L.-33004/99 सी.जी.-डी.एल.-अ.-20022026-270323 xxxGIDHxxx CG-DL-E-20022026-270323 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 117] नई दिल्ली, बुधवार, फरवरी 18, 2026/माघ 29, 1947 ष 22, 1947 No. 117] NEW DELHI, WEDNESDAY, FEBRUARY 18, 2026/MAGHA 29, 1947 s 1947 राष्ट्रीय आयर्ु वज्ञि ान आयोग अजधसचू ना नई दिल्ली, 17 फरवरी, 2026 स.ंएम-27011/01/20250-एमएआरबी(लीगल)/एनएमसी.— “राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम की धारा 57 की उप-धारा (2) के साथ पठित धारा 26, 28 और 29 द्वारा प्रित्त िजियों का प्रयोग करत े हुए, एतद्द्वारा, “नए जचदकत्सा संस्ट्थानों की स्ट्थापना, नए जचदकत्सा पाठ्यक्रमों की िुरुआत, मौिूिा पाठ्यक्रमों के जलए सीटों म ें वृजि और मूल्यांकन एवं रेटटंग जवजनयम, 2023” या “नए जचदकत्सा संस्ट्थानों की स्ट्थापना, मल्ू यांकन एवं रेटटंग जवजनयम, 2023” म ें और संिोधन करन े हते ु जनम्नजलजखत मसौिा जवजनयम बनाता है, अथाित्—” 1. i. इन जवजनयमों को “नए जचदकत्सा संस्ट्थानों की स्ट्थापना, नए जचदकत्सा पाठ्यक्रमों की िुरुआत, मौिूिा पाठ्यक्रमों के जलए सीटों में वृजि और मल्ू यांकन एवं रेटटंग (सिं ोधन) जवजनयम, 2026’ कहा िाएगा, तथा संक्षेप म ें “नए जचदकत्सा संस्ट्थानों की स्ट्थापना, मूल्यांकन एवं रेटटंग (संिोधन) जवजनयम, 2026” कहा िा सकेगा। ii. ये रािपत्र म ेंउनके प्रकािन की जतजथ स ेप्रवृत्त होंगे। 1247 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 2. जचदकत्सा संस्ट्थानों की स्ट्थापना म,ें मल्ू यांकन एवं रेटटंग जवजनयम, 2023 i. खडं 6(क) को हटा दिया िाएगा। ii. खडं 6(छ) के स्ट्थान पर जनम्नजलजखत स े प्रजतस्ट्थाजपत दकया िाएगा— “कंपनी अजधजनयम, 2013 या उसकी स्ट्थापना के समय प्रवृत्त दकसी अन्य संबंजधत कानून के अतं गति जवजधवत् जनगजमत कोई कंपनी।” iii. खडं 6(छ) के पश्चात् एक नया खडं 6(ि) जनम्नानुसार िोडा िाएगा: “कोई रस्ट्ट िो संबंजधत राज्य में रस्ट्टों को स्ट्थाजपत करन े और रेगलु ेट करन े के जलए बनाए गए संबंजधत कानून के अंतगति पंिीकृत ह।ैं “ iv. खडं 9, “योग्य संस्ट्था द्वारा प्रस्ट्ततु कोई भी आवेिन तब तक स्ट्वीकार नहीं दकया िाएगा िब तक दक उसके साथ— “ को जनम्नजलजखत से प्रजतस्ट्थाजपत दकया िाएगा— “योग्य संस्ट्था द्वारा जनम्नजलजखत िस्ट्तावेज़ िमा दकए िाएंगे।” v. खडं 9(क) को इस प्रकार प्रजतस्ट्थाजपत दकया िाएगा: “संबंजधत राज्य सरकार या केंद्र िाजसत प्रिेि प्रिासन या उपयुि प्राजधकारी िैसा मामला हो, द्वारा िारी अजनवायिता प्रमाणपत्र (ईसी), िब तक अन्यथा जनर्िष्टि न हो। आवेिन के समय अजनवायिता प्रमाणपत्र (ईसी) वैध होना चाजहए। यह खंड उन स्ट्थाजपत कॉलेिों पर लाग ू नहीं होगा िो नए स्नातकोत्तर पाठ्यक्रम िुरू करन े के जलए आवेिन कर रह ेह।ैं ” vi. खडं 9(ख) को इस प्रकार प्रजतस्ट्थाजपत दकया िाएगा: “एक मान्यता प्राप्त जवश्वजवद्यालय स े प्राप्त सहमजत पत्र (Consent of Affiliation – CoA), िो आवेिनकताि, मेजडकल कॉलेि/संस्ट्था के नाम से जलजखत रूप म ें िारी दकया गया हो। CoA आवेिन प्रस्ट्तुत करन े के समय वैध होना चाजहए; और vii. खडं 9(ग) को हटा दिया िाएगा। viii. खडं 9(घ) को इस प्रकार सिं ोजधत दकया िाएगा: आवेिन आमंजत्रत करने की अंजतम जतजथ से नब्बे दिनों के भीतर दकसी चाटिडि एकाउंटेंट द्वारा िारी दकए गए जपछल ेपूण ि जवत्तीय वषि के आधार पर एक िोध क्षमता प्रमाणपत्र (सॉल्वेंसी सर्टिदफकेट)। ix. खडं 9 के अतं गित, स्ट्पष्टीकरण 3 के पश्चात पहल ेउपबधं (Proviso) को इस प्रकार सिं ोजधत दकया िाएगा: बिते दक कोई भी अधूरा आविे न अथाित् वतिमान जवजनयम में जनर्ििष्ट अजनवायि िस्ट्तावेिों के जबना प्राप्त आवेिन, राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 की धारा 28(2) के अनुसार, उन्ह ें एक वैध/पात्र योिना नहीं माना िाएगा और ऐसे आवेिन को राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 के धारा 28(3) तथा इस जवजनयमन के खंड 13 के अतं गित जनधािठरत दकसी भी अवसर को प्रिान दकए जबना, जचदकत्सा मूल्यांकन एवं रेटटंग बोड ि (MARB) द्वारा अस्ट्वीकार कर दिया िाएगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 x. खंड 15 में “प्रथम अनुच्छेि” के पश्चात् तथा “प्रथम उपबंध” से पूवि जनम्नजलजखत “नया अनुच्छेि” िोडा िाएगा: "आवेिनकता/िसंस्ट्था द्वारा नए जचदकत्सा संस्ट्थान के संचालन के जलए जविेष रूप से जनधािठरत एक कॉपिस फंड के जनधािरण के संबंध में आवेिन प्रस्ट्तुत करने के समय एक वचनपत्र (Undertaking) प्रस्ट्ततु दकया िाएगा। इसके अजतठरि, पहले स े संचाजलत सभी मेजडकल कॉलेि को भी मेजडकल कॉलेि के संचालन हते ु जविेष रूप स े जनधािठरत एक कॉपिस फंड बनाए रखना होगा। इस कॉपिस फंड की राजि का जनधािरण जचदकत्सा मूल्यांकन एव ं रेटटंग बोड ि द्वारा दकया िाएगा तथा इसकी सूचना नोठटस के माध्यम से िी िाएगी। कॉपिस फंड की राजि समय- समय पर संिोजधत की िाएगी। कॉलेि को िब भी जचदकत्सा मूल्यांकन एवं रेटटंग बोडि (MARB) द्वारा जनिेजित िाएगा, कॉलेि को िस्ट्तावेिी प्रमाण प्रस्ट्तुत करना होगा। xi. खडं 31 (ग) को इस प्रकार सिं ोजधत दकया िाएगा: “दकसी नई योिना/योिनाओं के जलए या उस िैजक्षक वष ि या ऐसे जनधािठरत वषों के जलए सीटों में वृजि के आवेिन, की प्रदक्रया को रोकना या उन्ह ेंअस्ट्वीकार करना।" xii. खडं 31 (ि) को इस प्रकार सिं ोजधत दकया िाएगा: व्यजियों या एिेंजसयों के माध्यम से जचदकत्सा मूल्यांकन एवं रेटटंग बोड ि (MARB) या राष्ट्रीय आयुर्विज्ञान आयोग पर िबाव डालने का कोई भी प्रयास, जचदकत्सा संस्ट्थान द्वारा आवेिन/अनरु ोध की प्रदक्रया को तत्काल रोक िी िाएगी या उसे अस्ट्वीकृत कर दिया िाएगा। डॉ. राघव लगं र, सजचव [जवज्ञापन-III/4/असा./692/2025-26] नोट: मलू जवजनयम भारत के रािपत्र, असाधारण, भाग III, खंड 4 म,ें सीिी-डीएल-ई-0262023-246253 दिनांक 2 िून, 2023 के माध्यम से राष्ट्रीय आयुर्विज्ञान आयोग अजधसचू ना सं. No. M-27011/01/2025-MARB(LEGAL)/NMC- In exercise of the powers conferred vide sub- section (2) of Section 57 read with Sections 26,28 and 29 of the National Medical Commission hereby makes the following draft regulations to further amend the “Establishment of New Medical Institutions, Starting of New Medical Courses, Increase of Seats for Existing Courses & Assessment & Rating Regulations, 2023” or “Establishment of New Medical Institutions, Assessment & Rating Regulations, 2023” namely – 1. (i) These regulations may be called the – “Establishment of New Medical Institutions, Starting of New Medical Courses, Increase of Seats for Existing Courses & Assessment & Rating (Amendment) Regulations, 2026” in short “Establishment of New Medical Institutions Assessment & Rating (Amendment) Regulations, 2026”. (ii) They shall come into force from the date of the publication in Official Gazette. 2. In the Establishment of Medical Institutions, Assessment & Rating Regulations, 2023 i. Clause 6 (a) shall be deleted. ii. Clause 6(g) shall be substituted by “A Company duly incorporated under the Companies Act, 2013 or any other corresponding law in force during its establishment.” iii. After Clause 6(g) and a new Clause 6(h) shall be inserted as: “A Trust registered under the respective statute meant to establish and regulate trusts in the respective State.” iv The clause 9, “No application submitted by the eligible entity shall be entertained unless it is accompanied with- ” shall be substituted by “The following documents shall be submitted by the eligible entity-”. v. The clause 9 (a) shall be substituted as: “Essentiality Certificate (EC) issued by the concerned State Government or Union Territory administration or the appropriate authority as the case may be unless otherwise specified. The EC shall be valid at the time of application. This clause shall not be applicable for established colleges applying for starting of new Post-graduate courses.” vi. The clause 9(b) shall be substituted as:[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 “A Consent of Affiliation (CoA) letter obtained from a recognized university, issued in the name of the applicant/the Medical College/ the entity in writing. The CoA shall be valid at the time of submission of application; and vii. The Clause 9 (c) shall be deleted. viii The clause 9 (d) shall be amended as: A solvency certificate based on last completed financial year issued by a Chartered Accountant within ninety days prior to the last date of invitation of the application. ix The first proviso after Explanation 3, under clause 9 shall be amended as: “Provided any incomplete applications received, meaning applications without the mandated documents specified in the present Regulation, shall not constitute a valid/eligible scheme as per Section 28(2) of National Medical Commission Act, 2019 and the same be rejected by the MARB without any opportunity as mandated under Section 28(3) of the NMC Act and clause 13 of this regulation.” x. A “new para” shall be inserted after “first para” and before “the first proviso” of the clause 15 as: “The applicant/entity shall submit an undertaking at the time of submission of application for earmarking a corpus fund dedicatedly applicable to functioning of the new medical institution. Further, all Medical Colleges already running will also have to maintain a corpus fund dedicatedly applicable to functioning of the medical college. The amount of such Corpus fund shall be determined by the Medical Assessment & Rating Board and shall be communicated through Notice. The amount of corpus fund shall be subject of revision time to time. The College will have to submit the documentary proof whenever directed by the MARB.” xi The clause 31 (c) shall be amended as: Withholding processing or rejection of application(s) for any new scheme/s or for increase in seats for that academic year or for a such number of years. xii The clause 31 (h) shall be amended as: “Any attempt to pressurize MARB or NMC through individuals or agency will lead to immediate halt of the processing or rejection of the application(s)/request(s) by the medical Institution.” Dr. RAGHAV LANGER, Secy. The National Medical Commission proposes certain amendment to “Establishment of New Medical Institutions, Assessment & Rating Regulations, 2023”. The draft Regulation amending the Regulation in Clause 6, 9, 15 and 31 have been prepared and approved by the competent authority following due procedures is hereby published for information of all stakeholders likely to be affected thereby and notice is hereby given that the said draft Regulation (amendment) shall be taken into consideration on or after the expiry of a period of thirty (30) days from the date on which the copies of the Gazette of India containing these draft Regulation (amendment) are made available to public.
