(2) उ3 योजना राlय सरकार म! स+म (cid:10)ािधकारी 0ारा अनुमो(cid:22)दत (cid:22)कया जाएगा ।
(3) पा.रि9थितक(cid:9) संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म! िविनPदBट रीित से राl य सरकार 0ारा (cid:10)ासंिगक
क!’ीय और राl य िविधय4 तथा क!’ीय सरकार 0ारा जारी माग)िनदशn 4, य(cid:22)द कोई ह4, के अनु?प तैयार क(cid:9) जाएगी ।
(4) आंचिलक महायोजना, पा.रि9थितक(cid:9) और पया)वरणीय संबंधी सरोकार4 को समाकिलत करने के िलए राlय सरकार के िन"िलिखत
िवभाग4 के परामश) से तैयार क(cid:9) जाएगी, अथा)त्:--
(i) पया)वरण;
(ii) वन;
(iii) शहरी िवकास;
(iv) पय)टन;
(v) नगरपािलका;
(vi) राज9 व;
(vii) कृिष;
(viii) उ1र (cid:10)दशे राl य (cid:10)दषू ण िनयं(cid:3)ण बोड);
(ix) qसचाई;
(x) लोक िनमा)ण िवभाग ।
(5) जब तक इस अिधसूचना म! िविनPदL न हो, आंचिलक महायोजना म! वतम) ान म! अनुमो(cid:22)दत भ-ू उपयोग, अवसंरचना और
(cid:22)(cid:31)याकलाप4 पर कोई (cid:10)ितबंध नहr लगाया जाएगा तथा आचंिलक महायोजना म! सभी (cid:10)कार क(cid:9) अवसंरचनाs और (cid:22)(cid:31)याकलाप4 क(cid:9)
बेहतरी क(cid:9) Kव9था क(cid:9) जाएगी िजससे (cid:22)क वे अिधक द+ और पा.रि9थितक(cid:9) अनुकूल बन सक!।
(6) आंचिलक महायोजना म! अनाNछा(cid:22)दत +े(cid:3)4 के जीणbkार, िवiमान जल िनकाय4 के संर+ण, आवाह +े(cid:3)4 के (cid:10)बंधन, जल-संभर4¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3
के (cid:10)बंधन, भू-जल के (cid:10)बंधन, मृदा और नमी के संर+ण, 9थानीय जनता क(cid:9) आवGयकताs तथा पा.रि9थितक(cid:9) एवं पया)वरण के ऐसे अ&य
पहलुs, िजन पर tयान दने ा आवGयक ह,ै क(cid:9) Kव9था क(cid:9) जाएगी ।
(7) आंचिलक महायोजना म! सभी िवiमान पूजा 9थ ल4, fामीण और शहरी बि9तय4, वन4 क(cid:9) uेिणय4 और (cid:22)क9म 4, कृिष +े(cid:3)4,
ऊपजाऊ भूिम, उiान4 एवं उiान4 क(cid:9) तरह के ह.रत +े(cid:3)4, बागवानी +े(cid:3)4, बगीच4, झील4 और अ&य जल िनकाय4 क(cid:9) सीमा का सहायक
मानिच(cid:3)4 के साथ िनधा)रण (cid:22)कया जाएगा।
(8) आंचिलक महायोजना के अंतग)त पा.रि9थितक(cid:9) संवेदी जोन म! िवकास को िविनयिमत तथा 9थ ानीय समुदाय4 क(cid:9) आजीिवका
सुर+ा के िलए, पा.रि9थितक(cid:9) अनकु ूल िवकास सुिनिG चत तथा संवAधत (cid:22)कया जायेगा।
(9) इस (cid:10)कार अनुमो(cid:22)दत आंचिलक महायोजना इस अिधसूचना के उपबंध4 के अनुसार मानीटरी के अपने कृ^य4 को करने क(cid:9) दिृL स े
मानीटरी सिमित के िलए एक संदभ) द9तावेज होगी ।

(cid:22)कए गए खुले 9थान4 का वािणlय और उiोग संबंधी िवकास (cid:22)(cid:31)याकलाप4 के िलए उपयोग या संप.रवत)न नहr (cid:22)कया जाएगा:
परंतु, िनगरानी सिमित क(cid:9) िसफा.रश पर और राlय सरकार के पूव) अनुमोदन स,े 9थानीय िनवािसय4 क(cid:9) आवासीय ज?रत4 को पूरा करने
के िलए पा.रि9थितक(cid:9) संवेदी जोन के भीतर कृिष भूिम के संप.रवत)न क(cid:9) अनुमित दी जा सकती ह,ै अथा)त ्:-
(i) पा.रि9 थितक(cid:9) अनुकूल पय)टन (cid:22)(cid:31)याकलाप4 के िलए पय)टक4 के अ9थ ायी आवासन के िलए पा.रि9थ ितक(cid:9) अनुकूल आरामगाह जैसे (cid:22)क
तंबू और लकड़ी के मकान, आ(cid:22)द;
(ii) िवiमान सड़क4 को चौड़ा करना और उ&ह !सुदढृ करना तथा नई सड़क4 का िनमा)ण;
(iii) बुिनयादी ढांच4 और नाग.रक सुिवधाs का िनमा)ण और नवीकरण;
(iv) (cid:10)दषू ण उ^पw न करने वाले लघु उiोग;
(v) fामीण उiोग4 सिहत कुटीर उiोग; सुिवधा भRडार और गृह वास सिहत 9थानीय सिु वधाएं जो पा.रि9थितक(cid:9) पयट) न म !सहायक ह;E और
(vi) बढ़ावा (cid:22)दए गए और पैरा-4 म! वAणत (cid:22)(cid:31)याकलाप :
परंतु यह भी (cid:22)क राlय सरकार के (cid:10)ासंिगक िनयम4 तथा िविनयम4 एवं +े(cid:3)ीय शहरी िनयोजन अिधिनयम के अधीन स+म (cid:10)ािधकारी के
पूव) अनुमोदन के िबना तथा संिवधान के अनुNछेद 244 के उपबंध4 अथवा त^समय (cid:10)वृ1 िविध, िजसके अंतग)त अनुसूिचत जनजाित और
अ&य परंपरागत वन िनवासी (वन अिधकार4 क(cid:9) मा&यता) अिधिनयम, 2006 (2007 का 2) भी है, के अनुपालन के िबना वािणिlयक या
औiोिगक िवकास (cid:22)(cid:31)याकलाप4 के िलए जनजातीय भूिम का (cid:10)योग अनुzात नहr होगा:
परंतु यह भी (cid:22)क पा.रि9 थितक(cid:9) सवं ेदी जोन के भीतर क(cid:9) भूिम के अिभलेख4 म! उ^पw (cid:22)कसी (cid:3)ु.ट क(cid:9), िनगरानी सिमित के िवचार (cid:10)ाF
करने के पmात,् राlय सरकार 0ारा (cid:10)^येक मामले म! एक बार शुिk क(cid:9) जाएगी और उ3 (cid:3)ु.ट के शुिkकरण क(cid:9) सूचना क!’ीय सरकार के
पया)वरण, वन और जलवायु प.रवत)न मं(cid:3)ालय को दी जाएगी ।
परंतु यह भी (cid:22)क उपयु)3 (cid:3)ु.ट के शुिkकरण म,! इस उप-पैरा म! यथा उपबंिधत के िसवाय, (cid:22)कसी भी दशा म! भ-ू उपयोग का प.रवत)न
सि{मिलत नहr होगा ।
परंतु यह भी (cid:22)क वन +े(cid:3) और कृिष +े(cid:3) जैसे ह.रत +े(cid:3) म! कोई पा.रणामी कमी नहr क(cid:9) जाएगी और अनु(cid:10)युaत या अनु^प ादक कृिष +े(cid:3)4
म! पुन: वनीकरण करने पया)वास4 एवं जैव िविवधता क(cid:9) बहाली के (cid:10)यास (cid:22)कए जाएंगे ।
(2) (cid:1)(cid:1)(cid:1)(cid:1)ााााककककृृृृििििततततकककक जजजजलललल (cid:31)(cid:31)(cid:31)(cid:31)ोोोोतततत -- सभी (cid:10)ाकृितक जल |ोत4, जलमाग} के आवाह +े(cid:3)4 क(cid:9) पहचान क(cid:9) जाएगी और आचंिलक महायोजना म! उनके
संर+ण और बहाली क(cid:9) योजना सि{ मिलत क(cid:9) जाएगी । इन +े(cid:3)4 म !या आसपास के +े(cid:3)4 म! (cid:10)ितिषk िवकास (cid:22)(cid:31)याकलाप4 के िलए राlय
सरकार 0ारा सYत (cid:22)दशािनदशn तैयार (cid:22)कए जाएंगे।
(3) पपपपययययटट!!टट!! नननन: (क) पा.रि9थितक(cid:9) संवेदी जोन के भीतर सभी नए पा.रि9थितक(cid:9) पय)टन (cid:22)(cid:31)याकलाप या िवiमान पय)टन (cid:22)(cid:31)याकलाप4 का
िव9तार पा.रि9थितक(cid:9) संवेदी जोन संबंधी पय)टन महायोजना के अनुसार होगा ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ख) पा.रि9थितक(cid:9) पय)टन महायोजना उ1र (cid:10)दशे के पय)टन िवभाग 0ारा राlय के पया)वरण और वन िवभाग के परामश) से तैयार क(cid:9)
जायेगी ।
(ग) पय)टन महायोजना आंचिलक महायोजना का एक घटक होगी ।
(घ) पा.रि9थितक(cid:9) पय)टन संबंधी (cid:22)(cid:31)याकलाप िन"ानुसार िविनयिमत ह4गे,:-
(i) बखीरा प+ी अभयारRय क(cid:9) सीमा से एक (cid:22)कलोमीटर के भीतर या पा.रि9थितक(cid:9) संवेदी जोन क(cid:9) सीमा तक, इसम! जो भी
िनकट हो, (cid:22)कसी होटल या .रसॉट) का नया संिwमा)ण अनुzात नहr (cid:22)कया जाएगा । तथािप, व&यजीव अभयारRय क(cid:9) सीमा से
एक (cid:22)कलोमीटर क(cid:9) दरू ी से परे पा.रि9थितक(cid:9) संवेदी जोन क(cid:9) सीमा तक नए होटल4 और .रसॉट} क(cid:9) 9थापना पय)टन महायोजना
के अनुसार पा.रि9थितक(cid:9) पय)टन सुिवधाs के िलए पूव) प.रभािषत एवं अभीिहत +े(cid:3)4 म! अनुzात क(cid:9) जाएगी।
(ii) पा.रि9थितक(cid:9) संवेदी जोन के अ&दर सभी नए पय)टन (cid:22)(cid:31)या-कलाप या िवiमान पय)टन (cid:22)(cid:31)याकलाप4 का िव9तार के&’ीय
सरकार, पया)वरण, वन और जलवायु प.रवत)न मं(cid:3)ालय 0ारा जारी माग)दश(cid:127) िसkातं 4 तथा पा.रि9थितक(cid:9) पय)टन पर बल दते े
7ए रा(cid:128)ीय बाघ संर+ण (cid:10)ािधकरण 0ारा जारी पा.रि9थितक(cid:9) पय)टन माग)दश(cid:127) िसkांत4 के अनुसार होगा ।
(iii) आंचिलक महायोजना का अनुमोदन (cid:22)कए जाने तक, पय)टन के िवकास तथा िवiमान पय)टन (cid:22)(cid:31)याकलाप4 के िव9तार को
वा9तिवक 9थल िविनPदL संवी+ा तथा िनगरानी सिमित क(cid:9) िसफा.रश के आधार पर संबंिधत िविनयामक (cid:10)ािधकरण4 0ारा
अनुzात (cid:22)कया जाएगा और पा.रि9थितक(cid:9) संवेदी जोन के भीतर (cid:22)कसी नये होटल/.रसॉट) या वािणिlयक (cid:10)ित(cid:130)ान का संिwमा)ण
अनुzात नहr होगा ।
(4) (cid:1)(cid:1)(cid:1)(cid:1)ााााककककृृृृििििततततकककक ििििववववररररााााससससतततत -------- पा.रि9थितक(cid:9) संवेदी जोन म! ब7मूQय (cid:10)ाकृितक िवरासत के सभी 9थल4 जैसे (cid:22)क सभी जीन पूल .रजव) +े(cid:3), शैल
संरचना, जल (cid:10)पात, झरने, दरn, उपवन, गुफाएं, 9थल, वनपथ, रोहण माग,) उ^(cid:10)पात आ(cid:22)द क(cid:9) पहचान क(cid:9) जाएगी और उ&ह! संरि+त (cid:22)कया
जाएगा तथा इस अिधसूचना के (cid:10)काशन क(cid:9) तारीख से छह माह के भीतर, उनक(cid:9) सुर+ा एवं संर+ण क(cid:9) उपयु3 योजना बनायी जाएगी जो
आंचिलक महायोजना का भाग होगी ।

क(cid:9) जाएंगी तथा उ&ह ेआंचिलक महायोजना म! शािमल (cid:22)कया जाएगा।

NOTIFICATION
New Delhi, the 30th January, 2018
S.O. 431(E).—In supersession of Ministry’s draft notification S.O. 3493(E), dated 22nd December, 2015, the
following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred
by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Envi-
ronment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the Environ-
ment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given
that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the
date on which copies of the Gazette containing this notification are made available to the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft notifica-

Draft Notification
WHEREAS, Bakhira Bird Sanctuary is situated in district Sant Kabir Nagar in the State of Uttar Pradesh, covering an
area of 2.894 sq km.
AND WHEREAS, the sanctuary is an open habitat of large number and variety of migratory and resident birds. Apart
from birds, the Sanctuary is also home to a variety of trees, shrubs, hydrophytes. About 40000 birds belonging to about
30 species have been listed during winters and the important birds visiting this sanctuary are Cormorants (Phalacrocorax
carbo), Herons (Ardeola grayii), Egrets (Ardea alba), Storks (Mycteria leucocephala), Pochard (Aythya ferina), Coot
(Fulica atra), Ducks (Anas platyrhynchos) etc., breeding of Sarus Crane (Antigone antigone) and the Rare Black Necked
Stork (Ephippiorhynchus asiaticus) have been recorded in the sanctuary and as regards biodiversity of this sanctuary, the
flora of this area is represented by semi- arid vegetation outside it, and a typical aquatic vegetation of the lake in plains of
North India.
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which is specified in
paragraph 1 of this notification around the protected area of Bakhira Bird Sanctuary as Eco-sensitive Zone from ecologi-
cal and environmental point of view and to prohibit industries or class of industries and their operations and processes in
the said Eco-sensitive Zone.
NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and clause (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3)¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 13
of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies the area to an extent up
to one kilo meters around the boundary of the Bakhira Bird Sanctuary in the State of Uttar Pradesh as the Bakhira Bird
Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall be with the periphery of 33.46 sq
km, the extent of upto one kilometer around the boundary of the Bakhira Bird Sanctuary situated in the Sant Kabir Nagar
district (260 54' 26.91" N Latitude 830 8' 55.75" E Longitude) of Uttar Pradesh.
(2) The map of the Bakhira Bird Sanctuary demarcating the Eco-sensitive Zone boundary and landuse pattern along
with geo co-ordinates is appended in Annexure – I .
(3) The list of villages along with latitude and longitude is appended as Annexure-II.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notifica-
tion in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification.
(2) The said Plan shall be approved by the Competent Authority in the State Government.
(3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such a manner as is
specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by
the Central Government, if any.
(4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, for integrating envi-
ronmental and ecological considerations into it:
(i) Environment,
(ii) Forest,
(iii) Urban Development,
(iv) Tourism,
(v) Municipal,
(vi) Revenue,
(vii) Agriculture,
(viii) Uttar Pradesh State Pollution Control Board,
(ix) Irrigation,
(x) Public Works Department,
(5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activi-
ties, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure
and activities to be more efficient and eco-friendly.
(6) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, man-
agement of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of
local community and such other aspects of the ecology and environment that needs attention.
(7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and
kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas,
orchards, lakes and other water bodies.
(8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development
for livelihood security of local communities.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying
out its functions of monitoring in accordance with the provisions of the final notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for giving
effect to the provisions of this notification, namely:-
(1) Land use.- Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes
in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related development
activities:
Provided that the conversion of agricultural and other lands, within the Eco-sensitive Zone may be permitted on the rec-
ommendation of the Monitoring Committee, and with the prior approval of the State Government to meet the residential

(i) eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tour-
ism activities;
(ii) widening and strengthening of existing roads and construction of new roads;
(iii) construction and renovation of infrastructure and civic amenities;
(iv) small scale industries not causing pollution;
(v) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism in-
cluding home stay; and
(vi) promoted activities and given in paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without
the prior approval of the State Government and without compliance of the provisions of Article 244 of the Constitution
of India or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers
(Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State
Government after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall
be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change:
Provided also that the above correction of error shall not include change of land use in any case except as provided under
this sub-paragraph:
Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and
efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration
activities.
(2) Natural springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and
rejuvenation shall be incorporated in the Zonal Master Plan. The strict guidelines shall be drawn up by the State Gov-

(3) Tourism.-(a) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone
shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b) The Eco-tourism Master Plan shall be prepared by the Uttar Pradesh State Department of Tourism in consultation
with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of tourism shall be regulated as under, namely:-
(i) no new construction of hotels and resorts shall be allowed within one kilometer from the boundary of the Bakhira Bird
Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer: provided that beyond the distance of one kil-
ometer from the boundary of the Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and
resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in ac-
cordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time)
with emphasis on eco-tourism;
(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be
permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the
Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within the
Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve are-
as, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a
heritage conservation plan shall be drawn up for their preservation and conservation within six months from the date of
publication of final notification in the official Gazette and such plan shall from part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic,
and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conserva-
tion shall be prepared within six months from the date of publication of final notification in the official Gazette and such
plan shall from part of the Zonal Master Plan.¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 15
(6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be carried out in accord-
ance with the Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986;
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance
with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder;
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provi-
sions of the water (Prevention control of pollution ) Act, 1974 (6 of 1974) and the rules made thereunder.
(9) Solid wastes. - Disposal and management of solid wastes shall be as under:-
(i) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid
Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forests and
Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time;
(ii) the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco-
sensitive Zone;
(iii) no burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under:-
(i) the bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical
Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change vide notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time;
(ii) no common treatment facility or incineration shall be permitted within the Eco- sensitive Zone.
(11) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the
Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management
Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide noti-
fication number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(12) Plastic waste management:- The plastic waste management in the Eco-sensitive Zone shall be carried out as per
the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as
amended from time to time.
(13) Electronic Waste. - The Electronic Waste (E-Waste) Management in the Eco-sensitive Zone shall be carried out as
per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change and as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is
prepared and approved by the Competent authority in the State Government, the Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution. - Prevention and control of vehicular pollution in the Eco-sensitive Zone shall be carried out in
accordance with applicable laws and effort shall be made for use of cleaner fuel for example CNG, etc.
(16) Industrial units. - (i) no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be permitted within Eco-sensitive Zone as per classification of Industries
in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in
the final notification.
(17) Protection of hill slopes. - The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;
(b) no construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive
Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made

6. Terms of Reference:
(1) The Monitoring Committee shall monitor the compliance of the provisions of the final Notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Commit-
tee by the State Government and subsequently the Monitoring Committee would be constituted by the State
Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in
the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof,
shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to
the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental
clearances under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erst-
while Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and are fall-
ing in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4
thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and re-
ferred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Collector(s) or the concerned park
Deputy Conservator of Forests shall be competent to file complaints under section 19 of the Environment (Pro-
tection) Act, 1986 against any person who contravenes the provisions of the final notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives
from Industry Associations or concerned stakeholders to assist in its deliberations depending on the require-
ments on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of eve-
ry year by 30th June of that year to the Chief Wildlife Warden of the State as per pro- forma appended at An-
nexure-III.
(8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such direc-
tions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional measures. - The Central Government and State Government may specify additional measures, if
any, for giving effect to provisions of this notification.
8. Supreme Court, etc. orders; The provisions of this notification shall be subject to the orders, if any, passed, or
