बोट्टल-बीलौर सड़क और मनसार झील, उत्तर पक्षिम में तवी नदी और सुरीनसार झील के बीच 97.82 वग व ककलोमीटर के िेत्र म ें अवक्षथित ह।ै अभयारण्य तीन क्षजलों जम्मू-उधमपुर और साांबा में फैला हुआ ह ैऔर मुख्य भाग जम्मू और कश्मीर सांघ राज्य िेत्र के जम्मू क्षजला में पड़ता है; और, सुरीनसार–मनसार वन्यजीव अभयारण्य अक्षधसूचना सांख्या एसआरओ 138 कदनाांक 10 अप्रैल, 1990 के द्वारा वन्यजीव अभयारण्य घोक्षित ककया गया िा। अभयारण्य में प्रक्षतरूप सुरीनसार और मनसार झील भी शाक्षमल है क्षजसे 2005 में अन्द्तरााष्ट्रीर् महत्त्व की रामसर आर्द्भव ूक्षम सूची में जोड़ा गया िा और भारत सरकार के राष्ट्रीय आर्द्भव ूक्षम सांरिण कायवक्रम में भी शाक्षमल ककया गया ह;ै और, िेत्र क्षवक्षभन्न जांगली वनथपक्षत और जीवजांतु प्रजाक्षतयों के प्रवधवन, सांरिण और थिायीकरण के क्षलए “जीन पूल” का प्रक्षतक्षनक्षधत्व करता ह।ै सुरीनसार-मनसार वन्यजीव अभयारण्य से अक्षभक्षलक्षखत की गई जीवजांतु प्रजाक्षतया ां में थतनधाररयों की 15 प्रजाक्षतया,ां पक्षियों की 86 प्रजाक्षतयाां, सरीसृपों की 17 प्रजाक्षतया,ां मछक्षलयों की 8 प्रजाक्षतया ां(कोटवल.2012) शाक्षमल हैं; और, सुरीनसार–मनसार वन्यजीव अभयारण्य और इसके क्षनकटवती वन िेत्र को समृद्ध वन्यजीव और लुप्तप्राय वनथपक्षत और जीवजांतु जैसे भारतीय लॉन्ग क्षबल्लड क्षगद्ध (क्षजप्स इांक्षडकस), करते हुए, केंर्द् शाक्षसत प्रििे जम्मू कश्मीर के जम्मू क्षजला के सुरीनसार–मनसार वन्यजीव अभयारण्य की सीमा के चारों ओर (0) शून्य से 3.459 ककलोमीटर तक 72.42 वगव ककलोमीटर जवस्ट्ताररत क्षेत्र सुरीनसार–मनसार वन्यजीव अभयारण्य के पाररजस्ट्थजतकी संवेिी िोन (जिसे इसम ें इसके पश् चात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप में अजधसूजचत करती है, जिसका जववरण जनम्नानुसार ह,ै नामत: :- 1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और सीमा.-(1) सुरीनसार–मनसार वन्यजीव अभयारण्य की सीमा के चारों ओर शून्य स े 3.459 ककलोमीटर तक के क्षवथतार के साि पाररजस्ट्थजतकी संवेिी िोन 72.42 वगव ककलोमीटर होगा। सुरीनसार–मनसार वन्यजीव अभयारण्य के पक्षिमी भाग पर नांदानी वन्यजीव अभयारण्य के साि क्षनकटवती सीमा के कारण पाररजस्ट्थजतकी संवेिी िोन का शून्य क्षवथतार है। (2) सुरीनसार–मनसार वन्यजीव अभयारण्य और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का क्षववरण अनलु ग्नक-I के रूप में सांलग्न ह।ै (3) सीमा जववरण और अक्षांशों और ििे ांतरों के साथ पाररजस्ट्थजतकी संवेिी िोन को सीमांककत करते हुए वन्यजीव अभयारण्य के मानजचत्र अनुलग्नक -IIक, अनलु ग्नक -IIख और अनलु ग्नक -IIग के रूप में सांलग्न ह।ै (4) सुरीनसार–मनसार वन्यजीव अभयारण्य और पाररजस्ट्थजतकी संवेिी िोन की सीमा के भू-जनििे ाकं ों की सूची अनुलग्नक -III की सारणी क और सारणी ख में िी गई ह।ै (5) मुख्य सबांदओंु पर भ-ू क्षनदशे ाांकों के साि पाररक्षथिक्षतकी सांवेदी जोन के अांतगवत आन ेवाले ग्रामों की सूची अनलु ग्नक-IV के रूप में सांलग्न ह।ै 2. पाररजस्ट्थजतकी सवं ेिी िोन के जलए आचं जलक महार्ोिना.–(1) केंर्द् शाक्षसत प्रदशे सरकार, द्वारा पाररजस्ट्थजतकी संवेिी िोन के प्रर्ोिन के जलए, रािपत्र म ेंइस अजधसूचना के प्रकािन की तारीख स ेिो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा से और इस अजधसूचना में दिए गए अनुबंधों का पालन करते हुए, केंर्द् शाक्षसत प्रििे सरकार के सक्षम प्राजधकारी के अनुमोिनाथा एक आंचजलक महार्ोिना बनाई िार्ेगी। (2) केंर्द् शाक्षसत प्रदशे सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना इस अजधसूचना में जवजनर्िष्ा ट रीजत स े तथा प्रासजं गक केंरीर् और केंर्द् शाक्षसत प्रििे जवजधर्ों के अनुरूप तथा केंरीर् सरकार द्वारा िारी दििा जनििे ों, र्दि कोई हों, के अनुसार बनार्ी िाएगी। (3) आंचजलक महार्ोिना में पाररजस्ट्थजतकी और पर्ाावरण संबंधी सरोकारों को िाजमल करने के जलए इसे केंर्द् शाक्षसत प्रदशे सरकार के जनम्नजलजखत जवभागों के परामिा से बनार्ा िाएगा, अथाात्:- (i) पयाववरण, पाररक्षथिक्षतकी और ररमोट सेंससांग;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) वन; (iii) कृजष; (iv) राजथव; (v) शहर और नगर पाक्षलका; (vi) पयवटन क्षवभाग के अांतगवत सुरीनसार-मनसार क्षवकास प्राक्षधकरण; (vii) ससंचाई और बाढ़ जनर्ंत्रण; (viii) अजधसूजचत नगर क्षेत्र सजमजत; (ix) ग्रामीण जवकास और पंचार्ती राि; (x) लोक जन मााण जव भाग। (4) िब तक इस अजधसूचना में जवजनर्िष्टा न हो, आंचजलक महार्ोिना में वतामान में अनुमोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना में सभी अवसंरचनाओं और दक्रर्ाकलापों में सुधार करके उन्द्ह ेअजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनाने की व्यवस्ट्था की िाएगी। (5) आंचजलक महार्ोिना में वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के संरक्षण, िलग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भ-ू िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्द्र् पहलुओं की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै (6) आंचजलक महार्ोिना में सभी जवद्यमान पूिा स्ट् थलों, ग्रामों एवं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एवं दकस्ट् मों, कृजष क्षेत्रों, ऊपिाऊ भूजम, उद्यानों एवं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्द्र् िल जनकार्ों की सीमा का सहार्क मानजचत्र के साथ जनधाारण दकर्ा िाएगा और मौजूदा और प्रस्ट्ताजवत भू-उपर्ोग की जविेषताओं का ब्र्ौरा भी दिर्ा िाएंगा। (7) आंचजलक महार्ोिना में पाररजस्ट्थजतकी संवेिी िोन में होने वाले जवकास का जवजनर्मन दकर्ा िाएगा और सारणी में र्थासूचीबद्ध पैराग्राफ 4 में प्रजतजषद्ध एव ं जवजनर्जमत दक्रर्ाकलापों का पालन दकर्ा िाएगा और इसमें स्ट् थानीर् िनता की आिीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-अनुकूल जवकास का भी सुजनश्चर् एवं संवधान दकर्ा िाएगा। (8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी । (9) अनुमोदित आंचजलक महार्ोिना, जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि होगी तादक वह इस अजधसूचना के उपबंधों के अनसु ार जनगरानी के अपने कताव्यों का जनवाहन कर सके । 3. केंर्द् शाक्षसत प्रदशे सरकार द्वारा दकए िान ेवाल ेउपार्.- केंर्द् शाक्षसत प्रदशे सरकार इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत उपार् करेगी, अथाात्:- (1) भ-ू उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन में वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के जलए जचजन्द्हत उद्यानों और खुल े स्ट्थानों का वृहि वाजणजयर्क र्ा आवासीर् पररसरों र्ा औद्योजगक दक्रर्ाकलापों के जलए प्रर्ोग र्ा संपररवतान अनुमत नहीं दकर्ा िाएगा: परंतु पाररजस्ट्थजतकी संवेिी िोन के भीतर ऊपर भाग (क), में जवजनर्िष्टा प्रर्ोिन से जभन्न प्रर्ोिन के जलए कृजष और अन्द्र् भूजम का संपररवतान, जनगरानी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा अनुमोिन स े क्षेत्रीर् नगर र्ोिना अजधजनर्म तथा र्था लाग ूकेन्द्रीर् सरकार एवं केंर्द् शाक्षसत प्रदशे सरकार के अन्द्र् जनर्मों एवं जवजनर्मों के अधीन तथा इस अजधसूचना के उपबंधों के अनुसार स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् िरूरतों को पूरा करने के जलए अनुमत दकर्ा िाएगा िैसे:- (i) जवद्यमान सड़कों को चौड़ा करना, उन्द्हें सुिढ़ृ करना और नई सड़कों का जनमााण करना; (ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमाणा और नवीकरण;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (iii) प्रिषू ण उत्पन्न न करने वाले लघु उद्योग; (iv) कुटीर उद्योग एवं ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन में सहार्क सुजवधा भण्डार और स्ट्थानीर् सुजवधाएं तथा गृह वास; और (v) पैराग्राफ-4 में उजल्लजखत बढ़ावा दिए गए दक्रर्ाकलापः परंतु र्ह भी दक क्षेत्रीर् िहरी जनर्ोिन अजधजनर्म के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन के जबना तथा केंर्द् शाक्षसत प्रदशे सरकार के अन्द्र् जनर्मों एवं जवजनर्मों एवं सजं वधान के अनच्ु छेि 244 के उपबंधों तथा तत्समर् प्रवृत्त जवजध, जिसके अंतगात अनुसूजचत िनिाजत और अन्द्र् परंपरागत वन जनवासी (वन अजधकारों की मान्द्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै का अनुपालन दकए जबना वाजणजयर्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का प्रर्ोग अनुमत नहीं होगा: परंतु र्ह भी दक पाररजस्ट् थजतकी संवेिी िोन के अंतगात आने वाली भजू म के अजभलेखों में हुई दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पश्चात्, केंर्द् शाक्षसत प्रदशे सरकार द्वारा प्रत्र्के मामल ेमें एक बार सुधारा िाएगा और उि त्रुरट को सुधारने की सूचना केंरीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को िी िाएगी: परंतु र्ह भी दक उपर्ुाि त्रुरट को सुधारने में, इस उप-पैरा में र्था उपबंजधत के जसवार्, दकसी भी ििा में भ-ू उपर्ोग का पररवतान िाजमल नहीं होगा। (ख) अनुप्रर्ुक्त र्ा अनुत् पािक कृजष क्षेत्रों में वनीकरण तथा पर्ाावासों की बहाली के कायवकलापों से पुन: वनीकरण के प्रर्ास दकए िाएंग।े (2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी और आंचजलक महार्ोिना में उनके संरक्षण और बहाली की र्ोिना सज‍ मजलत की िाएगी और केंर्द् शाक्षसत प्रदशे सरकार द्वारा कदशा-क्षनदशे इस रीक्षत से तैयार ककए जाएांग े दक उसमें ऐसे क्षेत्रों में या उसके पास जवकास दक्रर्ाकलापों को प्रजतजषद्ध और जनबंजधत दकर्ा गर्ा हो । (3) पर्टा न एव ं पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संवेिी िोन में सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन सांबांधी पर्ाटन महार्ोिना के अनुसार अनुमत होगा। (ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना केन्र्द् शाक्षसत प्रदशे सरकार के पर्ाावरण और वन जवभाग के परामिा से पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबंधी दक्रर्ाकलाप जन‍ नानुसार जवजनर्जमत दकए िाएंगे, अथाात्:- (i) सांरक्षित िेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, दकसी होटल र्ा ररिॉटा का नर्ा सजन्नमाणा अनुमत नहीं दकर्ा िाएगाः परंतु र्ह, पाररजस्ट्थजतकी पर्ाटन सुजवधाओं के जलए सांरक्षित िेत्र की सीमा से एक दकलोमीटर की िरू ी से परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक पूवा पररभाजषत और अभीजहत क्षेत्रों में पर्ाटन महार्ोिना के अनुसार, नए होटलों और ररिॉटा की स्ट्थापना अनुमत होगी; (ii) पाररजस्ट्थजतकी संवेिी िोन के अन्द्िर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा िारी दििाजनििे ों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िने े वाले राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनििे ों (समर्-समर् पर र्था संिोजधत) के अनुसार होगा; (iii) आंचजलक महार्ोिना का अनुमोिन होने तक, पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन में दकसी नए होटल/ ररिॉटा र्ा वाजणजयर्क प्रजतष्ठान का संजन्नमाणा अनुमत नहीं होगा ।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेिी िोन के अंतगात आने वाले बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पूल ररिवा क्षेत्र, िैल संरचना, िल प्रपात, झरने, िरे, उपवन, गुफाएं, स्ट्थल, वनपथ, रोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एवं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (5) मानव जनर्मता जवरासत स्ट् थल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनके संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप में एक जवरासत संरक्षण र्ोिना बनार्ी िाएगी। (6) ध् वजन प्रिषू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में जनर्त उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिषू ण की रोकिाम और जनर्ंत्रण ककया जाएगा । (7) वार् ु प्रिषू ण.- पाररजस्ट्थजतकी संवेिी िोन में, वार्ु प्रिषू ण का जनवारण और जनर्ंत्रण, वार्ु (प्रिषू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार दकर्ा िाएगा । (8) बजहस्राव का क्षनथसरण.- पाररजस्ट्थजतकी संवेिी िोन में उपचाररत बजहस्राव का जनस्ट्सरण, पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर् प्रिषू ण के जनस्ट्सरण के जलए साधारण मानकों र्ा केंर्द् शाक्षसत प्रदशे सरकार द्वारा जनर्त मानकों, िो भी अजधक किोर हो, के उपबंधों के अनुसार होगा। (9) िोस अपजिष्ट.- िोस अपजिष्ट का जनपटान एवं प्रबन्द्धन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन में िोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं. का.आ. 1357(अ), दिनांक 8 अप्रैल, 2016 के तहत प्रकाजित िोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्द्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा; (ख) पाररजस्ट्थजतकी संविे ी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) अनमु त दकर्ा िार्ेगा। (10) िैव जचदकत्सा अपक्षशष्ट.- िैव जचदकत्सा अपजिष् ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा:- (क) पाररजस्ट्थजतकी संवेिी िोन म ेंिैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्–समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के तहत प्रकाजित िैव जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संविे ी िोन म ें मान्द्र् प्रौद्योजगदकर्ों का प्रर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के अनुरूप जैव क्षचककत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण अनुकूल प्रबंधन अनुमत दकर्ा िार्ेगा। (11) प्लाजस्ट्टक अपजिष्ट का प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख 18 माचा, 2016 के तहत प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधो के अनुसार दकर्ा िाएगा। (12) जनमाणा और जवध्वसं अपजिष्ट का प्रबंधन.- पाररजस्ट्थजतकी संवेिी िोन में जनमााण और जवध्वंस अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्था संिोजधत अजधसूचना सं.सा.का.जन 317(अ), तारीख 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित तथा समर्-समर् पर र्था संिोजधत ई–अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा। (14) सड़क-र्ातार्ात.- सड़क-र्ातार्ात को पर्ाावास-अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेष उपबंध िाजमल दकए िाएंगे। आंचजलक महार्ोिना के तैर्ार होने और केंर्द् शाक्षसत प्रदशे सरकार के सक्षम प्राजधकारी से अनुमोदित होने तक, जनगरानी सजमजत प्रासजं गक अजधजनर्मों और उनके तहत बनाए गए जनर्मों एवं जवजनर्मों के अनुसार सड़क-र्ातार्ात के अनुपालन की जनगरानी करेगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (15) वाहन िजनत प्रिषू ण.- वाहन िजनत प्रिषू ण की रोकथाम और जनर्ंत्रण लाग ू जवजधर्ों के अनुसार दकर्ा िाएगा और स्ट्वच्छतर ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे। (16) औद्योजगक ईकाइर्ा.ं- (क) सरकारी रािपत्र में इस अजधसूचना के प्रकािन की तारीख को र्ा उसके बाि पाररजस्ट्थजतकी संवेिी िोन में दकसी नए प्रिषू णकारी उद्योग की स्ट्थापना की अनुमक्षत नहीं होगी। (ख) केन्र्द्ीय प्रदिू ण क्षनयांत्रण बोडव द्वारा फरवरी, 2016 में जारी मागवदशवक क्षसद्धान्तों में उद्योगों के वगीकरण के अनुसार, जब तक कक अक्षधसूचना में इस प्रकार क्षवक्षनर्दष्टव न हो, समर्-समर् पर संिोजधत दकर्ा िाएगा; पाररक्षथिक्षतकी सांवेदी जोन के भीतर केवल गैर- प्रदिू णकारी उद्योगों को अनुज्ञात ककया जाएगा और इसके अक्षतररक्त, गैर प्रदिू णकारी उद्योगों को बढ़ावा कदया जाएगा। (17) पहाड़ी ढलानों का संरक्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकर्ा िाएगा:- (क) आंचजलक महार्ोिना में पहाड़ी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनमें दकसी भी संजनमााण की अनज्ञु ा नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खड़ी पहाड़ी ढलानों में अत्र्जधक भू-क्षरण होता ह ैउनमें दकसी भी सजं नमााण की अनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं ेिी िोन म ें प्रजतजषद्ध र्ा जवजनर्जमत दकए िान े वाले दक्रर्ाकलापों की सचू ी- पाररजस्ट्थजतकी संवेिी िोन में सभी दक्रर्ाकलाप, पर्ाावरण अजधजनर्म और उसके अधीन बने जनर्मों के उपबंधों जिसमें तटीर् जवजनर्मन िोन, 2011 एवं पर्ाावरणीर् प्रभाव आकलन अजधसूचना, 2006 िाजमल है सजहत वन (संरक्षण) अजधजनर्म, 1980 (1980 का 69), भारतीर् वन अजधजनर्म, 1927 (1927 का 16), वन्द्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), अन्द्र् लागू जनर्मों तथा उनमें दकए गए संिोधनों के अनुसार िाजसत होंगे और नीचे िी गई सारणी म ेंजवजनर्िष्टा रीजत से जवजनर्जमत होंगे, अथाात:्- सारणी क्रम स.ं दक्रर्ाकलाप रटप्पणी क. प्रजतजषद्ध दक्रर्ाकलाप 1. वाजणजयर्क खनन, पत्थर उत्खनन (क) पाररजस्ट्थजतकी संवेिी िोन के अंतगात वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की और अपघषाण इकाइर्ां । घरेलू आवश्र्कताओं जिसमें मकानों के संजनमााण र्ा मर‍मत के जलए धरती को खोिना सज‍मजलत है, के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघु और वृहत खजनि), पत्थर उत्खनन और अपघषाण इकाइर्ां तत्काल प्रभाव से प्रजतजषद्ध होंगी; (ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) सं. 202 म ें टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले में माननीर् उच्चतम न्द्र्ार्ालर् के आदशे 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) सां. 435 में गोवा फाउंडेिन बनाम भारत संघ के मामले म ेंतारीख 21 अप्रैल, 2014 के आििे के अनुसरण में होगा । 2. प्रिषू ण (िल, वार्ु, मृिा, ध्वजन, आदि) पाररजस्ट्थजतकी संवेिी िोन म ें कोई नर्ा उद्योग लगाने और वतामान उत्पन्न करने वाले उद्योगों की स्ट्थापना प्रिषू णकारी उद्योगों का जवस्ट्तार करने की अनमु जत नहीं होगीः । परन्तु यह कक केन्र्द्ीय प्रदिू ण क्षनयांत्रण बोडव द्वारा फरवरी, 2016 में जारी माग व दशवक क्षसद्धान्तों में उद्योगों के वगीकरण के अनुसार जब तक कक अक्षधसूचना में ऐसा क्षवक्षनर्दष्टव न हों, समर्-समर् पर संिोजधत दकर्ा िाएगा; पाररक्षथिक्षतकी सांवेदी जोन के भीतर गैर-प्रदिू णकारी उद्योगों को अनुज्ञात ककया जाएगा और इसके अक्षतररक्त गैर-प्रदिू णकारी कुटीर उद्यागों को बढ़ावा कदया जाएगा। 3. बड़ी िल जवद्युत पररर्ोिनाओं की प्रजतजषद्ध। स्ट्थापना ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा जमलों का जवस्ट्तार अनुमत नहीं होगा । 7. ईंट भट्टों की स्ट्थापना करना। प्रजतजषद्ध। 8. िलावन लकड़ी का वाजणजयर्क प्रक्षतक्षिद्ध। उपर्ोग। ख.जवजनर्जमत दक्रर्ाकलाप 9. होटलों और ररसोटों की वाजणजयर्क पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघु अस्ट्थार्ी संरचनाओं के जनमााण स्ट्थापना । के जसवार्, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, नए वाजणजयर्क होटलों और ररसोटो की स्ट्थापना अनुमत नहीं होगी: परंतु, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनमें िो भी अजधक जनकट हो, पर्ाटन महार्ोिना और लागू दििाजनििे ों के अनुसार सभी नए पर्ाटन दक्रर्ाकलाप करने र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करने की अनुज्ञा होगी । 10. संजनमाणा दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का वाजणजयर्क संजनमाणा अनुमत नहीं दकर्ा िाएगा: परंतु स्ट् थानीर् लोगों को पैराग्राफ 3 के उप पैराग्राफ (1) में सूचीबद्ध दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम में स्ट्थानीर् क्षनवाक्षसयों की आवासीर् आवश्र्कताओं को पूरा करने के जलए संजनमाणा करने की अनुमक्षत भवन उपजवजधर्ों के अनुसार िी िाएगी। परन्द्तु ऐसे लघु उद्योगों िो प्रिषू ण उत् पन्द् न नहीं करते ह,ैं से संबंजधत संजनमाणा दक्रर्ाकलाप जवजनर्जमत दकए िाएंगे और लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमक्षत से ही न्द् र्ूनतम पर रखे िाएंगे । (ख) एक दकलोमीटर से आगे आंचजलक महार्ोिना की अनुसार जवजनर्जमत होंगे । 11. गैर प्रिषू णकारी लघु उद्योग। फरवरी, 2016 में केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी उद्योगों म ें वगीकरण के अनुसार समर्-समर् पर संिोजधत दकर्ा िाएगा दक गैर- प्रिषू णकारी उद्योग और अपररसंकटमय में, लघु और सेवा उद्योग, कृजष, पुष्प कृजष, उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन से ििे ी सामग्री से उत्पािों को उत्पन्न करने वाले कृजष आधाररत उद्योग सक्षम प्राजधकारी द्वारा अनुज्ञात होंगे। 12. वृक्षों की कटाई । (क) केंर्द् शाक्षसत प्रििे सरकार में सक्षम प्राजधकारी की पूव ा अनुमक्षत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई केंरीर् र्ा संबंजधत केंर्द् शाक्षसत प्रििे के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । 13. वन उत्पािों और गैर काष्ठ वन उत्पािों लागू जवजधर्ों के अधीन जवजनर्जमत होगा । का संग्रहण । 14. जवद्युत और संचार टॉवर लगाने, तार- लागू जवजधर्ों के अधीन जवजनर्जमत होगा (भूजमगत केबल जबछाने को बढ़ावा जबछाने तथा अन्द्र् बुजनर्ािी ढांचे की दिर्ा िाएगा)।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 जवजनर्जमत होगा । संरक्षण । 19. राजत्र में वाहन र्ातार्ात का संचलन । लागू जवजधर्ों के अधीन वाजणजयर्क प्रर्ोिन के जलए जवजनर्जमत होगा । 20. स्ट्थानीर् िनता द्वारा अपनार्ी िा स्ट्थानीर् िनता के प्रर्ोग के जलए लागू जवजधर्ों के अधीन अनुमत होंगे। रही वतामान कृजष और बागवानी पद्धजतर्ों के साथ डेर्ररर्ां, िग्ुध उत्पािन, िल कृजष और मत्स्ट्र् पालन। 21. प्राकृजतक िल जनकार्ों र्ा भू क्षेत्र में िल जनकार्ों में उपचाररत अपजिष्ट िल/बजहस्रााव के जनस्ट्सरण से बचा उपचाररत अपजिष्ट िल/बजहस्रााव का िाएगा और उपचाररत अपजिष्ट िल के पुनचाक्रण और पुन:उपर्ोग के प्रर्ास जनस्ट्सरण । दकए िाएंगे अन्द्र्था उपचाररत अपजिष्ट िल/बजहस्रााव का जनस्ट्सरण लागू जवजधर्ों के अनुसार जवजनर्जमत दकर्ा िाएगा। 22. सतही और भूिल का वाजणजयर्क लागू जवजधर्ों के अधीन जवजनर्जमत होगा । प्रर्ोग एवं जनष्कषाण । 23. फमों, कारपोरेट और कंपजनर्ों द्वारा स्ट्थानीर् आवश्र्कताओं को पूरा करने के अलावा लाग ू जवजधर्ों के अधीन बड़े पैमाने पर वाजणजयर्क पिुधन जवजनर्जमत (अन्द्र्था उपबांध को छोड़कर) होंग े। संपिा और कुक्कुट फामों की स्ट्थापना । 24. कृजष और अन्द्र् उपर्ोग के जलए खुले क्षवक्षनयक्षमत एवां स‍बद्ध प्राजधकारी द्वारा दक्रर्ाकलापों की सख्ती से क्षनगरानी कुंआ, बोर कुंआ, आदि । की जाएगी। 25. िोस अपजिष् ट का प्रबंधन। लागू जवजधर्ों के अधीन जवजनर्जमत होगा । 26. पाररजस्ट्थजतकी पर्ाटन। लागू जवजधर्ों के अधीन जवजनर्जमत होगा । 27. वाजणजयर्क संकेत बोडा और होर्डंग का लागू जवजधर्ों के अधीन जवजनर्जमत होगा । प्रर्ोग । 28. पोजलथीन बैगों का उपर्ोग । । 5. पाररजस्ट्थजतकी-सवं ेिी िोन अजधसूचना की जनगरानी के जलए जनगरानी सजमजत.- पर्ाावरण (संरक्षण) अजधजनर्म, 1986 की धारा 3 की उपधारा (3) के तहत इस अक्षधसूचना के उपबांधों की प्रभावी क्षनगरानी के क्षलए केन्र्द्ीय सरकार एतद्वारा एक क्षनगरानी सजमजत का गिन करेगी िो जनम्नजलजखत स ेजमलकर बनेगी, अथाात्: क्र.स.ं क्षनगरानी सजमजत का गिन पि 1. संभागीर् आर्ुि, ि‍मू अध्र् क्ष; 2. जिला कलेक्टर / उपार्ुि उधमपुर / ि‍मू / सांबा सिस्ट्र्; 3. क्षेत्रीर् वन्द्र्िीव वाडान, ि‍मू क्षेत्र, ि‍मू सिस्ट्र्; 4. वन, पाररजस्ट्थजतकी और ररमोट सेंससंग जवभाग, ि‍मू और कश्मीर सरकार र्ा सिस्ट्र्; पाररजस्ट्थजतकी के एक प्रजतजनजध या पर्ाावरण के क्षेत्र में एक जविेषज्ञ को केंर्द् शाक्षसत प्रििे सरकार द्वारा नाजमत दकर्ा िाना है। 5. गैर-सरकारी संगिन (पाररजस्ट्थजतकी, पर्ाावरण संरक्षण सजहत जवरासत संरक्षण के क्षेत्र सिस्ट्र्; में काम करने वाले) के एक प्रजतजनजध को केंर्द् शाक्षसत प्रििे सरकार द्वारा नाजमत दकर्ा िाना ह।ै 6. केंर्द् शाक्षसत प्रििे िैव जवजवधता बोडा/पररषि का प्रजतजनजध सिस्ट्र्; 7. आवास और िहरी जनर्ोिन जवभाग / ग्रामीण जवकास जवभाग के प्रजतजनजध सिस्ट्र्; 8. कृजष उत्पािन जवभाग के प्रजतजनजध सिस्ट्र्; 9. सांबद्ध वन्द्र्िीव वाडान सिस्ट्र्- सजचव 6. जनििे जनबधं न:- (1) जनगरानी सजमजत इस अजधसूचना के उपबंधों के अनुपालन की जनगरानी करेगी। (2) जनगरानी सजमजत का कार्ाकाल अगले आदशे होन े तक ककया जाएगा, परांतु यह कक सक्षमक्षत के गैर-सरकारी सदथयों को समय-समय पर केंर्द् शाक्षसत प्रदशे सरकार द्वारा नामक्षनर्दष्टव ककया जाएगा। (3) पाररजस्ट्थजतकी संवेिी िोन में भारत सरकार के तत् कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना सं. का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची में सज‍मजलत और पाररक्षथिक्षतकी सांवेदी जोन में आन ेवाले दक्रर्ाकलापों और इस अजधसूचना के पैराग्राफ 4 के अधीन सारणी में र्था जवजनर्िष्टा प्रजतजषद्ध गजतजवजधर्ों के जसवार् आन े वाले ऐसे दक्रर्ाकलापों की वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूव ा पर्ाावरण अनापजत्त लेने के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िष्टा की िाएांगी। (4) इस अजधसूचना के पैरा 4 के अधीन सारणी म ें र्था जवजनर्िष्टा प्रजतजषद्ध दक्रर्ाकलापों के जसवार्, भारत सरकार के तत् कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अजधसूचना के अनुसूची के अधीन ऐसे दक्रर्ाकलापों, जिन्द्ह ें सज‍मजलत नहीं दकर्ा गर्ा है, परंतु जो पाररजस्ट्थजतकी संवेिी िोन में आत े ह,ैं ऐसे दक्रर्ाकलापों की वास्ट्तजवक[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उसे संबद्ध जवजनर्ामक प्राजधकरणों को जनर्िष्टा दकर्ा िाएगा । (5) जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा संबंजधत उपार्ुि ऐस े व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता ह,ै पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि िार्र करने के जलए सक्षम होगा। (6) जनगरानी सजमजत संबंजधत जवभागों के प्रजतजनजधर्ों र्ा जविेषज्ञों, औद्योजगक संघों के प्रजतजनजधर्ों र्ा संबंजधत पक्षों को, प्रत्र्ेक मामले मे आवश्र्कता के अनुसार, अपने जवचार-जवमिा म ेंसहार्ता के जलए आमजं त्रत कर सकेगी । (7) जनगरानी सजमजत प्रत्र्ेक वषा 31 माचा की जस्ट्थजत के अनुसार अपनी वार्षाक कारावाई ररपोटा रायर् के मुख्र् वन्द्र्िीव वाडान को, अनुलग्नक V में दिए गए प्रपत्र के अनुसार, उस वषा की 30 िून तक प्रस्ट्तुत करेगी । (8) केन्द्रीर् सरकार का पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् जनगरानी सजमजत को उसके कृत्र्ों के प्रभावी जनवाहन के जलए ऐसे जनििे ि ेसकेगा िो वह उजचत समझे । 7. अजतररक्त उपार्.- इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए केंरीर् सरकार और रायर् सरकार, अजतररक् त उपार्, र्दि कोई हों, जवजनर्िष्ा ट कर सकेंगी । 8. उच्चतम न्द्र्ार्ालर्, आििे आदि.- इस अजधसूचना के उपबंध भारत के माननीर् उच्चतम न्द्र्ार्ालर् and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections Notification WHEREAS, the Surinsar-Mansar Wildlife Sanctuary with an area of 97.82 square kilometers, is located between River Tawi in the North, Udhampur-Samba road and Gombir Khad in the East, Bottal-Bilour road and Mansar lake in the Southeast, River Tawi and Surinsar Lake in the Northwest. The Sanctuary is spread over three districts of Jammu, Udhampur and Samba and the major part falls in the Jammu District in the UT of Jammu and Kashmir; AND WHEREAS, the Surinsar-Mansar Wildlife Sanctuary was declared as Wildlife Sanctuary vide notification number SRO 138 dated 10th April 1990. The sanctuary also includes twin Surinsar & Mansar Lake which was added in the list of Ramsar Wetlands of International Importance in 2005 and also included in the National Wetland Conservation Programme of Government of India;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 AND WHEREAS, the area represents a “gene pool” for propagation, protection and perpetuation of various wild flora and fauna species. The recorded faunal species from Surinsar-Mansar Wildlife Sanctuary includes 15 species of mammals, 86 species of birds, 17 species of reptiles, 8 species of fishes (Kotwal. 2012); AND WHEREAS, the Surinsar-Mansar wildlife sanctuary and its adjacent forest area is given priority for protection purpose due to its rich wildlife and harbors viable population of the endangered floral and faunal species like Indian long billed vulture (Gyps indicus), Indian white-backed vulture (Gyps bengalensis), steppe eagle (Aquila nipalensis), common leopard (Panthera pardus), Indian monitor lizard (Varanus bengalensis); AND WHEREAS, the major faunal species found in the sanctuary are barking deer (Muntiacus muntejak), nilgai (Boselaphus tragocamelus), goral (Nemorhaedus goral), wild boar (Sus scorfa), jackal (Canis aureus), hare (Lepus nigricollis), jungle cat (Felis chaua), porcupine (Hystrix indica), mongoose (Herpestes edwardis), agama lizard (Agama agronensis), garden lizard (Calotes vesicolor), Indian cobra (Naja naja), common krait (Bungarus caerulus), Russel's viper (Vipera russeli russeli), rat snake (Ptyas mucosus), grass snake (Amphiesma stolata), cat snake (Boiga trigonata), Indian kukri snake (Oligidon ornensis), checkered keelback snake (Xenochrophis piscator), Indian bull frog (Haplobatracus tigrinis), Indian toad (Bufo melanosticus), marbled toad (Bufo stomaticus) etc; AND WHEREAS, the important avi-faunal species present in the area are pea fowl (Pavo cristatus), Red jungle fowl (Gallus gallus), black partridges (Francolinus francolinus), Grey partridge (Francolinus pondicerianus), Bush Quil (Prediculata asiatica), Red Turtle Dove (Streptopelia tranquebarica), Blue rock pigeon (Columba livia), Ring Dove (Streptopelia cecacto), Spotted Owlet (Athena brama), Blue jay (Coracias benghalensis), Parakeets (Psittacula cyanoocephala), Hoope (Upup aepops), Asian Koel (Eudyanmys scolopacea), Babblers (Turdoides caudatus).; AND WHEREAS, the Surinsar-Mansar twin scared lakes attract a good number of waterfowl populations during the winter months. The lakes are an ideal and attractive habitat for migratory waterfowl such as common teal (Anas crecca), mallard (Anas platyrhynchos), common pochard (Anas ferina), tufted duck (Aythya fuligua), gadwall (Anas strpera), brahminy duck (Tadorna ferruginea, wigeon (Anas penelope), grey heron (Ardea cinera), pond heron (Ardea grayii), night heron (Nycticorax nycticorax), little egret (Egretta garzetta), cattle egret (Bubulcus ibis), Indian moorhen (Gallinula chloropas), purple moorhen (Perchurio orphyroo), white breasted kingfisher (Halycons smyrnensis), common kingfisher (Alcedo atthis), grey wagtail (Motacilla cinera), pheasent tailed jacana (Hydrophasianua chirurgus) etc. AND WHEREAS, the twin lake also supports important species of turtles namely Indian flapshell turtle (Lissemys punctata) and Indian soft-shell turtle (Nilssonia gangeticus) listed in CITES Appendices. The lakes are also source of drinking and irrigation water to dozens of villages falling down stream to the protected area. AND WHEREAS, the Surinsar-Mansar wildlife sanctuary consists of northern dry mixed deciduous forests, Himalayan sub-tropical scrub forests, Himalayan subtropical pine forest, lower Shiwalik chir pine forest, Dodonea scrub forests. The major vegetation found in and around wildlife sanctuary are Acacia catechu, Acacia nilotica, Acacia modesta, Ficus recemosa, Ficus bengalensis, Ficus religiosa, Butea monosperma, Lannea coromandalica, Albizzia lebbeck, Mallotous philippensis , Dodonea viscosa, Adhatoda vasica, Carissa spinarum, Colebrookia oppositiffolia, Nerium indicum, Dalbergia sissoo, Punica granatum, Murraya koenigii, Ipomea fistula, Saccharum spontanium, Cymbopogon spp, Pinus roxburghii., Zizyphus Jujuba, Syzygium cumini, Emblica officinalis, Woodfordia fruticosa, Rumex hastatus etc.; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Surinsar- Mansar Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act), read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area of 72.42 square kilometers to an extent varying from (0) Zero to 3.459 kilometers around the boundary of Surinsar-Mansar Wildlife Sanctuary, in the Union Territory of Jammu and Kashmir as the Surinsar-Mansar Wildlife Sanctuary Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: 1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be of 72.42 square kilometres are with an extent of zero to 3.459 kilometres around the boundary of Surinsar-Mansar Wildlife Sanctuary. The zero extent of the Eco-sensitive zone is due to contiguous border with Nandani Wildlife Sanctuary on the Western side of the Surinsar-Mansar wildlife sanctuary. (2) The boundary description of Surinsar-Mansar Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (3) The maps of the Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB and Annexure-IIC (4) Lists of geo co-ordinates of the boundary of Surinsar-Mansar Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure-III. (5) The list of villages falling in the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The Union Territory Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the Union Territory. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union Territory Government in such manner as is specified in this notification and also in consonance with the relevant Central and Union Territory laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the Union Territory Government, for integrating the ecological and environmental considerations into the said plan:- i. Environment, Ecology and Remote Sensing; ii. Forest; iii. Agriculture; iv. Revenue; v. Urban and Municipality; vi. Surinsar-Mansar Development Authority under Tourism Department; vii. Irrigation and Flood Control; viii. Notified town area committee; ix. Rural Development & Panchayati Raj; x. Public Works Department; (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the Union Territory Government.- The Union Territory Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities:[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21 Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or Union Territory Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given in paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Union Territory Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the Union Territory Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the Union Territory Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Tourism Master Plan shall be prepared by the Union Territory Department of Tourism in consultation with the Union Territory Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made there under. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made there under or standards stipulated by the Union Territory Government, whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the Union Territory Government,[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23 the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (b) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non- polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Setting of industries causing New industries and expansion of existing polluting industries in the pollution (Water, Air, Soil, Eco-sensitive Zone shall not be permitted: Noise, etc.). Provided that, non-polluting industries shall be allowed within Eco- Sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification and in addition, the non-polluting cottage industries shall be promoted. 3. Establishment of major Prohibited hydroelectric project. 4. Use or production or processing Prohibited of any hazardous substance. 5. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye- laws to meet the residential needs of the local residents: Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 11. Small scale non polluting Non polluting industries as per classification of industries issued by industries. the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 12. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the Union Territory Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or Union Territory Act and the rules made there under. 13. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S. The Regional Wildlife Warden, Jammu Region, Jammu Member; 4. A representative of department of Forests, Ecology and Remote Sensing, Government Member; of Jammu and Kashmir or an expert in area of Ecology and Environment to be nominated by Union Territory Government. 5. One representatives of Non-Governmental Organization (working in the field of Member; Ecology, Environment including Heritage Conservation) to be nominated by the Union Territory Government 6. A representative of Union Territory Biodiversity Board/Council Member; 7. Representative of Housing and Urban Planning Department/Rural Development Member; Department 8. Representative of Agriculture Production Department Member; 9. Concerned Wildlife Warden Member- Secretary 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official members of the Committee shall be nominated by the Union Territory Government from time to time. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 27 (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the Union Territory as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. Additional measures. The Central Government and Union Territory Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. Orders of Supreme Court, etc.- The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal. In the South-Eastern side, the Eco-sensitive Zone enters the Co 6 Mansar Block Jindrah transverse it on Southern side of village Undahal enters into 5 Mansar Block Jindrah of Forest Division Jammu and then enters in Co. 43/Mahoregarh Range of Forest Division Samba and then Co. 42/Mahoregarh Range and crosses the Mansar Samba Road. In the Southern side, the ESZ transverse through Co 39/Mahoregarh, Co 38/ Mahoregarh North of village Babnergarh, then 36/Mahoregarh South of Mansar Forest, 33/ Mahoregarh, 32/Mahoregarh, 30/Mahoregarh North of Village Kumn, 29/Mahoregarh, enters 23/Purmandal (Forest Division Samba) and 21/Purmandal and then along the boundary of 20/ Purmandal and 21/Purmandal and moves forward along the boundary of 20/Purmandal and 44/Bahu and 33/ Purmandal and 44/Bahu, boundary of 33/Purmandal and enters into 34/ Purmandal south of village Dager and joins with Samani Nallah north of village Panjowa. In the South-Western side, the ESZ move along boundary of 34/ Purmandal and 35/ Purmandal, move along the Samani Nallah and move along the boundary of Co 42/Bahu and 35/ Purmandal, Co 46/Bahu and 35/ Purmandal, Co 46/Bahu and 41/ Purmandal, Co 47/Bahu and 41/ Purmandal, Co 48/Bahu and 41/Purmandal, along the boundary of 48/Bahu, 49/Bahu and 50/Bahu. In the Western side, the ESZ moves along the boundary of the 51/Bahu, 52/Bahu North of village Athem, crosses the Surinsar-Sidhra road, enters into Co 53/Bahu, then 56/Bahu, moves along the boundary of between 58/Bahu and 59 Bahu, then touches the river Tawi. The ESZ move along the Tawi along the boundary upto Co 15/Jindrah. The ESZ has been kept zero along the boundary of Surinsar-Mansar Wildlife Sanctuary with the Nandani Wildlife Sanctuary. The ESZ moves along the North of Village Doa, enters into Co 5 Tunnel Block Jindrah Range, then into 4 Tunnel Block Jindrah Range. In the North-Western side, the ESZ enters into Co 4/T, then South of village Tara, then along the South of village Kah. In the Northern side, the ESZ enters into the Rifle Range, upto Noth of Village Martin, then enters into the Nallah North of Village Nagola, move along the Nallah upto the North of village Upli Sari and Dhan. Then the ESZ move forward North of the villages Pera, Buthana.
