ऄधधधनयम, 1986 (1986 कय 29) की धयरय 3 की ईपधयरय (2) के खंड (v) और खंड (xiv) तथय ईपधयरय (3) के सयथ परित ईपधयरय (1) द्वयरय प्रदत्त शधियों कय प्रयोग करते हुए, जयरी करने कय प्रस्तयव करती ह,ै पययावरण (संरक्षण) धनयम, 1986 के धनयम 5 के ईपधनयम (3) की ऄपेक्षयनुसयर, जनसयधयरण की जयनकयरी के धलए, प्रकयधशत ह;ै धजनके ईससे प्रभयधवत होन े की संभयवनय ह,ै और यह ह ैदक ईि प्रयरूप ऄधधसूचनय पर, ईस तयरीख से, धजसको आस ऄधधसूचनय को ऄंतर्ववष् ट करन ेवयले भयरत के रयजपत्र की प्रधतययं जनसयधयरण को ईपलब्ध करय दी जयती ह,ैं सयि ददन की ऄवधध की समयधि पर यय ईसके पश्च यत् धवचयर दकयय जयएगय ; ऐसय कोइ व्यधि, जो प्रयरूप ऄधधसूचनय में ऄंतर्ववष्ट प्रस्तयवों के संबंध में कोइ यय सुझयव देने ह,ै ह आस प्रकयर धवधनर्ददष्ट ऄवधध के भीतर, केन्द्रीय सरकयर द्वयरय धवचयर दकए जयने के धलए, यय सुझयव सधचव, पययावरण, वन और जलवययु पररवतान मंत्रयलय, आंददरय पययावरण भवन, जोर बयग रोड, ऄलीगंज, नइ ददल्ली-110003 यय इ-मेल esz-mef@nic.in पर धलधखत रूप में भेज सकतय ह ै। प्रयरूप ऄधधसचू नय धतपेश् वर वन्द्य जीव ऄभययर्‍ य ह यवतमल धजले में धस्थत ह ैऔर 148.632 वगा दकलोमीटर क्षेत्र में फैलय हुअ ह।ै और, धतपेश् वर वन्द्य जीव ऄभययर्‍ य ए महत् वपूणा वन्द्य जीव ह ह ह ( ), तेंदअु (पेन्द्थेरय प्रड्यूस), ( ), भेधडयय( लुपस ), लकड़बग् घय(ह्ये ), ( ), नीलगयय( ), ह ( ), ( ), ह (ह ), स् तनधयररयों की 30 प्रजयधत -2 रीछ ( ), चौससगयमृग( ), –I अवयसी और प्रवयसी पक्षी ए ह।ै और, आस क्षेत्र में ईभयच , सरीसृ और धपसीन प्रजयधत पयइ जयती ह आस क्षेत्र में धततधलयों, की , भृं , केक ,झी , सीधपयों की और जूप् लयनककटोनस धवधवधतय पयए जय ह। और, ह ‘दधक्ष ण ईष्ण करटबधं ीय शुष् क पणापयती वन’ और यह 5ए/सी1ए के रूप में व कृत ह ैऔर धवधभ न्न अर्वथक, औषधीय, 356 GI/2018 (1)2 THE GAZETTE OF INDIA थल वनो के ऄंदर ही ह।ै और, वन्द्यजीव ऄभययर्‍य के चयरों ओर के क्षेत्र को, धजसकय धवस्तयर और सीमयएं आस ऄधधसूचनय के पैरय-1 में धवधनर्ददष्ट ह,ैं पयररधस्थधतकी औ पययावरण की दधृष्ट से पयररधस्थधतकी संवेदी जोन के रूप में सुरधक्षत और संरधक्षत करनय तथय ईि पयररधस्थधतकी संवेदी जोन में ईद्योगों यय ईद्योगों के प्रचयलन तथय प्रसंस्करण को प्रधतधषद्ध करनय अवश्यक ह ै; ऄतः, ऄब, केन्द्रीय सरकयर, पययावरण (संरक्षण) धनयम, 1986 के धनयम 5 के ईपधनयम (3) पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) की धयरय (1) तथय धयरय 3 (2) ए (3) के खंड (v) और खंड (xiv) द्वयरय प्रदत्त शधियों कय प्रयोग करते हुए, महयरयष्ट्र रयज् य के धतपेश् वर वन्द्य जीव ऄभययर्‍ य की सीमय के चय ओर 150 मीटर ( की दधक्षण-पधिम सीमय की ओर एक बहुत ही छोटे खंड के धलए जहयं नदी प्रस्तयधवत ऄभययर्‍य बनयती है) 11 दकलोमीटर तक के धवस् तयररत क्षेत्र को धतपेश् वर वन्द्य जीव ऄभययर्‍ य पयररधस् थधतक संवेदी जोन (धजसे आसमें आसके पश्च यत् पयररधस् थधतक संवेदी जोन कहय गयय ह)ै के रूप में ऄधधसूधचत करती ह,ै धजसकय धववरण धनम्नयनुसयर ह,ै ऄथयात ्:-- 1. पयररधस्थधतक संवदे ी जोन कय धवस्तयर और सीमय.-- (1) ह पयररधस्थधतक संवेदी जोन ऄक्षयंश 780 18’ 33.90” से 780 36’ 17.25” और देशयन्द्त र 19047’56.20” से 200 3’ 16. 83” धस् थ त ह ै । ह पयररधस्थधतकी संवेदी जोन 404.57 वगा दकलोमीटर क्षेत्र में धतपेश् वर वन्द् यजीव ऄभययर्‍ य की सीमय के ओर 150 मीटर से 11 दकलोमीटर तक धभ न्न-धभ न्द्न धवस् तयर के क्षेत्र में फैलय हुअ ह ैऔर आसकय सीमय वणान ईपयबधं I म ें ह ै। (2) पयररधस्थधतक संवेदी जोन कय मयनधचत्र ईपयबधं II के रूप में ह ै। (3) औ ए ईपयबधं III के रूप में ह।ै (4) पयररधस्थधतक संवेदी जोन अने वयले 60 ग्रयमों की सूची जी पी एस धनदेशयंक के सयथ, ईपयबधं IV के रूप में ह।ै 2. पयररधस्थधतकी संवदे ी जोन के धलए अचं धलक महययोजनय:– (1) रयज्य सरकयर, पयररधस्थधतकी संवेदी जोन के प्रयोजन के धलए, रयजपत्र में ऄंधतम ऄधधसूचनय के प्रकयशन की तयरीख से दो वषा की ऄवधध के भीतर, स्थयनीय व्यधियों के परयमशा से और आस ऄधधसूचनय में ददए गए ऄनुबंधों कय पयलन करते ए ए ह (2) ह रयज्य सरकयर के सक्षम प्रयधधकयरी ए । (3) पयररधस्थधतकी संवेदी जोन के धलए अचंधलक महययोजनय आस ऄधधसूचनय में धवधनर्ददष् ट रीधत रयज् य सरकयर प्रयसंधगक केंरीय और रयज् य धवधधयों तथय केंरीय सरकयर द्वयरय जयरी मयगाधनदे , यदद कोइ हों, तैययर ए । (4) ह औ ए ह रयज् य सरकयर के धनम्नधलधखत धवभयगों के परयमशा से तैययर की जययेगी,:-- (i) पययावरण; (ii) वन; (iii) ह धवकयस; (iv) पयाटन; (v) नगरपयधलकय; (vi) रयजस् व; (vii) कृधष ; (viii) रयज्य प्रदषू ण धनयंत्रण बोड ा (5) ह , अंचधलक महययोजनय ऄनुमोददत भ-ूईपयोग, ऄवसंरचनय और दक्रययकलयपों पर कोइ नहीं ए अचंधलक महययोजनय सभी ऄवसंरचनय और दक्रययकलयपों को ऄधधक दक्ष और पययावरण ऄनुकूल बनयने ए । (6)अंचधलक महययोजनय में ऄनयच्छयददत और ऄवक्रधमत क्षत्रे ों के जीणोद्धयर, धवद्यमयन जल धनकययों के संरक्षण, अवयह क्षत्रे ों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मृदय और नमी संरक्षण, स्थयनीय की अवश्यकतयओं तथय पयररधस्थधत ए पययावरण ऐसे ऄन्द्य पह ओं, धजन पर ध्ययन देनय अवश्यक ह,ै ए ।II (ii) 3 (7) अंचधलक महययोजनय सभी धवद्यमयन पूजय स् थलों, ग्रयमीण और ह , वनों की श्रेधणयों और दकस् मों, कृधष क्षत्रे ों, उपजयउ भूधम, ए ह हररत क्षे , , , और ऄन्द्य जल धनकययों ए । (8) ह के ऄंतगात वे ए - । (9) आस प्रकयर ऄनुमोददत अंचधलक महययोजनय आस ऄधधसूचनय के ईपबंधों के ऄनुसयर मयनीटरी के ऄपने कृत्यों को करने के धलए मयनीटरी सधमधत के धलए एक संदभा दस्तयवेज होगी । 3. रयज्य सरकयर द्वयरय दकए जयन ेवयल ेईपयय- रयज्य सरकयर आस ऄधधसूचनय के ईपबंधों को प्रभयवी के धलए धनम्नधलधखत ईपयय करेगी, ऄथयात्:-- (1) भ-ूईपयोग – (क) पयररधस्थधतकी संवेदी जोन में वनों, क्षत्रे ों, कृधष क्षत्रे ों, अमोद-प्रमोद के प्रयोजन के धलए धचधन्द्हत दकए गए और खुले स्थयनों कय वयधणधज्यक यय अवयसीय औद्योधगक दक्रययकलयपों के धलए ईपयोग यय संपररवतान नहीं ए : ( ) परंतु पयररधस्थधतकी संवेदी जोन के भीतर भयग (क) में धवधनर्ददष्ट प्रयोजन से धभन्न प्रयोजन के धलए कृधष और ऄन्द्य भूधम कय संपररवतान, मयनीटरी सधमधत की धसफयररश पर और क्षेत्रीय नगर योजनय ऄधधधनयम तथय और यथय लयगू केन्द्रीय/रयज्य सरकयर के ऄन्द्य धनयमों तथय धवधनयमों के ऄधीन सक्षम प्रयधधकयरी के पूवा ऄनुमोदन से, तथय आस ऄधधसूचनय के ईपबंधों द्वयरय स्थयनीय धनवयधसयों की धनम्नधलधखत अवयसीय जरूरतों को पूरय करने के धलए ऄनुज्ञयत दकयय जयएगय, जैस े :- (i) धवद्यमयन सड़कों को चौड़य करनय और ईन्द्ह ेंसुदढृ करनय औ नइ सड़कों कय संधनमयाण; (ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय संधनमयाण और नवीकरण; (iii) प्रदषू ण ईत्पन्न न करने वयले लघु ईद्योग, (iv) कुटीर ईद्योग धजसके ऄंतगात ग्रयमीण ईद्योग हैं; सुधवधय भ्‍डयर और स्थयनीय सुधवधयए , जो पयररधस्थधतकी पयाटन में सहययक हैं, धजसमें ग्रहवयस सधममधलत ह;ैऔर (v) संवर्वधत और पैरय 4 ( ) परंतु यह भी दक ह रयज्य सरकयर के ए ए तथय संधवधयन के ऄनच्ु छेद 244 के ईपबंधों तथय तत्समय प्रवृत्त धवधध, धजसके ऄंतगात ऄनुसूधचत जनजयधत और ऄन्द्य परंपरयगत वन धनवयसी (वन ऄधधकयरों की मयन्द्यतय) ऄधधधनयम, 2006 (2007 कय 2) भी ह,ै के ऄनुपयलन के धबनय वयधणधज्यक यय औ धवकयस दक्रययकलयपों के धलए जनजयतीय भूधम ह ह ( ) परंतु यह भी दक पयररधस् थधतकी संवेदी जोन के भीतर की भूधम के ऄधभलेखों में ईत्पन्न त्रुरट , धनगरयनी सधमधत के धवचयर प्रयि करने के पियत्, रयज्य सरकयर द्वयरय प्रत्येक मयमले में एक बयर शुधद्ध की जयएगी और ईि त्रुरट के शुधद्धकरण की सूचनय केंरीय सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को दी जयएगी । ( .) परंतु यह भी दक ईपयुाि त्रुरट के शुधद्धकरण में, आस ईप-पैरय में यथय ईपबंधधत के धसवयय, दकसी भी दशय में भू-ईपयोग कय पररवतान सधममधलत नहीं होगय । ( ) ऄ प्रयुक् त यय ऄनुत् पयदक कृधष क्षत्रे ों में पुन: वनीकरण औ - ह के प्रययस दकए जयएंगे । (2) प्रयकृधतक जल स्रोत -- सभी प्रयकृधतक जलमयगों के अवयह क्षेत्रों की पहचयन की जयएगी और अचंधलक महययोजनय में ईनके संरक्षण और बहयली की योजनय सधम मधलत की जयएगी औ आन क्षत्रे ों यय असपयस के क्षेत्रों ए ह प्रधतधषद्ध धवकयस दक्रययकलयपों के धलए रयज्य सरकयर द्वयरय ददशयधनदेश तैययर दकए जयएंगे। (3) पयटा न/पयररधस्थधतकी पयटा न: (क) पयररधस्थधतकी संवेदी जोन के भीतर सभी नए पयररधस्थधतकी पयाटन दक्रययकलय यय धवद्यमयन पयाटन दक्रययकलयपों कय धवस्तयर पयररधस्थधतकी संवेदी जोन संबंधी पयाटन महययोजनय के ऄनसु यर होगय । (ख) पयररधस्थधतकी पयाटन महययोजनय पयाटन धवभयग द्वयरय रयज्य के पययावरण और वन धवभयग के परयमशा से तैययर होगी । (ग) पयाटन महययोजनय अंचधलक महययोजनय कय एक घटक होगी । (घ) पयररधस्थधतकी पयाटन संबंधी दक्रययकलयप धनम्नयनुसयर धवधनयधमत होंगे,:- (i) वन्द्यजीव ऄभययर्‍य की सीमय से 1 दकलोमीटर के भीतर यय पयररधस्थधतकी संवेदी जोन की सीमय तक, आसमें जो भी धनकट हो, दकसी होटल यय ररसोटा कय नयय संधन्नमयाण ऄनुज्ञयत नहीं दकयय जयएगय । तथयधप, वन्द्यजीव ऄभययर्‍य की सीमय से 1 दकलोमीटर की दरू ी से परे पयररधस्थधतकी4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] संवेदी जोन की सीमय तक नए होटलों और ररसोटों की स्थयपनय पयाटन महययोजनय के ऄनुसयर पयररधस्थधतकी पयाटन सुधवधयओं के धलए पूव ा पररभयधषत एवं ऄभीधहत क्षेत्रों में ऄनज्ञु यत की जयएगी। (ii) पयररधस्थधतकी संवेदी जोन के ऄन्द्दर सभी नए पयाटन दक्रयय-कलयप यय धवद्यमयन पयाटन दक्रययकलयपों कय धवस्तयर केन्द्रीय सरकयर, पययावरण, वन और जलवययु पररवतान मंत्रयलय द्वयरय जयरी मयगादशी धसद्धयंतों तथय पयररधस्थधतकी पयाटन पर बल देत े हुए रयष्ट्रीय बयघ संरक्षण प्रयधधकरण द्वयरय जयरी पयररधस्थधतकी पयाटन मयगादशी धसद्धयंतों के ऄनुसयर होगय । (iii) अंचधलक महययोजनय कय ऄनुमोदन दकए जयने तक, पयाटन के धवकयस तथय धवद्यमयन पयाटन दक्रययकलयपों के धवस्तयर को वयस्तधवक स्थल धवधनर्ददष्ट संवीक्षय तथय धनगरयनी सधमधत की धसफयररश के अधयर पर संबंधधत धवधनययमक प्रयधधकरणों द्वयरय ऄनुज्ञयत दकयय जयएगय और पयररधस्थधतकी संवेदी जोन के भीतर दकसी नये होटल/ररसयटा यय वयधणधज्यक प्रधतष्ठयन कय संधन्नमयाण ऄनुज्ञयत नहीं होगय । (4) धवरयसत – पयररधस्थधत संवेदी जोन में धवरयसत के सभी स्थलों जैसे सभी जीन क्षत्रे , शैल , जल प्रपयत, झर , , ईपवन, गुफयएं, स्थल, , ह , पयत अदद की पहचयन की जयएगी तथय ए के धलए धवरयसत संरक्षण योजनय ए जो अंचधलक महययोजनय कय भयग हो । (5) मयनव धनर्वमत धवरयसत स्थ ल - पयररधस्थधतकी संवेदी जोन में भवनों, संरचनयओं, , ऐधतहयधसक, कलयत्मक और सयंस्कृधतक महत्व के क्षत्रे ों की पहचयन की जयएगी और संरक्षण के धलए धवरयसत संरक्षण योजनय बनययी जयएगी जो अंचधलक महययोजनय कय भयग होगी। (6) ध् वधन प्रदषू ण -- पयररधस्थधतकी संवेदी जोन में ध् वधन प्रदषू ण कय धनवयरण और धनयंत्रण, पययावरण (संरक्षण) ऄधधधनयम, 1986 के ऄधीन बनयए गए ध्वधन प्रदषू ण (धवधनयमन और धनयंत्रण) धनयम, 2000 के ऄनुसयर दकयय जयएगय । (7) वयय ुप्रदषू ण - पयररधस्थधत संवेदी जोन में, वययु प्रदषू ण कय धनवयरण एवं धनयंत्रण, वययु (प्रदषू ण धनवयरण और धनयंत्रण) ऄधधधनयम, 1981 (1981 कय 14) और ईसके ऄधीन बनयए गए धनयमों के ऄनुसयर ए । (8) बधहस्रयव कय धनस्सयरण - पयररधस्थधत संवेदी जोन में ईपचयररत बधहस्रयवों कय धनस्सयरण, पययावरण (संरक्षण) ऄधधधनयम, 1986 और ईसके ऄधीन बनयए गए धनयमों के ऄन्द्तगात ए ए पययावरणीय प्रदषू ण के धनस्सयरण संबंधी सयधयरण मयनकों यय रयज्य सरकयर द्वयरय धनयत मयनकों ह , के ऄनुसयर ए । (9) िोस ऄपधशष्ट - िोस ऄपधशष्ट कय धनपटयन और प्रबंधन धनम्नधलधखत रूप में होगय - (क) पयररधस्थधत संवेदी जोन में िोस ऄपधशष्ट कय धनपटयन औ भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की ऄधधसूचनय सं. कय.अ. 1357( ), 8 ऄप्रैल, 2016 ह िोस ऄपधशष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय। - ह ह ए ए - ए ; ( ) प्रौद्योधगदकयों (इएसएम) कय योग करते हुए धवद्यमयन धनयमों और धवधनयमों के ऄनुरूप िोस ऄपधश कय सुरधक्षत औ पययावरण प्रंबंधन ऄनुज्ञयत दकयय जययेगय। (10) जवै धचदक ऄपधशष्ट - (क) जैव धचदकत्सय ऄपधशष्ट कय धनपटयन धनम्न प्रकयर से दकयय जयएगय :- (क) पयररधस्थधत संवेदी जोन में जवै धचदक ऄपधशष्ट कय धनपटयन भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की – ऄधधसूचनय सं. .कय.धन 343 (ऄ), तयरीख 28 मयचा, 2016 तहत प्रकयधशत जैव धचदक ऄपधशष्ट प्रबंध धनयम, 2016 के ईपबंधों के ऄनुसयर दकयय जयएगय । ( ) प्रौद्योधगदकयों (इएसएम) कय योग करते हुए धवद्यमयन धनयमों और धवधनयमों के ऄनुरूप - ऄपधश कय सुरधक्षत औ पययावरण िोस प्रंबंधन ऄनुज्ञयत दकयय जययगे य। (11) ह - : - ह - अवयस-ऄनुकूल धवधनयधमत ए और आस संबंध में अंचधलक महययोजनय में धवशेष ईपबंध दकए जयएंगे अचं धलक महययोजनय के तैययर होन े और ऄनुमोददत ए तक, सधमधत औ ह ए ए धनयमों ए धवधनयमों के ऄनुसयर ह ह के ऄनुपयलन करेगी। (12) वयहन प्रदषू ण:- वयहन प्रदषू ण की रोकथयम और धनयंत्रण लयग ू धवधधयों के ऄनुसयर दकयय जयएगय। स्वच्छतर ईंधन जैसे दक सीएनजी, एलपीजी अदद के प्रयोग के प्रययस दकए जयएंगे । (13) प्लयधस्टक ऄपधशष्ट प्रबधं न: - पयररधस्थधत संवेदी जोन में प्लयधस्टक ऄपधशष्ट प्रबंध , भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की – ऄधधसूचनय सं.सय.कय.धन 340(ऄ), तयरीख 18 मयचा, 2016 के ह प्लयधस्टक ऄपधशष्ट प्रबंध धनयम, 2016 के दकयय जयएगय।II (ii) 5 (14) धनमयणा और धवध्वंस ऄपधशष्ट प्रबधं न: - पयररधस्थधत संवेदी जोन में धनमयाण और धवध्वंस ऄपधशष्ट प्रबंधन, भयरत सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय की – ऄधधसूचनय सं. .कय.धन 317(ऄ), तयरीख 29 मयचा, 2016 के ह संधनमयाण और धवध्वंस ऄपधशष्ट प्रबंधन धनयम, 2016 के ऄनुसयर दकयय जयएगय। (15) इ–ऄपधशष्ट:- पयररधस्थधत संवेदी जोन में इ–ऄपधशष्ट प्रबंध , भयरत सरकयर पययावरण, वन और जलवययु पररवतान मंत्रयलय द्वयरय प्रकयधशत इ– ऄपधशष्ट प्रबंध धनयम, 2016 – के ईपबंधों के ऄनुसयर दकयय जयएगय। (16) औद्योधगक इकयआयय:ं - (i) सरकयरी रयजपत्र में आस ऄधधसूचनय के प्रकयशन की तयरीख को यय ईसके बयद पयररधस्थधतकी संवेदी जोन के भीतर दकसी भी नए प्रदषू णकयरी ईद्योग की स्थयपनय ऄनुज्ञयत नहीं की जययेगी। (ii) जब तक आस ऄधधसूचनय में धवधनर्ददष्ट न हो, पयररधस्थधतकी संवेदी जोन में केंरीय प्रदषू ण धनयंत्रण बोडा द्वयरय फरवरी, 2016 में जयरी ददशयधनदेशों में दकए पहयड़ी ढलयनों कय संरक्षण धनम्नयनुसयर दकयय जययेगय: (क) अंचधलक महययोजनय में पहयड़ी ढलयनों के ईन क्षत्रे ों को दशयायय जयएगय धजनमें दकसी भी संधनमयाण की ऄनमु धत नहीं होगी । (ख) धजन धवद्यमयन खड़ी पहयड़ी ढलयनों यय ढलयनों में ऄत्यधधक भ-ूक्षरण होतय ह,ै ईनमें कोइ भी संधनमयाण ऄनुज्ञयत नहीं दकयय जययेगय । (18) केन्द्र सरकयर और रयज्य सरकयर, अवश्यक , आस ऄधधसूचनय के को प्रभयवी ए, ऄन्द्य ईपयय धनर्ददष्ट क । 4. प्रधतधषद्ध यय धवधनयधमत दकए जयन ेवयल ेदक्रययकलयपों की सचू ी - पयररधस्थधतकी संवेदी जोन में सभी दक्रययकलयप पययावरण (संरक्षण) ऄधधधनयम, 1986 (1986 कय 29) के ईपबंधों और ईसके तहत बनयए गए धनयमों तथय तटीय धवधनयमन जोन, 2011 और पययावरणीय प्रभयव अकलन ऄधधसूचनय, 2006 और वन (संरक्षण) ऄधधधनयम, 1980 (1980 कय 69), भयरतीय वन ऄधधधनयम, 1927 (1927 कय 16), वन्द्यजीव (संरक्षण) ऄधधधनयम, 1972 (1972 कय 53) के ईपबंधों यय पयररधस्थधत संवेदी जोन तक, आनमें जो धनकट ह , नए वयधणधज्यक होटल और ररसोटा ऄनुज्ञयत ह होंगे। परंतु, संरधक्षत क्षेत्र की सीमय से 1 दकलोमीटर के ह यय पयररधस्थधत संवेदी जोन तक, जो भी धनकट हो, ए ह औ ह । 11. संधनमयाण दक्रययकलयप । (क) संरधक्षत क्षेत्र की सीमय से एक दकलोमीटर के भीतर यय पयररधस्थधत संवेदी जोन तक, जो भी धनकट हो, दकसी भी प्रकयर कय वयधणधज्यक संधनमयाण ऄनुज्ञयत नहीं दकयय जयएगय: परंतु धल ए लोगों को, पैरय 6 के ईप पैरय (1) में सूचीबद्ध दक्रययकलयपों सधहत योग के धलए, भूधम में भवन ईप-धवधधयों के ऄनुसयर संधनमयाण करने की ऄनुमधत दी जयएगी :- (i) धवद्यमयन सड़कों को चौड़य करनय और ईन्द्ह ेंसुदढृ करनय और नइ सड़कों कय संधनमयाण; (ii) बुधनययदी ढयंचों और नयगररक सुधवधयओं कय संधनमयाण और नवीकरण; (iii) ह कुटीर ईद्योग, सुधवधय भ्‍डयर और ह ह पयररधस्थधतकी पयाटन में सहययक स्थयनीय सुधवधयएं ह; और (iv) आस ऄधधसूचनय में सूचीबद्ध ददए गए दक्रययकलयप । 12. गैर प्रदषू णकयरी लघु ईद्योग । फरवरी, 2016 में केन्द्रीय प्रदषू ण बोडा द्वयरय जयरी ईद्योगों के वगीकरण के ऄनुसयर गैर-प्रदषू णकयरी ईद्योग तथय ऄपररसंकटमय लघु और सेवय ईद्योग, कृधष, पुष्प कृधष, बयगबयनी यय कृधष अधयररत ईद्योग, जो पयररधस्थधतकी संवेदी जोन से ईत्पयद बनयते ह,ैं सक्षम प्रयधधकयरी द्वयरय ऄनुज्ञयत होंगे। 13. वृक्षों की कटयइ । (क) रयज्य सरकयर के सक्षम प्रयधधकयरी की पूव ा ऄनुमधत के धबनय वन भूधम यय सरकयरी यय रयजस्व यय धनजी भूधम पर वृक्षों की कटयइ नहीं होगी । (ख) वृक्षों की कटयइ केंरीय यय संबंधधत रयज्य के ऄधधधनयम यय ई के ऄधीन बनयए गए धनयमों के ईपबंधों के ऄनुसयर धवधनयधमत होगी । 14. वन ईत्पयदों और गैर कयष्ठ वन ईत्पयदों लयगू धवधधयों के ऄधीन धवधनयधमत होगय । (एनटीएफपी) कय संग्रहण । 15. नयगररक सुधवधयओं सधहत बुधनययदी ढयंचय। लयगू धवधधयों, धनयमों और धवधनयमों तथय जूदय ददशयधनदेशों के ऄनुसयर ईपशमन ईपययों के सयथ दकयय जययेगय। 16. पयाटन से संबंधधत ऄन्द्य दक्रययकलयप जैसे दक लयगू धवधधयों के ऄधीन धवधनयधमत होगय । पयररधस्थधतकी संवेदी जोन क्षेत्र के उपर से गमा वययु के गुब्बयरे, हले ीकयप्टर, ड्रोन, मयआक्रोलयआट्सII (ii) 7 अदद जैसे दक्रययकलयप । 17. फमों, कॉपोरेट, कंपधनयों द्वयरय बड़े पैमयने पर स्थयनीय लोगों के ईपयोग के धलए लयगू धवधधयों के ऄनुसयर प्रधतधषद्ध ( ईपबंधधत वयधणधज्यक पशुधन संपदय और कुक्कुट फयमों की के धसवयय) । स्थयपनय । 18. धवद्युत और संचयर टॉवर लगयने और तयर-धबछयने लयगू धवधधयों के ऄधीन धवधनयधमत होगय एवं ऄन्द्य बुधनययदी ढयंचे की व्यवस्थय । 19. होटलों और लॉज के धवद्यमयन पररसरों में बयड लयगू धवधधयों के ऄधीन धवधनयधमत होगय । लगयनय 20. प्रयकृधतक जल धनकययों यय भू क्षत्रे में जल धनकययों में ईपचयररत ऄपधशष्ट जल/बधहस्रयव के धनस्सयरण से बचय जयएगय। ईपचयररत/ऄपधशष्ट जल/बधहस्रयाव कय धनस्सयरण । ईपचयररत ऄपधशष्ट जल के पुनचाक्रण और पुन:ईपयोग के प्रययस दकए जयएंगे ऄन्द्यथय ईपचयररत ऄपधशष्ट जल/ बधहस्रयव कय धनस्सयरण लयगू धवधधयों के ऄनुसयर धवधनयधमत दकयय जयएगय। 21. सतही और भूजल कय वयधणधज्यक ए लयगू धवधधयों के ऄधीन धवधनयधमत होगय । धनष्कषाण । 22. कृधष यय ऄन्द्य ईपयोग के धलए खुले कुएं/ बोर कुएं समधुचत प्रयधधकयरी द्वयरय धवधनयधमत दकयय जयएगय तथय दक्रययकलयप की सख्त अदद कय धनमयाण । धनगरयनी की जयएगी। 23. वयधणधज्यक संकेत बोडा और होर्डडग । लयगू धवधधयों के ऄधीन धवधनयधमत होगय । 24. वययु, ध् वधन और ययधनक प्रदषू ण । लयगू धवधधयों के ऄधीन धवधनयधमत होगय । 25. धवदेशी प्रजयधतयों को लयनय । लयगू धवधधयों के ऄधीन धवधनयधमत होगय । 26. पयररधस्थधतकी पयाटन। लयगू धवधधयों के ऄधीन धवधनयधमत होगय । 27. सुरक्षय बल धशधव लयगू धवधधयों के ऄधीन धवधनयधमत होगय । 28. नए कयष् ि अधयररत ईद्योग पयररधस् थधतक संवेदी जोन के भीतर नए कयष् ि अधयररत ईद्योग की स् थयपनय ऄनुज्ञयत नहीं होगी परंतु पयररधस्थधतक संवेदी जोन में 100% अययधतत कयष् ि क करने वयल े नए कयष् ि अधयररत ईद्योग की स् थयपनय की जय सकेगी । 29. पयररधस्थधतक ऄनुकूल पयाटन दक्रययकलयपों के धलए लयगू धवधधयों के ऄधीन धवधनयधमत होगय । पयाटकों के ऄस्थ ययी अवयसन ह पयररधस्थधतक ऄनुकूल अरयमगयह जैसे टेंट, लकड़ी के मकयन अदद ; 30. िोस ऄपधशष्ट प्रबंधन (धनपटयन और ऄपधशष्ट लयगू धवधधयों के ऄधीन धवधनयधमत होगय । धनपटयन को छोड़कर) ग. सवं र्वधत दक्रययकलयप 31. वषया जल संचयन । सदक्र य रूप से बढयवय ददयय जयएगय । 32. जैधवक खेती। सदक्र य रूप से बढयवय ददयय जयएगय । 33. सभी गधतधवधधयों के धलए हररत प्रौद्योधगकी कय सदक्र य रूप से बढयवय ददयय जयएगय । ऄंगीकरण । 34. ग्रयमीण कयरीगरी सधहत कुटीर ईद्योग। सदक्र य रूप से बढयवय ददयय जयएगय । 35. नवीकरणीय उजया और ईंधन कय प्रयोग । बययोगैस, सौर प्रकयश आत्ययदद को सदक्रय रुप से बढयवय ददयय जयएगय। 36. कृधष वयधनकी । सदक्र य रूप से बढयवय ददयय जयएगय । 37. पयररधस्थधतकी ऄनुकूल ययतयययत कय योग । सदक्र य रूप से बढयवय उपर ईधल्लधखत प्रधतधषद्ध दक्रययकलयप प्रयरूप ऄधधसूचनय जयरी ह की तयरीख से ह । 5. धनगरयनी सधमधत.- पयररधस्थधतक संवेदी जोन की प्रभयवी धनगरयनी के धलए ए एक धनगरयनी सधमधत गरित करती ह,ै जो धनम्नधलधखत से धमलकर सयरणी में यथय धवधनर्ददष्ट , ए औ ह ईि ऄधधसूचनय के ईपबंधों के ऄधीन पूवा पययावरण स्वीकृधत के धलए केन्द्र सरकयर के पययावरण, वन और जलवययु पररवतान मंत्रयलय को भेजय ए । (4) वे दक्रययकलयप, जो भयरत सरकयर के तत्कयलीन पययावरण एवं वन मंत्रयलय की ऄधधसूचनय संख्यय कय.अ. 1533(ऄ), तयरीख 14 धसतंबर, 2006 की ऄ सूची के ऄंतगात नहीं अते ह,ैं परन्द्तु जो पयररधस्थधतकी संवेदी जोन के ऄंतागत अते ह,ैं ईनकी, आस ऄधधसूचनय के पैरय-4 में दी गइ सयरणी में यथय धवधनर्ददष्ट प्रधतधषद्ध दक्रययकलय के धसवयय, वयस्तधवक स्थल धवधशष्ट दशयओं के अधयर पर, धनगरयनी सधमधत द्वयरय संवीक्षय की जययगे ी और ईन्द्ह ेंसंबंधधत धवधनययमक प्रयधधकरणों को भेजय जययेगय। (5) धनगरयनी सधमधत कय सदस्य-सधचव यय संबंधधत कलेक्टर यय संबंधधत आस ऄधधसूचनय के ईपबंधों कय ईल्लंघन करने वयले दकसी व्यधि के धवरुद्ध पययावरण (संरक्षण) ऄधधधनयम, 1986 की धयरय 19 के ऄंतगात धशकययत दजा करने के धलए सक्षम होगय । (6) धनगरयनी सधमधत प्रत्येक मयमले में अवश्यकतयओं के अधयर पर संबंधधत धवभयगों के प्रधतधनधधयों यय धवशेषज्ञों, औद्योधगक संघों के प्रधतधनधधयों यय संबंधधत पक्षों को ऄपने धवचयर-धवमशा में सहययतय के धलए अमंधत्रत कर सकेगी । (7) धनगरयनी सधमधत प्रत्येक वषा 31 मयचा की धस्थधत के ऄनुसयर ऄपनी वयर्वषक कयरावयइ ररपोटा रयज्य के मुख्य वन्द्यजीव वयडान को, ईपयबधं V म ें ददए गए प्रपत्र के ऄनुसयर, ईस वषा की 30 जून तक प्रस्तुत करेगी । (8) केन्द्रीय सरकयर कय पययावरण, वन और जलवययु पररवतान मंत्रयलय धनगरयनी सधमधत को ईसके कृत्यों के प्रभयवी धनवाहन के धलए ऐसे धनदेश दे सकेगय जो वह ईधचत समझे Draft Notification WHEREAS, Tipeshwar Wildlife Sanctuary situated in Yavatmal district of Maharashtra State is spread over an area of 148.632 sq.kms. AND WHEREAS, Tipeshwar Wildlife Sanctuary is an important wildlife habitat and needs to be conserved suitably for protection of wild animals including 30 species of mammals such as Tiger (Panthera tigris) Leopard (Panthera pardus), Civet (Viverricula indica), Wolf (Canis lupus pallipes), Hyeana (Hyaena hyaena), Cheetal (Axis axis), Nilgai (Boselaphus tragocamelus), Black Buck (Antilope cervicapra), Jackal (Canis aureus), Porcupine (Hystrix indica), and including schedule-I species such as Sloth Bear (Melursus ursinus), four horned antelope (Tetracerus quadricornis) are found with varieties of residential and migratory bird species. AND WHEREAS, varieties of amphibian, reptilian and Piscean species are found in this area. Various kinds of invertebrates from zooplanktons varieties of butterflies, moths, beetles, odonates, crabs, prawns, spiders, shells are found in this area. AND WHEREAS, the forest type is ‘Southern Tropical Dry Deciduous forest and it is grouped as 5 A/C1a.’ It serves as a living repository of various economical, medicinal, aromatic and ornamental plant species.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] AND WHEREAS, primitive scheduled tribes like Kolam and Gond are sharing common habitat with wildlife of this area. These tribal communities resides adjacent to the forest. Their day to day requirements are fulfilled from the forests. Their deities and other religious places of worship are inside the forests. AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of which are specified in paragraph 1 of this notification around the protected area of Tipeshwar Wildlife Sanctuary as Eco- sensitive Zone from ecological and environmental point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone. NOW THEREFORE, in exercise of the power conferred by sub section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from 150 metres (for a very small stretch in the south-west side of the sanctuary where river forms the boundary of the proposed ESZ) to 11 kms around the boundary of Tipeshwar Wildlife Sanctuary in the State of Maharashtra as the Tipeshwar Wildlife Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:- 1. Extent and Boundaries of Eco-sensitive Zone.- (1) Eco-sensitive Zone is situated between - 78° 18' 33.90'' to 78° 36' 17.25'' East. Latitude- 19° 47' 56.20'' to 20° 3' 16.83'' North Longitude. The Eco-Sensitive Zone is spread over an area of 404.57 square kilometers with an extent varying from 150 meter to 11 kms around the boundary of Tipeshwar Wildlife Sanctuary and the boundary description of such Zone is given in Annexure-I. (2) The map of Eco-sensitive Zone is appended as Annexure-II. (3) GPS coordinates of boundary of Tipeshwar Wildlife Sanctuary and its ESZ are appended as Annexure-III. (4) The list of 60 villages falling in Eco-Sensitive Zone along with GPS coordinates is appended as Annexure-IV. 2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco- sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification. (2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government. (3) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (4) The Zonal Master Plan shall be prepared in consultation with all concerned State Departments, namely:- (i) Environment, (ii) Forest, (iii) Urban Development, (iv) Tourism, (v) Municipal, (vi) Revenue, (vii) Agriculture (viii) State Pollution Control Board,for integrating environmental and ecological considerations into it. (5) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (6) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (7) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.II (ii) 25 (8) The Zonal Master Plan shall regulate development in Eco-sensitive Zone so as to ensure Eco-friendly development and livelihood security of local communities. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Landuse.- (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco- sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities. (b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii)Small scale industries not causing pollution; (iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) Promoted activities and given under para 7. (c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): (d) Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: (e) Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (f) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural Springs.- The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism/ Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco- Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b)The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The activities of eco-tourism shall be regulated as under, namely:- (i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre- defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism; (iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area. (4) Natural Heritage.- Natural Heritage- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan. (6) Noise pollution.- Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder and amendments thereto. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes. - Disposal and Management of solid wastes shall be as under:- (a) The solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone. (b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (2) Bio-medical waste. – Bio medical waste management shall be as under: (a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016. (b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone. (11) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (12) Vehicular Pollution-Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc. (13) Plastic Waste Management:- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (14) Construction and Demolition Waste Management:- The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.II (ii) 27 (15) E-waste- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E- Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time. (16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted. (17) Protection of Hill Slopes.- The protection of hill slopes shall be as under: (a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. (b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted. (18) The Central Government and the State Government shall specify other measures, if it considers necessary, in giving effect to the provisions of this notification. 4. Prohibited, Regulated and Promoted Activities All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area, except for small temporary structures for Eco- tourism activities. Provided that, beyond one kilometre from the boundary of the protected Area or upto the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable. 11. Construction activities. (a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as: (i) Widening and strengthening of existing roads and construction of new roads; (ii) Construction and renovation of infrastructure and civic amenities; (iii) Cottage industries including village industries; convenience stores & local amenities supporting eco- tourism including home stays; and (iv) Promoted activities listed in this Notification. 12. Small scale non polluting industries. Non polluting industries termed as White Category as per classification of industries issued by the Central Pollution Control Board in February 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 13. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 14. Eco-sensitive Zone Monitoring Committee.- (1) The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the Eco-sensitive Zone, which shall comprise of the following namely:- 1. District Collector, Yavatmal Chairman; 2. Chief Executive Officer, Zilha Parishad, Yavatmal Member; 3. Regional Officer, Maharashtra State Pollution Control Board, Amravati Member; 4. Town Planning Officer, Yavatmal Member; 5. One representative of Non-Governmental Organization (working in the Member; field of environment and heritage conservation) to be nominated by the State Government for a period of three year 6. One expert in the area of ecology & environment to be nominated by the Member; State Government for a period of three year 7. Representative of Addl. Principal Chief Conservator Of Forests, (East) Member; Wildlife, Nagpur 8. Member of State Biodiversity Board Member; 9. Deputy Conservator of Forests, Pandharkawda Forest Division Member-Secretary. 6. Terms of Reference: (1) The Monitoring Committee shall monitor the compliance of the provisions of the final Notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
