करते हुए, न्यासी बोडड, कोयला खान भजिष्य जनजध संगठन केंद्र सरकार की अनुमजत से, कोयला खान भजिष्य जनजध संगठन के पिों पर भती की जिजध के जिजनयमन हते ु, एति द्वारा जनम्नजलजखत जनयमािली जिसका नाम कोयला खान भजिष्य जनजध (कमडचारी भती) जनयमािली, 2024 होगा, बनाती ह।ैं बिते दक इस तरह के अजधक्रमण स े कोयला खान भजिष्य जनजध (कमडचारी भती) जनयम, 2024 के लागू होने स े पहले की गई दकसी भी बात, िारी दकए गए दकसी भी आिेि, की गई दकसी भी कारडिाई या प्रयोग की गई दकसी भी िजि पर कोई प्रभाि नहीं पडगे ा और इन जनयमों के िुरू होने से पहले िी गई सभी मंिूरी, आिेि, घोषणा या अन्य कारडिाई इन जनयमों के िरूु होने के बाि भी लाग ू रहगे ी, िब तक दक जििषे रूप स े उस प्राजधकारी द्वारा जिसने इस तरह की मंिूरी िी थी या ऐसे आिेि िारी दकए थ ेया ऐसा कायड दकया था, रद्द या जनरस्ट्त नहीं दकया िाता ह।ै 1578 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] बिते यह भी दक सभी मौिूिा कमडचारी अगल े आिेिों तक मौिूिा िेतन और भत्तों और सेिा की अन्य ितों के तहत ‘िैसा ह ै िहां ह’ै के आधार पर कायड करना िारी रखेंगे और यह भी दक पहले स े अजधसूजचत दकसी भी भती जनयमािली से उत्पन्न होन े िाले लाभों को उठाने का कोई जपछला मामला अजधक भगु तान की िसूली के जलए दफर स े नही खोला िाएगा। 1. सजं िप्त नाम एि ंप्रारंभ: - (1) यह जनयमािली कोयला खान भजिष्य जनजध (कमडचारी भती) जनयम, 2024 कहलाएगी। (2) यह आजधकाररक रािपत्र म ेंप्रकािन की जतजथ स ेप्रभािी होगी। 2. आििे न : - यह जनयमािली इन जनयमों के साथ संलग्न अनुसूची के कॉलम 1 में जनर्िष्टड पिों पर लाग ूहोगी। 3. पिों की सख्ं या, िगीकरण िते न मरै रक्स म ेंिते न लिे ल: - उि पिों की संख्या, उनका िगीकरण और उनसे िडु े िेतन लेिल उि अनुसूची के कॉलम 2 से 4 में जनर्िष्टड के अनुसार होगी। 4. भती की जिजध, आय ुसीमा, अहतड ा: - (1) भती की जिजध, आय ु सीमा, योग्यताए और उसस े संबंजधत अन्य मामल े उि अनुसूची के कॉलम 5 स े 13 में जनर्िडष्ट होंगे। (2) सरकारी सेिक/ सीएमपीएफओ कमडचाररयों के जलए समूह ‘क’ ि ‘ख’ के पिों के जलए आय ु सीमा में 5 िष ड की और समूह ‘ग’ के पिों के जलए 40 िषड की आय ुतक छूट िी िाएगी। ये सभी कमडचारी सीएमपीएफओ में सेिा के बराबर आयु छूट के जलए पात्र होंगे, बित े ऐसी सेिा उस पि के कतडव्यों से संबंजधत िेत्र में हो, जिसके जलए आिेिन दकया गया ह।ै (3) आयु सीमा जनधाडररत करने की महत्िपूणड जतजथ उम्मीििारों से आिेिन प्राप्त करने की अंजतम जतजथ होगी। (4) इन जनयमों के साथ संलग्न अनुसूची में उल्लेजखत पिों की भती कोयला खान भजिष्य जनजध एिं प्रकीणड उपबंध अजधजनयम, 1948 (1948 का 46)की धारा 3 क की उपधारा 2 और उपधारा 3 के अधीन भती करने के जलए सिम प्राजधकाररयों द्वारा दकया िायेगा। 5. अयोग्यता: - कोई भी व् यजि: - (1) जिसने दकसी ऐसे व्यजि के साथ जििाह अथिा जििाह के जलए अनुबंध दकया हो जिसकी पहले स े पजत या पत्नी हो अथिा (2) जिसने पजत या पत्नी के िीजित रहते हुए दकसी अन् य व्यजि स े जििाह या जििाह के जलए अनबु ंध दकया हो, जनयुजि के जलए पात्र नही होगा। परंतु यदि केन्द्रीय सरकार का यह समाधान हो िाता ह ै दक ऐसा जििाह ऐसे व्यजि और िसू रे पिकार को जििाह के जलए लागू स्ट्िीय जिजध के अधीन अनज्ञु ेय ह ैऔर ऐसा करने के जलए अन्य आधार हैं, तो िह दकसी व्यजि को इस जनयम के प्रितडन से छूट िे सकेगी। 6. सीधी भती के साथ-साथ एक समहू स े िसू रे समहू म ेंपिोन्नत होन े िालों के जलए अजनिाय ड प्रििे प्रजििण: - सीधी भर्तडयों के सभी मामलों म ें कम से कम िो सप्ताह की अिजध का अजनिायड प्रिेि प्रजििण होगा। पररिीिा की पणू डता के जलए प्रजििण का सफल समापन पूि-ड आिश्यकता होगी। प्रजििण का पाठ्यक्रम कोयला खान भजिष्य जनजध संगठन द्वारा समय- समय पर जनधाडररत पाठ्यक्रम रहगे ा। एक समूह स े िसू रे समूह में पिोन्नत होने िाले सभी मामलों के जलए भी कम से कम िो सप्ताह की अिजध का समान अजनिायड प्रजििण होगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 7. िररष्ठों पर जिचार: - िहां कजनष्ठों जिन्होंन े अहकड / पात्र सिे ा पूण ड की हो, को पिोन्नजत के जलए जिचार दकया िा रहा हो िहााँ उनके िो िररष्ठों पर भी जिचार दकया िायेगा बितें दक उन्होंने पूिड-आिश्यक अहकड / पात्र सेिा में अहकड / पात्र सेिा के आधे से कम या िो िषड िो भी कम हो, और पिोन्नजत के जलए अगले उच्चतम ग्रडे के जलए पररिीिा सफलतापूिडक पूणड की हो। 8. जिभागीय पिोन्नजत सजमजत/ चयन सजमजत का गठन:- इन जनयमों के प्रयोिन के जलए केंद्र सरकार द्वारा समय-समय पर िारी अनिु ेिों के अनुसार, िें पि जिनकी भती केंद्र सरकार द्वारा की िानी हैं, उसकी जिभागीय पिोन्नजत सजमजत/ चयन सजमजत का गठन उनके द्वारा दकया िायेगा और िेष पिों के जलए कोयला खान भजिष्य जनजध आयुि द्वारा दकया िायेगा। यदि आिश् यक हो तो दकसी भी अजतररक्त सिस्ट् य को अध् यि के अनुमोिन से सहयोजित दकया िा सकता ह।ै यदि आिश्यक हो तो दकसी भी अजतररि सिस्ट्य को अध्यि के अनुमोिन से सहयोजित दकया िा सकता है 9. िहा ं इन जनयमों म ें कोई प्रािधान नहीं ह ैं या अपयाडप्त प्रािधान ह,ैं केंद्र सरकार द्वारा समय-समय पर केंद्र सरकार के कमडचाररयों के संबंजधत श्रेणी के जलए िारी जनयम या अनिु िे यथा संिोजधत, आिश्यक पररितडनों सजहत कोयला खान भजिष्य जनजध संगठन के कमडचाररयों पर लागू होन े िैसे िो इन जनयमों में समाजिष्ट ह।ैं 10. प्रारजम्भक गठन: - दकसी पि को हटाने/उन्नयन/नाम बिलन े के कारण, ऐस े पिों पर आरूढ़ अजधकाररयों की सेिा अनुमोदित संिगड समीिा में जनर्िडष्ट सेिा भती जनयमों की अजधसूचना िारी होने स े पहले ऐसे अजधकाररयों द्वारा की गई जनयजमत सेिा की गणना करने के जलए की िाजमल करन े की आिश्यकता ह।ै 11. इन जनयमों के तहत पिोन्नजत के जलए अहतड ा प्राप्त करने िाली सेिा की अिजध को ररजि िषड के 1 िनिरी को फीडर ग्रेड में जनयजमत सेिा के िषड परू े दकए िाएगं े यदि ररजि 1 िनिरी से 30 िून (िोनों जतजथ समाजिष्ट) और 1 िलु ाई से 31 दिसंबर (िोनों जतजथ समाजिष्ट) के बीच होती ह।ै 11.1 ररजि िषड कैलडं र िषड आधाररत होगा तथा जिभागीय पिोन्नजत सजमजत की बैठक आिश्यकता अनुसार होगी। 12. मौििू ा पात्रता सिे ा का प्रजतधारण: - िब भी पात्रता सेिा को ऊपर की ओर संिोजधत दकया िाता हैं, तो यह इन जनयमों की अजधसूचना की तारीख के अनुसार जनयजमत आधार पर फीडर पि रखन े िाल े व्यजियों के जलए समान बना रहगे ा। 13. जिजथल करन ेकी िजिया:ं - िहां जनयुजि प्राजधकारी की यह राय में आिश्यक हो या समीचीन हो, तो िो आिेि द्वारा तथा उन कारणों को जलजखत रूप म ें िि ड करत े हुए, व्यजियों के दकसी िगड अथिा श्रणे ी के संबंध में इन जनयमों के दकसी प्रािधान में छूट ि े सकता ह।ैं 14. सरं िण: - इन जनयमों की कोई भी बात इस संबंध म ें केंद्र सरकार द्वारा समय-समय पर िारी आिेिों के अनुसार अनुसूजचत िाजतयों, अनुसूजचत िनिाजतयों, पूिड सैजनकों और अन्य जििेष श्रणे ी के व्यजियों के जलए आरिण, आय ु सीमा म ें छूट और प्रिान की िाने िाली आिश्यक अन्य ररयायत को प्रभाजित नहीं करेगी। जििय कुमार जमश्र, आयुक्त , प्रजतित 11. पिोन्नजत, प्रजतजनयुजि/ अंतरण के पिोन्नजत िेत्रीय आयुि-I िते न मैररक्स के लेिल-12 में 5 िषो की जनयजमत सेिा मामलें म ें पिोन्नजत, प्रजतजनयुजि/ के साथ। अंतरण के ग्रडे जिससे दकया िाना ह ैं की अिजध जिसमें केंद्र सरकार के उसी या दकसी अन्य संगठन या जिभाग में इस जनयुजि से ठीक पहल े धाररत दकसी अन्य पूिड-कैडर पि म ें जबताई गई प्रजतजनयुजि की अिजध िाजमल ह,ै आमतौर पर 5 िषड स ेअजधक नहीं होगी। 2. उसका संयोिन क्या 1. अपर सजचि - अध्यि होगा? 2. संयुि सजचि - सिस्ट्य 3. आयुक् त, सीएमपीएफओ - सिस्ट्य 13. भती करते समय दकन पररजस्ट्थजतयो में संघ लोक सेिा आयोग से परामिड की आिश्यकता नहीं ह।ैं संघ लोक सेिा आयोग से परामि ड दकया िाएगा। सीएमपीएफओ म ेंित्रे ीय आयिु -I के पि के जलए भती जनयम 1. पि का नाम ित्रे ीय आयिु -I 2. पिों की संख्या 19* (2023) *कायडभार के अनसु ार पररितडनीय 3. िगीकरण समूह ‘क’ 4. िेतन सीए, आईसीडब्लूए, सीएफए, एमबीए (जित् त्त) या समकि योग् यता। िाछं नीय केंद्र सरकार/ केंद्रीय स्ट् िायत जनकाय के िैसे अजधकारी िो जित्त एिं लेखा के िेत्र में 5 िषड का अनुभि रखते हों। नोट: 1. प्रजतजनयुजि की अिजध जिसमें केंद्र सरकार के उसी या दकसी अन्य संगठन या जिभाग म ें इस जनयुजि से ठीक पहले धाररत दकसी अन्य पूिड-कैडर पि म ें जबताई गई प्रजतजनयुजि की अिजध िाजमल ह,ै आमतौर पर 5 िष डसे अजधक नहीं होगी। 2. Provided that such supersession shall not affect anything done, any order issued, any action taken or any power exercised before coming into force of the Coal Mines Provident Fund (Employees’ Recruitment) Rules, 2024 and all sanctions, orders, declarations or other action taken before the commencement of the Rules shall continue to be operative and in force, even after commencement of these Rules, unless specifically cancelled or revoked by the authority who accorded such sanctions or issued such orders or took such action. Provided further that all the existing employees shall continue to function on as-is-where-is basis under the existing pay and allowances and other conditions of service until further orders and also that no past cases of availing benefits arising out of any RRs notified previously shall be reopened for recovery of excess payment. 1. Short title and commencement: - (1) These Rules may be called the Coal Mines Provident Fund (Employees’ Recruitment) Rules, 2024. (2) They shall come into force from the date of their publication in Official Gazette. 2. Application: – These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules. 3. Number of posts, classification and level of pay in pay Matrix: - The number of said posts, their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule. 4. Method of recruitment, age limit, qualifications etc.- (1) The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 13 of the aforesaid Schedule; (2) The age limit shall be relaxable for Government servant/ CMPFO employees up to 5 years in appointment to Group A and Group B posts and up to the age of 40 years in appointment in Group C posts. The employees of CMPFO will be eligible for further age relaxation equivalent to completed years of services in CMPFO, provided that such service is in a field relevant to duties of post for which the application is made. (3) The crucial date for determining the age limit shall be the closing date for receipt of applications from candidates. (4) Recruitment to the posts mentioned in the Schedule annexed to these rules shall be made by authorities competent to make appointment under sub-section (2) and sub-section (3) of Section 3C of the Coal Mines Provident Fund and Miscellaneous Provisions Act, 1948 (46 of 1948). 5. Disqualification: - No person- (a) Who has entered into or contracted a marriage with a person having a spouse living, or (b) Who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule. 6. Mandatory induction training for direct recruits as well as those being promoted from one Group to another Group: There shall be mandatory induction training of at least two weeks duration in all cases of direct recruitment. Successful completion of the training shall be a pre-requisite for completion of probation. The syllabus for training shall be as prescribed by Coal Mines Provident Fund Organisation from time to time. Consideration of seniors: Where juniors who have completed their qualifying / eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying / eligibility service by more than half of such qualifying /eligibility service or two years whichever is less, and have successfully completed probation period for promotion to the next higher grade. 8. Constitution of Departmental Promotion/Selection Committee: - Departmental Promotion Committee (s)/Selection Committees(S) shall be constituted by the Central Government for posts to which recruitment is made by them and by the Coal Mines Provident Fund Commissioner for the remaining posts, for purpose of these rules in accordance with Government instructions issued from time to time. Any additional member, if required, may be co- opted with the approval the Chair. 9. Where no provision or insufficient provision exists in these rules, the rules or instructions framed or issued by the Central Government from time to time on the subject for the corresponding category of Central Government servants shall mutatis mutandis apply to the employees of the Coal Mines Provident Fund Organisation as covered by these rules. 10. Initial Constitution: - Owing to abolition/upgradation/renaming of a post, the officials in such posts are required to be included in the service of the posts as specified in the approved Cadre Review so as to count the regular service rendered by such officials before the date of notification of the Recruitment Rules. 11. The period of service that will qualify for promotion under these Rules shall be completed years of regular service in the feeder grade as on 1st January of the vacancy year if the vacancy occurs between 1st January to 30th June (both dates inclusive) and 1st July of the vacancy year if the vacancy occurs between 1st July to 31st December (both dates inclusive). 11.1 The vacancy year shall be the Calendar years based, and the DPC is to be held as and when required. 12. Retention of the existing eligibility service: Whenever the eligibility service has been revised upwards, it shall continue to be the same for persons holding the feeder posts on regular basis as on the date of notification of these Rules. 13. Powers to relax: - Where the Appointing Authority is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 14.
