संरजक्षत करना तथा ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों की िेजणयों के प्रचालन तथा प्रसंस्ट्करण को प्रजतजर्द्ध करना अवश्यक ह;ै ऄतः ऄब, केन्द्रीय सरकार, पयाावरण (संरक्षण) जनयमावली, 1986 के जनयम 5 के ईपजनयम (3) के साथ परित पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आसमें आसके पश्चात ् पयाावरण ऄजधजनयम कहा गया ह)ै की ईपधारा (1)तथा धारा 3 की ईपधारा (2) खंड (v) और खंड (xiv) एवं ईपधारा (3) के द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, कनााटक राज्य क जचक्कमंगलरूु औ ग क ( घ ) की सीमा के चारों ओर 1.0 क 12.5 क तक जवस्ट्ताररत क्षेत्र को पाररजस्ट्थजतकी संवेदी जोन (जजसे आसमें आसके पश् चात् पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप म ें ऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार ह,ै ऄथाात ् :- 1. पाररजस्ट्थजतकी सवं दे ी जोन का जवस्ट्तार और सीमा.-(1) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार ( घ ), की सीमा के चारों ओर 1.0 क 12.5 क तक और पाररजस्ट्थजतकी संवेदी जोन का क्षेत्रफल 740.56 वगा दकलोमीटर ह।ै (2) ( घ ) और आसके पाररजस्ट्थजतकी संवेदी जोन की सीमा का वणान ईपाबधं -I के रूप में ईपाबद्ध ह।ै (3) सीमा जववरण और ऄक्षांि और देिांतर के साथ पाररजस्ट्थजतकी संवेदी जोन का सीमांकन करत े हुए ( घ ) का मानजचत्र ईपाबधं -II के रूप म ें ईपाबद्ध ह।ै (4) पाररजस्ट्थजतकी संवेदी जोन और ( घ ) की सीमा के भू-जनदेिांकों की सूची ईपाबधं - III क सारणी क और सारणी ख में दी गइ ह।ै (5) मुख्य डबदओंु के भ-ू जनदेिाकं ों के साथ प्रस्ट्ताजवत पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अन े वाले ग्रामों की सूची ईपाबधं -V के रूप में ईपाबद्ध ह।ै (6) ( घ ) क पाररजस्ट्थजतकी संवेदी जोन क ग क ईपाबधं -IV के रूप में ईपाबद्ध ह।ै 2. पाररजस्ट्थजतकी सवं दे ी जोन के जलए अचं जलक महायोजना.–(1) राज्य सरकार, द्वारा पाररजस्ट्थजतकी संवेदी जोन के प्रयोजन के जलए, राजपत्र म ें ऄंजतम ऄजधसूचना के प्रकािन की तारीख से दो वर्ा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामि ा से और आस ऄजधसूचना में ददए गए ऄनबु ंधों का पालन करत े हुए, राज्य सरकार के सक्षम प्राजधकारी के ऄनुमोदनाथा एक अंचजलक महायोजना बनाइ जायेगी। (2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना आस ऄजधसचू ना म ें जवजनर्ददष् ट रीजत स े तथा प्रासंजगक केंरीय और राज्य जवजधयों के ऄनुरूप तथा केंरीय सरकार द्वारा जारी ददिा जनदेिों, यदद कोइ हों, के ऄनुसार बनायी जाएगी। (3) अंचजलक महायोजना म ें पाररजस्ट्थजतकी और पयाावरण सबं ंधी सरोकारों को िाजमल करने के जलए आसे राज्य सरकार के जनम्नजलजखत जवभागों के परामिा से बनाया जाएगा, ऄथाात:्- (i) पयाावरण; (ii) वन और वन्द्यजीव; (iii) कृजर्;[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 (iv) राज ; (v) िहरी जवकास; (vi) पयाटन; (vii) ग्रामीण जवकास (viii) डसचाइ और बाढ़ जनयंत्रण; (ix) ग क ; (x) पंचायती राज; (xi) क क राज्य प्रदर्ू ण जनयंत्रण बोड;ा और (xii) लोक जन मााण जव भाग (4) जब तक आस ऄजधसूचना में जवजनर्ददष्ट न हो, अंचजलक महायोजना में वतामान में ऄनुमोददत भू-ईपयोग, ऄवसंरचना और दक्रयाकलापों पर कोइ प्रजतबंध नहीं लगाया जाएगा तथा अचंजलक महायोजना म ें सभी ऄवसंरचनाओं और दक्रयाकलापों में सुधार करके ईन्द्ह ेऄजधक दक्ष और पाररजस्ट्थजतकी-ऄनुकूल बनान ेकी व्यवस्ट्था की जाएगी। (5) अंचजलक महायोजना म ें वनरजहत और ऄवक्रजमत क्षेत्रों के सुधार, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मृदा और नमी के संरक्षण, स्ट्थानीय जनता की अवश्यकताओं तथा पाररजस्ट्थजतकी एव ं पयाावरण के ऐसे ऄन्द्य पहलओंु की व्यवस्ट्था की जाएगी जजन पर ध्यान ददया जाना अवश्यक ह।ै (6) अंचजलक महायोजना में सभी जवद्यमान पूजा स्ट् थलों, ग्रामों एवं िहरी बजस्ट्तयों, वनों की िेजणयों एव ं दकस्ट् मों, कृजर् क्षेत्रों, उपजाउ भूजम, ईद्यानों एवं ईद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और ऄन्द्य जल जनकायों की सीमा का सहायक मानजचत्र के साथ जनधाारण दकया जाएगा। और प्रस्ट्ताजवत भ-ू ईपयोग की जविेर्ताओं का ब्यौरा भी ददया जाएंगा। (7) अंचजलक महायोजना म ें पाररजस्ट्थजतकी संवेदी जोन म ें होने वाले जवकास का जवजनयमन दकया जाएगा और सारणी म ें यथासूचीबद्ध पैराग्राफ 4 में प्रजतजर्द्ध एव ं जवजनयजमत दक्रयाकलापों का पालन दकया जाएगा। आसमें स्ट् थानीय जनता की अजीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-ऄनुकूल जवकास का भी सुजनश्चय एवं संवधान दकया जाएगा। (8) अंचजलक महायोजना, क्षेत्रीय जवकास योजना की सह-काजलक होगी । (9) ऄनुमोददत अंचजलक महायोजना, जनगरानी सजमजत के जलए एक संदभा दस्ट्तावेज होगी तादक वह आस ऄजधसूचना के ईपबंधों के ऄनुसार जनगरानी के ऄपने कताव्यों का जनवाहन कर सके । 3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:- (1) भ-ू ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन म ेंवनों, बागवानी क्षेत्रों, कृजर् क्षेत्रों, मनोरंजन के जलए जचजन्द्हत ईद्यानों और खुल े स्ट्थानों का वृहद वाजणजज्यक या अवासीय पररसरों या औद्योजगक दक्रयाकलापों के जलए प्रयोग या संपररवतान ऄनुज्ञात नहीं दकया जाएगा: परंत ु पाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क), में जवजनर्ददष्ट प्रयोजन स े जभन्न प्रयोजन के जलए कृजर् और ऄन्द्य भूजम का संपररवतान, मानीटरी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा ऄनुमोदन स े क्षेत्रीय नगर योजना ऄजधजनयम तथा यथा लागू केन्द्रीय सरकार एवं राज्य सरकार के ऄन्द्य जनयमों एव ं जवजनयमों के ऄधीन तथा आस ऄजधसूचना के ईपबंधों के ऄनुसार स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय जरूरतों को पूरा करने के जलए ऄनुज्ञात दकया जाएगा जैसे:- (i) जवद्यमान सडकों को चौडा करना, ईन्द्ह ेंसुद ृ करना और नइ सडकों का जनमााण करना;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रदर्ू ण ईत्पन्न न करने वाल े लघ ुईद्योग; (iv) कुटीर ईद्योग एवं ग्राम ईद्योग; पाररजस्ट्थजतकी पयाटन में सहायक सुजवधा भण्डार, औ स्ट्थानीय सुजवधाए ं तथा गह वास; और (v) बढ़ावा ददए गए पैरा -4 में ईजल्लजखत दक्रयाकलापः परंत ु यह भी दक क्षेत्रीय िहरी जनयोजन ऄजधजनयम के ऄधीन सक्षम प्राजधकारी के पूवा ऄनुमोदन के जबना तथा राज्य सरकार के ऄन्द्य जनयमों एवं जवजनयमों एव ं संजवधान के ऄनच्ु छेद 244 के ईपबंधों तथा तत्समय प्रवृत्त जवजध, जजसके ऄंतगात ऄनुसूजचत जनजाजत और ऄन्द्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्द्यता) ऄजधजनयम, 2006 (2007 का 2) भी अता ह,ै का ऄनुपालन दकए जबना वाजणजज्यक या औद्योजगक जवकास दक्रयाकलापों के जलए जनजातीय भूजम का प्रयोग ऄनुज्ञात नहीं होगा: परंत ु यह भी दक पाररजस्ट् थजतकी संवेदी जोन के ऄंतगात अन े वाली भूजम के ऄजभलेखों म ें हुइ दकसी त्रुरट को, मानीटरी सजमजत के जवचार प्राि करन े के पश्चात,् राज्य सरकार द्वारा प्रत्येक मामल े म ें एक बार सुधारा जाएगा और ईि त्रुरट को सुधारन े की सूचना केंरीय सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय को दी जाएगी: परंत ु यह भी दक ईपयुाि त्रुरट को सुधारन े म,ें आस ईप-पैरा में यथा ईपबंजधत के जसवाय, दकसी भी दिा म ें भू- ईपयोग का पररवतान िाजमल नहीं होगा (ख) ऄनप्रु य ु या ऄनुत् पादक कृजर् क्षेत्रों में पनु : वनीकरण तथा पयाावासों और जैव- जवजवधता की बहाली के प्रयास दकए जाएंगे। (2) प्राकृजतक जल स्रोत.- अंचजलक महायोजना में सभी प्राकृजतक जलमागों के अवाह क्षेत्रों की पहचान की जाएगी और अंचजलक महायोजना में ईनके संरक्षण और बहाली की योजना सज‍ मजलत की जाएगी और राज्य सरकार द्वारा जल अवाह प्रबंधन योजना आस रीजत स े बनाइ जाएगी दक ईसम ें अवाह क्षेत्रों में जवकास दक्रयाकलापों को प्रजतजर्द्ध और जनबंजधत दकया गया हो । (3) पयटा न एव ं पाररजस्ट्थजतकी पयटा न.– (क) पाररजस्ट्थजतकी संवेदी जोन में सभी नए पाररजस्ट्थजतकी पयाटन दक्रयाकलाप या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेदी जोन स‍बंधी पयाटन महायोजना के ऄनुसार ऄनज्ञु ात होगा। (ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य सरकार के पयावा रण और वन जवभाग के परामिा से पयाटन जवभाग द्वारा बनायी जाएगी। (ग) पयाटन महायोजना अंचजलक महायोजना का घटक होगी। (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जायेगी (ङ) पाररजस्ट्थजतकी पयाटन संबधं ी दक्रयाकलाप जन‍न ानुसार जवजनयजमत दकए जाएंग,े ऄथाात:्- (i) की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन की सीमा तक, आनम ें जो भी ऄजधक जनकट हो, दकसी होटल या ररजॉटा का नया सजन्नमाणा ऄनुज्ञात नहीं दकया जाएगाः परंत ु यह, पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए की सीमा से क दकलोमीटर की दरू ी से परे पाररजस्ट्थजतकी सवं ेदी जोन की सीमा तक पूवा पररभाजर्त और ऄभीजहत क्षेत्रों म ें पयटा न महायोजना के ऄनुसार, नए होटलों और ररजॉटा की स्ट्थापना ऄनुज्ञात होगी; (ii) पाररजस्ट्थजतकी संवेदी जोन के ऄन्द्दर सभी नए पयाटन दक्रया-कलापों या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार, केन्द्रीय सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय द्वारा जारी ददिाजनदेिों तथा पाररजस्ट्थजतकी पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देने वाले राष्ट्रीय व्याघ्र संरक्षण[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 प्राजधकरण द्वारा जारी पाररजस्ट्थजतकी पयाटन संबंधी ददिाजनदेिों (समय-समय पर यथा सिं ोजधत) के ऄनुसार होगा; (iii) अंचजलक महायोजना का ऄनुमोदन होने तक, पयाटन के जवकास और जवद्यमान पयाटन दक्रयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के अधार पर संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन में दकसी नए होटल/ ररजॉटा या वाजणजज्यक प्रजतष्ठान का संजन्नमााण ऄनुज्ञात नहीं होगा । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अने वाल े बहुमूल्य प्राकृजतक जवरासत के सभी स्ट्थलों जैसे दक जीन पूल ररजव ा क्षत्रे , िैल संरचना, जल प्रपात, झरन,े दरे, ईपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा ईत्प्रपात अदद की पहचान की जाएगी और ईनकी सुरक्षा एव ं संरक्षण के जलए अंचजलक महायोजना के भाग के रूप म ें एक जवरासत संरक्षण योजना बनायी जाएगी। (5) मानव जनर्वमत जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्य संबधी, सौंदयाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण के जलए अंचजलक महायोजना के भाग के रूप में एक जवरासत संरक्षण योजना बनायी जाएगी। (6) ध्व जन प्रदर्ू ण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदर्ू ण (जवजनयमन और जनयंत्रण) जनयम, 2000 में जनयत ईपबंधों के ऄनुसार म ें पाररजस्ट्थजतकी संवेदी जोन में ध्वजन प्रदर्ू ण के जनयंत्रण के जलए जवजनयमों को कायााजन्द्वत करेगा । (7) वाय ु प्रदर्ू ण.- पाररजस्ट्थजतकी संवेदी जोन म,ें वायु प्रदर्ू ण के जनवारण और जनयंत्रण का वाय ु (प्रदर्ू ण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया जाएगा । (8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन म ें ईपचाररत बजहस्राव का जनस्ट्सारण, साधारणों मानकों के ऄन्द्तगात पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अन े वाल े पयावा रणीय प्रदर्ू ण के जनस्ट्सारण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक किोर हो, के ईपबंधों के ऄनुसार होगा। (9) िोस ऄपजिष्ट.- िोस ऄपजिष्ट का जनपटान एवं प्रबन्द्धन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन म ें िोस ऄपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना सं. का.अ. 1357(ऄ), ददनांक 8 ऄप्रैल, 2016 के तहत प्रकाजित िोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन स ेबाहर जचजन्द्हत दकए गए स्ट्थानों पर पयाावरण-ऄनुकूल रीजत से दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन म ें मान्द्य प्रौद्योजगदकयों (इएसएम) का प्रयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनरूु प िोस ऄपजिष्ट का सरु जक्षत और पयाावरण ऄनुकूल प्रबंधन ऄनुज्ञात दकया जायेगा। (10) जवै जचदकत्सा ऄपजिष्ट .- जैव जचदकत्सा ऄपजिष्ट का प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन म ें जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय–समय पर यथा संिोजधत ऄजधसचू ना सं.सा.का.जन 343 (ऄ), तारीख 28 माच,ा 2016 के तहत प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (ख) पाररजस्ट्थजतकी सवं ेदी जोन म ें मान्द्य प्रौद्योजगदकयों का प्रयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप िोस ऄपजिष्ट का सुरजक्षत और पयाावरण ऄनुकूल प्रंबंधन ऄनुज्ञात दकया जायेगा। (11) प्लाजस्ट्टक ऄपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन म ें प्लाजस्ट्टक ऄपजिष्ट का प्रबंधन, भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना सं.सा.का.जन 340(ऄ),8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] तारीख 18 माच,ा 2016 के तहत प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधो के ऄनुसार दकया जाएगा। (12) जनमाणा और जवध्वसं ऄपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन म ें जनमााण और जवध्वंस ऄपजिष्ट का प्रबंधन, भारत सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना सं.सा.का.जन 317(ऄ), तारीख 29 माचा, 2016 के तहत प्रकाजित संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन में इ–ऄपजिष्ट का प्रबंधन, भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय द्वारा प्रकाजित तथा समय-समय पर यथा संिोजधत इ–ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (14) सडक-यातायात.- सडक-यातायात को पयाावास-ऄनुकूल तरीके स े जवजनयजमत दकया जाएगा और आस संबंध म ें अंचजलक महायोजना म ें जविेर् ईपबंध िाजमल दकए जाएंगे। अंचजलक महायोजना के तैयार होन े और राज्य सरकार के सक्षम प्राजधकारी से ऄनुमोददत होने तक, मानीटरी सजमजत प्रासंजगक ऄजधजनयमों और ईनके तहत बनाए गए जनयमों एव ं जवजनयमों के ऄनुसार सडक-यातायात के ऄनुपालन की मानीटरी करेगी। (15) वाहन जजनत प्रदर्ू ण.- वाहन जजनत प्रदर्ू ण की रोकथाम और जनयंत्रण लाग ू जवजधयों के ऄनुसार दकया जाएगा। स्ट्वच्छतर ईंधन के ईपयोग के जलए प्रयास दकए जाएगं े । (16) औद्योजगक इकाआया.ं- (i) सरकारी राजपत्र म ें आस ऄजधसूचना के प्रकािन की तारीख को या ईसके बाद पाररजस्ट्थजतकी संवेदी जोन म ेंदकसी नए प्रदर्ू णकारी ईद्योग की स्ट्थापना ऄनज्ञु ात नहीं होगी। (ii) जब तक आस ऄजधसूचना में जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन म ें केंरीय प्रदर्ू ण जनयंत्रण बोडा द्वारा फरवरी, 2016 में जारी ददिाजनदेिों म ें दकए गए ईद्योगों के वगीकरण के ऄनुसार केवल गैर-प्रदर्ू णकारी ईद्योगों की स्ट्थापना ऄनुज्ञात होगी। आसके ऄजतररि, गैर-प्रदर्ू णकारी कुटीर ईद्योगों को बढ़ावा ददया जाएगा। (17) पहाडी ढलानों का सरं क्षण.- पहाडी ढलानों का सरं क्षण जनम्नानुसार दकया जाएगा:- (क) अंचजलक महायोजना में पहाडी ढलानों के ईन क्षेत्रों को दिााया जाएगा जजनमें दकसी भी संजनमााण की ऄनज्ञु ा नहीं होगी; (ख) जजन ढलानों या जवद्यमान खडी पहाडी ढलानों में ऄत्यजधक भू-क्षरण होता ह ै ईनमें दकसी भी संजनमााण की ऄनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं दे ी जोन म ें प्रजतजर्द्ध या जवजनयजमत दकए जान े वाल े दक्रयाकलापों की सचू ी- पाररजस्ट्थजतकी संवेदी जोन म ें सभी दक्रयाकलाप, पयाावरण ऄजधजनयम ईसके ऄधीन बने जनयमों के ईपबंधों जजसमें तटीय जवजनयमन जोन ऄजधसूचना, 2011 एवं पयाावरणीय प्रभाव अकलन ऄजधसूचना, 2006 िाजमल ह ै सजहत वन (संरक्षण) ऄजधजनयम, 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्द्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53) ऄन्द्य लाग ू जनयमों तथा ईनम ें दकए गए संिोधनों के ऄनुसार िाजसत होंग े और नीच े दी गइ सारणी म ेंजवजनर्ददष्ट रीजत स े जवजनयजमत होंगे, ऄथाात:् -[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 9 सारणी क्रम स.ं दक्रयाकलाप में अदिे तारीख 4 ऄगस्ट्त, 2006 और 2012 की ररट याजचका (सी) सं. 435 म ें गोवा फाईंडिे न बनाम भारत संघ के मामल े में तारीख 21 ऄप्रैल, 2014 के अदिे के ऄनसु रण म ें प्रचाजलत की जाएगं ी। 2. प्रदर्ू ण (जल, वाय,ु मृदा, ध्वजन, पाररजस्ट्थजतकी संवदे ी जोन में कोइ नया ईद्योग लगाने और वतमा ान प्रदर्ू णकारी ईद्योगों का जवस्ट्तार करने की ऄनमु जत नहीं होगीः अदद) ईत्पन्न करने वाले ईद्योगों की स्ट्थापना । जब तक दक आस ऄजधसचू ना में जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन में फरवरी, 2016, में केंरीय प्रदर्ू ण जनयंत्रण बोड ा द्वारा जारी ददिाजनदिे ों म ें दकए गए ईद्योगों के वगीकरण के ऄनुसार केवल गैर- प्रदर्ू णकारी ईद्योगों की स्ट्थापना होगी। आसके ऄजतररि, गैर-प्रदर्ू णकारी कुटीर ईद्योगों को प्रोत्साहन ददया जाएगा। 3. जल जवद्युत पररयोजनाओं की लागू जवजधयों के ऄनसु ार प्रजतजर्द्ध (ऄन्द्यथा ईपबंजधत के जसवाय) होंगे। स्ट्थापना । 4. जलावन लकडी का ईपयोग। लाग ूजवजधयों के ऄनसु ार प्रजतजर्द्ध (ऄन्द्यथा ईपबंजधत के जसवाय) होंगे । 5. प्राकृजतक जल जनकायों या भूजम क्षेत्र लागू जवजधयों के ऄनसु ार प्रजतजर्द्ध (ऄन्द्यथा (ऄन्द्यथा ईपबंजधत के जसवाय) होंगे । 9. नए काष्ि अधाररत ईद्योग लागू जवजधयों के ऄनसु ार प्रजतजर्द्ध (ऄन्द्यथा ईपबंजधत के जसवाय) होंगे । ख.जवजनयजमत दक्रयाकलाप 10. होटलों और ररसोटों की वाजणजज्यक पाररजस्ट्थजतकी पयाटन दक्रयाकलापों हते ु लघु ऄस्ट्थायी संरचनाओं के स्ट्थापना । जनमााण के जसवाय, संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन की सीमा तक, आनमें जो भी ऄजधक जनकट हो, नए वाजणजज्यक होटलों और ररसोटो की स्ट्थापना ऄनुज्ञात नहीं होगी: परंतु, संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर बाहर या पाररजस्ट्थजतकी सवं ेदी जोन की सीमा तक, पयाटन महायोजना और लाग ू10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ददिाजनदिे ों के ऄनुसार आनमें जो भी ऄजधक जनकट हो, सभी नए पयाटन दक्रयाकलाप करने या जवद्यमान दक्रयाकलापों का जवस्ट्तार करने की ऄनुज्ञा होगी । 11. संजनमााण दक्रयाकलाप । (क) संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक जो भी जनकट हो, दकसी भी प्रकार का वाजणजज्यक संजनमाणा ऄनुज्ञात नहीं दकया जाएगा: परंतु स्ट्थ ानीय लोगों को परै ा 3 के ईप परै ा (1) में सूचीबद्ध दक्रयाकलापों सजहत ईनके ईपयोग के जलए ईनकी भूजम म ें स्ट्थानीय की अवासीय अवश्यकताओं को पूरा करने जलए संजनमाणा करने की ऄनमु जत भवन ईपजवजधयों के ऄनुसार दी जाएगी परन्द्तु ऐसे लघु ईद्योगों जो प्रदर्ू ण ईत् पन्द्न नहीं करते ह,ैं स े संबंजधत संजनमााण दक्रयाकलाप जवजनयजमत दकए जाएंगे और लागू जनयमों और जवजनयमों, यदद कोइ हों, के ऄनसु ार सक्षम प्राजधकारी की पूवा ऄनुमजत से ही न्द् यूनतम पर रखे जाएंगे । (ख) एक दकलोमीटर से अगे अंचजलक महायोजना की ऄनुसार जवजनयजमत होंगे । 12. गैर प्रदर्ू णकारी लघ ुईद्योग। फरवरी, 2016 में केन्द्रीय प्रदर्ू ण जनयंत्रण बोड ा द्वारा जारी ईद्योगों के वगीकरण के ऄनुसार गरै -प्रदर्ू णकारी ईद्योग तथा ऄपररसकं टमय लघ ु और सेवा ईद्योग, कृजर्, पष्ु प कृजर्, बागबानी या कृजर् अधाररत ईद्योग, जो पाररजस्ट्थजतकी संवेदी जोन से दिे ी सामजग्रयों से ईत्पाद बनाते ह,ैं सक्षम प्राजधकारी द्वारा ऄनुज्ञात होंगे। 13. वृक्षों की कटाइ । (क) राज्य सरकार के सक्षम प्राजधकारी की पूवा ऄनमु जत के जबना वन भूजम या सरकारी या राजस्ट्व या जनजी भूजम पर वृक्षों की कटाइ नहीं होगी । (ख) वृक्षों की कटाइ केंरीय या संबंजधत राज्य के ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनसु ार जवजनयजमत होगी । 14. वन ईत्पादों और गैर काष्ठ वन लागू जवजधयों के ऄधीन जवजनयजमत होगा । ईत्पादों का संग्रहण । 15. जवद्युत और सचं ार टॉवर लगान,े लागू जवजधयों के ऄधीन जवजनयजमत होगा । (भूजमगत केबल जबछाने को तार-जबछाने तथा ऄन्द्य बुजनयादी बढ़ावा ददया जाएगा)। लाग ू जवजधयों के ऄनसु ार न्द्यनू ीकरण ईपायों जनय और जवजनयमन और ईन्द्ह ें सुदढृ बनाना और नइ सडकों ईपलब्ध ददिाजनदिे ों के साथ दकए जाएंगे। का जनमााण। 18. पयाटन से संबंजधत ऄन्द्य दक्रयाकलाप लागू जवजधयों के ऄधीन जवजनयजमत होगा । जैसे दक पाररजस्ट्थजतकी संवेदी जोन क्षेत्र के उपर से गमा वाय ु के गुब्बारे, हले ीकाप्टर, ड्रोन, माआक्रोलाआट्स ईडाना अदद। 19. पहाडी ढ और नदी तटों का लागू जवजधयों के ऄधीन जवजनयजमत होगा । संरक्षण । 20. राजत्र में वाहन यातायात का लागू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए जवजनयजमत होगा ।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 11 संचलन । 21. स्ट्थानीय जनता द्वारा ऄपनायी जा स्ट्थानीय जनता के प्रयोग के जलए लागू जवजधयों के ऄधीन ऄनुज्ञात होंगे। रही वतामान कृजर् और बागवानी पद्धजतयों के साथ डये ररयां, दग्ु ध ईत्पादन, जल कृजर् और मत्स्ट्य पालन। 22. फमों, कारपोरेट, कंपजनयों द्वारा बड े स्ट्थानीय अवश्यकताओं को पूरा करने के जलए लागू जवजधयों के ऄधीन पैमाने पर वाजणजज्यक पिुधन सपं दा जवजनयजमत (ऄन्द्यथा प्रदान दकए गए) होंग े और कुक्कुट फामों की स्ट्थापना । 23. प्राकृजतक जल जनकायों या भ ू क्षेत्र म ें जल जनकायों में ईपचाररत ऄपजिष्ट जल/बजहस्रााव के जनस्ट्सारण से बचा ईपचाररत ऄपजिष्ट जल/बजहस्रावा का जाएगा। ईपचाररत ऄपजिष्ट जल के पुनचाक्रण और पनु :ईपयोग के प्रयास जनस्ट्सारण । दकए जाएंगे ऄन्द्यथा ईपचाररत ऄपजिष्ट जल/बजहस्रााव का जनस्ट्सारण लाग ू जवजधयों के ऄनुसार जवजनयजमत दकया जाएगा। 24. सतही और भजू ल का वाजणजज्यक लागू जवजधयों के ऄधीन जवजनयजमत होगा । प्रयोग एवं जनष्कर्ाण । बढ़ावा ददया जाएगा । 5. पाररजस्ट्थजतकी-सवं दे ी जोन ऄजधसचू ना की जनगरानी के जलए जनगरानी सजमजत.- प्रभावी जनगरानी के जलए प्रदत्त िजियों का प्रयोग करते हुए केंरीय सरकार, पयाावरण (संरक्षण) ऄजधजनयम, 1986 की वन्द्यजीव संरक्षण के क्षत्रे म ें काम करन े सदस्ट्य; वाले गरै -सरकारी संगिन का प्रजतजनजध (x) क्षेत्रीय ऄजधकारी, कनााटक राज्य प्रदर्ू ण जनयंत्रण बोड,ा मैसूर सदस्ट्य; (xi) कनााटक सरकार द्वारा नाजमत राज्य के प्रजतजष्ठत सस्ट्ं थान या जवश्वजवद्यालय के सदस्ट्य; पाररजस्ट्थजतकी में एक जविेर्ज्ञ (xii) राज्य जैव जवजवधता बोडा के सदस्ट्य सदस्ट्य; (xiii) ईपा युि या ईनके प्रजतजनजध, जचक्कमंगलरूु जजला सदस्ट्य; (xiv) मुख्य वन सरं क्षक और जनदेिक, भरा वन्द्यजीव ऄभयारण्य ( घ ररजवा), जचक्कमंगलरूु सदस्ट्य- सजचव। 6.जवचाराथ ाजवर्य:- (1) जनगरानी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन की जनगरानी करेगी। (2) जनगरानी सजमजत का कायाकाल तीन वर् ा तक या राज्य सरकार द्वारा नइ सजमजत का पनु गािन दकए जाने तक होगा और आसके बाद जनगरानी सजमजत राज्य सरकार द्वारा गरित की जाएगी। (3) पाररजस्ट्थजतकी संवेदी जोन म ें भारत सरकार के तत्क ालीन पयाावरण और वन मंत्रालय की ऄजधसूचना सं. का.अ. 1533(ऄ), तारीख 14 जसतंबर, 2006 की ऄनुसूची म ें के ऄधीन सज‍मजलत दक्रयाकलापों और आस ऄजधसूचना के पैरा 4 के ऄधीन सारणी म ें यथा जवजनर्ददष्ट प्रजतजर्द्ध गजतजवजधयों के जसवाय अन े वाले ऐसे दक्रयाकलापों की दिा म ें वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं पर अधाररत जनगरानी सजमजत द्वारा संवीक्षा की जाएगी और ईि ऄजधसूचना के ईपबंधों के ऄधीन पूव ा पयाावरण ऄनापजत्त के जलए केन्द्रीय सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय को जनर्ददष्ट की जाएगी। (4) आस ऄजधसूचना के पैरा 4 के ऄधीन सारणी म ें यथा जवजनर्ददष्ट प्रजतजर्द्ध दक्रयाकलापों के जसवाय, भारत सरकार के तत्क ालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्या का.अ. 1533(ऄ), तारीख 14 जसतंबर, 2006 की ऄजधसूचना के ऄनुसूची के ऄधीन ऐसे दक्रयाकलापों, जजन्द्ह ें सज‍मजलत नहीं दकया गया ह,ै परंत ु पाररजस्ट्थजतकी संवेदी जोन म ें अत े ह,ैं ऐसे दक्रयाकलापों की वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं पर अधाररत जनगरानी सजमजत द्वारा संवीक्षा की जाएगी और ईसे संबद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया जाएगा ।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 13 (5) जनगरानी सजमजत का सदस्ट्य-सजचव या संबद्ध ईपायुक् त या संबंजधत ईपायुि ऐस े व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी ईपबंध का ईल्लंघन करता ह,ै पयाावरण ऄजधजनयम की धारा 19 के ऄधीन पररवाद दायर करन े के जलए सक्षम होगा। (6) जनगरानी सजमजत संबंजधत जवभागों के प्रजतजनजधयों या जविेर्ज्ञों, औद्योजगक संघों के प्रजतजनजधयों या सबं ंजधत पक्षों को, प्रत्येक मामले मे अवश्यकता के ऄनुसार, ऄपन े जवचार-जवमिा म ें सहायता के जलए अमंजत्रत कर सकेगी । (7) जनगरानी सजमजत प्रत्येक वर्ा 31 माचा की जस्ट्थजत के ऄनुसार ऄपनी वार्वर्क कारावाइ ररपोट ा राज्य के मुख्य वन्द्यजीव वाडान को, ईपाबधं V म ेंददए गए प्रपत्र के ऄनुसार, ईस वर्ा की 30 जून तक प्रस्ट्तुत करेगी । (8) केन्द्रीय सरकार का पयाावरण, वन और जलवाय ु पररवतान मंत्रालय जनगरानी सजमजत को ईसके कृत्यों के प्रभावी जनवाहन के जलए ऐसे जनदेि दे सकेगा जो वह ईजचत समझे । 7. आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए केंरीय सरकार और राज्य सरकार, ऄजतररक्त ईपाय, यदद कोइ हों, जवजनर्ददष् ट कर सकेंगी । 8. आस draft notification S.O. 2635(E), dated 5th August, 2019, the following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in esz-mef@nic.in Draft Notification WHEREAS, the Bhadra Wildlife Sanctuary (Tiger Reserve) is situated in Chikkamagaluru, Tarikere and Narsimha Raja Pura Talukas of Chikkamagaluru District and Shivamogga and Bhadravthi Talukas of Shivamogga District of Karnataka State and lies between 130 22’ to 130 47’ N latitude, 750 29’ to 750 45’ E longitude; AND WHEREAS, initially the area was declared as Jagara Valley Sanctuary in 1951. Later, the area was re-constituted as Bhadra Wildlife Sanctuary (Tiger Reserve) in the year 1974 vide notification no. AFD 25 FW174 dated the 6th September, 1974 for an area of 492.46 square kilometers. The final notification was issued in the year 1998 vide G.O. No.FEE 58 FWL 96 dated the 9th March, 1998. Subsequently, after the relocation of 418 families from 12 villages from the Sanctuary, an additional area of ~8 sq km was notified as Sanctuary in the year 2010 under several other notifications. The Sanctuary consists of 14 Reserved Forests and 2 Minor Forests in Block-A and one Reserve Forest in Block-B. The current area of the Sanctuary 500.16 square kilometers includes 87 square kilometers of backwaters of the Bhadra Reservoir; AND WHEREAS, the Bhadra Wildlife Sanctuary (Tiger Reserve) is contiguous with Shettihalli Wildlife Sanctuary to the northwest connected through Aramballi, Kakanahosudi, Umblebylu and Choranadahalli Reserved Forests. The Sanctuary was declared as a Tiger Reserve vide GOI letter No:1-17/94-PT dated the 23rd December, 1998 and as Core Critical Tiger Habitat vide Govt. of Karnataka Notification No: FEE-299 FWL 2007 dated the 20th December, 2007; AND WHEREAS, the Tiger Reserve consists of varied forest types including dry and moist deciduous and semi evergreen forests and also shola grassland vegetation in Kemmangundi area within the Sanctuary limits; AND WHEREAS, Bhadra Wildlife Sanctuary (Tiger Reserve) supports good densities of large mammal species and 42 mammal species have been recorded. The major wildlife found in this sanctuary includes tiger,[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 23 leopard, wild dog, sloth bear, elephant, gaur, sambar, mouse deer, flying squirrel and otters. Nearly 264 species of birds have been identified here. Important avifauna found in the Sanctuary include Malabar pied hornbill, great pied hornbill, Malabar grey hornbill which is endemic to the Western Ghats and other species. King cobra, marsh crocodile and other reptiles are also found in this Sanctuary; AND WHEREAS, the Bhadra Reservoir built across the Bhadra River forms a part of the Sanctuary. This protected area is also the catchment of the other important streams including Somavahini, Tadabehalla that flow through the Sanctuary and finally join the Bhadra River and the Bhadra Reservoir built across the Bhadra River; AND WHEREAS, Rare, Endangered and Threatened (RET) species of flora found in Bhadra Wildlife Sanctuary (Tiger Reserve) are bilva pathre (Aegle marmelos), dindiga (Anogeissius latifolia), muttuga (Butea monosperma), urugalu (Choleoxylon Swictenia), beete (Dalbergia latifolia), kamara (Hardiwiekea binata), honne (Pterocarpus marsupium), shrigandha (Santalum album), sagade (Schleichera oleosa), matti (Terminalia tomentosa), tare (Terminalia bellerica), hale, halgouri (Wrightia tinctoria), jalari (Shorea), etc; AND WHEREAS, Rare, Endangered and Threatened (RET) species of mammals found in Bhadra Wildlife Sanctuary (Tiger Reserve) are tiger (Panthera tigris), leopard (Panthera pardus), jungle cat (Felis chaus), leopard cat (Felis bengalensis), wild dog (Cuon alpinus), elephant (Elephas maximus), gaur (Bos gaurus), sambar (Cervus unicolor), spotted deer (Axis axis) barking deer (Muntiacus muntjac), mouse deer (Tragulus meminna) Indian wild boar (Sus scrofa), pangolin (Manis crassicaudata) common langur (Presbytis entellus) bonnet macaque (Macaca radiate) slender lorries (Loris tardigradus), small Indian civet (Viverricula indica), Malabar civet (Viverra megaspila) common palm (civet Paradoxurus hermaphroditus), common mangoose (Herpestes edwardsi), stripenecked mongoose (Herpestes vitticollis) brown mongoose (Herpestes fuscus), sloth bear (Melursus ursinus), giant flying squirrel (Petaurista petaurista), Malabar giant squirrel (Ratufa indica), Indian porcupine (Hystrix indica), Indian hare (Lepus nigricollis), common otter (Lutra lutra), striped hyena (Hyaena hyaena), jackal (Canis aureus), dusky striped squirrel(Funambulus sublineatus), grey musk shrew (Suncus murinus), Indian pipistrelle (Pipistrellus coromandra), flying fox (Pteropus giganteus), slender loris (Loris tardigradus) common palm civet (Paradoxurus paradoxurus), etc; AND WHEREAS, Rare, Endangered and Threatened (RET) species of birds found in Bhadra Wildlife Sanctuary (Tiger Reserve) are jungle babbler (Turdoides striatus), black-headed babbler (Rhopocichla atriceps), common babbler (Turdoides caudatus), rufous-bellied babbler (Dumetia hyperythra), slaty-headed scimitar-babbler (Pomatorhinus schisticeps), spotted babbler (Pellorneum ruficeps), quaker babbler (Alcippe poioicephala), red- whiskered bulbul (Pycnonotus jocosus), red-vented bulbul (Pycnonotus cafer), yellow-browed bulbul (Hypsipetes indicus), white-browed bulbul (Pycnonotus luteolus), black bulbul (Hypsipetes madagascariensis), ruby-throated bulbul (Pycnonotus melanicterus gularis), pied buschat (Saxicola caprata), collared bushchat (Saxicola torquata), black red start (Phoenicurus ochruros phoenicuroid), blackbird (Turdus merula), black-headed bunting (Emberiza melanocephala), crimson breasted barbet (Megalaima haemacephala), crimson throated barbet (Megalaima rubricapilla rubricapilla), large green barbet (Megalaima zeylanica), chestnut-headed bee-eater (Merops leschenaultia), blue bearded bee-eater (Nyctoyornis athertoni), green bee-eater (Merops orientalis), Malayan night heron (Gorsachius melanolophus), etc; AND WHEREAS, Rare, Endangered and Threatened (RET) species of snakes found in Bhadra Wildlife Sanctuary (Tiger Reserve) are king cobra (Ophiophagus Hannah), Indian cobra (Naja naja), common Indian krait (Bungarus caeruleus), Russel's viper (Vipera russellii), bamboo pit viper (Trimeresurus gramineus), hump nosed pit viper (Hypnale hypnale), common worm snake (Typhlina bramina), shield tail (Uropeltis ocellatus), Indian rock python (Python molurus), trinket snake (Coelognathus Helena), common kukri snake (Oligodon arnensis) bronze- backed tree snake (Dendrelaphis tristis), flying snake (Chrysopelea ornate), checkered keelback snake (Xenochrophis piscator), etc; AND WHEREAS, Rare, Endangered and Threatened (RET) species of reptiles found in Bhadra Wildlife Sanctuary (Tiger Reserve) are common crocodile (Crocodylus porosus), monitor lizard (Varanus flavescens), mugger or harsh crocodile (Crocodylus palustris), Indian black turtle (Melanochelys trijuga), Indian flapshell turtle (Lissemys punetata), Roux's forest calotes (Calotes rouxii), draco or flying lizard (Draco dussumieri), chamaeleon (Chamaeleo Zeylanicus), keeled Indian Mabuya (Mabuya carinata), common Indian monitor (Varanus bengalensis), etc; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Bhadra Wildlife Sanctuary (Tiger Reserve) which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 1.0 kilometre to 12.524 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] kilometres around the boundary of Bhadra Wildlife Sanctuary (Tiger Reserve), in Chikkamagaluru and Shivamogga districts in the State of Karnataka as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco- sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 1.0 kilometre to 12.5 kilometres around the boundary of Bhadra Wildlife Sanctuary (Tiger Reserve) and the area of the Eco-sensitive Zone is 740.56 square kilometres. (2) The boundary description of Bhadra Wildlife Sanctuary (Tiger Reserve) and its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Bhadra Wildlife Sanctuary (Tiger Reserve) demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA. (4) List of geo-coordinates of the boundary of Bhadra Wildlife Sanctuary (Tiger Reserve) and Eco-sensitive Zone are given in Table A and Table B of Annexure III. (5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. (6) The list of notified Reserve Forests located within the Eco-sensitive Zone of Bhadra Wildlife Sanctuary (Tiger Reserve) is appended as Annexure-V. 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purposes of the Eco- sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Karnataka Pollution Control Board; and (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 25 (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer:26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco- education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 27 Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011, Amendment thereunder and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995 and dated the 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012. 2. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. Small scale non polluting industries. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government.[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 31 (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure VI. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal. [F. GARKOTI, Scientist ‘G’ ANNEXURE-I ECOSENSITIVE ZONE AROUND BHADRA WILDLIFE SANCTUARY (TIGER RESERVE) IN THE STATE KARNATAKA North:- The boundary starting from the tri-junction bandhs of Kakanahosudi-Siddamaji Hosur and Kaithottlu villages, the line runs towards North-East direction along the northern boundary of Kakanahosudi - Bairapura –Umblebylu and Hunasekatte village to meet the tri-junction bandh of Hunasekatte-Huliyaramankoppa & Kalanayakanakatte village. East:- Then the line runs towards South east, South, South West and South East direction along the Eastern boundary of Hunasekatte, Thammadihalli, Gonibeedu, Mallenahalli, Thavarearghatta, Nellisara, Hunasenahalli, Kanchikoppa, Doddakundur, Haruvanahalli and Baragenahalli to meet the corner bandhs of Bargenahalli and Waddaradibba villages and then line runs in the South easterly direction along the Eastern boundary of Baragenahalli, Gurupura, Waddarabeeranahalli, Nandibattlu, Ranganathapura, Kallathipura, Kamanadurga, Attigiri villages and then the line runs towards South Easterly direction along the Eastern boundaries of Dattathreya peeta, Kolagame, Malagaru, Kolagame, Pandaravalli villages.
