तक लगभग 26 (cid:24)कलोमीटर क* लंबाई और उ/र स े दि)ण तक लगभग 7 (cid:24)कलोमीटर क* चौड़ाई म मोटे तौर पर आयताकार

आकार म ह ैऔर इसका िव(cid:27)तार राज(cid:27)व थान2 हजारीबाग, आईचक और पदमा के अंतग&त आने वाल े72 Qाम2 तक ह ै।
और, हजारीबाग व#यजीव अभयारLय म (cid:8)चुर जैव िविवधता ह।ै िवगत म, यह भारतवष& म सबस े बड़ा िहरण
(cid:8)जाित सांभर का िनवास था। इस पया&वास म चीतल, बनैला सूअर, काला भाल,ू िसयार, साही, लकडबTघा, साल, खरगोश
आ(cid:24)द भी रहते ह।@ यहाँ अWसर (cid:24)दखाई देन ेवाली महYवपणू &प)ी (cid:8)जाितया ँह @सरप ट ग9ड, पैराडाइस Zलाई कैचर, कौिडJला,
बी ईटर, सूइZट, िविभ\ (cid:8)कार के ब>लस&, >लकै ]ोनो, कठफोडवा, लैप_वंग, मटरमुगा,& बगलु ा, गौ,रया इ‘या(cid:24)द। यहां कभी-
कभी मासं भ)ी जैस े भिे डया और तद आु भी (cid:24)दखाई पडते ह।@ हजारीबाग िजल के गजट, 1917 म यह अवलो(cid:24)कत (cid:24)कया गया
था (cid:24)क दतं 2 क* पहािड़यां बाघ और त दeु के (cid:27)थायी पया&वास ह ैँजो हजारीबाग क(cid:27)ब2 म अWसर दखे े गए थ।े इस अभयारLय के
वन2 म हािथय2 का भी बसेरा ह।ै
और, हजारीबाग व#यजीव अभयारLय कई छोटी नदी (cid:8)णािलय2 जैस ेfेता, िसवान ेऔर दायता के जलQहण )े(cid:3)2 के
बीच ि(cid:27)थत है। यह संरि)त )े(cid:3), कई बरसाती (cid:8)ाकृितक न(cid:24)दय2 और झील2 के जलQहण )े(cid:3)2 के 9प म काय & करता ह।ै इस
संरि)त )े(cid:3)2 के वन भूजल ,रचाज& करने और िमiी के )रण को रोक कर नदी म गाद जमाव को रोकन ेम सहायक ह।@
और, इस संरि)त )े(cid:3) म िविवध (cid:8)कार के वन ह-@ जैस े (cid:24)क उ/री भारतीय आ$ & पणप& ाती वन, आ$ & एवं शु;क
(cid:8)ाय.ीपीय साल वन और उ/री शु;क िमिjत पण&पाती यह (cid:27)तनधा,रय2 क* 16, पि)य2 क* 124 और वन(cid:27)पितय2 क* 142
(cid:8)जाितय2 तथा त दआु , रीछ, साल, अजगर, इ‘या(cid:24)द (cid:24)क जैसी सकं टाप\ (cid:8)जाितय2 क* एक क* ब4त बड़ी आबादी का उ‘कृD
पया&वास ह।ै
और, हजारीबाग व#यजीव अभयारLय के सरं ि)त )े(cid:3) के चार2 ओर के )े(cid:3) को पा,रि(cid:27)थितक* और पया&वरण क*
दिृ;ट से पा,रि(cid:27)थ ितक* संवेदी जोन के 9प म सरं ि)त और सुरि)त करना आवB यक ह।ै
अतः, अब, के#$ीय सरकार, पया&वरण (सरं )ण) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प,ठत
पया&वरण (संर)ण) अिधिनयम, 1986 (1986 का 29) क* उपधारा (1) तथा धारा 3 क* उपधारा (2) एव ं उपधारा (3) के
खंड (v) और खंड (xiv) .ारा (cid:8)द/ शि1य2 का (cid:8)योग करत े4ए, झारखLड राoय म हजारीबाग व#यजीव अभयारLय क* सीमा
के चार2 ओर 5 (cid:24)कलोमीटर तक िव(cid:27)ता,रत )े(cid:3) को हजारीबाग व#यजीव अभयारLय पा,रि(cid:27)थितक* संवेदी जोन (िजसे इसम
इसके पBच ात ् पा,रि(cid:27)थितक* संवेदी जोन कहा गया ह)ै के 9प म अिधसूिचत करती ह,ै िजसका िववरण िन!ानसु ार ह,ै

(4) हजारीबाग अभयारLय पा,रि(cid:27)थितक* संवेदी जोन के अंतगत& आन ेवाल ेQाम2 क* सूची उउउउपपपपााााबबबबधधंंधधंं IIIIIIIIIIII के 9प म संलr ह।ै
2. पपपपाााा(cid:8)(cid:8)(cid:8)(cid:8)ररररिििि(cid:18)(cid:18)(cid:18)(cid:18)थथथथििििततततकककक(cid:21)(cid:21)(cid:21)(cid:21) ससससववंंववंं ददेेददेे ीीीी जजजजोोोोनननन ककककेेेे ििििललललएएएए आआआआंचंचंचंचििििललललकककक ममममहहहहााााययययोोोोजजजजननननाााा.–((((1111) राoय सरकार, पा,रि(cid:27)थितक* संवेदी जोन के (cid:8)योजन के
िलए, राजप(cid:3) म अंितम अिधसचू ना के (cid:8)काशन क* तारीख से दो वष& क* अविध के भीतर, (cid:27)थानीय Cि1य2 के परामश& स ेऔर
इस अिधसूचना म (cid:24)दए गए अनुबंध2 का पालन करत े 4ए, राoय सरकार के स)म (cid:8)ािधकारी के अनुमोदनाथ & एक आंचिलक

(2) राoय सरकार .ारा पा,रि(cid:27)थितक* संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म िविनHद;& ट रीित स े
तथा (cid:8)ासिं गक क $ीय और राoय िविधय2 के अन9ु प तथा क $ीय सरकार .ारा जारी (cid:24)दशा िनदशq 2, य(cid:24)द कोई ह2, के अनसु ार
बनायी जाएगी ।
(3) आंचिलक महायोजना म पा,रि(cid:27)थितक* और पया&वरण संबंधी सरोकार2 को शािमल करन े के िलए इस े राo य सरकार
के िन!िलिखत िवभाग2 के परामश& से बनाया जाएगा, अथा&त:्--
i. पया&वरण;
ii. वन और व#यजीव;
iii. कृिष और बागवानी;
iv. राज(cid:27)व ;
v. शहरी िवकास;
vi. पा,रि(cid:27)थितक* पय&टन सिहत पय&टन;
vii. Qामीण िवकास;
viii. _संचाई और बाढ़ िनयं(cid:3)ण;
ix. नगरपािलका और शहरी िवकास;
x. पंचायती राज और
xi. लोक िन मा&ण िवभ ाग।
(4) जब तक इस अिधसूचना म िविनHदD& न हो, आंचिलक महायोजना म वत&मान म अनमु ो(cid:24)दत भ-ू उपयोग, अवसंरचना
और (cid:24)(cid:30)याकलाप2 पर कोई (cid:8)ितबंध नहu लगाया जाएगा तथा आचिं लक महायोजना म सभी अवसंरचनाe और (cid:24)(cid:30)याकलाप2
म सधु ार करके उ#ह ेअिधक द) और पा,रि(cid:27)थितक*-अनकु ूल बनाने क* Cव(cid:27)था क* जाएगी।
(5) आंचिलक महायोजना म वनरिहत और अव(cid:30)िमत )े(cid:3)2 क* बहाली, िवvमान जल िनकाय2 के संर)ण, आवाह )े(cid:3)2
के (cid:8)बंधन, जल-सभं र2 के (cid:8)बंधन, भ-ू जल के (cid:8)बंधन, मदृ ा और नमी के सरं )ण, (cid:27)थानीय जनता क* आवBयकताe तथा
पा,रि(cid:27)थितक* एव ंपया&वरण के ऐसे अ#य पहलeु क* Cव(cid:27)था क* जाएगी िजन पर wयान (cid:24)दया जाना आवBयक ह।ै
(6) आंचिलक महायोजना म सभी िवvमान पूजा (cid:27) थल2, Qाम2 एवं शहरी बि(cid:27)तय2, वन2 क* jेिणय2 एव ं (cid:24)क(cid:27)म 2, कृिष
)े(cid:3)2, ऊपजाऊ भूिम, उvान2 एवं उvान2 क* तरह के ह,रत )े(cid:3)2, बागवानी )े(cid:3)2, बगीच2, झील2 और अ#य जल िनकाय2 क*
सीमा का िनधा&रण (cid:24)कया जाएगा तथा सहायक मानिच(cid:3) भी (cid:24)दया जाएगा। इस महायोजना म िवvमान और (cid:8)(cid:27)तािवत भ-ू
उपयोग क* िवशेषताe का >यौरा दने ेवाले मानिच(cid:3) भी (cid:24)दए जाएंगे।
(7) आंचिलक महायोजना म पा,रि(cid:27)थितक* संवेदी जोन म होन े वाल ेिवकास का िविनयमन (cid:24)कया जाएगा और सारणी म
यथासूचीबy (cid:8)ितिषy एवं िविनयिमत (cid:24)(cid:30)याकलाप2 का पालन (cid:24)कया जाएगा। इसम (cid:27) थानीय जनता क* आजीिवका क* सुर)ा
के िलए पा,रि(cid:27)थितक*-अनकु ूल िवकास का भी सिु नB चय एवं संवध&न (cid:24)कया जाएगा।
(8) आंचिलक महायोजना, )े(cid:3)ीय िवकास योजना क* सह-कािलक होगी ।
(9) अनुमो(cid:24)दत आंचिलक महायोजना, िनगरानी सिमित के िलए एक संदभ& द(cid:27)तावेज होगी ता(cid:24)क वह इस अिधसूचना के
उपबंध2 के अनुसार िनगरानी के अपने कत&C2 का िनव&हन कर सके ।

((((1111)))) भभभभ---ूू-ूू उउउउपपपपययययोोोोगगगग –––– (क) पा,रि(cid:27)थितक* संवेदी जोन म वन2, बागवानी )े(cid:3)2, कृिष )े(cid:3)2, मनोरंजन के िलए िचि#हत उvान2 और
खुल े (cid:27)थान2 का वृहद वािणिoयक या आवासीय प,रसर2 या औvोिगक (cid:24)(cid:30)याकलाप2 के िलए (cid:8)योग या संप,रवत&न अनुzात

(ख) परंत ु पा,रि(cid:27)थितक* संवदे ी जोन के भीतर भाग (क) म िविनHदD& (cid:8)योजन से िभ\ (cid:8)योजन के िलए कृिष और अ#य भूिम
का संप,रवत&न, िनगरानी सिमित क* िसफा,रश पर और स)म (cid:8)ािधकारी के पूव& अनुमोदन स,े )े(cid:3)ीय नगर योजना
अिधिनयम तथा यथा लागू के#$ीय/राoय सरकार के अ#य िनयम2 एव ं िविनयम2 के अधीन तथा इस अिधसूचना के उपबंध2 के
अनसु ार (cid:27)थानीय िनवािसय2 क* िन!िलिखत आवासीय ज9रत2 को पूरा करन ेके िलए अनुzात (cid:24)कया जाएगा:-
(i) िवvमान सड़क2 को चौड़ा करना, उ#ह सुदढृ करना और नई सड़क2 का सिं नमा&ण;
(ii) बुिनयादी ढांच2 और नाग,रक सुिवधाe का सिं नमाण& और नवीकरण;
(iii) (cid:8)दषू ण उ‘प\ न करन ेवाल ेलघ ुउvोग,
(iv) कुटीर उvोग एवं Qाम उvोग; पा,रि(cid:27)थितक* पय&टन म सहायक सुिवधा भLडार, (cid:27)थानीय सिु वधाए ंतथा Qह वास; और
(v) बढ़ावा (cid:24)दए गए और परै ा-4 म उिJलिखत (cid:24)(cid:30)याकलाप।
(ग) परंत ु यह भी (cid:24)क )े(cid:3)ीय शहरी िनयोजन अिधिनयम के अधीन स)म (cid:8)ािधकारी के पवू & अनमु ोदन के िबना तथा राoय
सरकार के अ#य िनयम2 एवं िविनयम2 एव ं संिवधान के अनुFछेद 244 के उपबंध2 तथा त‘समय (cid:8)वृ/ िविध, िजसके अंतगत&
अनसु िू चत जनजाित और अ#य परंपरागत वन िनवासी (वन अिधकार2 क* मा#यता) अिधिनयम, 2006 (2007 का 2) भी
आता है, का अनुपालन (cid:24)कए िबना वािणिoयक या औvोिगक िवकास (cid:24)(cid:30)याकलाप2 के िलए जनजातीय भिू म का (cid:8)योग अनुzात
नहu होगा।
(घ) परंत ु यह भी (cid:24)क पा,रि(cid:27)थ ितक* संवेदी जोन के अंतग&त आन े वाली भिू म के अिभलेख2 म 4ई (cid:24)कसी (cid:3)ु,ट को, िनगरानी
सिमित के िवचार (cid:8)ाA करने के पPात्, राoय सरकार .ारा (cid:8)‘यके मामल े म एक बार सधु ारा जाएगा और उ1 (cid:3)ु,ट को
सुधारन ेक* सूचना क $ीय सरकार के पया&वरण, वन और जलवाय ुप,रवत&न मं(cid:3)ालय को दी जाएगी ।
(ड.) परंत ुयह भी (cid:24)क उपयु&1 (cid:3)ु,ट को सधु ारन े म , इस उप-पैरा म यथा उपबंिधत के िसवाय, (cid:24)कसी भी दशा म भ-ू उपयोग का
प,रवतन& शािमल नहu होगा ।
(च) अनु(cid:8)युWत या अन‘ु प ादक कृिष )े(cid:3)2 म पुन: वनीकरण तथा पया&वास2 और जैव- िविवधता क* बहाली के (cid:8)यास (cid:24)कए
जाएंगे ।

जाएगी और उसम उनके संर)ण और पुन9yार क* योजना शािमल क* जाएगी ।

िवvमान पय&टन (cid:24)(cid:30)याकलाप2 का िव(cid:27)तार पा,रि(cid:27)थितक* संवेदी जोन स(cid:127)बंधी पय&टन महायोजना के अनुसार अनुzात होगा ।
(ख) पा,रि(cid:27)थितक* पय&टन महायोजना राoय सरकार के पया&वरण और वन िवभाग2 के परामश& स ेपय&टन िवभाग .ारा बनायी
जाएगी ।
(ग) पय&टन महायोजना आंचिलक महायोजना का घटक होगी ।
(घ) पा,रि(cid:27)थितक* पय&टन संबधं ी (cid:24)(cid:30)याकलाप िन(cid:127) नानुसार िविनयिमत (cid:24)कए जाएगं े, अथा&त ्:-
(i) व#यजीव अभयारLय क* सीमा स े एक (cid:24)कलोमीटर के भीतर या पा,रि(cid:27)थितक* संवेदी जोन क* सीमा तक, इनम
जो भी अिधक िनकट हो, (cid:24)कसी होटल या ,रजाट& का नया सि\मा&ण अनुzात नहu (cid:24)कया जाएगा। तथािप,
पा,रि(cid:27)थितक* पय&टन सिु वधाe के िलए व#यजीव अभयारLय क* सीमा से एक (cid:24)कलोमीटर क* दरू ी स े परे
पा,रि(cid:27)थितक* संवेदी जोन क* सीमा तक पूव& प,रभािषत और अभीिहत )े(cid:3)2 म पय&टन महायोजना के अनुसार, नए
होटल2 और ,रसोट~ क* (cid:27)थापना अनुzात क* जाएगी।
(ii) पा,रि(cid:27)थितक* संवेदी जोन के अ#दर सभी नए पय&टन (cid:24)(cid:30)या-कलाप2 या िवvमान पय&टन (cid:24)(cid:30)याकलाप2 का
िव(cid:27)तार, के#$ीय सरकार के पया&वरण, वन और जलवायु प,रवत&न मं(cid:3)ालय .ारा जारी (cid:24)दशािनदशq 2 तथा
पा,रि(cid:27)थितक* पय&टन पर बल दने े वाले रा(cid:128)ीय Cा(cid:129) संर)ण (cid:8)ािधकरण .ारा जारी पा,रि(cid:27)थितक* पय&टन संबंधी¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5
(cid:24)दशािनदशq 2 (समय-समय पर यथा संशोिधत) के अनसु ार होगा ।
(iii) आंचिलक महायोजना का अनमु ोदन होन े तक, पय&टन के िवकास और िवvमान पय&टन (cid:24)(cid:30)याकलाप2 के िव(cid:27)तार
को वा(cid:27)तिवक (cid:27)थल-िविशD संवी)ा तथा िनगरानी सिमित क* िसफा,रश के आधार पर संबंिधत िविनयामक
(cid:8)ािधकरण2 .ारा अनुzात (cid:24)कया जाएगा और पा,रि(cid:27)थितक* संवेदी जोन म (cid:24)कसी नए होटल/,रसाट& या वािणिoयक

S.O. 695.(E).—In supersession of Ministry’s draft notification S.O. 2244(E), dated 17th August, 2015, the
following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred
by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the
Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub-rule (3) of rule 5 of the

Draft Notification
WHEREAS, the Hazaribag Wildlife Sanctuary lies between latitudes 24001' to 24012' North and Longitudes
85013' and 85032' East in the Hazaribag district of Jharkhand. The sanctuary occupies an area of 186.25 sq km and is
roughly rectangular in shape covering a length of about 26 km from East to West and a breadth of about 7 km. from
North to South. It extends over 72 villages falling under the revenue thanas of Hazaribag, Ichak and Padma.
AND WHEREAS, the Hazaribag Wildlife sanctuary has a wide range of biodiversity. In the past, it was known
as the home of sambhars, the largest deer species of India. The habitat is also shared by cheetals, wild boars, black bears,
jackals, porcupines, hyenas, pangolins, hares, etc. The important bird species which can be spotted frequently are serpent
eagle, paradise fly catcher, king fisher, bee eater, swift, different types of babblers, black drongo, wood pecker, lapwing,
pea fowl, pond heron, egret, etc. Sometimes carnivores like wolves and leopards are also spotted. In the District
Gazetteer of Hazaribag, 1917, it was observed that the hills of Danto served as the permanent habitat of tigers and that of
leopards and were frequently visited the town of Hazaribag. The forests of the sanctuary also fall in the home range of
elephant.
Hazaribag Wildlife Sanctuary lies in the catchments of many small river systems like Kweta, Siwane and Daita.
The Protected Area also serves as the catchments of many rain-fed natural streams and lakes. The forests of the Protected
Area intercept rainfall to help recharge ground water aquifer and protect the river streams against silting by checking soil
erosion.
AND WHEREAS, The Protected Area is home to diverse types of forests - Northern Indian Moist Deciduous Forest,
Moist & Dry Peninsular Sal Forest and Northern Dry Mixed Deciduous Forest - and is an excellent habitat for significant
populations of 16 species of mammals, 124 species of birds and 142 species of flora, including leopards, sloth bears,
pangolins, python, etc., which are all endangered species.
AND WHEREAS, it is necessary to conserve and protect the area around the protected area of Hazaribag Sanctuary as
eco-sensitive zone from ecological and environmental point of view;
NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2)
and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of
the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent of 5 kilometres
around the boundary of Hazaribag Sanctuary in the State of Jharkhand as the Hazaribag Sanctuary Eco-sensitive Zone
(herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-
1. Extent and boundaries of Eco-sensitive Zone.-(1) The total area of the eco-sensitive zone of Hazaribag
Sanctuary is 667.87 square kilometers that falls in Hazaribag district. The extent of Eco-sensitive Zone where is from 2
kilo meters to 5 kilo meters.
(2) The map of the Eco-sensitive Zone boundary along with boundary description is at Annexure I;
(3) The list of geo co-ordinates of the boundary of the Protected Area and the Eco-Sensitive Zone is at Annexure II;
(4) The list of villages within Hazaribag Sanctuary Eco-sensitive zone is appended as Annexure III.
2. Zonal Master Plan for the Eco-sensitive Zone.- (1) The State Government shall, for the purpose of the Eco-
sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final
notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this
notification for approval of Competent Authority in the State Government.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is
specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by
the Central Government, if any.
(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating the
ecological and environmental considerations into the said plan:
i. Environment,

iii. Agriculture and Horticulture,
iv. Revenue,
v. Urban Development,
vi. Tourism including eco-tourism,
vii. Rural Development,
viii. Irrigation and Flood Control,
ix. Municipal and Urban Development,
x. Panchayati Raj, and
xi. Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and
activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all
infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water
bodies, management of catchment areas, watershed management, groundwater management, soil and moisture
conservation, needs of local community and such other aspects of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and
kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards,
lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of
existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities
listed in Table and also ensure and promote eco-friendly development for livelihood security of local communities.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out
its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by State Government.-The State Government shall take the following measures for
giving effect to the provisions of this notification, namely:-
(1) Landuse.- The State Government shall take the following measures for giving effect to the provisions of this
notification, namely:-
(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the
Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or
industrial activities.
(b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a),
within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the
prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of
Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the
local residents such as:
i. Widening and strengthening of existing roads and construction of new roads;
ii. Construction and renovation of infrastructure and civic amenities;
iii. Small scale industries not causing pollution;
iv. Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism
including home stay; and
v. Promoted activities and given under para 4.
(c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities
without the prior approval of the competent authority under Regional Town Planning Act and other rules and
regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the
law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition
of Forest Rights) Act, 2006 (2 of 2007):
(d) Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the
State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said
error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:
(e) Provided also that the above correction of error shall not include change of land use in any case except as provided
under this sub-paragraph.
(f) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat and

(2) Natural Springs.- The catchment areas of all natural springs/rivers/channels shall be identified and plans for their
conservation and rejuvenation shall be incorporated in the Zonal Master Plan.
(3) Tourism/Eco-Tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the
Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.
(b)The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of
Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The activities of eco-tourism shall be regulated as under, namely:-
(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Wildlife Sanctuary
or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the
Wildlife Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be
allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in
accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate
Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time)
with emphasis on eco-tourism;
(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall
be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the
Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.
(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve
areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a
heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic,
and cultural significance shall be indentified in the Eco-sensitive Zone and heritage conservation plan for their
conservation shall be prepared as part Zonal Master Plan.
(6) Noise pollution.- The Environment Department of the State Government or Jharkhand State Pollution Control Board
shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions
stipulated of The Noise Pollution (Regulation And Control) Rules, 2000 under the Environment (Protection) Act, 1986.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance
with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made thereunder
and amendments thereto.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the
provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental
(Protection) Act, 1986 and rules made thereunder or standards stipulated by State Government whichever is more
stringent.
(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid
Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and
Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the
inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive
Zone;
(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and
regulations using identified technologies may be allowed within Eco-Sensitive Zone.
(10) Bio-medical waste.- Bio medical waste management shall be as under:
(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical
Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016 as amended from time to time.
(b) Safe and Environmentally Sound Management (ESM) of Bio-medical wastes in conformity with the existing rules
and regulations using identified technologies may be allowed within Eco-Sensitive Zone.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per
the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of
Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as
amended from time to time.
(12) Construction and Demolition Waste Management.- The Construction and Demolition Waste Management in the
Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management
Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide
notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.- The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the
E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and
Climate Change and as amended from time to time.
(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific
provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is
prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor
compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular Pollution.- Prevention and control of Vehicular Pollution shall be complied with in accordance with
applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.
(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting
industries shall be allowed to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued
by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting
cottage industries shall be promoted.
(17) Protection of Hill Slopes: The protection of hill slopes shall be as under:
(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.
(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.
(18) The Central Government and the State Government shall specify other additional measures, if it considers
necessary, in giving effect to the provisions of this notification.
4. List of activities prohibited or to be regulated or promoted within the Eco-sensitive Zone.- All activities in
the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and
the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact
Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of
1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made
thereto and be regulated in the manner specified in the Table below, namely:-

per Classification done by Central Pollution Control

(iv) Cottage industries including village industries;

eco-tourism including home stays; and
(v) Promoted activities listed in this Notification.
(b) Provided that the construction activity related to small
scale industries not causing pollution shall be regulated and
kept at the minimum, with the prior permission from the
competent authority as per applicable rules and regulations,
if any.
(c) Beyond one kilometre it shall be regulated as per the
Zonal Master Plan.

5. Monitoring Committee.- In exercise of the powers conferred by sub-section (3) of section 3 (1) of the
Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby constitutes the first Monitoring
Committee, for effective monitoring of the Eco- Sensitive Zone, which shall comprise of, namely:-
i. Commissioner, North Chhotanagpur Division, Hazaribag -Chairperson;
ii. Representative of State Pollution Control Board -Member;
iii. One representative of non-Governmental Organisation (working in the field of environment including heritage
conservation) to be nominated by the State Government -Member;
iv. A representative nominated by the Forest & Environment Department of Jharkhand -Member;
v. An expert in Biodiversity to be nominated by the State Government -Member;
vi. An expert in Ecology and environment to be nominated by the State Government -Member;
vii. In-charge Protected Area -Member Secretary.
Terms of Reference.-
(1) The Monitoring Committee shall monitor the compliance of the provisions of this Notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by
the State Government and subsequently the Monitoring Committee would be constituted by the State Government.
(3) The Monitoring Committee shall not allow the activities that are covered in the Schedule to the notifications of the
Government of India in the erstwhile Ministry of Environment and Forests namely Environmental Impact Assessment,
2006 vide S.O. 1533 (E), dated the 14th September, 2006, and Coastal Regulation Zone, 2011 vide S.O. No. 19(E)
dated 6th January, 2011 and subsequent amendments therein, and are falling in the Eco-sensitive Zone, including the
prohibited activities as specified in the Table under paragraph 4 thereof. Only white categories of industries shall be
considered as specified in the guidelines issued by the CPCB for “classification of Industries, 2016”.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile
Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and S.O. 19 (E) dated 6th
January, 2011 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table
under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions
and referred to the concerned Regulatory Authorities.
(5) The Member Secretary of the Monitoring Committee or the concerned Commissioner shall be competent to file
complaints under section 19 of the Environment (Protection) Act, 1986 (29 of 1986) against any person who
contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from
Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to
issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every
year by 30th June of that year to the Chief Wild Life Warden of the State under intimation to this Ministry as per
proforma appended at Annexure IV.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it
deems fit, to the Monitoring Committee for effective discharge of its functions.
6. The Central Government and State Government may specify additional measures, if any, for giving effect to

7. The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble
Supreme Court of India or the High Court or National Green Tribunal.
