/2021 for withdrawal of Recognition under section 14 of Indian Nursing Council Act, 1947 addressed to Principal Secretary (H&FW) Department of Health, Government of Bihar, Vikas Bhawan, New Secretariat, Bihar was issued. Copy of the notice dated 09/02/2021 was also enclosed Maa Mundeshwari Paramedical & Nursing Training Sansthan situated at Village – Odar, PO – Odar, PS – Sonhan, Distt. Kaimur (Bhabhua) – 821108, Bihar. In the notice issued, the State Government was requested to submit their recommendations to the Council as respects Suitability of the nursing institution. Whereas, the Council has not received any recommendation from the State Government as respects the case of Maa Mundeshwari Paramedical & Nursing Training Sansthan. Even the institution Maa Mundeshwari Paramedical & Nursing Training Sansthan has not responded to the notices issued. Whereas, the Council has considered the matter in its entirety. Refusal for statutory inspection under section 13 of Indian Nursing Council Act 1947 is a serious issue. It is on the basis of inspections only that the Council would be in a position to decide about the suitability of the nursing institution to conduct nursing courses. Refusal for inspection would ipso facto mean that the institution does not possess the requisite Teaching, Clinical or infrastructural facilities. Now therefore, the Council exercising powers under section 14(3)(b) of Indian Nursing Council Act, 1947 declares that with effect from 25/06/2022 any person holding a recognized qualification of ANM from Maa Mundeshwari Paramedical & Nursing Training Sansthan situated at Village – Odar, PO – Odar, PS – Sonhan, Distt.
